CONTRACT(example)Contractfortherecovery/disposalofwasteaccordingtoRegulation(EC)No1013/2006ofEuropeanParliamentandoftheCouncilThecontractrelatestonotificationnumber:Notifier:Registrationnumber:Address:Consignee:Registrationnumber:Address:Disposal/recoveryfacility(ifotherthantheconsignee):Registrationnumber:Address:ofthewasteandlistofwastecode:Totalintendedquantityofwaste:Thecontractvaliduntilacertificateisissuedinaccordancewitharticle16e),orwhereappropriate,article15d)or15e).(Thecontractmustbeconcludedeffectiveattimeofnotificationuntilthefinalcertificateisissuedfromthedisposal/recoveryfacilityThenotifiershalltakethewasteiftheshipmentortherecoveryordisposalhasnotcompletedasintendedorifithasbeeneffectedasanillegalshipment,inaccordancewithArticle22andArticle24(2)Theconsigneeshallrecoverordisposeofthewasteifithasbeeneffectedasanillegalshipment,inaccordancewithArticle24(3)Thedisposal/recoveryfacilityshallprovideacertificate,inaccordancewithArticle16(e)thatthewastehasrecoveredordisposedof,inaccordancewithnotificationandconditionsspecifiedthereinandtherequirementsofthethisregulation.NB!thewasteistobeexportedfromtheCommunitytoaThirdcountrythefollowingtextistobeincludedinthecontract:(i)ifafacilityissuesanincorrectcertificateofdisposaltheconsequencethatthefinancialguaranteeisreleased,theconsigneeshallthecostsarisingfromthedutytoreturnthewastetotheareajurisdictionofthecompetentauthorityofdispatchandfromitsrecoveryordisposalinanalternativeandenvironmentallysound(ii)withinthreedaysofreceiptofthewastefordisposal,thefacilityshallsendsignedcopiesofthecompleteddocument,exceptforthecertificateofdisposalreferredtoinsubpointiii,tothenotifierthecompetentauthoritiesconcerned,and(iii)assoonaspossiblebutnolaterthan30daysaftercompletionofdisposal,andnolaterthanonecalendaryearfollowingthereceiptofthewastethefacilityshall,underitsresponsibility,certifythatthedisposalhasbeencompletedandshallsendsignedcopiesofthemovementdocumentcontainingthiscertificationtonotifierandtothecompetentauthoritiesconcerned.NB!thewasteshippedisdestinedinterimrecoveryordisposaloperations,thecontractshallincludefollowingadditionalobligations:theobligationonthefacilityofdestinationtoprovide,inaccordancewithArticle15(d)and,appropriate,Article15(e),thecertificatesthatthewastehasbeenrecoveredordisposedofaccordancewiththenotificationandtheconditionsspecifiedthereinandtherequirementsofthisRegulation;theobligationontheconsigneetosubmit,whereapplicable,notificationtotheinitialcompetentauthorityoftheinitialcountryofdispatchinaccordancewithArticle15(f)(ii)._______________________________________
