ernmentandthestates.InArizonav.UnitedStates,themajorityoverturnedthreeofthefourcontestedprovisionsofArizona’scontroversialplantohavestateandlocalenforcefederalimmigrationlaw.TheConstitutionalprinciplesthatWashingtonalonehasthepowerto“establishauniformRuleofNaturalization”andthatfederallawsprecedestatelawsarenoncontroversial.Arizonahadattemptedtofashionstatepoliciesthatranparalleltotheexistingfederalones.JusticeAnthonyKennedy,joinedbyChiefJusticeJohnRobertsandtheCourt’sliberals,ruledthatthestateflewtooclosetothefederalsun.Ontheoverturnedprovisionsthemajorityheldthecongresshad y“occupiedthefield”andArizonahadthusintrudedonthefederal’sprivilegedHowever,theJusticessaidthatArizonawouldbeallowedtoverifythelegalstatusofpeoplewhocomeincontactwithlawenforcement.That’sbecauseCongresshasalwaysenvisionedjointfederal-stateimmigrationenforcementandexplicitlyencouragesstateofficerstoshareinformationandcooperatewithfederalcolleagues.TwoofthethreeobjectingJustice-SamuelAlitoandClarenceThomas-agreedwiththisConstitutionallogicbutdisagreedaboutwhichArizonarules edwiththefederalstatute.TheonlymajorobjectioncamefromJusticeAntoninScalia,whoofferedanevenmorerobustdefenseofstateprivilegesgoingbacktotheAlienandSeditionActs.The8-0objectionto ObamaturnsonwhatJusticeSamuelAlitodescribesinhisobjectionas“ashockingassertionoffederalexecutivepower”.TheWhiteHousearguedthatArizona’slaws itsenforcementpriorities,evenifstatelawscompliedwithfederalstatutestotheletter.Ineffect,theWhiteHouseclaimedthatitcouldinvalidateanyotherwiselegitimatestatelawthatitdisagreeswith.Somepowersdobelongexclusivelytothefederalernment,andcontrolofcitizenshipandthebordersisstatus,itcould.Itneverdidso.Theadministrationwasinessenceassertingthatbecauseitdidn’twanttocarryoutCongress’simmigrationwishes,nostateshouldbeallowedtodosoeither.EveryJusticerightlyrejectedthisremarkableclaim.ThreeprovisionsofArizona’splanwereoverturnedbecausedeprivedthefederalofConstitutionaldisturbedthepowerbalancebetweendifferentoversteppedtheauthorityoffederalimmigrationcontradictedboththefederalandstateOnwhichofthefollowingdidtheJusticesagree,accordingtoFederalofficers’dutytowithholdimmigrantsStates’independencefromfederalimmigrationStates’legitimateroleinimmigrationCongress’sinterventioninimmigrationItcanbeinferredfromParagraph5thattheAlienandSeditionviolatedtheunderminedthestates’supportedthefederalstoodinfavoroftheTheWhiteHouseclaimsthatitspowerofoutweighsthatheldbytheisdependentonthestates’isestablishedbyfederalrarelygoesagainststateWhatcanbelearnedfromthelastImmigrationissuesareusuallydecidedbyJusticesintendedtocheckthepoweroftheJusticeswantedtostrengthenitscoordinationwithTheAdministrationisdominantoverimmigrationPartInthefollowingarticle,somesentenceshavebeenremoved.ForQuestions41-45,choosethemostsuitableonefromthelistA-Gtofitintoeachofthenumberedblank.Therearetwoextrachoices,whichdonotfitinanyofthegaps.MarkyouranswersonANSWERSHEET1.(10points)Thesocialsciencesareflourishing.Asof2005,therewerealmosthalfamillionprofessionalsocialscientistsfromallfieldsintheworld,workingbothinsideandoutsideacademia.AccordingtotheWorldSocialScienceReport2010,thenumberofsocial-sciencestudentsworldwidehasswollenbyabout11%everyyearsincesecurity,sustainabledevelopmentandhealth.(41)
