外國文教專家聘用合同英文英文版外國文教專家聘用合同ContractforEmployingForeignCulturalandEducationalExperts甲方(Employer):Name:Address:Postcode:Contactperson’snameandposition:電話(Tel):國際/Local:傳真(Fax):國際/Local:電子郵件(E-mail):乙方(Expert):Name:Nationality:Passport/IDNo.:Address:Postcode:Contactperson’snameandposition(ifnecessary):電話(Tel):國際/Local:傳真(Fax):國際/Local:電子郵件(E-mail):鑒于本甲方需要聘請乙方為本機構的外國文教專家，經乙方同意，甲乙雙方基于平等、自愿的原則，根據(jù)中華人民共和國法律、法規(guī)和有關規(guī)定，達成以下協(xié)議：WhereastheEmployerneedstoemploytheExpertasaforeignculturalandeducationalexpertofthisinstitutionandtheExpertagrees,theEmployerandtheExpert,onthebasisofequalityandmutualbenefit,havereachedthefollowingagreementaccordingtothelaws,regulations,andrelevantprovisionsofthePeople’sRepublicofChina.一、聘用內容(EmploymentContent)1.甲方聘請乙方為本機構的外國文教專家，從___________年___________月___________日至___________年___________月___________日，共計______天/周/月。TheEmployerhirestheExpertasaforeignculturalandeducationalexpertofthisinstitution,from(year)(month)(day)to(year)(month)(day),foratotalofdays/weeks/months.2.乙方的主要職責和任務如下:ThemajordutiesandtasksoftheExpertareasfollows:________________________________________________________________________________________________________________________________________________________________________________________________________________________________________3.乙方工作時間為每周工作______(一周至少40小時），其中每天工作時間為8小時，工作日為星期一至星期五。乙方根據(jù)工作需要，應配合加班。TheExpert’sworkinghoursare_____perweek(nolessthan40hoursperweek),with8hoursperday,workingfromMondaytoFriday.TheExpertshouldcooperatewithovertimeworkaccordingtotheworkrequirement.二、乙方的權利和義務(RightsandObligationsoftheExpert)1.乙方享有護照簽證及工作證明的辦理權，并須在規(guī)定有效期內合法居留和工作。乙方應遵守中國的有關法律、法規(guī)和機構規(guī)章制度。TheExperthastherighttoapplyforpassport,visa,andworkpermit,andhe/shemustlegallyresideandworkwithinthevalidperiod.TheExpertshouldcomplywiththerelevantlaws,regulations,andinstitutionalrulesandregulations.2.乙方需履行其工作職責和任務，完成工作計劃和工作量，并為機構發(fā)展做出貢獻，保持機構的聲譽和形象。TheExpertshouldperformhis/herjobdutiesandtasks,completeworkplansandworkload,contributetothedevelopmentoftheinstitutionandmaintainthereputationandimageoftheinstitution.3.乙方應加強對本機構工作規(guī)則、政策、法律法規(guī)、制度及其他規(guī)定的學習和了解。TheExpertshouldstrengthenhis/herlearningandunderstandingoftheworkrules,policies,laws,regulations,andotherprovisionsoftheinstitution.4.乙方應保護本機構的商業(yè)機密，不得泄露任何與本機構商業(yè)機密有關的信息。TheExpertshouldprotectthebusinesssecretsoftheinstitutionandnotdiscloseanyinformationrelatedtothebusinesssecretsoftheinstitution.5.乙方應定期向甲方提供工作報告，并根據(jù)甲方工作需求，與甲方定期溝通工作。TheExpertshouldregularlyprovideworkreportstotheEmployerandcommunicatewiththeEmployerregularlybasedontheworkrequirementsoftheEmployer.三、甲方的權利和義務(RightsandObligationsoftheEmployer)1.甲方應為乙方提供必要的工作條件，并按合同規(guī)定支付乙方的合理工資和福利待遇。TheEmployershouldprovidenecessaryworkingconditionsfortheExpert,andpaytheExpert’sreasonablesalaryandwelfarebenefitsasstipulatedinthecontract.2.甲方應定期考核乙方的工作表現(xiàn)，并提出改進意見，對乙方的工作成績所得到的榮譽和獎勵全由乙方享受。TheEmployershouldregularlyevaluatetheworkperformanceoftheExpert,provideimprovementsuggestions,andtheExpertshouldenjoyallthehonorsandrewardsobtainedfromthework.3.甲方應為乙方提供必要的安全保障措施，對乙方所接觸的機構機密及自身安全等內容予以保護。TheEmployershouldprovidenecessarysecuritymeasuresfortheExpert,protectthebusinesssecretsandpersonalsafetyoftheinstitutiontouchedbytheExpert.4.如乙方在工作期間遇有個人意外或突發(fā)事件，甲方應及時處理，并協(xié)助乙方解決相關問題。IftheExpertencounterspersonalaccidentsoremergenciesduringtheworkperiod,theEmployershoulddealwiththeminatimelymannerandhelptheExpertsolverelatedproblems.四、工資及其他待遇(SalaryandOtherBenefits)1.甲方將按照合同規(guī)定向乙方支付工資。具體數(shù)額和支付方式見附件二。TheEmployershallpaytheExpert'ssalarytohim/herasstipulatedinthecontract.SpecificamountandpaymentmethodsareintheAttachmentII.2.甲方應為乙方繳納個人所得稅（依照相關法規(guī)制度執(zhí)行）。TheEmployershouldpaypersonalincometaxfortheExpert(implementedinaccordancewithrelevantlawsandregulations).五、期限和終止(TermandTermination)1.合同期限按照雙方的約定履行。如有需要，雙方可以協(xié)商延長合同期限。Thetermofthecontractshallbeexecutedaccordingtotheagreementofbothparties.Ifnecessary,bothpartiescannegotiatetoextendthetermofthecontract.2.甲、乙雙方應妥善履行本合同約定。如一方違反合同規(guī)定，應承擔違約責任。所產生的一切法律后果由違約方承擔。Bothpartiesshouldproperlyperformtheagreement.Ifonepartyviolatesthecontract,he/sheshouldbearthebreachliability.Alllegalconsequencesarisingtherefromshallbebornebythebr3.雙方同意在本合同期滿前至少二十一天，提前書面通知對方，協(xié)商續(xù)簽或終止合同。如未續(xù)簽合同或未及時書面通知，視為自動終止合同。Bothpartiesagreetoprovideatleasttwenty-onedayswrittennoticetotheotherpartybeforetheexpirationofthetermofthecontractandnegotiatetherenewalorterminationofthecontract.Ifthecontractisnotrenewedorthewrittennoticeisnotgivenintime,thecontractisconsideredtobeautomaticallyterminated.4.下列情況發(fā)生時，本合同可終止：Thecontractcanbeterminatedincaseofthefollowing:(1)乙方主動提出終止合同，并且雙方協(xié)議同意；TheExpertinitiativelyproposestoterminatethecontract,andbothpartiesagreetotheproposal;(2)乙方在本機構工作中表現(xiàn)不佳、不履行職責或違反服務協(xié)議，致使甲方或者相關單位損失嚴重，經甲方三次勸告（口頭或書面），仍無改變，甲方可以單方面終止合同，但必須書面通知乙方。此種情況下，乙方應承擔違約責任，甲方已支付給乙方的各項工資不再予以返還；TheExpertfailstoperformhis/herjobdutiesorviolatestheserviceagreement,causingseriouslossestotheEmployerorrelevantunits.Afterthethreetimesofwarning(oralorwritten),theEmployercanunilaterallyterminatethecontractbutmustgivewrittennoticetotheExpert.Inthiscase,theExpertshouldbeartheliabilityforthebreach,andtheEmployerwillnotrefundanysalarypaidtotheExpert;(3)乙方因病等原因，不能履行工作職責，經甲方確認達到合同約定的期限，甲方可以單方面終止本合同;TheExpertcannotperformjobdutiesduetoillnessorotherreasons.AftertheEmployerconfirmsreachingthetermofthecontract,theEmployercanunilaterallyterminatethecontract;(4)甲方因故不能繼續(xù)提供工作報酬并在合同規(guī)定期間內逾期未支付工資，經乙方書面提出抗議并要求終止合同時，合同即行終止；IftheEmployerfailstoprovidetheworkremunerationanddoesnotpaythesalaryontimewithinthecontractterms,andtheExpertexpresseshis/her
