安全，指預(yù)知人類在生產(chǎn)和生活各個(gè)領(lǐng)域存在的固有的或潛在的危險(xiǎn)，并且為消除這些危險(xiǎn)所采取的各種方法、手段和行為的總稱。包括人身安全、設(shè)備與財(cái)產(chǎn)安全、環(huán)境安全等。

安全生產(chǎn)，是指在勞動(dòng)生產(chǎn)過程中，通過努力改善勞動(dòng)條件，克服不安全因素，防止傷亡事故發(fā)生，使勞動(dòng)生產(chǎn)在保障勞動(dòng)者安全健康和國(guó)家財(cái)產(chǎn)不受損失的前提下順利進(jìn)行。

1.安全控制的方針

（1）Safetycontrolpolicy

安全控制的目的是為了安全生產(chǎn)，因此安全控制的方針也應(yīng)符合安全生產(chǎn)的方針，即“安全第一，預(yù)防為主?！?/p>

1.Allocationoffull-timesafetyproductionmanagementpersonnelinconstructionenterprises

(1)建筑施工總承包資質(zhì)序列企業(yè):特級(jí)資質(zhì)不少于6人;一級(jí)資質(zhì)不少于4人;二級(jí)和二級(jí)以下資質(zhì)企業(yè)不少于3人。

(4)建筑施工企業(yè)的分公司、區(qū)域公司等較大的分支機(jī)構(gòu)(以下簡(jiǎn)稱分支機(jī)構(gòu))應(yīng)依據(jù)實(shí)際生產(chǎn)情況配備不少于2人的專職安全生產(chǎn)管理人員。

二、施工項(xiàng)目專職安全生產(chǎn)管理人員的設(shè)置

2.Settingoffull-timesafetyproductionmanagementpersonnelforconstructionprojects

項(xiàng)目專職安全生產(chǎn)管理人員具有以下主要職責(zé):

(1)負(fù)責(zé)施工現(xiàn)場(chǎng)安全生產(chǎn)8常檢查并做好檢查記錄。

(2)現(xiàn)場(chǎng)監(jiān)督危險(xiǎn)性較大工程安全專項(xiàng)施工方案實(shí)施情況。

Supervisetheimplementationofspecialconstructionschemesforsafetyofprojectswithhighrisksonsite.

(3)對(duì)作業(yè)人員違規(guī)違章行為有權(quán)予以糾正或查處。

Correctorinvestigatetheviolationsofoperators.

(4)對(duì)施工現(xiàn)場(chǎng)存在的安全隱患有權(quán)責(zé)令立即整改。

Orderimmediaterectificationofpotentialsafetyhazardsonconstructionsites.

(5)對(duì)于發(fā)現(xiàn)的重大安全隱患，有權(quán)向企業(yè)安全生產(chǎn)管理機(jī)構(gòu)報(bào)告。

總承包單位配備項(xiàng)目專職安全生產(chǎn)管理人員應(yīng)當(dāng)滿足下列要求:

Thegeneralcontractor’sfull-timesafetyproductionmanagementpersonnelshallmeetthefollowingrequirements:(1)建筑工程、裝修工程按照建筑面積配備:

Constructionprojectsanddecorationprojectsshallbeequippedaccordingtotheconstructionarea:

1)1萬㎡以下的工程不少于1人。Nolessthan1personforprojectslessthan10000㎡.

2)1萬~5萬㎡的工程不少于2人。Nolessthan2personsforprojectswithanareaof10000㎡~50000㎡.

3)5萬㎡及以上的工程不少于3人，且按專業(yè)配備專職安全生產(chǎn)管理人員。Nolessthan3personsforprojectswithanareaof50000㎡andabove,andfull-timesafetyproductionmanagementpersonnelshallbeequippedaccordingtotheirspecialties.(2)土木工程、線路管道、設(shè)備安裝工程按照工程合同價(jià)配備:Civilengineering,pipelinesandequipmentinstallationprojectsshallbeprovidedaccordingtotheprojectcontractprice:

1)5000萬元以下的工程不少于1人。Nolessthanonepersonforprojectsbelow50millionyuan.

2)5000萬~1億元的工程不少于2人。Nolessthan2peopleforprojectsof50million~100millionyuan.

3)1億元及以上的工程不少于3人，且按專業(yè)配備專職安全生產(chǎn)管理人員。Nolessthan3personsforprojectsof100millionyuanandabove,andfull-timesafetyproductionmanagementpersonnelshallbeequippedaccordingtotheirspecialties.第二節(jié)

分包單位配備項(xiàng)目專職安全生產(chǎn)管理人員應(yīng)當(dāng)滿足下列要求:Thesubcontractor'sfull-timesafetyproductionmanagementpersonnelshallmeetthefollowingrequirements:

(1)專業(yè)承包單位應(yīng)當(dāng)配置至少1人，并根據(jù)所承擔(dān)的分部分項(xiàng)工程的工程量和施工危險(xiǎn)程度增加。

Theprofessionalcontractorshallallocateatleastoneandincreasethenumberaccordingtothequantitiesofdivisionalandsub-divisionalworksandthedegreeofconstructionrisks.

(2)勞務(wù)分包單位施工人員在50人以下的，應(yīng)當(dāng)配備1名專職安全生產(chǎn)管理人員;50~200人的，應(yīng)當(dāng)配備2名專職安全生產(chǎn)管理人員;200人及以上的，應(yīng)當(dāng)配備3名及以上專職安全生產(chǎn)管理人員，并根據(jù)所承擔(dān)的分部分項(xiàng)工程施工危險(xiǎn)實(shí)際情況增加，不得少于工程施工人員總?cè)藬?shù)的5%。

1.Safetyproductionlicensesystemofconstructionenterprises

1.安全生產(chǎn)許可證的申請(qǐng)條件

（1）Applicationconditionsforthesafetyproductionlicense

(1)主要負(fù)責(zé)人、項(xiàng)目負(fù)責(zé)人、專職安全生產(chǎn)管理人員經(jīng)建設(shè)主管部門或者其他有關(guān)部門考核合格。

Themainpersonincharge,projectleaderandfull-timesafetyproductionmanagementpersonnelshallpasseexaminationsofthecompetentconstructiondepartmentorotherrelevantdepartments.

(2)管理人員和作業(yè)人員每年至少進(jìn)行--次安全生產(chǎn)教育培訓(xùn)并考核合格。

Managementpersonnelandoperatorsshallreceivesafetyproductioneducationandtrainingonceayearandpasstheexamination.

(3)有職業(yè)危害防治措施，并為作業(yè)人員配備符合國(guó)家標(biāo)準(zhǔn)或者行業(yè)標(biāo)準(zhǔn)的安全防護(hù)用具和安全防護(hù)服裝。

Occupationalhazardpreventionandcontrolmeasuresareaccessible,andsafetyprotectionappliancesandclothingthatmeetnationalorindustrialstandardsshallbeprovidedforoperators.

(4)有生產(chǎn)安全事故應(yīng)急救援預(yù)案、應(yīng)急救援組織或者應(yīng)急救援人員，配備必要的應(yīng)急救援器材、設(shè)備。

BasicSystemofConstructionProjectSafetyManagement2.安全生產(chǎn)許可證的申請(qǐng)與頒發(fā)

（2）Applicationandissuanceofthesafetyproductionlicense

建筑施工企業(yè)從事建筑施工活動(dòng)前，應(yīng)當(dāng)依照《建筑施工企業(yè)安全生產(chǎn)許可證管理規(guī)定》向省級(jí)以上建設(shè)主管部門申請(qǐng)領(lǐng)取安全生產(chǎn)許可證。中央管理的建筑施工企業(yè)(集團(tuán)公司、總公司)應(yīng)當(dāng)向國(guó)務(wù)院建設(shè)主管部門申請(qǐng)領(lǐng)取安全生產(chǎn)許可證。其他建筑施工企業(yè)，包括中央管理的建筑施工企業(yè)(集團(tuán)公司、總公司)下屬的建筑施工企業(yè)，應(yīng).當(dāng)向企業(yè)注冊(cè)所在地省、自治區(qū)、直轄市人民政府主管部門申請(qǐng)領(lǐng)取安全生產(chǎn)許可證。

Beforeengaginginconstructionprojects,aconstructionenterpriseshallapplytothecompetentconstructiondepartmentatorabovetheprovinciallevelforasafetyproductionlicenseinaccordancewiththeProvisionsontheAdministrationofSafetyProductionLicensesforConstructionEnterprises.Constructionenterprises(groupcompaniesandheadoffices)underthecentraladministrationshallapplytothecompetentconstructiondepartmentoftheStateCouncilforsafetyproductionlicenses.Otherconstructionenterprises,includingthoseunderthecentralmanagementofconstructionenterprises(groupcompaniesandheadoffices),shallapplytothecompetentdepartmentofthepeople'sgovernmentoftheprovince,autonomousregionormunicipalitydirectlyunderthecentralgovernmentwheretheenterpriseisregisteredforaworksafetylicense.

建設(shè)主管部門應(yīng)當(dāng)自受理建筑施工企業(yè)的申請(qǐng)之日起45日內(nèi)審查完畢。

安全生產(chǎn)許可證的有效期為3年。安全生產(chǎn)許可證有效期滿需要延期的，企業(yè)應(yīng)當(dāng)于期滿前3個(gè)月向原安全生產(chǎn)許可證頒發(fā)管理機(jī)關(guān)申請(qǐng)辦理延期手續(xù)。企業(yè)在安全生產(chǎn)許可證有效期內(nèi)，嚴(yán)格遵守有關(guān)安全生產(chǎn)的法律法規(guī)，未發(fā)生死亡事故的，安全生產(chǎn)許可證有效期屆滿時(shí)，經(jīng)原安全生產(chǎn)許可證頒發(fā)管理機(jī)關(guān)同意，不再審查，安全生產(chǎn)許可證有效期延期3年。

Thetermofvalidityofthesafetyproductionlicenseis3years.Ifthesafetyproductionlicenseneedstobeextendedattheexpirationofitsvalidity,theenterpriseshallapplytotheoriginalsafetyproductionlicenseissuanceandadministrationauthorityforanextensionthreemonthsbeforetheexpiration.Duringtheperiodofvalidityofthesafetyproductionlicense,theenterpriseshallstrictlyabidebythelawsandregulationsrelatedtosafetyproduction.Ifthereisnofatalaccident,upontheexpiration,withtheconsentoftheoriginalsafetyproductionlicenseissuanceandadministrationauthority,theexaminationwillnotbeconducted,andtheperiodofvalidityofitshallbeextendedfor3years.

建筑施工企業(yè)變更名稱、地址、法定代表人等，應(yīng)當(dāng)在變更后10日內(nèi)，到原安全生產(chǎn)許可證頒發(fā)管理機(jī)關(guān)辦理安全生產(chǎn)許可證變更手續(xù)。

（3）Supervisionandmanagementofsafetyproductionlicense

安全生產(chǎn)許可證頒發(fā)管理機(jī)關(guān)或者其上級(jí)行政機(jī)關(guān)發(fā)現(xiàn)有下列情形之一的，可以撤銷已經(jīng)頒發(fā)的安全生產(chǎn)許可證:

(1)安全生產(chǎn)許可證頒發(fā)管理機(jī)關(guān)工作人員濫用職權(quán)、玩忽職守頒發(fā)安全生產(chǎn)許可證的。Astaffmemberoftheadministrationauthorityissuingsafetyproductionlicenseabuseshispowerandneglectshisdutytoissuethesafetyproductionlicense.

(2)超越法定職權(quán)頒發(fā)安全生產(chǎn)許可證的。

(3)違反法定程序頒發(fā)安全生產(chǎn)許可證的。

(4)對(duì)不具備安全生產(chǎn)條件的建筑施工企業(yè)頒發(fā)安全生產(chǎn)許可證的。

（4）Legalliability

違反規(guī)定，建筑施工企業(yè)隱瞞有關(guān)情況或者提供虛假材料申請(qǐng)安全生產(chǎn)許可證的，不予受理或者不予頒發(fā)安全生產(chǎn)許可證，并給予警告，1年內(nèi)不得申請(qǐng)安全生產(chǎn)許可證。建筑施工企業(yè)以欺騙、賄賂等不正當(dāng)手段取得安全生產(chǎn)許可證的，撤銷安全生產(chǎn)許可證，3年內(nèi)不得再次申請(qǐng)安全生產(chǎn)許可證;構(gòu)成犯罪的，依法追究刑事責(zé)任。Ifaconstructionenterpriseconcealsrelevantinformationorprovidesfalsematerialstoapplyforasafetyproductionlicenseinviolationoftheregulations,itshallnotbeacceptedorissuedone,andawarningshouldbegiven,andshallnotbeallowedtoapplyforanotheronewithinoneyear.Ifaconstructionenterpriseobtainsasafetyproductionlicensebydeception,briberyandotherimpropermeans,thelicenseshallberevoked,andtheenterpriseshallnotbeallowedtoapplyforalicenseagainwithinthreeyears.Ifacrimeisconstituted,criminalresponsibilityshallbeinvestigatedaccordingtolaw.第三節(jié)

二、建筑施工企業(yè)三類人員考核任職制度

（1）Threecategoriesofpersonnel

三類人員是指建筑施工企業(yè)的主要負(fù)責(zé)人、項(xiàng)目負(fù)責(zé)人、專職安全生產(chǎn)管理人員。

Thethreecategoriesofpersonnelrefertoprincipal,projectleaderandfull-timesafetyproductionmanagementpersonneloftheconstructionenterprise.

建筑施工企業(yè)主要負(fù)責(zé)人，包括企業(yè)法定代表人、經(jīng)理、企業(yè)分管安全生產(chǎn)工作的副經(jīng)理等。

Principaloftheconstructionenterprise,includingthelegalrepresentative,manageranddeputymanagerinchargeofsafetyproductionoftheenterprise.

建筑施工企業(yè)項(xiàng)目負(fù)責(zé)人，是指由企業(yè)法定代表人授權(quán)，負(fù)責(zé)建設(shè)工程項(xiàng)目管理的負(fù)責(zé)人等;

Theprojectleaderofaconstructionenterprisereferstothepersoninchargeofconstructionprojectmanagementauthorizedbythelegalrepresentativeoftheenterprise.

建筑施工企業(yè)專職安全生產(chǎn)管理人員，是指在企業(yè)專職從事安全生產(chǎn)管理工作的人員，包括企業(yè)安全生產(chǎn)管理機(jī)構(gòu)的負(fù)責(zé)人及其工作人員和施工現(xiàn)場(chǎng)專職安全生產(chǎn)管理人員。

(1)施工單位應(yīng)當(dāng)設(shè)立安全生產(chǎn)管理機(jī)構(gòu)，配備專職安全生產(chǎn)管理

(3)施工單位不得在尚未竣工的建筑物內(nèi)設(shè)置員工集體宿舍。

(4)施工單位應(yīng)當(dāng)自施工起重機(jī)械和整體提升腳手架、模板等自升式架設(shè)設(shè)施驗(yàn)收合格之日起30日內(nèi)，向建設(shè)行政主管部門或者其他有關(guān)部門登記。登記標(biāo)志應(yīng)當(dāng)置于或者附著于該設(shè)備的顯著位置。

(7)施工單位在采用新技術(shù)、新工藝、新設(shè)備、新材料時(shí)，應(yīng)當(dāng)對(duì)作業(yè)人員進(jìn)行相應(yīng)的安全生產(chǎn)教育培訓(xùn)。

(8)施工單位應(yīng)當(dāng)為施工現(xiàn)場(chǎng)從事危險(xiǎn)作業(yè)的人員辦理意外傷害保險(xiǎn)。意外傷害保險(xiǎn)費(fèi)由施工單位支付。實(shí)行施工總承包的，由總承包單位支付意外傷害保險(xiǎn)費(fèi)。意外傷害保險(xiǎn)期限自建設(shè)工程開工之日起至竣工驗(yàn)收合格止。

項(xiàng)目經(jīng)理是施工現(xiàn)場(chǎng)文明施工的第一責(zé)任人，全面負(fù)責(zé)施工現(xiàn)場(chǎng)的文明施工管理工作。要建立以項(xiàng)目經(jīng)理為首的施工現(xiàn)場(chǎng)文明施工領(lǐng)導(dǎo)小組，領(lǐng)導(dǎo)現(xiàn)場(chǎng)文明施工的開展。
