7、shallimplementrelevantstateprovisions.六、勞動(dòng)保護(hù)、勞動(dòng)條件和職業(yè)危害防護(hù)Laborprotection,laborconditionandoccupationalharmpreventionandcurePartyAshallequipPartyBwiththenecessarysafetyprotectionmeasuresandissuethenecessarylaborprotectionarticlesaccordingtotheneedsofthepostandtherulesofthelaborsafetyandhygiene.:PartyA
8、shallsetupandoptimizetheoccupationaldiseasecureresponsibilitysystem,enforcethemanagementovertheoccupationaldiseaseandpromotethecureleveloftheoccupationaldisease.七、勞動(dòng)合同的解除、終止和經(jīng)濟(jì)補(bǔ)償Change,Cancellation,TerminationandRenewaloftheLaborContract第十三條甲乙雙方解除、變更、終止、續(xù)訂勞動(dòng)合同應(yīng)當(dāng)依照勞動(dòng)合同法和國家及省、市等有關(guān)規(guī)定執(zhí)行。:Ifthepartiesrev
9、oke,modify,terminateandextentthelaborcontract,theyshallperformthemaccordingtotherelevantrulesoftheLaborContractLawandthecountry,provinceandcityetc.第十四條甲方應(yīng)在解除或者終止勞動(dòng)合同時(shí),為乙方出具解除或者終止勞動(dòng)合同的證明,并在15日內(nèi)為勞動(dòng)者辦理相關(guān)手續(xù)。乙方應(yīng)在甲方出具解除或者終止勞動(dòng)合同的證明后10日內(nèi)辦理工作移交,如涉及經(jīng)濟(jì)補(bǔ)償?shù)陌磭矣嘘P(guān)規(guī)定在辦結(jié)工作交接時(shí)支付。:Upontherevocationorterminationofthela
10、borcontract,PartyAshallissuethecertificationforrevocationorterminationofthelaborcontracttoPartyBanddealwiththerelevantformalitiesforthelaborerwithinfifteen(15)days.PartyBshallmaketheworkhandoverwithinten(10)daysafterissuancebyPartyAofthecertificateofrevocationorterminationofthelaborcontract.Regardin
11、ganyeconomiccompensation,theyshallbepaiduponthehandoveroftheworkaccordingtotherulesofthecountry.八、勞動(dòng)爭(zhēng)議處理LaborDisputeResolutions:Incasedisputesarisebetweentwoparties,eitherpartycanappealtolabourdisputesarbitrationcommissionatpartyAslocation,subjecttomediationoradjudicationbyarbitrationcommission.Inca
12、seofdisobedienceofarbitrationresult,eitherpartycansuetothecourtatpartyAslocation.Eitherpartyneitherbringsthelawsuitduringthevalidperiodnorperformstheadjudication;theotherpartyhastherighttoapplyforforcibleexecutiontothecourt.:PartyBpromiseshiscorrespondenceaddressofthecontractshallbetheaddressthatPar
13、tyAsendsthelettersormailstoPartyB.IfanylettersormailsarenotreturnedorundeliverableafterPartyAsendsthem,itisdeemedthattheyhavearrivedatPartyB.第十七條本合同未盡事宜,應(yīng)按國家現(xiàn)行法律、法規(guī)、規(guī)章執(zhí)行。本合同條款如與國家法律、法規(guī)、政策相抵觸時(shí),以國家規(guī)定為準(zhǔn)。Article17:Affairsunmentionedinthiscontractshallbeexecutedaccordingtopresentlaws,statutesandregulationsofthestate.Incaseanycontradictionarisesbetweenthearticlesofthiscontractandlaws,statutesorpoliciesofthestate,thelattershallbereferredtoasfinal.Article18:Thecontractisinduplicate,heldbyPa
