2、blicofChina.TermoftheContract:Thetermofthiscontractisforyearsandshallcommenceon,andshallcontinueuntil,unlessearlierterminatedpursuanttothisContract.TheEmployeeshallundergoaprobationaryperiodof_months.JobDescription:TheEmployeragreestoemployMr./Ms.(name)as(jobtitle)inDepartment,locatedin(officelocati

3、onandcity).RemunerationofLabourThesalaryoftheEmployeeshallbemonthlypaidbytheEmployerinaccordancewithapplicablelawsandregulationsofP.R.C.ItshallbepaidbylegaltenderandnotlessthanthestandardminimumsalaryinTianjin.ThesalaryoftheEmployeeisRMB$permonthintheprobationaryperiodandRMB$aftertheprobationaryperi

4、od.Ifthedelayordefaultofsalarytakesplace,theEmployershallpaytheeconomiccompensationexceptthesalaryitselfinaccordancewiththerelevantlawsandregulations.WorkingHours&Rest&VocationThenormalworkinghoursoftheEmployeeshallbeeighthourseachday,excludingmealsandrestforanaverageoffivedaysperweek,foranaverageof

5、fortyhoursperweek.TheEmployeeisentitledtoalllegalholidaysandotherpaidleavesofabsenceinaccordancewiththelawsandregulationsofthePRCandthecompanysworkrules.TheEmployermayextendworkinghoursduetotherequirementsofitsproductionorbusinessafterconsultationwiththetradeunionandtheEmployee,buttheextendedworking

6、hourforadayshallgenerallynotexceedonehour;Ifsuchextensioniscalledforduetospecialreasons,theextendedhoursshallnotexceedthreehoursaday.However,thetotalextensioninamonthshallnotexceedthirty-sixhours.5.SocialSecurity&WelfareTheEmployerwillpayforallmandatorysocialsecurityprogramssuchpensioninsurance,unem

7、ploymentinsurance,medicalinsuranceoftheEmployeeaccordingtotherelevantgovernmentandcityregulations.DuringtheperiodoftheContract,theEmployeeswelfareshallbeimplementedaccordancewiththelawsandrelevantregulationsofP.R.C.WorkingProtection&WorkingConditionsTheEmployershouldprovidetheEmployeewithoccupationa

8、lsafetyandhealthconditionsconformingtotheprovisionsoftheStateandnecessaryarticlesoflaborprotectiontoguaranteethesafetyandhealthduringtheworkingprocess.TheEmployershouldprovidetheEmployeewithsafetyeducationandtechniquetraining;TheEmployeetobeengagedinspecializedoperationsshouldreceivespecializedtrain

9、ingandacquirequalificationsforsuchspecialoperations.TheEmployeeshouldstrictlyabidebytherulesofsafeoperationintheprocessoftheirwork.LabourDisciplinea.TheEmployermaydraftbylawsandlabourdisciplinesoftheCompany,Accordingtowhich,theEmployershallhavetherighttogiverewardsortakedisciplinaryactionstotheEmplo

10、yee;b.TheEmployeeshallcomplywiththemanagementdirectionsoftheEmployerandobeythebylawsandlabourdisciplinesoftheEmployer.TheEmployeeshallundertaketheobligationtokeepandnottodisclosethetradesecretfortheEmployerduringtheperiodofthisContract;ThisobligationofconfidentialityshallsurvivetheterminationofthisC

11、ontractforaperiodoftwo(2)years.8.Termination,Modification,RenewandDischargeoftheContractTherelevantclausesoftheContractmaybemodifiedbytheparties:Thespecificclauseisrequiredtobemodifiedbythepartiesthroughconsultation;Duetotheforcemajeure,theContractcannotbeexecuted;Therelevantlawsandregulationshavebe

12、enmodifiedorabolishedbythetimeofsigningtheContract.TheContractmaybeautomaticallyterminated:ThisContractisnotrenewedattheexpirationofthisContract;TheEmployerislegallyannouncedtobebankruptcy,dismissed,orcanceled;iii)ThedeathoftheEmployeeoccurs;Theforcemajeuretakesplace;v)Theconditionsofterminationagre

13、edintheContractbythepartiesarise.TheContractmayberenewedattheexpirationthroughconsultationbythepartieswiththefulfillmentoftheprocedurewithin15daystotheexpiration;TheContractmaybedischargedthroughconsultationbytheparties;TheContractmaybedischargedbytheEmployerwithimmediateeffectandtheEmployeewillnotb

14、ecompensated:TheEmployeedoesnotmeetthejobrequirementsduringtheprobationaryperiod;TheEmployeeseriouslyviolatesdisciplinesorbylawsoftheEmployer;TheEmployeeseriouslyneglectshisduty,engagesinmalpracticeforselfishendsandbringssignificantlosstotheEmployer;TheEmployeeisbeingpunishedbyphysicallabourforitsmi

15、sfeasanceTheEmployeeisbeingchargedwithcriminaloffences:TheContractmaybeterminatedbytheEmployerbygivingnoticeinwrittenform30(thirty)daysinadvance:TheEmployeefailsillorisinjuredto(otherthanduetowork)andaftercompletionofmedicaltreatment,isnotabletoperformhispreviousfunctionoranyotherfunctiontheEmployer

16、assignstohim;TheEmployeedoesnotshowsatisfactoryperformanceandaftertrainingandadjustingmeasuresisstillnotabletoperformsatisfactorily;ThecircumstanceshavemateriallychangedfromthedatethisContractwassignedtotheextentthatitisimpossibletoexecutetheContractprovided,however,thatthepartiescannotreachanagreem

17、enttoamendthecontracttoreflectthechangedcircumstances.TheEmployerisbeingconsolidatedinthelegalconsolidationperiodonthebrinkofbankruptcyorthesituationofbusinessisseriouslyintrouble,undersuchcondition,itisrequiredtoreducetheemplouee.(inlegalprocedure)TheEmployeeshallnotbedismissed:TheContracthasneithe

18、rexpirednorconformedto8.d,8.e,8.f,8.g;TheEmployeeisillwithoccupationaldiseaseorinjuredduetoworkandhasbeenauthenticatedfullyorpartlydisabledbytheLabourAuthenticationCommissioninBaodiCounty,Tianjin.TheEmployeeisillorinjured(otherthanduetowork)andiswithintheperiodofmedicalleaveprovidedforbyapplicablePR

19、ClawandregulationsandCompanypolicy;TheEmployeeiswomanwhoispregnant,onmaternityleave,ornursingababyunderoneyearofage;ori.TheapplicablePRClawsandregulationsotherwiseprohibittheterminationofthisContract.TheContractmaybedichargedbytheEmployeebygivingnoticeinwrittenform30(thirty)daysinadvance.However,the

20、EmployeemayinformtheEmployertodischargetheContractatrandomunderthefollowingoccasions:TheEmployeeisstillintheprobationaryperiod;.TheEmployerforcetheEmployeetoworkbyviolence,duressorillegalrestrictiontophysicalfreedom;i.TheEmployerdoesnotpaytheremunerationoftheEmployeeaccordancewiththerelevantclausein

21、theContract;.TheEmployerviolatestherelevantregulationsofStateorTianjinforitsterriblesafeandhealthcondition,whichisharmfultotheEmployeeshealth.I.TheContractcannotbeterminatedbytheEmployeebeforetheexpirationifnotconformingto8.d,8.h,j.TheEmployershallpaytheeconomiccompensationtotheEmployeriftheContract

22、isterminatedconformingto8.d,8.f,8.h.i-8.h.iv.AdditionalfeeformedicalallowanceshouldbepaidtotheEmployeeiftheContractisterminatedconformingto8.f.i.9.BreachLiabilitiesDuetoeitherpartysfault,ifbreachingtheContract,thatpartyshallundertakethebreachliabilityaccordingtotheextenttotheperformanceoftheContract

23、;ifthepartiesbothbreachtheContract,theyshallundertakeitsseparateliabilityaccordingtotheconcretesituation.Duetoeitherpartysfault,ifbreachingtheContracttodamagetheotherparty.ThedamageshouldbecompensatedbythefaultypartyaccordancewiththerelevantlawsandregulationsofPRC.Duetotheforcemajeure,causingthenon-

24、performanceorthedamagestoeitherparty,theotherpartymaynotundertakethebreachliability;TheEmployeewantstoresignandhasreceivedtrainingprovidedbytheEmployer,theEmployeeshallcompensateforthetrainingcost.Themethodofcompensationshouldbefixedaccordingtotherelevantcompanyregulationsasfollows:TheEmployeeshallc
