PAGEPAGE27裝修裝飾工程施工合同CONTRACTOFDECORATIONENGINEERING簽署日期Dateof工程名稱：ProjectName:工程地址：ProjectPlace:發(fā)包方(甲方)：Owner(HereinafterreferredtoaspartyA)承包方(乙方)：Contractor:(hereinaftercalledpartyB)鑒于甲方擬對辦公樓進(jìn)行裝修裝飾，通過招投標(biāo)程序，將該工程授予乙方施工并完成；鑒于乙方具備裝修裝飾施工的資質(zhì)，并愿意接受招投標(biāo)規(guī)定的條件，同意承擔(dān)該工程的施工并完成；鑒于雙方同意遵照《中華人民共和國合同法》、《建筑裝飾裝修管理規(guī)定》、《住宅室內(nèi)裝飾裝修管理辦法》及有關(guān)法律、法規(guī)規(guī)定履行本合同；基于本合同之合意、聲明、約定及其它約因，雙方當(dāng)事人茲就下列各事項(xiàng)達(dá)成協(xié)議：WHEREASpartyAintendstomakedecorationofofficebuilding,throughbiddingprocedure,awardthisprojectherebytopartyBforconstructionandcompletionthereof.WHEREASpartyBiswiththequalificationofdecorationengineering,intendstoacceptbiddingconditionsandconsenttoundertaketheprojectconstructionandcomplete.WHEREASpartiesheretoagreetoexecutethiscontractinaccordancewithLAWOFCONTRACT,REGULATIONSOFCONSTRUCTIONDECORATIONMANAGEMENT,ADMINISTRATIONRULESFORINDOORHOMEDECORATIONandconcernedlawsandregulations.NOWTHEREFOREinconsiderationofthemutualpromises,assertionsandcovenantshereinandothergoodandvaluableconsiderations,thereceiptsofwhichisacknowledgedhereby,thepartiesherebyagreeasfollows:第一條工程概況WorkOverview1、 工程名稱：ProjectName2、工程地址：ProjectPlace:3、承包方式：總承包（包工包料，包質(zhì)量，包安全，包工期）ContractingMeans:Generalcontracting,includingcontractingofmaterialsandlabor,liabilitiesofquality,work’ssafetyandwork’sschedule.4、承包內(nèi)容：包括所有的拆除及改造工程，以附件《工程報(bào)價(jià)單》為準(zhǔn)。Contractingcontentsincludeallworksofdemolishmentandmodification,whichshouldbesubjecttoConstructionQuotation.第二條合同工期ProjectPeriod本合同的工期自年月日開工至年月日竣工。Projectperiodhereofisfromthedateofcommencementoftothedateofcompletionof.第三條裝修審批和資質(zhì)ApprovalofProjectandQualificationofConstruction1、除本合同另有規(guī)定外，乙方同意依法辦理與裝修有關(guān)的所有審批、登記及驗(yàn)收手續(xù)，包括消防手續(xù)。UnlessotherwiseprovidedhereinpartyBagreetoprocessallformalities,whicharerelatedtothisdecoration,oftheapproval,registrationandacceptanceinadditiontofireprotection.2、乙方保證，其具備符合本工程要求的施工資質(zhì)。本合同項(xiàng)下甲方發(fā)包給乙方的所有裝修工程均沒有超出乙方資質(zhì)證書規(guī)定的范圍。PartyBherebywarrantythatitsexecutionqualificationconformtothisprojectrequirementsandnoneofdecorationworkshereunder,whichareawardedbypartyA,arebeyondthescopeofpartyB’sCertificationofQualification.第四條工程價(jià)款及付款方式ProjectCostandPayment1、本工程合同價(jià)款為人民幣：元整。ThecostofthisprojectisYuanRMBonly.2、付款方式：Paymentby（1）在乙方如期完成全部的裝修施工工程并經(jīng)甲方根據(jù)第八條驗(yàn)收合格后，甲方將于收到乙方正式發(fā)票后30天內(nèi)按實(shí)際完成的工作量及投標(biāo)單價(jià)一次性結(jié)算支付全部工程款項(xiàng)。UponandafterpartyB’scompletionofalldecorationworksonscheduleandmakingacceptancebypartyApursuanttothestipulationofArticle8,partyAwill,within30daysofreceiptofformalinvoicefrompartyB,effectpaymentinalumpsumofallprojectamountinaccordancewithactualcompletionofworksandbiddingunitprice.（2）由于設(shè)計(jì)變更及甲方要求修改等而引起的工程量較大的增減時(shí)，須由乙方編制增減工程預(yù)算書，經(jīng)甲方審核確認(rèn)后，在相應(yīng)的工程進(jìn)度款付款時(shí)予以結(jié)算支付。Providedthatlargerincreaseordecreaseofquantityduetodesignmodificationand/orpartyA’srequirementthereof,shouldbesubjecttopartyB’spreparationofengineeringbudgetfortheincreaseordecreaseofquantity,whichshouldbereviewedandexaminedbypartyAbeforepaymentofprojectprogressbesettledanpaidcorrespondently.3、乙方向甲方提供正式稅務(wù)發(fā)票前，甲方?jīng)]有付款義務(wù)。PartyAwillnoteffectpaymentuntilandunlesspartyBhaveprovidetheformalinvoicetopartyA.第五條工程質(zhì)量要求RequirementsofProjectQuality1、乙方嚴(yán)格按照經(jīng)甲方確認(rèn)的施工圖紙進(jìn)行施工，隨時(shí)接受甲方代表或委派人員的檢查檢驗(yàn)，為檢查檢驗(yàn)提供便利條件。同時(shí)施工嚴(yán)格按照國家規(guī)范進(jìn)行，施工滿足設(shè)計(jì)要求，質(zhì)量達(dá)到工程建設(shè)強(qiáng)制性標(biāo)準(zhǔn)、其他技術(shù)標(biāo)準(zhǔn)以及本合同的規(guī)定。否則，甲方有權(quán)要求乙方拆除重建，由此產(chǎn)生的一切費(fèi)用和損失，包括工期延誤的損失，由乙方承擔(dān)。PartyBshould,pursuanttoinstrictthedrawingswhichconfirmedbypartyA,carryoutexecutionandacceptinanytimetheinspection/checkingbypartyA’srepresentativeordesignatedpersonnel,forwhichprovidethefacilitateconditions.ConstructionshouldbecarriedoutinaccordancestrictlywithState’snorms,satisfydesignrequirements,thequalitythereofreachthecompulsorystandardsofconstruction,otherstandardsconcernedandregulationshereof.OtherwisepartyAisentitletorequirepartyBtodismantleandreconstructtheworkfromwhichanyandallexpenseandlossshouldbeundertakenbypartyB.2、工程以包工包料的方式進(jìn)行，材料按甲方指定采購，并應(yīng)當(dāng)符合國家標(biāo)準(zhǔn)及環(huán)保要求。禁止使用國家明令淘汰的建筑裝修裝飾材料和設(shè)備。Thisprojectisprocessedbythemeansofcontractingmaterialsandlabor,respectingtomaterialwhichshouldbepurchasedunderpartyAnamedandconformtotherequirementsofState’sstandardsandenvironmentalprotection.Thematerialsofdecorationandequipments,whichhavebeeneliminatedexpresslybyStateisprohibitedtoused.3、乙方對設(shè)計(jì)方案的可實(shí)施性和安全性承擔(dān)全部責(zé)任，任何因設(shè)計(jì)方案無法實(shí)施，修改方案導(dǎo)致的費(fèi)用增加,以及不能通過消防等相關(guān)驗(yàn)收而引起的損失或費(fèi)用增加均由乙方承擔(dān)。PartyBshouldbetakefullresponsibilityforthefeasibilityandsecurityofdesignscheme,ifany,alladdedexpenseduetotheunfeasibilityandalterationofdesign,inadditiontothelossorincreaseexpenseduetofailureofacceptanceoffireprotectionshallbeundertakenbypartyB.6、乙方應(yīng)當(dāng)按照圖紙施工，不得擅自改變設(shè)計(jì)圖紙。PartyBshouldconducttheconstructionpursuanttodrawingsandcannotmake,atitsowninitiative,modificationoramendmentofdesigndrawings.7、裝修工程竣工后，室內(nèi)空氣質(zhì)量應(yīng)當(dāng)符合國家有關(guān)標(biāo)準(zhǔn)，包括《室內(nèi)空氣質(zhì)量標(biāo)準(zhǔn)》(GB/T18883-2002)和《民用建筑工程室內(nèi)環(huán)境污染控制規(guī)范》（GB50325-2001）。Theatmospherequalityindoorshould,aftercompletionofdecorationengineering,conformtotheconcernedstandardsissuedbyStateincludingSTANDARDSOFAIRQUALITYINDOORandNORMALOFINDOORENVIRONMENTPOLLUTIONOFCIVILCONSTRUCTION.8、施工中，甲方如有特殊施工項(xiàng)目或特殊質(zhì)量要求，雙方應(yīng)確認(rèn)，增加的費(fèi)用應(yīng)另簽訂補(bǔ)充合同。Whereanyparticularprojectorspecialrequirementforquality,duringworks,beingraisedbypartyA,shouldbesubjecttotheconfirmationbypartiesheretoandsupplementaryagreementontheaddedcost.第六條雙方權(quán)利義務(wù)Rights&ObligationsofParties1、甲方權(quán)利義務(wù)：Rights&ObligationsofPartyA:（1）配合辦理施工報(bào)批相關(guān)手續(xù)；Tomakecooperationofprocessingallnecessarywork’permission.（2）在收到乙方提供的裝修圖紙后合理時(shí)間內(nèi)作出確認(rèn)或提出修改意見；Togiveconformationormodificationpinionwithinareasonableperiod,uponreceiptofdecorationdrawingssubmittedbypartyB.（3）按時(shí)支付工程款項(xiàng)；TopaythecontractamounttoPartyBonscheduleasagreed.（4）協(xié)助乙方與甲方指定分包商的施工配合TomakecooperationwithothersubcontractorwhichisnominatedbypartyA.（5）組織工程竣工驗(yàn)收工作。Toorganizetheacceptanceofproject’scompletion.2、乙方權(quán)利義務(wù)：Rights&ObligationsofPartyB（1）乙方應(yīng)當(dāng)在合同生效后10日內(nèi)按設(shè)計(jì)要求提供詳細(xì)施工報(bào)批圖紙，以便甲方和業(yè)主審核，并在甲方和業(yè)主對裝修圖紙?zhí)岢鲂薷囊庖姾?日內(nèi)提供修改后的報(bào)批圖紙。乙方應(yīng)按經(jīng)甲方和業(yè)主同意的施工圖紙施工。施工圖紙確認(rèn)后，施工過程中的變更也應(yīng)經(jīng)過甲方和業(yè)主事先同意。由于乙方的施工方案沒經(jīng)過業(yè)主及甲方同意，而造成的經(jīng)濟(jì)損失，及對業(yè)主的賠償責(zé)任由乙方承擔(dān)。賠償將從合同的款項(xiàng)中扣除,如不足以支付賠償金額,乙方還應(yīng)補(bǔ)足余額。如果乙方未能在本條款定期限內(nèi)提供詳細(xì)施工報(bào)批圖紙，則按第七條承擔(dān)責(zé)任。PartyBshould,withintendaysafterthiscontractcomeintoeffectpursuanttothedesignrequirement,submitthedetailexecutiondrawingforpartyAandownerforexamandapproval,andwithinthreedaysuponpartyAandowner‘ssubmissionofamendmentopinionsprovidethealtereddrawingsforre-exam/approval.PartyBshouldconducttheexecutioninaccordancewiththedrawingwhichhavebeenapprovedbypartyAandowner.AnyalterationduringtheexecutionshouldbesubjecttothepriorconsentofpartyAandowner,incaseoffailureoftheconsenttopartyB’sconstructionprogram,anyeconomiclossarisingtherefromandcompensationtoownershallbeundertakenbypartyB.Thecompensationwillbededucteddirectlyfromthecontractpayment,whereinsufficiencyofcontractpayment,partyBshouldmakeupthebalanceofcompensation.ProvidedthatpartyB‘sfailuretoprovidedetaildrawingforapprovalwithinthelimitedperiodherein,willassumethecorrespondingresponsibilitiesunderArticleSevenhereof.（2）開工前，乙方應(yīng)在與甲方協(xié)商后指派一名合格人員作為乙方工地代表，負(fù)責(zé)與甲方聯(lián)絡(luò)，監(jiān)督合同履行。PartyBshould,priortocommencementthroughthenegotiationwithpartyA,designaqualifiedpersonaspartyB’srepresentativeforliaisonwithpartyAandmakesupervisionofcontractperformance.（3）配備合格的施工人員。甲方代表有權(quán)要求乙方更換不具備相應(yīng)資格的施工人員，乙方應(yīng)在收到甲方代表的要求后日內(nèi)做出更換。Deploywithqualifiedconstructionpersonnel.PartyAisentitletorequestpartyBtoreplacethedisqualifiedpersonnelandpartyBshouldwithindaysreplacesuchpersonneluponreceiptoftherequestofpartyA’srepresentative.（4）做好施工組織管理，精心施工，保證工程質(zhì)量，定期向甲方匯報(bào)施工進(jìn)度情況，按時(shí)完工。做好施工安全防范措施，確保施工安全并承擔(dān)施工造成人身和財(cái)產(chǎn)損失的直接賠償責(zé)任。Conductthemanagementofexecutionorganization,carefulconstructionsoastoensureprojectquality,submittheprogresstopartyAatregularandhavecompletionofprojectonschedule.Conducttheprecautionofsafetyonsiteandensuresafeexecutionandundertaketheresponsibilityofdirectcompensationforanyperson’scasualtyandpropertylossduetoitsexecution.（5）已竣工工程未交付甲方驗(yàn)收之前，負(fù)責(zé)成品保護(hù)，保護(hù)期間發(fā)生損壞，乙方自費(fèi)予以修復(fù)。甲方在竣工驗(yàn)收前使用，發(fā)生損壞的修理費(fèi)用，由甲方承擔(dān)。由于乙方不履行上述義務(wù)，造成工期延誤和經(jīng)濟(jì)損失，責(zé)任由乙方承擔(dān)。ToberesponsiblefortheprotectionoffinishedproductswhichhavebeencompletedpriortopartyA’sacceptance,if,anydamageduringtheprotectionpartyBshouldrepairthesameonitsownaccount.ProvidedthatpartyAusethefinishedproductpriortoacceptancetherepaircostofdamagewillbeonpartyA’saccount.Howeverthedelayofwork’speriodandeconomiclossduetopartyB‘sfailureofperformanceofaforementionedliabilitiesshallberesponsibilityofpartyB.（9）組織參加工程竣工驗(yàn)收工作。Toorganizeandtakeparkintheacceptanceofcompletion.（10）文明施工，保證在施工過程中不在施工場地周圍亂放建材及廢物，并保證在工程竣工后負(fù)責(zé)清理并承擔(dān)相應(yīng)費(fèi)用。Conductorderlyexecutionandguarantythatnoconstructionmaterialsanddebriswillbeplacedoutoforderaroundthesite,inadditiontoclearandcleanthesiteaftercompletionandbearthecostthereon.第七條工期延誤Work’sDelay以下原因造成竣工日期拖延，經(jīng)甲方代表確認(rèn)后，工期才可相應(yīng)順延：Work’speriodmaybepostponedprovidedthatifthecompletiondayisdelayedduetofollowingreasonswhichhavebeenconfirmedbypartyA’srepresentative.甲方要求的設(shè)計(jì)及工程量重大變更；Thedesignandwork’squantity,whicharerequestedbypartyAhavebeenmaterialalteration.非乙方原因，一周內(nèi)累計(jì)停水、停電八小時(shí)以上的；DisruptiontimeofwaterandcurrencysupplyismoreeighthourswithinoneweekduetononpartyB’sreason.（3）不可抗力，系指戰(zhàn)爭和自然災(zāi)害；Forcemajeureshallrefertowaranddisasters.除上述因素外，因乙方原因造成工程未按合同工期竣工的，由乙方承擔(dān)違約責(zé)任，工期每延誤一天,乙方支付違約金人民幣元。Excepttoaforesaidreasons,providedthatiffailureofcompletionasthescheduleundercontractduetopartyB’sreason,theresponsibilitythereofshallbeonpartyBandpartyBshouldeffectthepaymentofliquidateddamagesonRMBforeachdelayeddayofworkperiod.第八條工程驗(yàn)收ProjectAcceptance1、工程具備覆蓋、掩蓋條件以及進(jìn)行隱蔽工程之前，乙方應(yīng)提前1天通知甲方檢查，甲方在驗(yàn)收記錄上簽字后，方可進(jìn)行隱蔽和繼續(xù)施工。否則甲方應(yīng)當(dāng)有權(quán)要求乙方拆除重建或者另行聘請第三方拆除重建，由此產(chǎn)生的一切費(fèi)用和損失，包括工期延誤的損失，由乙方承擔(dān)。PartyBshould,priortotheprojectwiththeconditionsofcoverandcarryingoutconcealedwork,giveonedayadvancenotificationtopartyAforinspection,andcannotconducttheconcealedworkorcontinueexecutionuntilpartyAhavesignedontheacceptancerecord.OtherwisepartyAisentitletorequirepartyBtodismantleandreconstructorretainathirdpartytodothesame,allexpensesandlossesconsequentthereonorincidentalthereto,includingthelossofperioddelay,shallbeassumedbypartyB.2、甲方有權(quán)要求對工程進(jìn)行分階段驗(yàn)收，具體階段性驗(yàn)收時(shí)間由甲方確定。PartyAhasrighttoconductthephasedacceptanceofproject,respecttothetimeofparticularacceptance,shallbesubjecttopartyA’sdetermination.3、工程具備竣工驗(yàn)收條件，乙方應(yīng)當(dāng)向甲方提供完整竣工資料和竣
