STANDARDCONTRACTAPPENDIXB-SPECIALCOMDITIONSSC-1DEFINITIONSInthisContractthetermslistedbelowshall.unlessthecontraryintentionappcars.havetheparticularmeaningassignedtothembythisSpecialCondition:Employershallmeananditsauthorizedrepresentatives.ContractorshallmeanChinaStateConstructionDecorationEngineeringCompanyanditsauthorizedrepresentatives.Contractortomanagerthecompetitionofthecontractwork.ThecontractorappointsMr.Liuyongasitsrepresentative.SC-2COMMUNICATIONSANDNOTICESTheCommunicationsandNoticesbetweenEmployerandContractorshallbeinwriting,anyparolagreementbetweenpartiesheretoshallbeconfirmedinwritinglater.Theofficialaddressesofthepartiesheretoareasfollows:Employer:Contractor:SC-3INTERPRETATIONOFCONTRACTDOCUMENTSThecontractdocumentsshallbemutuallyexplanatory,Incaseofdiscrepancy,followingsequenceshallbeapplied,ContractForm,AppendicesD,C,B,A,E,FSC-4INSURANCEREQUIREMENTSContractorshallprocureandmaintainallinsuranceprovidedbelowwithtermsandconditionsacceptabletoEmployer.Worker’sCompensationinsurancecoveringallworkersassignedtoperformtheworkunderthisContract.Underthecoverageofthisinsurance,anyworkerwhogetinjuredordeadinperformingtheworkofundertheContractwillbeproperlycompensatedinaccordancewiththelawsofthepeople’sRepublicofChina.Contract’EquipmentInsurancecoveringConteractor’sequipmenttoitsfullvalueagainst.alldamagefromanyaccidentalllossordamage.SC-5MEASUREMENTSYSTEMContractorshallusethemetricsystemofmeasurementforalldesigns,specifications,drawings,plansandworkexceptasotherwisedirectedinwritingbyEmployer.SC-6EMPLOYER-FURNISHEDUTILITIESANDFACILITIESUtilities:TheutilitieslistedbelowwillbefurnishedbyEmployerwithoutcosttoContractor,providedthatallsuchutilitieswillbefurnishedatoutletsexistingonthejobsiteandContractorshall,atitsownexpense,extendsuchutilitiesfromsaidoutletstopointsofuseanduponcompletionofallmaterialsandequipmentusedforsuchextensions.WaterforconstructionElectricpowerat380&220volts.3&1phaseSC-7EMPLOYER-FURNISHEDMATERIALANDEQUIPMENTEmployershallsupplythematerialandequipmentindicatedinAppendixD,EmployerSuppliedMaterialandEquipmentList.Contractorshallberesponsibleforreceipt,storageandinstallationofthesematerialsandequipmentexpectthosematerialsandequipmentwhichshallbeinstalledbytheEmployer’ssuppliers.SC-8CONTRACTOR-FURNISHEDSAMPLESANDDATAA:SamplesWheresamplesarerequired,theyshallbesubmittedbyandattheexpenseofContractor.Suchsubmittalshallbemadenolessthanten(10)calendardayspriortothetimethatthematerialsrepresentedbysuchsamplesareneededforincorporationintoanywork.ThataresubjecttoreviewandapptoalbyEmployer,MaterialsrepresentedbysuchsamplesshallnotbemanufactureddeliveredtotheJobsiteorincorporatedintoanyworkwithoutsuchreviewandapproval.EachsampleshallbearalabelshowingContractor’sname,Projectname,Contractnumber,nameoftheitem,manufacturer’sname,brandname,modelnumber,suoolie’sname,andreferencetotheappropriatedrawingnumber,technicalspccificationsectionandparagragraphnumber,allasapplicable.B:DataandMillCertificatesWherecertificatesarerequired,MillCertificatesformajoritemstobeincorporatedintoworksshallbesubmitted.Certificatesshallclearlyidentifythematerialbeingcerfiedandshallinclude,butnotlimitedto,providingthefollowinginformation:Contractor’sname,andreferencetotheappropriatedrawing,technicalspecificationsectionandparagraphnumber,allasapplicable.Sc-9AS-BUILTDRAWINGSANDQUALITYCONTROLDOCUMENTSQualityControlDocuments:ContractorshallprepareandissueallqualitycontroldocumentscoveringalltheworksperformedundertheContractasrequiredbyrelatedregulationsandcoderissuedbynationaland/orlocalconstructionadministrationauthorities.ThequalitycontroldocumentsshallbepreparedandcompiledinmanneracceptabletoConstructionQualityBureau.Endorsement:BeforethequalitycontroldocumentsareturnedovertoEmployer,Contractorshallsignandchopformsandcorersofthequalitycontroldocuments,andshallnotethereonthatdeviationsandannotationsarecompleteandaccurate..Contractorshallberesponsiblefortheacceptanceofthesequalitycontroldocumentsbytherelevantconstructionadministrationauthoritiesincluding,butnotlimitedto,theConstructionQualityBureau.SC-10COMMENCEMENT,PROGRESSANDCOMPLETIONOFTHEWORKContractorshallcompleteallworkinaccordancewiththecontractprogramtomeetthefollowingMilestoneDates:StartdayMay26,2000Completedday:preliminaryJuly31,200.(ItisdependontheworkareasuppliedbypartyAandthetime)Ifatanytime,Contractor’sactualprogressisinadequatetomeettherequirementsofthiscontract,Employermaynotify.Contractortotakesuchstepsasmaybenecessarytoimproveitsprogress.IfwithinareasonableperiodasdeterminedbyEmployer,ifContractordoesnotimproveperformancetomeettheContractMilestonessetforthabove.EmployermayrequireanincreaseinContractor’slaborforce,thenumberofshifts,overtimeoperations,additionaldaysofworkperweek,expeditedshipment(s)ofequipmentandmaterials,andanincreaseintheamountofconstructionplantandequipment,allwithoutadditionalcosttoEmployer,NeithersuchnoticenorEmployer’sfailuretoissuesuchnoticeshallrelieveContractorofitsobligationtoachievethequalityofworkandrateofprogressrequiredbythisContract.NoncompliancewithEmployer’sinstructionsshallbegroundsforEmployer’sdeterminationthatContractorisnotprosecutingtheWorkwithsuchdiligenceaswillassurecompletionwithinthetimeperiodspecified.Uponsuchdetermination,EmployermayterminatethiscontractpursuanttotheGeneralConditiontitled”TERMINATIONFORDEFAULT”.SC-11DelayinWorksIfthedelayinworkcausedbyfollowingfactors,theConstructionDurationandCompletionDatespecifiedinContractcouldbeextendedaccordinglysubjecttothereviewbytheSupervisoryCompanyandapprovalbytheEmployer’sRepresentatives:Increaseinquantityofworksandchangeindesign.Withinoneweektheaccumulativestoppageofworksexceeds8hourscausedbyfailureofwatersupplyand/orpowersupplywhichisnotcausedbythefaultoftheContractor.ForceMajeure.FailurebyEmployertoperformhisobligationsconcernedunderthecontract.DelayinarrivaloftheEmployersuppliedmaterialandequipment.DelaybyEmployer’sothercontractors.Withinoneweekaftertheoccurrenceoftheabove,theContractorshallsubmithisreport,togetherwithevidenceandsubstantiatingdocumentstodetailthesituationandextentofdelayinworks,andsuchreportshallbisubmittedtotheEmployer’sRepresentativeintime.TheEmployer’sRepresentativeshallrecognizewithin3daysuponreceiptofthereport,andtheEmployer’sshouldgivereplywithin7daysuponreceiptoftheirrepresentative’sreportonlytheactivitiesinthecriticalpathhavebeendelayedcantheconstructionperiodandcompletiondatebeextended.SC-12CONTRACTPROGRAMContractorshall,withinfive(5)calendardaysfromandafterContractor’sreceiptofwrittennoticeofaward,andbeforethefirstprogresspaymentismade,submittoEmployerforapprovaladetailedConstructionProgrammeetingthedatesestablishedinthespecialConditiontitled“COMMENCEMENT,PROGRESSANDCOMPLETIONOFTHEWORK”andshowingallconstructionactivitiesandsequenceofoperationsneededfortheorderlyperformanceandcompletionofanyseparablepartsofandallworkinaccordancewiththiscontract.SC-13METHODSTATEMENTANDSAFETYPROGRAMContractorshall,withinfive(5)calendardaysfromandafterContractor’sreceiptofwrittennoticeofaward,andbeforethefirstprogresspaymentismade,submittoEmployerforapprovaladetailedConstructionMethodStatementandadetailedSafetyProgram.Uponapprovalofthetwodocuments,Contractorshallassignqualifiedsiteengineersandsitesafetyofficerstoenforcethetwodocumentsinhisperformanceoftheworkunderthecontract.SC-14CONTRACTORFURNISHEDDATA:ContractorshallfurnishtoEmployer,attheaddressindicatedintheSpecialConditiontitled”COMMUNICATIONSNOTICES”,f
