一年（普通）聘用合同PartyA:InternationalEducationLt,.d甲方：XXX國際教育有限公司InternationalKindergartenandEnglishSchoolareregisteredinstitutionsunderthegoverninglawsofthePeople’sRepublicofChina.XXXX少兒英文培訓(xùn)學(xué)校及幼兒園是遵照中華人民共和國相關(guān)法律注冊(cè)的有限公司。Hereinnownas 2^以下簡(jiǎn)稱甲方）PartyB:Phone:Passportnumber：Visa： EmergencyContacts:.Name: Relationship: Address: Email: Phone: WHEREAS:備注：PartyAwishestoemployPartyBasanaccredited（‘ESL’）secondlanguageteacher.甲方同意聘用乙方為合格的外語（主要為英語）教師。PartyBisacceptedafullyqualifiedESLteacherandwishestoacceptemploymentwithPartyA.乙方為合格ESL教師并同意任職于甲方。NOWTHEREFORETHISCONTRACTSTATESthatinconsiderationofthepremisesandmutualagreementscontainedherein,thepartiesagreeasfollows:經(jīng)雙方協(xié)商，達(dá)成以下共同協(xié)議：Employment雇用ThepartiesagreethatPartyBwillbeemployedbyPartyAasanESLteachertoperformthefollowingduties:雙方同意甲方將雇用乙方作為外語(主要為英語)教師去履行如下職責(zé)：WorktogetherwithCIEOtoobtainthehighesteducationstandardfromestablishedcurriculumprovidedbyPartyAtoPartyB.甲方為乙方提供ESL教育指導(dǎo)，建立課程的最高標(biāo)準(zhǔn)。ProvidesupportoutsideoftheclassroomwhereitisnecessarytofurthertheEnglisheducationofstudents,whichmayincludebutisnotlimitedtodistributionofpromotionalmaterials.提供課堂以外的支持，進(jìn)一步提高學(xué)生英語水平，包括但是不僅僅限于推廣材料的分發(fā)。Knowandbeabletointroducethecurriculumtoanywhomaybeinterested.Example,school’sparentsofstudents,potentialstudents,etc.在甲方要求下，向家長(zhǎng)及學(xué)校推介我們學(xué)校的系統(tǒng)。Attendtoamaximumoffive-twelve(5-12)hoursperweekofmeetings.Thisincludesbutisnotlimitedto,holidaypresentations,homevisits,lessonplanningandanynecessarypaperwork.參加每周最多5-12小時(shí)的培訓(xùn),家訪或者行政會(huì)議和課程計(jì)劃。ProvideESLinstructiontobothoncampusandoutsideinstitutions.Example,summerandwintercampsareheldoffcampus.為校園內(nèi)部及外校提供ESL講座。PartyBshallcarryoutalladditionalresponsibilitieslistedinthe‘Teacher’sResponsibilitiesForm.(kindergarten/school)乙方必須履行《教師職責(zé)表》中的所有職責(zé)(幼兒園/英文學(xué)校)。RepresentationbyPartyA.甲方陳述PartyAwillensurethatPartyBreceivesthenecessaryworkpermitinthePeople’sRepublicofiCnah.甲方確保乙方獲得在中國工作必需的工作許可。PartyArepresentsthatitisanaccredited,authorizedandfullylicensedschoolinthePeople’sRepublicofChina.甲方是經(jīng)中華人民共和國認(rèn)證，授權(quán)，資質(zhì)健全的培訓(xùn)學(xué)校。RepresentationbyPartyB乙方陳述PartyBagreestofollowthecurriculumestablishedbyPartyAfortheteachingofESLtoPartyA’sstudents.乙方同意根據(jù)甲方指定的課程對(duì)甲方的學(xué)生進(jìn)行ESL教學(xué)。PartyBunderstandsthatduetothenatureofPartyA’sbusiness,flexibilityofworkinghoursmaybenecessaryand,therefore,PartyBagreestoworkflexibleworkinghours.乙方理解由于甲方業(yè)務(wù)需要而導(dǎo)致的工作時(shí)間的靈活性，乙方同意接受靈活的工作時(shí)間。PartyBagreesthatwillnotengageinanyothercompany’semploymentwhileboundunderthiscontractperiod.乙方同意在合同期內(nèi)不受聘于其他公司。PartyBagreestomaintainabsoluteconfidentialityregardingtheteachingmethods,curriculumoranyproprietaryinformationaboutPartyA,itsteachingcenter,methods,ormannerofdoingbusinesstoanythirdpartywhoisnotanemployer,officeroragentofPartyA.乙方同意不將諸如教學(xué)方法，教學(xué)課程及其教學(xué)中心，商業(yè)運(yùn)作的手段泄露于非雇主、官方或者甲方代理人以外的任何第三方。PartyBwill,atalltimes,conducthimselforherselfinthePeople’RsepublicofChinainamannerappropriatewiththatofaforeignvisitor.PartyBwillberespectfulandfollowallChineselaws.乙方須一直以中華人民共和國外籍來訪者的身份嚴(yán)格要求自己，乙方須尊重和服從所有的中國法律。TermsandWages待遇與薪金.PartyAshallcompensatePartyBsalaryandbonus8000ChineseRMBpermonthwithinthecontractedperiod(30days/month).甲方合同期內(nèi)必須按合同規(guī)定每月付給乙方薪金及獎(jiǎng)金人民幣8000元。PartyA是根據(jù)中國的勞工制度按每月30天為月工資的計(jì)薪標(biāo)準(zhǔn)支付薪金給PartyB。Thefirsttwomonthsofthiscontractareaprobationaryperiod.PartyB’ssalaryis7000ChineseRMBpermonth.PartyBssalaryshallberaisedtotheamountmentionedinsection4.1onlyifhis/herperformanceisconsideredsatisfactory.乙方薪金前2個(gè)月是合同所規(guī)定的試用期，乙方試用期薪金為人民幣7000元每月。只有在乙方的表現(xiàn)被認(rèn)為滿意時(shí)，方可領(lǐng)取轉(zhuǎn)正后的工資。Aftertheprobationperiod,PartyBshallreceivesalaryRMB7000andmonthlybonusof1000ChineseRMBifthefollowingrequirementsaremet,accordingtoeachschoolbonusguidelines.試用期后乙方能達(dá)到以下工作質(zhì)量要求，可獲得薪金人民幣7000元及月獎(jiǎng)金為1000元。Noscheduledclassesaremissedand/orbeginlate.Noscheduledclassesaremissedandlatefor15mins.沒有缺課、且無遲到15分鐘。Nostudenthasanyaccidentswheremedicaltreatmentatahospitalorbytheschoolsnurseisrequired.沒有學(xué)生的安全事故，指流血、縫針及須到醫(yī)院處理等事故。Noefficientreportsfromparents,studentsandschool,andlessthan3studentsleavetheschoolbecauseofthosecomplaints.沒有來自家長(zhǎng)、學(xué)生及學(xué)校的投訴，以及由此導(dǎo)致的學(xué)員流失達(dá)3名/月。PartyBmeetstheschool’tseachingmanagementsrequests,suchasstudentsprogress,classcontent,services(eg.phonecall,homevisit,parentsmeeting),studentreports,andfinishestheteachingplanontimeandcarriesouttheplan.符合教學(xué)管理要求，如進(jìn)度、內(nèi)容、服務(wù)(電訪、家訪、家長(zhǎng)會(huì))、學(xué)員成績(jī)報(bào)告、評(píng)估、按時(shí)完成教學(xué)計(jì)劃、計(jì)劃的落實(shí)等。AllsectionsofMonthlyPerformanceSheetrateexcellentorhigher.整個(gè)部門每月月工作效率優(yōu)或更高。IfPartyBbreaksoneitemsofa—e,PartyAwilldeduct20%fromeachitembroken.如果乙方違反以上a e任何一項(xiàng)，獎(jiǎng)金則扣除20%，依此類推.Themonthlybonusisseparatefromthemonthlysalary,andunliketeachinghours,cannotbemadeup.Nordoesitaffectthesystemofpaymentformonthlysalaries.月獎(jiǎng)金與月薪分開的，與教學(xué)時(shí)間不同，不可以累加，而且它不會(huì)影響到每月月薪的支付體系.PartyAwillprovidePartyBwillproperlegaldocumentationofincometaxpaidwhenPartyAgotfromgovernment(normallyafterpaid12monthstax).甲方在乙方完成12個(gè)月合同后，將由有關(guān)部門提供具法律效應(yīng)的繳稅證明。PartyBshouldpaythepersonalincometaxbasedonthesalaryandbonusaccordingtotherelatedtaxlawsinChina.乙方須根據(jù)中國的相關(guān)稅法交納工資及獎(jiǎng)金的個(gè)人所得稅.ThiscontractisbindingfromDMYtoDMY.Including2monthsprobationperiod.ForOneyear0month.此合同從 年月日到年月日,包含2個(gè)月試用期。期限為壹年零月。.PartyAshallkeep1000ChineseRMBasaccommodationandvisadeposit,tobereturnedtopartyBuponcompletionofthiscontract.甲方必須收取人民幣1000元作為房屋及簽證押金，直到乙方完成此合同后退回乙方。ThisdepositshallbedeductedfromPartyBssalaryatarateof500ChineseRMBpermonthfor2months,startingfromthefirstmonth.此押金在乙方第一個(gè)月開始的薪金中扣除每月人民幣 500元(分?jǐn)?shù)月扣除，直至扣完為止)。IfPartyBbreaksthiscontract,orifPartyAdismissesPartyB,PartyAshallnotreturnthedeposit.如果乙方毀約或甲方解雇乙方的情況下，甲方將不予以返還乙方押金。4.8.Thefirstandsecondmonths’salaryshallonlybpeaidtoPartyBoncePartyBhascompletedonefullmonthplusthree(3)daysofwork.前二個(gè)月的工資只有在乙方完成整月的工作并附加3天的工作后付于乙方。Thereafter,themonthlysalaryshallbepaidonthenext6thoftheeachmonth.此后，教師的工資在下個(gè)月的6日發(fā)放。Uponcompletionofthiscontract,theperformanceoftheteacherwillberatedasfollows:根據(jù)合同，教師的工作表現(xiàn)以下列標(biāo)準(zhǔn)來衡量：PartyBhasfollowedtheprinciplesofthiscontract,andhasfollowedtheteacher’sresponsibilities,listedintheattachedTeacher’sResposnibilitiesForm.服從合同的原則，履行教師的職責(zé)。PartyBhashadagoodworkingrelationshipwiththeteamandPartyAandhasdemonstratedgoodteachingskills.具備良好的工作人際關(guān)系，良好的教學(xué)技巧等。Uponcompletionofthecontract,PartyAshallrewardPartyBabonusofupto10000ChineseRMB.PartyAwilljudgethisbonusbaseduponthepointslistedinsection4.8.1,4.8.2.在完成合同后，甲方必須支付給乙方獎(jiǎng)金人民幣10000元。詳見4.8.1,4.8.2。Nootherparttimejobsarepermittedforfulltimeemployees.（includingnotgettingpaidbyotherjobbesidesPartyA）任何全職老師不允許兼職其他工作。（包括不領(lǐng)取新酬的其他與甲方約定外的工作。）Dismissal解雇IftheperformanceofPartyBisconsideredunsatisfactory:在乙方的工作表現(xiàn)被確認(rèn)為不滿意的情況下：Adiscussionbasedonexpectedimprovementinperformanceshallserveasafirstnotice.對(duì)其工作表現(xiàn)進(jìn)行討論并且期待進(jìn)步作為第一警告。Awrittennoticeandexpectedimprovementinperformanceshallserveasasecondnotice.書面警告并且期待進(jìn)步作為第二警告。Uponathirdnotice,PartyBshallbedismissedwithoutanyfurtherpaymentorthedepositmentionedin4.6.乙方將會(huì)在無任何薪金支付和押金退回的情況下被解雇，此為第三警告。IfpartyBbreaksthiscontract,PartyAshallreservetherighttodismissPartyBwithnofurtherpaymentofanyremainingwagesandthedepositmentionedin4.6.如果乙方違約，甲方保留在無任何薪金支付及押金退回的情況下解雇乙方（詳見4.6）Schedule,HoursandLocation日程表，時(shí)間與位置PartyBshallcompleteatotalof25inclassteachinghoursplus5-12hoursofadditionalweeklyactivitiesforPartyAincludingbutnotlimitedto:teachermeetings,observingclasses,homevisits,parentphoning,andadditionaltraining.乙方必須完成總共為25小時(shí)的教學(xué)時(shí)間，家訪，電訪或培訓(xùn)以及每周5-12小時(shí)的會(huì)議以及課程觀摩時(shí)間。IfteachinginoneofIOindergartens,PartyBshallcompletea唾liofclassteachinghours.如在幼兒園任職的外教，需完成每周25小時(shí)的授課時(shí)間。PartyBisentitledtohave1.5--2completedaysperweekfreeofwork,whileworkingforPartyAundercontract.（Onlywhenyouareinthepositionunderthecontract,youcanhavethedays.off.）乙方按規(guī)定每周可以休息1.5--2天。（注：在崗假期，離崗不享用）Theschedulewillbedifferentduringthesummer,winter,MayDay,Newyear,andinternationalholidaytimes.日程表在暑假、寒假、五一、春節(jié)與國際假日時(shí)有所不同。

Holiday,SickDaysandSubstitution假期、病假及其工作替代PartyBshallreceivepaidholidaysforallChinesegovernmentassignedholidaysandChristmas.YoumustbeworkingundercontractforPartyAtoreceivetheseholidays.Holidaysareasfollows:乙方將得到如下的主要中國假日與圣誕節(jié)的有薪假期，此有薪假期(在崗才能享受)如下列節(jié)日：Eachschoolarrangesholidaysaroundtheirindividualclassschedules.SpringFestival:7days(includespreviouslyassigneddaysoffforthatweek)春節(jié)：7天 （包括休息日）Summer:4days暑假：Summer:4days暑假：4天Christmas:3days圣誕節(jié)：3天(AccordingtoPartyA’rsequirementofcourseandactivity,ifwewon’thaveholidaysduring24,25,26thesethreedays.SothatwepostponetoSpringholiday.)(IfPartyArequiresPartyBtoworkonDecember24,25or26,(asChristmasisnotaChineseNationalHoliday),PartyAwillensurePartyBreceivesthemisseddaysduringtheChineseNewYearHoliday.)NewYear’sday:1day元旦：1天NationalDayHoliday:2days國慶節(jié)：2天MayDayHoliday:1day五一節(jié)：1天Mid-autumnday:1day中秋節(jié)：1天Inordertoreceiveadditionaldaysoff,arequestmustbebroughtforthtothemanagementoftheschoolPartyBisworkingat.Arequestdoesnotguaranteethedayswillbegranted.Also,daysoffareunpaid.要獲得額外休假，必須獲得分校辦公室的批準(zhǔn),但是無薪的。YouwillonlyreceiveyourspringholidaypayifyouhavealreadyworkedforCIEOfor2months.只有為XXX國際教育有限公司工作滿兩個(gè)月的時(shí)間，才可以獲得有薪的春節(jié)假期。Summer,winter,Nationalday,MayDayandNewYgramsarecalculatedasfollows:Toaccommodatetraveltimeandtimeoff,programsoperateona25houraweekprinciplewith2fulldaysoff.Theseprogramsconcentrateteachingtimewhichallowsdaysofftobeaddedtogetherattheendoftheprogram.Semestersalsooperateonthesameprinciple,however,teachingtimeisnotconcentrated,whichmeansanyteachinghoursabovethe25hourmaximumwillbepaidat150Yuanperhourorarrangedayoffinstead.Thereisnodeductionforhoursunderthemaximum.Thereisnominimumamountofhourstocomplete.暑假、寒假、國慶、五一和元旦等節(jié)日計(jì)劃如下：為使在旅游時(shí)合理安排時(shí)間，通常以每周25小時(shí)教學(xué)時(shí)間，加上1.5-2天休息為準(zhǔn)，集中教學(xué)時(shí)間允許將休息日調(diào)在完成教學(xué)任務(wù)一起休，學(xué)期時(shí)間也在同樣的準(zhǔn)則上執(zhí)行，然而教學(xué)時(shí)間不是集中的，如教學(xué)時(shí)間超過25小時(shí),學(xué)校將補(bǔ)貼150元/小時(shí)或安排補(bǔ)休，但在最長(zhǎng)的工作時(shí)間下學(xué)校是不會(huì)允許增加工作時(shí)間的,因此在一定意義上來講是沒有最低的工作時(shí)間的。IntheeventoflosthoursduetosicknessonthepartofPartyB:乙方因生病不能工作時(shí)：PartyBisentitledto3paidsickdaysperyear.(Adoctorsnoteisrequired.)PartyBshallbeobligedtobeavailabletomakeupalllosthoursoverthe3paidsickdaysbysubstitutingorworkingadditionalteachinghours.乙方享有一年3天帶薪病假休假需提供醫(yī)院有效證明。如超過3天，將視為無薪休假，或通過補(bǔ)課來抵消超出的休假時(shí)間。IfPartyBisunavailabletomakeuplosthours(notincludingthe3paidsickdays-doctorsnoterequired);PartyB’swagesshallbepenalizedattherateof160RMB/hour.如果乙方無法補(bǔ)回工作時(shí)間(3天/年的病假不算)，其工資會(huì)按每小時(shí)160元被扣除。Intheeventofsicknessofco-workers;外教的生病事件：IfsubstitutionoranyotherrelatedtemporaryworkisrequiredduringPartyB’steachingdaysorsetofficehours,PartyBwillbeobligedtosubstitute.AllhourssubstitutedshallbecountedaspartofPartyB’srequire2d5hoursthatweek.PartyAwillinformPartyBofsuchsubstitutioneitherinoralorwrittenformatleastonedaypriortotherequestedtime.Howeverincaseofemergency,urgencyorunexpectedsituation,PartyBshouldunderstandthesituationandaccepttherequesttosubstitute.如要求乙方在教學(xué)時(shí)間或辦公時(shí)間進(jìn)行代課，或從事某項(xiàng)臨時(shí)性工作。甲方須至少提前一天用書面或口頭的形式通知乙方，然而如果甲方在緊急或不可預(yù)知的情況下要求乙方代課或從事某項(xiàng)臨時(shí)性工作，乙方也應(yīng)該理解這種情況并且接受工作。乙方有義務(wù)接受要求。所有代課時(shí)間將作為乙方在代課的星期內(nèi)所要求的25小時(shí)工作時(shí)間的一部分。IsfubstitutionisrequiredoutsideofPartyB’steachingdaysorsetofficehours,orifsubstitutionisreuiredaboveandbeyondPartyB’Sioursforthatweek,PartyBmaychoosetosubstituteandbecompensatedat150ChineseRMB/hour.如要求代課是超出乙方的教學(xué)時(shí)間或辦公時(shí)間，或者如果代課要求超出乙方在一周內(nèi)的工作時(shí)間，乙方選擇代課后，將得到150元/小時(shí)的補(bǔ)償。PartyAisonlyresponsibleforinjuriesormishapsoccurringduringPartyB’soffice/teachinghours.AnyinjuriesormishapsoccurringoutsideofthesetimesaretheresponsibilityofPartyB.甲方對(duì)乙方在教學(xué)時(shí)間和辦公時(shí)間中的人身安全負(fù)責(zé)。任何乙方在工作時(shí)間以外產(chǎn)生的傷害、災(zāi)禍都必須由乙方自行負(fù)責(zé)。PartyBisresponsibleforallpersonalhealthandmedicalcosts.PartyAmaynotemployPartyBiftheydonothaveprovincialandtravelmedicalinsurance.乙方必須自負(fù)所有個(gè)人健康及醫(yī)療費(fèi)用。如不提供其醫(yī)療保障文件，甲方可不聘用乙方。DutiesandExpectations職責(zé)與預(yù)期Asaforeignteacher,PartyBshall:作為一名外教，乙方必須：Carryoutallresponsibilitieslistedintheeachers Responsibilities砧履行所有教師職責(zé)表列出的職責(zé)。Attendweeklyteachermeetings.參加每周的教師會(huì)議。Listentootherteachers’classesatscheduledtimes,toimprovePartyB’sownteaching,aswellasprovideconstructiveinputtoimprovetheteachingofothers.乙方應(yīng)按規(guī)定時(shí)間聽課，提高自己的教學(xué)質(zhì)量，同時(shí)提供有助于提高其他教師的教學(xué)質(zhì)量的建設(shè)性建議。EnsurethecontinualandorganizedimplementationoftheInternationaKlid’Esnglishsystemforallteachers,andstudents.確保XXX國際教育有限公司所有教職員工和學(xué)生的英文體系的連續(xù)性和有組織地執(zhí)行。Responsibilityforbreakingthecontractand/ordismissal違約責(zé)任與解雇PartyBshouldgiveathirty(30)daynoticeinwritingtoPartyAifPartyBwishestoterminatethecontractbeforethedateofitsexpiration.PartyBisrequiredtomakeappropriatearrangementsfortheconclusionoftheiremployment,returnalltheteachingmaterials,andresidentpermitappliedforbyPartyAbeforePartyBcanofficiallyterminatethecontract.乙方若想在合同期滿日前終止合同，必須提前30天向甲方提出書面告知，乙方須對(duì)他的聘用結(jié)束期作適當(dāng)?shù)陌才?，在乙方可以公開終止合同之前，交回所有的教學(xué)資料和由甲方申請(qǐng)的居住許可證。PartyAmayimmediatelyterminatetheemploymentofPartyBifPartyAdeterminesthatPartyBhasdonesomethingcritical.Example,PartyBhascausedharmtoastudent，staffmemberorschool’sname.ThisistothediscretionofthemanagementofCIEO.在甲方認(rèn)為乙方以不夠友好或消極的態(tài)度對(duì)待其學(xué)生和雇主及有損校方名譽(yù)，工作表現(xiàn)不盡如人意時(shí)，可以終止對(duì)乙方的雇用。IfPartyBbreaksthiscontractorleaveswithoutaonemonthnotice,PartyAreservestherighttodismissPartyBwithnofurtherpaymentofanyremainingwagesorthedepositmentionedinthiscontract.PartyAalsoreservestherighttosuePartyBforanydamagescausedbyPartyBnotfulfillingtheircontractwithPartyA.如乙方?jīng)]有提前一個(gè)月告知甲方而離開，甲方有權(quán)解雇乙方，并且不會(huì)付給乙方剩余的工資及押金。Confidentiality保密PartyAreservestherighttoallcomponentsoftheInternationalKid’EsnglishsystemandallteachingmaterialusedattheInternationalChildren’sSchool.Anyactiontodisperseo
