幼兒園章程(模板)幼兒園章程第一章總則根據(jù)《教育法》、《民辦教育促進(jìn)法》、《民辦教育促進(jìn)法實(shí)施條例》、《民辦非企業(yè)單位登記暫行條例》和相關(guān)法律法規(guī)，制定本章程。第二條幼兒園名稱：第三條幼兒園地址：第四條幼兒園性質(zhì)：本園為自愿舉辦、非盈利性社會服務(wù)機(jī)構(gòu)，是基礎(chǔ)教育的有機(jī)組成部分，是學(xué)校教育制度的基礎(chǔ)階段，為學(xué)前幼兒提供保育和教育。第五條辦學(xué)宗旨：本園遵守法律法規(guī)，貫徹國家的教育方針，遵守社會道德風(fēng)尚。第六條監(jiān)督管理：本園自愿接受上杭縣教育局、上杭縣民政局的業(yè)務(wù)指導(dǎo)和監(jiān)督管理。第七條條款規(guī)定：本章程中的各項(xiàng)條款如與法律、法規(guī)、規(guī)章不符，以法律、法規(guī)、規(guī)章的規(guī)定為準(zhǔn)。第二章舉辦者、開辦資金和辦學(xué)結(jié)構(gòu)第八條舉辦者：本單位的舉辦者是（刪除有問題的內(nèi)容）。舉辦者享有以下權(quán)利：（一）了解本單位經(jīng)營狀況和財(cái)務(wù)狀況；（二）推薦董事或理事；（三）有權(quán)查閱理事會或董事會會議記錄和本單位財(cái)務(wù)會計(jì)報(bào)告。第九條開辦資金：本單位開辦資金為萬元，出資者為（刪除有問題的內(nèi)容），金額為萬。第十條辦學(xué)結(jié)構(gòu)：（一）辦學(xué)規(guī)模：1.本園占地面積平方米；2.建筑面積平方米；3.幼兒園戶外活動面積平方米；4.審批部門核準(zhǔn)在園生人數(shù)為個(gè)班，人。（二）辦學(xué)層次：幼兒園學(xué)制為三年。（三）辦學(xué)形式：本園招生對象為3-6歲的幼兒，提供小、中、大班全日制學(xué)前教育。第三章組織管理制度第十一條董事會：本園依法設(shè)立董事會，每屆任期三年，是幼兒園的決策機(jī)構(gòu)。第十二條董事會人員：董事會人員應(yīng)不少于五人，主要由舉辦者或其代表、校長、教職工代表組成。其中，三分之一以上的董事應(yīng)具有五年以上教育教學(xué)經(jīng)驗(yàn)。第十三條董事會成員：董事會成員必須熱心教育事業(yè)，品行良好，具有政治權(quán)利和完全民事行為能力。第十四條董事會人員更換：首屆董事、董事長由舉辦者推選產(chǎn)生。董事長更換由董事會投票選舉，全體董事過半數(shù)通過。董事更換由董事長提名，經(jīng)三分之二以上董事會組成人員同意通過。第十五條董事任期：董事每屆任期為三年，可以連選連任。第十六條職權(quán)：董事會行使以下職權(quán)：（一）聘任和解聘園長；（二）修改幼兒園章程和制定幼兒園的規(guī)章制度；（三）制定發(fā)展規(guī)劃，批準(zhǔn)年度工作計(jì)劃；（四）籌集辦學(xué)經(jīng)費(fèi)，審核預(yù)算、決算；（五）決定教職工的編制定額和工資標(biāo)準(zhǔn)；（六）決定幼兒園的分立、合并、終止。Article17:TheBoardofDirectorsshallholdatleasttwomeetingseveryyear,andaninterimmeetingmaybecalledinthefollowingsituations:(1)WhentheChairmandeemsitnecessary;(2)Whenproposedbymorethanone-thirdofthemembersoftheBoardofDirectors.Article18:TheBoardofDirectorsshallhaveoneChairmanandoneViceChairman.Article19:TheViceChairmanshallassisttheChairmaninhis/herwork.WhentheChairmanisunabletoexercisehis/herpowers,theViceChairmandesignatedbytheChairmanshallexercisehis/herpowersonhis/herbehalf.Article20:TheChairmanshallexercisethefollowingpowers:(1)ConveningandpresidingovermeetingsoftheBoardofDirectors;(2)ImplementingtheimplementationofresolutionsoftheBoardofDirectors;(3)Signingrelevantdocumentsonbehalfofthekindergarten;(4)Fulfillingobligationsandresponsibilitiesstipulatedbylaws,regulations,andrelevanteducationalregulations.Article21:TheBoardofDirectorsshallimplementaone-person-one-votesystemandtheminorityshallbesubjecttothemajoritybasedonthenumberofdirectorspresentatthemeeting.Whenthenumberofvotesinfavorandagainstareequal,theChairmanshallmakethefinaldecision.However,forthefollowingmajorissues,approvalbymorethantwo-thirdsofthemembersisrequired:(1)Appointmentanddismissaloftheprincipal;(2)Amendmentofthekindergarten'sarticlesofassociation;(3)Formulationofdevelopmentplans;(4)Reviewofbudgetsandfinalaccounts;(5)Decisionsonotherimportantchangessuchastheseparation,merger,andterminationofthekindergarten.Article22:TheChairmanorhis/herdesignatedpersonnelshallnotifyalldirectorsofthetime,place,andcontentofthemeetingtendaysbeforetheBoardofDirectorsmeeting.Ifadirectorisunabletoattendthemeetingduetounforeseencircumstances,he/shemayappointanotherdirectortoattendthemeetingonhis/herbehalf.Theauthorizationlettermustspecifythescopeofauthorization.Article23:ThenumberofdirectorspresentattheBoardofDirectorsmeetingmustbemorethanhalfofthetotalnumberofdirectors.Ifitislessthanhalf,theresolutionpassedisinvalid.Ifthenumberofdirectorswhoapprovetheresolutionafterthemeetingexceedstwo-thirdsoftheabsentdirectors,theresolutionisvalid.Article24:TheBoardofDirectorsshallkeeparecordofthemeetingandtheattendingdirectorsshallsignonthemeetingrecord.ThedirectorsshallberesponsiblefortheresolutionsoftheBoardofDirectorsmeeting.TherecordsoftheBoardofDirectorsmeetingshallbekeptandmanagedbypersonneldesignatedbytheChairman.Article25:Thekindergartenshallhaveoneprincipal,whoshallbeappointedordismissedbytheBoardofDirectors.Article26:TheprincipalshallberesponsibletotheBoardofDirectorsandexercisethefollowingpowers:(1)Implementingthedecisionsofthekindergarten'sBoardofDirectors;(2)Implementingdevelopmentplans,draftingannualworkplans,financialbudgets,andkindergartenrulesandregulations;(3)Appointinganddismissingkindergartenstaff,andimplementingrewardsandpunishments;(4)Organizingeducationalandteachingactivities,scientificresearchactivities,andensuringthequalityofeducationandteaching;(5)Beingresponsibleforthedailymanagementofthekindergarten;(6)Beingresponsibleforthesafety,health,andhealthmanagementofthekindergarten.Article27:TheprincipalshallnotchangetheresolutionsoftheBoardofDirectorsorexceedthescopeofauthorizationwhenexercisinghis/herpowers.ChapterIVLegalRepresentativeoftheKindergartenArticle28:TheChairmanshallbethelegalrepresentativeofthekindergarten.Article29:Thefollowingsituationsshalldisqualifyapersonfromservingasthelegalrepresentativeofthekindergarten:第四十二條規(guī)定了幼兒園提取發(fā)展基金的用途，包括建設(shè)、維護(hù)和更新教學(xué)設(shè)備等。第四十三條規(guī)定了出資人取得合理回報(bào)的比例，必須經(jīng)過三分之二以上董事會成員同意才能通過。在確定比例后15天內(nèi)，必須將決定和與辦學(xué)水平、教育質(zhì)量有關(guān)的材料、財(cái)務(wù)狀況報(bào)審批機(jī)關(guān)備案。第七章規(guī)定了章程的修改程序，必須經(jīng)過董事會表決通過后15天內(nèi)，報(bào)業(yè)務(wù)主管
