nationsstatesthatadefendantmayonlybejudgedonthebasisofwhatheorshecouldreasonablyhave

25knownatthetimeofaction.Knowledgethatisgatheredlater,suchasfromaccidentsceneinvestigations,forensictests,orthearbitrarydiscoveryofanoddlymisusedproduct,isdeemedirrelevantinevaluatingthequalityofthedecisions

30madeinthemoment,thatis,beforeafocalmishapoccurred.Asempiricalstudieshaveshown,however,hindsightbiasroutinelyafflictsjudgmentsofadefendant’spastconduct.

Therealityofhindsightbiasissometimesdifficult

35toconveytoseasoneddecisionmakersbecausehindsightbiascanbeconfusedwithsimplelearningfromexperience.Individualandorganizationsinnovate,thrive,andprosperwhentheyanalyzemistakesandadjusttheirstrategiesaccordingly.
