鑄造鑄件合同范本(2024版)合同編號：__________castingcastingcontracttemplate(2024edition)甲方：__________address:__________contactperson:__________contactinformation:__________乙方：__________address:__________contactperson:__________contactinformation:__________鑒于甲方是一家專業(yè)從事鑄造業(yè)務(wù)的企業(yè)，乙方是一家專業(yè)從事鑄件生產(chǎn)的企業(yè)，雙方本著平等互利的原則，經(jīng)協(xié)商一致，就甲方向乙方采購鑄件事宜達(dá)成如下合同：article1:scopeofsupply1.1theseller(hereinafterreferredtoas"乙方")agreestosupplythefollowingproducts(hereinafterreferredtoas"貨物")tothebuyer(hereinafterreferredtoas"甲方"):(listofgoods)1.2thegoodsshallbeproducedandmanufacturedinaccordancewiththespecifications,drawingsandtechnicalrequirementsprovidedthebuyer.1.3thequantity,qualityanddeliverytimeofthegoodsshallbeasagreedinthecontract.article2:qualityandinspection2.2thesellershallprovidethebuyerwiththerelevantinspectioncertificatesandtechnicaldocumentsrequiredfortheinspectionanduseofthegoods.2.3thebuyerhastherighttoinspectandtestthegoodsatanytimeduringtheproductionanddeliveryprocesstoensurethatthegoodsmeetthequalitystandardsspecifiedinthecontract.article3:priceandpayment3.1thepriceofthegoodsshallbeasagreedinthecontractandshallbepaidthebuyerwithintheagreedtime.3.2thebuyershallmakethepaymentbanktransferorothermethodsagreedbothparties.3.3ifthebuyerfailstomakethepaymentwithintheagreedtime,thesellershallhavetherighttoclaiminterestontheoutstandingamountatthecurrentinterestrate.article4:deliveryandtransportation4.1thesellershalldeliverthegoodstothebuyer'sdesignatedplaceofdestinationwithintheagreeddeliverytime.4.2thesellershallberesponsibleforthetransportationofthegoodsandshallinsurethegoodsagainstlossordamageduringtransportation.4.3thebuyershallhavetherighttoinspectandacceptthegoodsupondelivery.Ifthegoodsdonotmeetthequalitystandardsspecifiedinthecontract,thebuyershallhavetherighttorejectthegoodsanddemandarefundorreplacement.article5:warrantyandaftersalesservice5.1thesellerwarrantsthatthegoodsshallbefreefromdefectsinmaterialsandworkmanshipforaperiodof[period]fromthedateofdelivery.5.2ifanydefectsarefoundinthegoodsduringthewarrantyperiod,thesellershall,atitsownexpense,repairorreplacethedefectivegoodsorpartsthereof.5.3thesellershallprovidetechnicalsupportandaftersalesserviceforthegoodsasagreedinthecontract.article6:breachofcontract6.1ifeitherpartybreachesanyprovisionofthiscontract,theotherpartyshallhavetherighttoclaimdamagesandotherlossescausedthebreach.6.2ifthesellerfailstodeliverthegoodswithintheagreeddeliverytime,thebuyershallhavetherighttoclaimliquidateddamagesinanamountequalto[amount]ofthepurchasepriceforeachdayofdelay.6.3ifthebuyerfailstomakethepaymentwithintheagreedtime,thesellershallhavetherighttoclaiminterestontheoutstandingamountatthecurrentinterestrateandclaimdamagesforanylossescausedthebuyer'sbreach.article7:termination7.1eitherpartymayterminatethiscontractgivingwrittennoticetotheotherpartyiftheotherpartybreachesanymaterialprovisionofthiscontractandfailstocuresuchbreachwithinareasonableperiodoftime.7.2theterminationofthiscontractshallnotaffectanyrightsandobligationsofthepartiesarisingoutofthiscontractpriortothedateoftermination.article8:disputeresolution8.1anydisputesarisingoutoforinconnectionwiththiscontractshallberesolvednegotiationbetweentheparties.8.2ifthepartiesfailtoresolvethedisputesthroughnegotiation,eitherpartymaysubmitthedisputestothepeople'scourtwithjurisdictionovertheplaceofperformanceofthiscontract.article9:otherprovisions9.1thiscontractshallbeeffectiveuponthesignatureofbothpartiesandshallbebindinguponthepartiesandtheirsuccessorsandassigns.9.2thiscontractmaynotbeamendedorterminatedunlessagreedtoinwritingbothparties.9.3thiscontractconstitutestheentireagreementbetweenthepartieswithrespect一、附件列表：

1.甲方未按合同約定時間支付貨款

2.乙方未按合同約定時間交付鑄件

3.鑄件質(zhì)量不符合合同約定標(biāo)準(zhǔn)

4.乙方未提供合同約定的檢測證書和技術(shù)文件

5.乙方未按合同約定提供售后服務(wù)

6.任何一方未履行合同約定的其他義務(wù)三、法律名詞及解釋：

1.甲方：指合同中買方，負(fù)責(zé)采購鑄件的一方。

2.乙方：指合同中賣方，負(fù)責(zé)生產(chǎn)鑄件的一方。

3.貨物：指合同中約定由乙方供應(yīng)給甲方的鑄件。

4.質(zhì)量標(biāo)準(zhǔn)：指合同中約定的鑄件質(zhì)量要求。

5.違約：指合同一方未履行合同約定的義務(wù)。四、執(zhí)行中遇到的問題及解決辦法：

1.乙方延期交付鑄件：

提前溝通，了解原因，協(xié)商延期交付。

要求乙方承擔(dān)相應(yīng)的違約責(zé)任，如賠償逾期交付的損失。

2.鑄件質(zhì)量不符合要求：
