2024年度版通用跑步活動安全協(xié)議書本合同目錄一覽1.協(xié)議范圍1.1活動類型1.2活動地點1.3活動日期2.參與者的資格要求2.1年齡限制2.2健康要求2.3參與者責任3.組織者的責任3.1活動籌備3.2安全措施3.3醫(yī)療支持4.活動規(guī)則4.1活動流程4.2安全指南4.3違規(guī)行為處理5.保險事宜5.1保險覆蓋5.2保險申請5.3保險理賠6.個人物品6.1必備物品6.2禁止攜帶物品6.3物品保管7.緊急情況處理7.1緊急聯(lián)系信息7.2緊急疏散計劃7.3醫(yī)療救援8.法律責任8.1豁免條款8.2責任限制8.3爭議解決9.隱私保護9.1個人信息收集9.2信息使用與保護9.3信息公開10.協(xié)議修改與終止10.1修改條款10.2終止條件10.3終止后事項11.違約責任11.1違約行為11.2違約后果11.3違約處理12.爭議解決方式12.1協(xié)商解決12.2調(diào)解解決12.3法律途徑13.其他條款13.1通知方式13.2合同生效13.3合同期限14.簽署信息14.1簽署日期14.2簽署地點14.3簽署方信息第一部分：合同如下：1.協(xié)議范圍1.1活動類型本協(xié)議書適用于2024年度舉辦的各類跑步活動，包括但不限于全程馬拉松、半程馬拉松、迷你馬拉松及相應(yīng)配套活動。1.2活動地點活動將在【活動城市】舉行，具體比賽路線將提前公布。1.3活動日期活動日期為2024年【月】月【日】日。2.參與者的資格要求2.1年齡限制參與者須年滿18周歲。對于16至18周歲的未成年人參與活動，須由其法定監(jiān)護人簽署同意書。2.2健康要求參與者應(yīng)確保自身身體健康，適合參加跑步活動。如有心臟病、高血壓等不適宜高強度運動的疾病，不宜參加本次活動。2.3參與者責任參與者需按照活動規(guī)則和安排參加本次活動，并保證所提供的個人信息真實準確。3.組織者的責任3.1活動籌備組織者將確?；顒忧暗幕I備工作充足，包括賽道布置、裁判員和志愿者培訓、醫(yī)療救護設(shè)備準備等。3.2安全措施組織者將采取必要的安全措施，包括活動現(xiàn)場的安全監(jiān)控、交通管制、緊急醫(yī)療救援等，確?；顒禹樌M行。3.3醫(yī)療支持組織者將在活動現(xiàn)場設(shè)置醫(yī)療站點，并提供必要的醫(yī)療支持。參與者如有不適，應(yīng)立即向醫(yī)療人員求助。4.活動規(guī)則4.1活動流程參與者須按照活動規(guī)定的流程參與活動，包括簽到、檢錄、起跑等。4.2安全指南參與者應(yīng)遵守安全指南，包括佩戴號碼布、遵守交通規(guī)則、不攜帶危險物品等。4.3違規(guī)行為處理對于違反活動規(guī)則和安全指南的參與者，組織者有權(quán)取消其參賽資格，并在必要時追究其法律責任。5.保險事宜5.1保險覆蓋組織者將為每位參與者購買活動期間的人身意外傷害保險。5.2保險申請參與者須在活動報名時提供準確的個人信息，以便組織者購買保險。5.3保險理賠在保險有效期內(nèi)，如發(fā)生保險事故，參與者應(yīng)按照保險公司的理賠程序進行理賠。6.個人物品6.1必備物品參與者應(yīng)自備號碼布、運動裝備、水壺等必備物品。6.2禁止攜帶物品參與者不得攜帶易燃、易爆、有毒、有害物品及其他違禁物品進入活動區(qū)域。6.3物品保管參與者如需寄存物品，應(yīng)提前向組織者指定的物品寄存處提交，并自行承擔物品遺失或損壞的風險。7.緊急情況處理7.1緊急聯(lián)系信息參與者應(yīng)準確提供緊急聯(lián)系人信息，并在活動期間保持通訊暢通。7.2緊急疏散計劃組織者將制定緊急疏散計劃，并在活動現(xiàn)場進行標識和指引。7.3醫(yī)療救援如參與者發(fā)生意外，組織者將立即啟動醫(yī)療救援程序，并通知其緊急聯(lián)系人。8.法律責任8.1豁免條款參與者acknowledgeandagreethatparticipatingintheEvent,theyassumeallrisksassociatedwiththeirparticipation,includingbutnotlimitedtopersonalinjury,death,propertydamage,orotherloss.8.2責任限制Tothemaximumextentpermittedapplicablelaw,theOrganizershallnotbeliableforanydirect,indirect,incidental,special,punitive,orconsequentialdamagesarisingoutoforinanywayconnectedwiththeEventortheparticipationintheEvent,whetherornottheOrganizerhasbeenadvisedofthepossibilityofsuchdamages.8.3爭議解決AnydisputesarisingoutoforinconnectionwiththisAgreementshallberesolvedarbitrationinaccordancewiththerulesoftherelevantarbitrationinstitutioninthePlaceofEvent,andthedecisionofthearbitrator(s)shallbefinalandbindinguponbothparties.9.隱私保護9.1個人信息收集TheOrganizercollectstheParticipant'spersonalinformationforthepurposesoforganizing,managing,andpromotingtheEvent.TheParticipant'spersonalinformationwillbehandledinaccordancewithrelevantlawsandregulationsandwillnotbedisclosedtoanyunauthorizedthirdparties.9.2信息使用與保護TheOrganizerwillusetheParticipant'spersonalinformationforthepurposesofthisEventandmayalsouseitforotherpurposesasdescribedintheOrganizer'sprivacypolicy.TheOrganizerwilltakereasonablemeasurestoprotecttheParticipant'spersonalinformationfromunauthorizedaccess,use,disclosure,alteration,ordestruction.9.3信息公開ExceptasrequiredlaworwiththeParticipant'sconsent,theOrganizerwillnotpubliclydisclosetheParticipant'spersonalinformation.10.協(xié)議修改與終止10.1修改條款ThisAgreementmaybeamendedormodifiedtheOrganizeratanytime.AnysuchamendmentormodificationwillbeeffectiveuponnotificationtotheParticipant.10.2終止條件ThisAgreementmaybeterminatedeitherpartyuponwrittennoticetotheotherpartyintheeventofamaterialbreachofthisAgreementthatisnotcuredwithinareasonableperiodoftime.10.3終止后事項UponterminationofthisAgreement,theParticipant'srighttoparticipateintheEventwillterminate,andtheParticipantwillhavenofurtherobligationtotheOrganizerunderthisAgreement.11.違約責任11.1違約行為TheParticipantagreesthatanybreachofthisAgreementmayresultintherevocationoftheirparticipationintheEventandtheforfeitureofanybenefitsassociatedwiththeEvent.11.2違約后果TheOrganizerreservestherighttopursuelegalactionandclaimdamagesagainsttheParticipantintheeventofabreachofthisAgreement.11.3違約處理IntheeventofabreachofthisAgreement,theOrganizermay,atitssolediscretion,takeanyappropriateactiontoenforceitsrights,includingbutnotlimitedtoterminationofthisAgreementandpursuitoflegalaction.12.爭議解決方式12.1協(xié)商解決ThepartiesagreetoresolveanydisputesarisingoutoforinconnectionwiththisAgreementthroughfriendlynegotiation.12.2調(diào)解解決Ifthepartiesareunabletoresolvethedisputethroughnegotiation,eitherpartymayapplytoamediationinstitutionformediation.12.3法律途徑13.其他條款13.1通知方式13.2合同生效13.3合同期限ThisAgreementmaybeextendedwiththewrittenconsentofbothparties.14.簽署信息14.1簽署日期ThisAgreementissignedonthe__thdayof___,2024.14.2簽署地點ThePlaceofEvent.14.3簽署方信息[PartyAInformation][PartyBInformation]第二部分：第三方介入后的修正1.第三方定義及責任1.1第三方定義ForthepurposesofthisAgreement,"ThirdParty"meansanyindividual,entity,ororganizationthatisnotPartyAorPartyB,andthatmaybeinvolvedintheperformanceorfulfillmentofthisAgreement.1.2第三方責任TheThirdPartyshallberesponsiblefortheirownactsandomissionsintheperformanceoftheirobligationsunderthisAgreement,andshallindemnifyandholdharmlessPartyAandPartyBfromandagainstanyandallclaims,damages,losses,andexpenses(includingreasonableattorney'sfees)arisingoutoforinconnectionwithsuchactsoromissions.2.第三方介入情形2.1中介方介入IntheeventthatanintermediaryorbrokerisinvolvedinthenegotiationandexecutionofthisAgreement,suchintermediaryorbrokershallbeconsideredaThirdParty.ThePartiesagreetoprovidetheintermediaryorbrokerwithallnecessaryinformationanddocumentationtofacilitatethetransaction,andtopromptlyresolveanydisputesarisingbetweenthePartiesinconnectionwiththeintermediary'sorbroker'sservices.2.2服務(wù)供應(yīng)商介入IntheeventthataserviceproviderisengagedPartyAorPartyBtoperformcertainobligationsunderthisAgreement,suchserviceprovidershallbeconsideredaThirdParty.ThePartiesagreetoensurethattheserviceproviderisawareofandboundthetermsandconditionsofthisAgreement,andtoassumeresponsibilityfortheactsandomissionsoftheserviceproviderintheperformanceoftheirobligations.3.第三方責任限額3.1第三方責任限制Tothemaximumextentpermittedapplicablelaw,theliabilityoftheThirdPartytoPartyAandPartyBunderthisAgreementshallbelimitedtotheextentoftheinsurancecoverageprovidedtheThirdPartyortheamountpaidtheThirdPartytoPartyAandPartyB,whicheverisless.3.2第三方責任免除TheThirdPartyshallnotbeliableforanyindirect,incidental,punitive,orconsequentialdamagesarisingoutoforinanywayconnectedtotheperformanceorbreachofthisAgreement.4.甲乙方與第三方的權(quán)益劃分4.1甲乙方權(quán)益PartyAandPartyBshallhavetherighttoenforcetheirrightsandremediesagainsttheThirdPartydirectly,andtoseekindemnificationandreimbursementfromtheThirdPartyforanylossesandexpensessufferedasaresultoftheThirdParty'sbreachofthisAgreement.4.2第三方權(quán)益TheThirdPartyshallhavetherighttoseekindemnificationandreimbursementfromPartyAandPartyBforanylossesandexpensessufferedasaresultoftheParties'breachofthisAgreement,totheextentthatsuchlossesandexpensesarenotcoveredtheThirdParty'sinsurancecoverageorothersourcesofindemnification.5.第三方介入后的通知義務(wù)5.1通知義務(wù)UpontheoccurrenceofanyeventthatwouldreasonablyleadPartyAorPartyBtobelievethataThirdPartymaybeliabletoPartyAorPartyBunderthisAgreement,PartyAorPartyBshallpromptlynotifytheotherPartyofsuchevent.5.2合作處理ThePartiesagreetocooperateintheinvestigationandresolutionofanyclaimsordisputesarisingoutoforinconnectionwiththeactsoromissionsoftheThirdParty.6.第三方介入后的爭議解決6.1協(xié)商解決ThePartiesagreetoresolveanydisputesarisingoutoforinconnectionwiththeactsoromissionsoftheThirdPartythroughfriendlynegotiation.6.2調(diào)解解決IfthePartiesareunabletoresolvethedisputethroughnegotiation,eitherPartymayapplytoamediationinstitutionformediation.6.3法律途徑7.第三方介入后的合同修改7.1修改條款ThisAgreementmaybeamendedormodifiedthePartieswithrespecttothetermsandconditionsgoverningtherelationshipwiththeThirdParty,uponwrittennoticetotheotherParty.7.2終止條款ThisAgreementmaybeterminatedeitherPartyuponwrittennoticetotheotherPartyintheeventofamaterialbreachofthisAgreementtheThirdPartythatisnotcuredwithinareasonableperiodoftime.8.定義和解釋8.1定義TermsusedinthisAgreementshallhavethemeaningsassignedtotheminthebodyofthisAgreement,unlessotherwisedefinedinthisArticle8.8.2解釋AnyinterpretationofthisAgreementshallbemadeinaccordancewiththeplainlanguageoftheAgreementandtheintentofthePartiesasevidencedtheirsignatureshereto.9.適用法律ThisAgreementshallbe
