英文調(diào)解協(xié)議書(shū)

ThisMediationAgreementismadeandenteredintoasofthis_____dayof______________,20____,byandbetween[PartyAName]("PartyA")and[PartyBName]("PartyB").

WHEREAS,PartyAandPartyBaredesirousofresolvingtheirdisputethroughmediation("theDispute");

NOW,THEREFORE,inconsiderationofthemutualcovenantsandagreementssetforthherein,thepartiesagreeasfollows:

1.MediationProcess

1.1Themediationshallbeconductedbyamediatortobemutuallyagreeduponbybothparties.Ifthepartiescannotagreeonamediatorwithinthirty(30)daysofthisAgreement,themediatorshallbeselectedfromapre-approvedlistprovidedby[MediationCenterName]orappointedbyamutuallyagreed-uponmethod.

1.2Themediationsessionsshallbeheldatamutuallyagreed-uponlocationorviavirtualmeans,asdeterminedbythemediator.

2.MediationRules

2.1Themediationshallbeconductedinaccordancewiththeprinciplesofgoodfaithandconfidentiality.

2.2AllpartiesagreetoprovidefullandfrankdisclosureofallrelevantinformationnecessarytofacilitatetheresolutionoftheDispute.

3.Confidentiality

3.1Allcommunications,discussions,andinformationsharedduringthemediationprocessareconfidentialandshallnotbedisclosedtoanythirdpartywithoutthepriorwrittenconsentoftheotherparty,exceptasrequiredbylaw.

4.MediationAgreement

4.1ThepartiesagreetomeetwiththemediatorinagoodfaithefforttoresolvetheDispute.Themediatorshallfacilitatethediscussionandassistthepartiesinreachingamutuallyacceptableagreement.

4.2Ifthepartiesreachanagreement,awrittensettlementagreementshallbepreparedandexecutedbybothparties.Thiswrittenagreementshallbefinalandbindingontheparties.

5.CostsandFees

5.1Eachpartyshallberesponsiblefortheirownmediatorfees,ifany,andotherexpensesincurredduringthemediationprocess,unlessotherwiseagreedinwriting.

6.DisputeResolution

6.1IfthepartiesfailtoresolvetheDisputethroughmediationwithin[number]mediationsessions,thepartiesagreeto[specifynextstep,e.g.,submittheDisputetoarbitrationorlitigation].

INWITNESSWHEREOF,thepartieshaveexecutedthisMediationAgreementasofthedatefirstabovewritten.
