Whereas:

(1)Tacklingclimateandenvironment-relatedchallengesandreachingtheobjectivesofthe

ParisAgreement3,adoptedon12December2015undertheUnitedNationsFramework

ConventiononClimateChange(UNFCCC),areatthecoreoftheCommission's

communicationof11December2019onthe(EuropeanGreenDeal'.Thenecessityand

valueoftheEuropeanGreenDealhaveonlygrowninlightoftheverysevereeffectsofthe

COVID-19pandemiconthehealthandeconomicwell-beingoftheUnion'scitizensandof

Russia'swarofaggressionagainstUkraine.

(2)TheEuropeanGreenDealcombinesacomprehensivesetofmutuallyreinforcingmeasures

andinitiativeswhichaimtoachieveclimateneutralityintheUnionby2050,andsetsouta

newgrowthstrategythataimstotransformtheUnionintoafairandprosperoussociety

withamodern,resource-efficientandcompetitiveeconomy,whereeconomicgrowthis

decoupledfromresourceuse.Italsoaimstoprotect,conserveandenhancetheUnion's

naturalcapital,andprotectthehealthandwell-beingofcitizensfromenvironment-related

risksandimpacts.Atthesametime,thattransitionaffectswomenandmendifferentlyand

hasaparticularimpactonsomedisadvantagedandvulnerablegroups,suchaslow-income

householdsandpersons,olderpeople,personswithdisabilitiesandpersonswithaminority

racialorethnicbackground.Itmustthereforebeensuredthatthetransitionisjustand

inclusive,leavingnoonebehind.

(3)FollowingtheadoptionbytheEuropeanParliamentandtheCouncilofessentialelements

oftheTitfor55'legislativepackage,asproposedbytheCommissioninJuly2021,the

UnionsubmittedinOctober2023anupdatednationallydeterminedcontribution(NDC)of

theUnionanditsMemberStalestotheUNFCCC,confirmingthattheUnionwillcutits

netgreenhousegasemissionsbyatleast55%by2030comparedto1990levels.

(4)ThroughtheadoptionofRegulation(EU)2021/1119oftheEuropeanParliamentandof

theCouncil4,IlieUnionhasenshrinedinaUnionlegislativeacttheobjectiveof

economy-wideclimateneutralitywithintheUnionatthelatestby2050andtheaimof

achievingnegativeemissionsthereafter.Moreover,thatRegulationestablishesabinding

Uniondomesticreductiontargetfornetgreenhousegasemissions(emissionsafter

deductionofremovals)ofatleast55%comparedto1990levelsby2030.Ilalsosetsthe

frameworkfortheesUblishmentofintermediateUnionclimatetargetsandforthe

publicationoftheprojectedindicativeUniongreenhousegasbudgetforthe2030-2050

period.

establishingtheframeworkforachievingclimateneutralityandamendingRegulations

(5)Allsectorsoftheeconomyareexpectedtocontributetoachievingthoseemission

reductions,includingtheroadtransportsector.Initscommunicationof9December2020

on'SustainableandSmartMobilityStrategy-puttingEuropeantransportontrackforthe

future',theCommissionsetsoutaroadmapforasustainableandsmartfutureforEuropean

transport,withanactionplantowardstheobjectiveofdeliveringa90%reductionin

emissionsfromthetransportsectorby2050.Heavy-dutyvehiclesarecuiTentlyresponsible

formorethanaquarterofgreenhousegasemissionsfromroadtransportintheUnionand

forover6%oftheUnion'stotalgreenhousegasemissions.

(6)TheTitfor55,legislativepackageaimstoimplementthe2030greenhousegasemissions

reductiontarget.Itcoversarangeofpolicyareas.TherevisionofRegulation

(EU)2019/1242oftheEuropeanParliamentandoftheCouncil5isanintegralpartofthat

legislativepackage.

(7>Initscommunicationof18May2022onthevREPowerEUPlan',theCommissionoutlined

aplantomaketheUnionindependentfromRussianfossilfuelswellbeforetheendofthis

decade.Thatcommunicationhighlightstheimportance,interalia,offurtherincreasingthe

efficiencyof,andreducing,fossilfuelconsumptioninthetransportsector,where

electrificationcanbecombinedwiththeuseoffossil-freehydrogentoreplacefossilfuels.

settingCO2emissionperformancestandardsfornewheavy-dutyvehiclesandamending

Regulations(EC)No595/2009and(EU)2018/956oftheEuropeanParliamentandofthe

(8)Inordertocontributetothereductioninnetgreenhousegasemissionsofatleast55%

comparedto1990levelsby2030andinconformitywiththeenergyefficiencyfirst

principle,itisnecessarytostrengthentheCO2emissionsreductionrequirementsfor

heavy-dutyvehiclessetoutinRegulation(EU)2019/1242.Aclearpathwayalsoneedsto

besetforfurtheremissionreductionsbeyond2030fortheheavy-dutyvehiclessectorto

contributetoachievingtheclimate-neutralityobjectiveby2050.

(9)ThestrengthenedCO2emissionsreductionrequirementsshouldincentiviseanincreasing

shareofzero-emissionheavy-dutyvehiclesbeingdeployedontheUnionmarketwhilst

providingbenefitstousersandcitizensintermsofairqualityandenergysavings,aswell

asensuringthatinnovationintheautomotivevaluechainandtheassociatedhigh-quality

jobscanbemaintained.Zero-emissionheavy-dutyvehiclescurrentlyincludebattery

electricvehicles,fuel-cellandotherhydrogen-poweredvehicles,andtechnological

innovationcontinues.

(10)NewstrengthenedCO:emissionsreductiontargetsshouldbesetfornewheavy-duty

vehiclesfrom2030onwards.Thosetargetsshouldbesetatalevelthatwilldeliverastrong

signaltoacceleratetheuptakeofzero-emissionheavy-dutyvehiclesontheUnionmarket,

stimulateinnovationinzero-emissiontechnologiesinacost-efficientway,givethe

necessarysignaltoacceleratethedeploymentofchargingandrefuellinginfrastructure

acrosstheUnion,ensurethelong-termcompetitivenessoftheUnionindustryonaglobal

market,andcontributetoreducingtherunningcostsfortransportcompanies,while

ensuringthattheUnionmeetsitsclimateobjectivesanditsobjectivetoalleviateair

pollution.

(11)Airpollutionisaparticularlyacuteproblemincities,affectingthehealthofmillionsof

Europeancitizens.Transportisoneofthemainsourcesofurbanairpollution.The

acceleratedroll-outofzero-emissionheavy-dutyvehicles,throughstrengthenedCO:

emissionsreductionrequirements,willcontributetoalleviatingtheurbanairpollution

problem.

(12)TheCommission'scommunicationof5May2021on'Updatingthe2020NewIndustrial

Strategy:BuildingastrongerSingleMarketforEurope'srecovery,aimstoachievethe

co-creationofgreenanddigitaltransitionpathwaysinpartnershipwithindustry,public

authorities,socialpartnersandotherstakeholders.Inthatcontext,atransitionpathwayis

beingdevelopedforIhemobilityecosystemtoaccompanythetransitionoftheautomotive

valuechain.Thetransitionpathwaypaysparticularattentiontosmallandmedium-sized

enterprisesintheautomotivesupplychain,andtotheconsultation,includingbyMember

States,ofsocialpartners.IlalsobuildsontheEuropeanSkillsAgendawithinitiativessuch

asthePactforSkillstomobilisetheprivatesectorandotherstakeholderstoup-skilland

re-skillEurope'sworkforceinviewofthegreenanddigitaltransitions,andbuildsonthe

TalentBoosterMechanismintheframeworkoftheHarnessingTalentsinEUregions

initiative.TheappropriateactionsandincentivesatEuropeanandnationalleveltoboost

theaffordabilityofzero-emissionvehiclesarealsobeingaddressedinthetransition

pathway.Thatcould,forexample,includethepossibilityforMemberStatestousethe

SocialClimateFundestablishedbyRegulation(EU)2023/955oftheEuropeanParliament

andoftheCouncil6(the'SocialClimateFund5)toassistmicro-enterprisesinpurchasing

zero-emissionheavy-dutyvehicles.Particularattentionshouldbegiventotheimpactthat

thattransitionwillhaveonmicro,smallandmedium-sizedenterprises(SMEs)alongthe

supplychain.TheCommission'scommunicationof1February2023on'AGreenDeal

IndustrialPlanfortheNet-ZeroAge'aimstoenhancethecompetitivenessofEurope's

net-zeroindustryandtosupportthefasttransitiontoclimateneutrality.

establishingaSocialClimateFundandamendingRegulation(EU)2021/1060

ThalplanaimstoprovideamoresupportiveenvironmentforthescalingupoftheUnion's

manufacturingcapacityforthenet-zerotechnologiesandproductsrequiredtomeetthe

Union'sambitiousclimatetargets.Accesstotrainingandreskillinginnumeroussectors

thatneedtoundergofundamentalchanges,includingtheheavy-dutyvehiclesandthe

refuellingandrechargingsectors,iscrucialforasociallyjustandeffectivetransition.

Investmentsintheskillsneededforaneffectivetransitionareacollectiveresponsibility.

Employeesandjobseekersshouldhaveaccesstoreskillingandupskillingopportunities,

andtheirparticipationinthoselearningactivitiesshouldbesupported.MemberStatesare

encouragedtorampupinvestmentsinreskillingandupskillingandtomapoutandanalyse

thepredictedchangesinthejobmarket.

(13)Togetherwithinitiativestoaccelerateamodalshifttowardsmoresustainabletransport

modes,thestrengtheningoftheCO2emissionsreductionrequirementsforheavy-duty

vehiclesandrolling-outthenecessaryrechargingandrefuellinginfrastructurewillplaya

keyroleinreducingtheCO2emissionsoftheheavy-dutyvehiclessector.TheUnion

fleet-wideCO2emissionsreductiontargetslaiddowninthisRegulationarecomplemented

bytherechargingandrefuellinginfrastructurerequirementssetoutinRegulation

(EU)2023/1804oftheEuropeanParliamentandoftheCouncil7.Unionfundingplaysan

importantroleintheinfrastructurerolloutatnationallevel.Thedeploymentofrecharging

infrastructureforheavy-dutyelectricvehiclesisequallyimportantinprivatelocationsthat

arenotaccessibletothepublic,suchasinprivatedepotsandatlogisticscentreswhich

provideovernightanddestinationcharging.MemberStatesshouldconsidertaking

measuresinthecontextofsettinguptheirrevisednationalpolicyframeworkstoensure

thatappropriateinfrasiructureisprovidedforovernightanddestinationchargingfor

heavy-dutyelectricvehicles.Itisalsoappropriatetoconsider,inviewofpossible

infrastructuralconstraintsinthirdcountries,theimpactofthisRegulationonthepossibility

fornewheavy-dutyvehiclesregisteredinaMemberStatetooperateoutsidetheUnion.

13September2023onthedeploymentofalternativefuelsinfrastructure,andrepealing

(14)In2015,followingtheadoptionofDirective2014/94/EUoftheEuropeanParliamentand

oftheCouncil8,theSustainableTransportForum(ihe4Forum')wassetupbythe

Commission.TheForumassiststheCommissioninimplementingtheUnion'sactivities

andprogrammesaimedatfosteringthedeploymentofsustainablealternativefuels

infrastructure.FollowingtheadoptionofthisRegulation,theCommissionwillensurethat

theForumsupportstheeffectiveandcost-efficientroll-outoftherechargingandrefuelling

infrastructureneededtomeetthestrengthenedCO?emissionsreductionrequirementsfor

heavy-dutyvehicles,andthatitinformsthereviewreferredtoinArticle24(2)of

Regulation(EU)2023/1804,sothatthetargetssetoutinthatRegulationarealignedwith

theambitionofthisRegulation.

(15)Thetransitiontoclimateneutralityrequiressignificantinvestmentintheelectricitygrid,

includingenhancedcapacity,resilienceandstorage,aswellasadditionalconnections.In

viewoftheCO2emissionsreductiontargetsforheavy-dutyvehiclesfortheyear2030

establishedunderthisRegulation,theshareofzero-emissionheavy-dutyvehiclesinthe

tolalfleetofheavy-dutyvehiclesontheroadsandelectricityconsumptioninthesectorwill

remainlimited.Therefore,therelatedimpactontheelectricitygridwillremainlimitedas

well.

Directive2014/94/EUoftheEuropeanParliamentandoftheCouncilof22October2014on

thedeploymentofalternativefuelsinfrastructure(OJL307,28.10.2014,p.1).

(16)WhilethestrengthenedCO2emissionsreductiontargetswillacceleratetheuptakeof

zero-emissionheavy-dutyvehicles,asignificantpartofthetotalfleetofheavy-duty

vehiclesontheroadswillremaininternalcombustionenginevehicles.Forthatpartofthe

fleettocontributetotheachievementoftheUnion'sclimatetargets,furtherinnovationand

anaccelerateduptakeofsustainablerenewablefuelsisessential.ExistingUnionpolicies

andlegalinstruments,inparticularDirective(EU)2()18/20()1oftheEuropeanParliament

andoftheCouncil9andtheEUemissionstradingsystemestablishedbyDirective

2003/87/ECoftheEuropeanParliamentandoftheCouncil10,willpromotethe

decarbonisationoftransportfuels,withtheaimofphasingoutfossilfuels.The

Commissionshouldfurtherdevelopacoherentframeworkofincentivesforadvanced

biofuelsandbiogasandrenewablefuelsofnon-biologicalorigin.Thatframeworkshould

addressbannerstotheuptakeandsupplyinacomprehensiveway,takingintoaccount

demandacrosseconomicsectors,inthecontextoftheoveralleffortstoreachtheUnion's

climatetargets.BuildingontheobjectivesforbiomethaneintheRePowerEUplan,the

Commissionshouldalsoaddresshowthescale-upoftheproductionofbiomethaneinthe

Unioncancontributetothedecarbonisationoftheeconomy,includingthetransportsector.

(17)Followingconsultationwithstakeholders,theCommissionwill,withinoneyearofthedate

ofentryintoforceofthisRegulation,assesstheroleofamethodologyforregistering

heavy-dutyvehiclesrunningexclusivelyonCO2neutralfuels,inconformitywithUnion

lawandwiththeUnion'sclimate-neutralityobjective.

2018onthepromotionoftheuseofenergyfromrenewablesources

(18)Manufacturersshouldcontinuetobeprovidedwithsufficientflexibilitywhenadapting

theirheavy-dutyvehiclefleetsovertimeinordertomanagethetransitiontowards

zero-emissionheavy-dutyvehiclesinacost-efficientmanner.Itisthereforeappropriateto

maintaintheapproachofstrengtheningtargetlevelsinfive-yearsteps.

(19)Duetotheheterogeneousstructureofthetotalfleetofheavy-dutyvehicles,itisnot

possibletofullypredictwhethertechnologicaldevelopmentswillbequickenoughto

ensurethatzero-emissiontailpipetechnologyisaviablechoiceforallnicheuses.1his

couldincludeheavy-dutyvehiclesforcriticalsecurityandsafetyapplicationsthatcannot

befulfilledbyzero-emissiontailpipetechnologies.Suchvehiclesshouldconstitutea

limitedshareofthetotalfleetofheavy-dutyvehicles.InitsreviewofRegulation

(EU)2019/1242,theCommissionshouldassessthepossibilityofapplyingmeasuresto

reduceCO?emissionsfromsuchvehicles.

(20)FortheirpublicprocurementprocedurescoveredbythisRegulation,contracting

authoritiesandcontractingentitiesarestronglyencouragedtouseanawardcriterionora

technicalspecificationthatrelatestotheproportionoftheproductsoftendersoriginating

fromcountriesthatarenotpartiestotheWorldTradeOrganizationAgreementon

GovernmentProcurement(the'GPA')andthathavenotconcludedafreetradeagreement

containingrulesonpublicprocurementwiththeUnion.Suchcriteriawillplayan

importantroleinfosteringthesupplyofzero-emissionurbanbusesbytheEuropean

industry,ensuresustainableandresilientsupplychainsforurbanbusesandreinforce

securityofsupplywithintheUnion.

(21)Contractingauthoritiesandcontractingentitiesarcencouragedtouseanenvironmental

sustainabilitycriterionasanawardcriterionorasatechnicalspecificationfortheirpublic

procurementprocedurescoveredbythisRegulation.WithoutprejudicetoUnionlegislative

actsapplicabletoaspecifictechnology,includingRegulation(EU)2023/1542ofthe

EuropeanParliamentandoftheCouncil11andRegulation(EU)2024/...oftheEuropean

ParliamentandoftheCouncil12*,whenevaluatingtheenvironmentalsustainabilityof

urbanbusesprocuredonthebasisofthisRegulation,itshouldbepossibleforcontracting

authoritiesandcontractingentitiestotakeintoaccountvariouselementswithanimpacton

theclimateandtheenvironment.Thoseelementscaninclude,forinstance:thedurability

andreliabilityofthesolution,theeaseofrepairandmaintenance,theeaseandqualityof

recycling,theuseofsubstances,theconsumptionofenergy,waterandotherresourcesin

oneormorelifecyclestagesoftheproduct,theincorporationofusedcomponents,the

environmentalfootprintoftheproductanditslifecycleenvironmentalimpact,andthe

amountofwastegenerated.

(22)WiththestricterUnionfleet-wideCO2emissionsreductiontargetsfrom2030onwards,

manufacturersaretodeploysignificantlymorezero-emissionheavy-dutyvehiclesonthe

Unionmarket.Inthatcontext,theincentivemechanismforzero-andlow-emission

heavy-dutyvehicleswouldnolongerserveitsoriginalpurposeandwouldrisk

underminingtheeffectivenessofRegulation(EU)2019/1242.Thatincentivemechanism

shouldthereforeberemovedfrom2030.

concerningbatteriesandwastebatteries,amendingDirective2008/98/ECandRegulation

(23)ThepossibilitytoassigntherevenuesfromtheexcessCO2emissionspremiumstoa

specificfundorarelevantprogrammehasbeenevaluatedasrequiredpursuantto

Article15(4)ofRegulation(EU)2019/1242,withtheconclusionthatdoingsowould

significantlyincreasetheadministrativeburden,withoutresultinginanydirectbenefitto

theautomotivesectorinitstransition.RevenuesfromtheexcessCO2emissionspremiums
