駕校教練掛靠收費標(biāo)準(zhǔn)合同甲方（教練員）：_________，身份證號：________________________，聯(lián)系電話：____________________，地址：__________________________________________________。乙方（駕校）：__________________，統(tǒng)一社會信用代碼：____________________，聯(lián)系電話：____________________，地址：__________________________________________________。鑒于甲方具備合法教練資格，wishtoutilizetheteachingresourcesandbrandof乙方forconductingdrivertrainingactivities;and乙方wishestoprovidethenecessaryresourcesandauthorizationfor甲方toteachunderthenameandwithintheframeworkof乙方.Basedonthemutualagreementandunderstanding,bothpartiesherebyenterintothefollowingcontract:1.ContractPurposeandRelationship:ThisContract(hereinafterreferredtoasthe"Contract")isenteredintobetweenPartyA(Coach)andPartyB(DrivingSchool).PartyAagreestoconductdrivertrainingteachingactivitiesusingtheresourcesandbrandofPartyB.PartyBagreestoauthorizePartyAtouseitsdesignatedorprovidedvehicles,venues,teachingfacilities,etc.forteachingactivities,andtoprovidethenecessarysupport.Therelationshipbetweenthetwopartiesisacooperationrelationship,notanemploymentrelationship.2.AuthorizationScope:PartyBauthorizesPartyAtoconductdrivertrainingteachingactivitieswithinthedesignatedarea(ifanyspecified)forcertaintypesofvehicles(ifanyspecified)usingtheresourcesprovidedbyPartyB.PartyAshallusePartyB'steachingresourcesandfacilitiesinaccordancewiththeprovisionsofthisContractandrelevantnationalandlocalregulations.3.PartyA'sIdentityandResponsibilities:PartyAshallusethecoachidentityidentificationprovidedbyPartyB(suchasnametags,workbadges)duringteachingandmaintaintheimageofPartyB.PartyAshallberesponsibleforteachingaccordingtothenationalandlocaldrivertrainingsyllabus,teachingspecifications,andshallensureteachingqualityandsafety.PartyAshallbesolelyresponsibleforthesafetyofitselfanditstraineesduringthetrainingprocess,complywithtrafficregulationsandPartyB'ssafetymanagementsystem.4.TeachingManagementRequirements:TheteachingofPartyAshallusetheteachingmaterialsandmethodsprovidedorapprovedbyPartyB.Theprocessofstudentreservation,trainingrecordkeeping,examinationapplication,etc.shallbehandledinaccordancewiththeproceduresagreedbybothpartiesortheproceduresprovidedbyPartyB.Therequirementfortheprovisionofsafetyinspectors(whetherprovidedbyPartyAorPartyBshallbespecified).5.FeesandCharges(CoreClause):PartyAagreestopayPartyBfeesforthe掛靠serviceandteachingactivitiesconductedunderPartyB'sauthorization.Thefeestructureisasfollows:(1)BasicFee/ManagementFee:PartyAshallpayabasicfee/managementfeetoPartyBona_______(monthly/quarterly/annual/perinstructorbasis)basis.Thefeerateis_______(e.g.,XXRMBperteachinghour,XXRMBperinstructorpermonth,orafixedamount).Thecalculationmethodforteachinghoursshallbe_______(e.g.,basedonthenumberofsessions,basedontheactualtrainingtimeofthetrainee).Paymentshallbemadeonorbeforethe_______dayofeach_______(month/quarter/year).Paymentshallbemadeby_______(cash/banktransfer)totheaccountnumber_______.(2)HourlyFeeSplit/Commission:IfPartyAindependentlyenrollstrainees,PartyAshallagreetopayPartyBacertainpercentageofthetrainingfeespaidbythetraineesasasplit/commission.Thesplitratiois_______(e.g.,XX%).Thesettlementcycleis_______(e.g.,monthly/quarterly).ThesettlementmethodinvolvesPartyBverifyingthepaymentinformationofthetraineesandcalculatingandpayingthesplitamounttoPartyAaccordingtotheagreedratio.(3)OtherFees:Additionalfees,suchasvenueusagefees(ifusingvenuesotherthanPartyB'smainvenues),vehicleusagefees/depreciationfees(ifPartyAborrowsvehiclesfromPartyBforteaching),textbookfees/consumablefees,andtaxes(specifyingwhobearsthetaxburden)shallbe_______(e.g.,bornebyPartyA,bornebyPartyB,orincludedintheabovefees).6.RightsandObligationsofPartyA:Rights:PartyAhastherighttousePartyB'sresourcesforteaching;receiveremunerationinaccordancewiththeagreement;haveacertaindegreeofautonomyintheteachingprocess(withinregulations).Obligations:Complywithnationallaws,regulations,trafficregulations,andallrelevantrulesandregulationsofPartyB;ensureteachingqualityandsafety;payallfeesstipulatedinthisContractontimeandinfull;takegoodcareofPartyB'svehiclesandfacilities;maintainthereputationofPartyB;cooperatewithPartyBinteachinginspectionsandmanagement.7.RightsandObligationsofPartyB:Rights:PartyBhastherighttocollectfeesasagreed;supervisePartyA'steachingactivities,correctorhandlenon-compliantbehavior;managetheuseofPartyB'sresourcesbyPartyA.Obligations:ProvidePartyAwithnecessaryteachingresourcesandsupport;provideteachingspecificationsandstandards;conductbasicverificationofPartyA'scoachingqualification;assistinhandlingemergenciesduringtheteachingprocess;settleandpayPartyA'sdueremunerationontime.PartyBshallensurethatPartyAcanconductteachingactivitiesnormallyandprovidethenecessarysupportaccordingtotheprovisionsofthisContract.8.ResponsibilitiesandDisclaimer:PartyAshallbearprimaryresponsibilityforteachingaccidents,studentcomplaints,andsafetyincidentsthatoccurduringtheteachingprocess,andmaybearcompensationordisciplinarymeasuresfromPartyBaccordingtothecircumstances.PartyBshallbearcorrespondingresponsibilityforteachingissuesorsafetyincidentscausedbyitsownmanagementneglect;ensurethenormalconductofPartyA'steachingactivities.9.ContractTermandTermination:ContractTerm:ThevalidityperiodofthisContractshallbe_______(e.g.,oneyear,twoyears,orlong-term).TerminationConditions:TheContractshallbeterminatednaturallyuponexpiration;ifonepartyseverelybreachestheContractresultingintheinabilitytocontinuethecontract;ifPartyA'scoachingqualificationisrevoked;ifamajorsafetyaccidentoccurs.TerminationProcedures:Noticeperiod(ifanyspecified);settlementoffees;returnofresources;handlingoffiles.10.LiabilityforBreachofContract:PartyAshallbeliableforanybreachofthisContract(e.g.,failingtopayfeesontime,violatingteachingspecifications)andPartyBshallbeliableforanybreach(e.g.,failingtopayremunerationorwithholdingthesplitontime,etc.).Thespecificliabilitymayincludepayingliquidateddamages,compensatingforlosses,orhavingtherighttoterminatethecontract.11.DisputeResolution:Themethodforresolvingdisputesshallbe_______(e.g.,negotiation,mediation,arbitration
