2025年酒店住宿銷(xiāo)售合同模板，中英文版合同協(xié)議ThisContractismadeandenteredintoon[InsertDate],byandbetween:PartyA(TheHotel):[InsertHotelFullLegalName],havingitsprincipalplaceofbusinessat[InsertHotelAddress],andregisteredwith[InsertBusinessRegistrationNumber](hereinafterreferredtoas"PartyA").PartyB(TheGuest):[InsertGuestFullNameifIndividual/LegalNameifCompany],residingat[InsertGuestAddress],andcontactableat[InsertGuestPhoneNumber]and[InsertGuestEmailAddress](hereinafterreferredtoas"PartyB").RECITALSWHEREAS,PartyAoperatesahotelfacilityandoffersaccommodationservicestoguests;andWHEREAS,PartyBdesirestobookandreceiveaccommodationservicesfromPartyA;NOW,THEREFORE,inconsiderationofthemutualcovenantsandagreementssetforthherein,thepartiesagreeasfollows:1.BookingandConfirmationPartyBherebymakesabookingforaccommodationservicesatPartyA'shotel,specifyingtheroomtype(s)of[InsertRoomType(s)],fortheperiodfrom[InsertCheck-inDate]to[InsertCheck-outDate],foratotalof[InsertNumberof]nights.Thebookingwasmadevia[InsertBookingMethod,e.g.,telephone,email,onlineplatform]on[InsertBookingDate].PartyAconfirmsthisbookingbyissuingaconfirmationdocumenttoPartyBon[InsertConfirmationDate].ThisconfirmationconstitutesanagreementbetweenthepartiessubjecttothetermsandconditionssetforthinthisContract.2.PriceandPaymentThetotalpricefortheaccommodationservicesbookedis[InsertTotalPrice],whichincludes[orexcludes,specify]applicabletaxesandservicefees,expressedin[InsertCurrency,e.g.,ChineseYuan(RMB)]andcalculatedbasedon[InsertRateBasis,e.g.,theroomratespecifiedintheconfirmationtimesthenumberofnights].PartyBagreestopaythetotalpriceinaccordancewiththepaymenttermssetforthinSection3below.3.PaymentTermsPartyBshallpaythefollowingamountstoPartyA:(a)Anon-refundabledepositof[InsertDepositAmountorPercentage]ofthetotalprice,amountingto[InsertDepositTotal],shallbepaidwithin[InsertDepositPaymentDeadline,e.g.,7days]followingthedateofthebookingconfirmation,via[InsertPaymentMethod,e.g.,banktransfertotheaccountdetailsspecifiedinSection9].(b)Theremainingbalance,totaling[InsertBalanceAmount],shallbepaidbeforecheck-inoruponcheck-in,asperPartyA'scheck-inrequirements,via[InsertPaymentMethodsacceptedatcheck-in,e.g.,cash,creditcard,banktransfer].Allpaymentsshallbemadetothefollowingaccount:BankName:[InsertBankName]AccountName:[InsertAccountName]AccountNumber:[InsertBankAccountNumber]BankCode:[InsertBankCode]PartyAshallissueaninvoicetoPartyBforthetotalprice[ortheremainingbalance,asapplicable]uponreceiptoffullpaymentorasrequiredbyPartyB.Thetypeofinvoiceshallbe[InsertInvoiceType,e.g.,Value-AddedTaxInvoice/OrdinaryInvoice].4.Check-inandCheck-outPartyBisauthorizedtocheckinbetweenthehoursof[InsertCheck-inHours,e.g.,3:00PM]and[InsertCheck-outHours,e.g.,11:00AM]on[InsertCheck-inDate].Uponcheck-in,PartyBshallpresenttheconfirmationdocument[andanyotherrequiredidentificationdocuments,e.g.,government-issuedphotoID]toPartyA'sfrontdeskstaff.PartyAmayrequireavalidcreditcardorcashdepositof[InsertDepositAmount]uponcheck-in,whichshallbeheldbyPartyAassecurityforanypotentialadditionalchargesorlossofhotelpropertyduringthestay.ThedepositshallberefundedtoPartyBwithin[InsertRefundTimeline,e.g.,14days]aftercheck-out,providednodamagesoroutstandingchargesexist.PartyBshallcheckoutandsettleallaccounts,includinganyadditionalchargesincurredduringthestay(suchasbutnotlimitedtotelephonecalls,internetusage,mini-barconsumption,laundryservices,etc.,asdetailedinPartyA'spublishedpricelist),betweenthehoursof[InsertCheck-outHours,e.g.,11:00AM]on[InsertCheck-outDate].PartyBshallreturnallkeys,roomcards,andhotelpropertyprovidedduringthestayuponcheck-out.5.RoomandServicesPartyAshallprovidePartyBwiththebookedroom(s)ofthespecifiedtype,whicharesuitableforthepurposeofaccommodation.TheroomshallbecleanedandmadereadyforoccupancypriortoPartyB'sscheduledcheck-intime.Theaccommodationincludesaccesstostandardhotelfacilitiessuchas[ListKeyPublicFacilities,e.g.,elevators,lobbies,restrooms,Wi-Fiaccessincommonareas,ifapplicable].Specificroomamenities(e.g.,typeofbed,TV,airconditioning,bathroomfacilities)aredetailedinPartyA'sroomdescriptionsandaredeemedacceptabletoPartyBuponbooking.PartyBacknowledgesthatthedescriptionoftheroomandthelistofprovidedservicesareforgeneralreferenceandthatminorvariationsmayoccurwithoutliabilitytoPartyA,providedthestandardofaccommodationisnotsubstantiallycompromised.6.PartyB'sObligationsandRulesPartyBagreesto:(a)Complywithallapplicablelawsandregulations.(b)AbidebyPartyA'shouserules,whichareavailableuponrequestor[InsertWhereHouseRulesCanBeFound,e.g.,onPartyA'swebsite]andinclude,butarenotlimitedto,rulesregardingnoisecontrol,smoking(e.g.,onlyindesignatedareasornotatall),pets,guestcapacity,andprotectionofhotelproperty.(c)Usethehotelfacilitiesandservicesresponsiblyandfortheirintendedpurpose.(d)NotifyPartyApromptlyofanychangestocontactinformationoranyspecialrequirementsduringthestay(e.g.,dietaryrestrictions,medicalconditions).(e)Payallchargesincurredduringthestay,ifapplicable.(f)Exitthehotelpremisesthroughdesignatedexitsuponcheck-out.7.CancellationandModification(a)EarlyCancellation:IfPartyBcancelsthisbookingormodifiesthecheck-inorcheck-outdatesbefore[InsertCut-offDateforFreeCancellation],nocancellationfeeshallbeimposed.IfPartyBcancelsafterthecut-offdatebutpriortocheck-in,PartyBshallbeliableforacancellationfeeequalto[InsertPercentage,e.g.,50%]ofthetotalprice.IfPartyBcancelsonorafterthecheck-indate,orfailstocheckinwithoutpriorwrittenconsentfromPartyA,PartyBshallbeliableforthefulltotalpriceofthebooking,ortheactuallossesincurredbyPartyA,whicheverisgreater.(b)LateCancellation/NoShow:IfPartyBfailstocheckinonthescheduledcheck-indatewithoutpriorwrittenconsentfromPartyA,thebookingshallbeconsideredcancelled,andthepenaltiesoutlinedinSection7(a)shallapply.8.LiabilityandDamage(a)PartyAshallnotbeliableforanyloss,damage,ordelaysufferedbyPartyBduringthestayunlesssuchloss,damage,ordelayresultsdirectlyfromPartyA'snegligenceorwillfulmisconduct.(b)PartyBshallbefullyliableforanydamagetothehotelroomorpropertycausedduringthestay.PartyAreservestherighttochargePartyBthecostofrepairorreplacementforanysuchdamage.(c)PartyAshallnotbeliableforanylossofordamagetoPartyB'spersonalbelongingswhilewithinthehotelpremises,exceptforlossesresultingfromPartyA'sgrossnegligenceorwillfulact.9.ConfidentialityBothpartiesagreetokeepconfidentialallnon-publicinformationdisclosedbytheotherpartyduringthetermofthisContractandforaperiodof[InsertDuration,e.g.,twoyears]thereafter,exceptasrequiredbylaworasnecessaryfortheperformanceofthisContract.10.GoverningLawandDisputeResolutionThisContractandanydisputesarisingoutoforinconnectionwithitshallbegovernedbyandconstruedinaccordancewiththelawsofthePeople'sRepublicofChina.AnydisputebetweenthepartiesarisingfromorrelatedtothisContractshallfirstbeattemptedtoberesolvedthroughamicablenegotiationormediation.Ifthedisputecannotberesolvedthroughnegotiationormediationwithin[InsertTimeLimit,e.g.,30days]aftertheoccurrenceofthedispute,itshallbesubmittedto[InsertArbitrationInstitution,e.g.,theXi'anArbitrationCommission]forarbitrationinaccordancewithitsrelevantrules.Alternatively,thedisputemaybesubmittedtothepeople'scourthavingjurisdictioninaccordancewiththelawsofthePeople'sRepublicofChina.11.EntireAgreementThisContract,includinganyreferencedhouserulesorpricelists,constitutestheentireagreementbetweenthepartiesconcerningthesubjectmatterhereofandsupersedesallprioragreements,representations,andunderstandings,whetherwrittenororal,betweentheparties.12.AmendmentsNoamendmentormodificationofthisContractshallbevalidunlessmadeinwritingandsignedbyauthorizedrepresentativesofbothparties.13.SeverabilityIfanyprovisionofthisContractisfoundtobeinvalidorunenforceablebyacourtofcompetentjurisdiction,thevalidityandenforceabilityoftheremainingprovisionsshallnotbeaffectedthereby.14.NoticesAllnotices,requests,demands,andothercommunicationsrequiredorpermittedunderthisContractshallbeinwritingandshallbedeemedgiven:(a)Whendeliveredpersonally;(b)Uponconfirmationofreceiptwhensentbyemail;(c)Onebusinessdayafterdepositingwithareputableovernightcourierservice;(d)ThreebusinessdaysafterdepositingwiththeU.S.PostalServiceoritsequivalent
