6、should finish working task with quality and quantity guaranteed.3、甲方本著“一專多能、一職多崗”的用人原則,可以根據(jù)經(jīng)營需要及乙方的工作能力調(diào)整乙方的工作職務(wù)和崗位,乙方應(yīng)服從安排。Based on the principle of “one skill with multiple ability, one post with multiple work”, and according to the business demand and Party Bs competence, Party A may adjust Party
7、 Bs duty and post, while Party B should obey the adjustment. 三、勞動保護和勞動條件Labor Protection & Labor Condition1、甲方根據(jù)國家有關(guān)安全生產(chǎn)、勞動保護、職業(yè)衛(wèi)生的規(guī)定,為乙方提供必要的工作條件和勞動保護設(shè)施,保障乙方的安全與健康;According to the related stipulation of safety manufacture/labor protection/occupational health from the state, Party A provides necess
8、ary working condition and labor protection facilities, insuring Party Bs safety and health.2、甲方根據(jù)國家有關(guān)規(guī)定制定工時制度,乙方確因生產(chǎn)經(jīng)營需要延時的,甲方應(yīng)當(dāng)依法安排乙方補休或支付相應(yīng)的加班費;若乙方實行的是級別工資,則在當(dāng)月的績效考核中體現(xiàn);According to the relevant regulations of working hour system,if Party B needs to extend the working hours due to the need of prod
9、uction and operation, party A shall arrange party B compensatory time off or pay overtime salary in accordance with the law; If party B is implemented wage levels, the compensation should be reflected in the performance appraisal for the month.3、甲方根據(jù)國家有關(guān)規(guī)定為孕期、產(chǎn)期、哺乳期的女職工提供勞動保護;Party A should provide
10、protection for women workers in pregnancy, childbirth, breastfeeding, in accordance with the relevant provisions of the State.4、甲方負責(zé)對乙方進行政治思想、職業(yè)道德、業(yè)務(wù)技術(shù)、勞動安全衛(wèi)生及有關(guān)規(guī)章制度的告知、教育和培訓(xùn)。Party A is responsible to provide political ideology, professional ethics, business technology, labor safety and hygiene, and
11、 related rules, education and training for Party B.四、勞動報酬 Labor remuneration根據(jù)“按勞分配”原則,實行同工同酬,乙方的報酬不得低于當(dāng)?shù)刈畹凸べY標準。具體薪酬標準、支付方式以及支付時間按公司制定的薪酬管理制度執(zhí)行。According to the principle of distribution, and equal pay for equal work, remuneration of Party B shall not be lower than the local minimum wage standard. 12、pecific compensation standards, payment, and time is set by the “the system of compensation management” by the company 五、社會保險 Social Insurance甲方應(yīng)按照國家有關(guān)社會保險的法律、法規(guī)和政策為乙方繳納基本養(yǎng)老、基本醫(yī)療、失業(yè)、工傷、生育保險費用;社會保險費個人繳納部分,甲方從乙方工資中代扣代繳。In accordance with national laws, regulations and policies relating to social insur
13、ance, Party A shall pay the basic pension, basic medical, unemployment, work injury and maternity insurance costs, for the Party B; social insurance premiums paid by individuals part is withhold wages from Party B.六、勞動紀律和規(guī)章制度 Labor discipline and regulations1、甲方依法制定的勞動紀律和規(guī)章制度,乙方有義務(wù)遵守;Labor disciplin
14、e and regulations legally stipulated by party A, party B shall have the duty to abide by it.2、簽訂本合同前,甲方已對乙方進行了勞動紀律、操作規(guī)程、管理制度等相應(yīng)的培訓(xùn);Before signing this contract, Party A has to provide party B the labor discipline, operating procedures, management system and the corresponding training3、乙方應(yīng)當(dāng)遵守甲方的工作操作規(guī)
15、程,服從工作安排;Party B shall abide by the working procedures, obey the work arrangement of party A.4、乙方違反勞動紀律或規(guī)章制度,甲方有權(quán)按本單位的規(guī)章制度,給予紀律處分,直至解除本合同。If Party B violates labor discipline or regulations, Party A is entitled by the rules of the unit to give Party A disciplinary action, up to terminate this contra
16、ct.七、勞動合同的變更 The change of labor contract訂立本合同所依據(jù)的客觀情況發(fā)生重大變化,致使本合同無法繼續(xù)履行的,經(jīng)雙方協(xié)商同意,予以變更勞動合同相關(guān)內(nèi)容。If the objective situation this contract based on, changes significantly, to result the contract unable to perform, by mutual consent, related content in labor contracts shall be changed.八、勞動合同的解除The remov
17、e of labor contract(一)雙方協(xié)商一致,勞動合同可以解除。The two party may terminate the labor contract with mutual agreement.(二)乙方有下列情形之一的,甲方可以即行解除勞動合同:Of any of the following circumstances, party A may immediately terminate the labor contract.1、在試用期內(nèi)被證明不符合錄用條件的;Been proven not to meet the conditions of employment du
18、ring the trial period.2、采取欺詐手段訂立本合同的;Adopted fraudulent means to enter into this contract.3、嚴重違反勞動紀律或規(guī)章制度給甲方造成重大損害的;Seriously violated labor discipline or regulations to cause significant harm to the Party A.4、嚴重失職、營私舞弊,或泄露甲方商業(yè)秘密,給甲方利益造成重大損失的;Gross negligence, malpractice, or disclosure of trade sec
19、rets Party A, to cause heavy losses to the interests of the Party A.5、乙方同時與其他用人單位建立勞動關(guān)系,對完成本單位的工作任務(wù)造成嚴重影響,或者經(jīng)用人單位提出,拒不改正的;Party A built labor relationships with other unit, to cause a serious impact on the completion of the tasks of the unit, or refused to correct the rules made by the employer 6、被依
20、法追究刑事責(zé)任的。Be investigated for criminal responsibility according to law(三)有下列情形之一的,甲方可以提前30日以書面形式通知乙方解除勞動合同:Of the following circumstances, Party A can give notice to inform Party B to terminate the labor contract ahead of 30 days.1、乙方不能勝任工作,經(jīng)培訓(xùn)或調(diào)整工作崗位仍不能勝任工作的;Party B is not competent for work, after
21、training or adjustment of jobs.2、乙方患病或者非因工負傷,醫(yī)療期滿后,不能從事原工作,也不能從事甲方另行安排工作的;Party B was ill or injured due to non-work relation, after completion of medical, Part A is not competent for his original work, or alternative arranged jobs.3、勞動合同訂立時所依據(jù)的客觀情況發(fā)生重大變化,致使勞動合同無法履行,雙方協(xié)商不能就變更勞動合同達成協(xié)議的。If the objecti
22、ve situation this contract based on, changes significantly, to result the contract unable to perform, mutual consent can not be reached, in change of this labor contracts.(四)有下列情形之一的,甲方可以提前30日通知工會,經(jīng)工會同意后,與乙方解除勞動合同:Of the following circumstances, Party A can give notice ahead of 30 days, to inform th
23、e Labor Union, after agreement, Party A may terminate the labor contract.1、甲方依照企業(yè)破產(chǎn)法規(guī)定進行重整的;Party A restructured pursuant to the Enterprise Bankruptcy Law2、甲方生產(chǎn)經(jīng)營發(fā)生嚴重困難的;Production and business operation of Party A met serious difficulties.3、甲方轉(zhuǎn)產(chǎn)、重大技術(shù)革新或者經(jīng)營方式調(diào)整,經(jīng)變更勞動合同后,仍需裁減人員的;production, technolog
24、ical innovation or business method of Party A adjusted, after the change of labor contracts, still needed to reduce staff.4、其他因勞動合同訂立時依據(jù)的客觀經(jīng)濟情況發(fā)生重大變化,致使勞動合同無法履行的。If other objective situation this contract based on, changes significantly, to result the contract unable to perform.(五)乙方有下列情形之一的,甲方不得解除勞
25、動合同:Of any of the following circumstances, party A can not terminate the labor contract.1、在本單位患職業(yè)病或者因工負傷并被確認喪失或者部分喪失勞動能力的;Injured due to occupational disease or work-related reasons, and was confirmed as having lost or partially lost the ability to work.2、患病或者非因工負傷,在規(guī)定的醫(yī)療期內(nèi)的;Illness or non-work rela
26、ted injury within the prescribed period of medical treatment.3、女職工在孕期、產(chǎn)期、哺乳期的;women workers in pregnancy, childbirth, breastfeeding.4、在本單位連續(xù)工作滿十五年,且距法定退休年齡不足五年的;Worked continuously for 15 years and less than five years away from his legal retirement age In this unit.5、法律、行政法規(guī)規(guī)定的其他情形。Other circumstan
27、ces stipulated by laws and administrative regulations.(六)乙方解除勞動合同,應(yīng)當(dāng)提前三十日(試用期內(nèi)提前三日)以書面形式通知甲方,甲方在乙方完成業(yè)務(wù)以及清理完債權(quán)債務(wù)的情況下,可以解除勞動合同。Of the following circumstances, Party B shall give notice to inform Party A to terminate the labor contract ahead of 30 days after cleaning up the credits and debts.(七)有下列情形之一
28、的,乙方可以通知甲方解除勞動合同: Of the following circumstances, Party B may give notice to inform Party A to terminate the labor contract.1、在試用期內(nèi)的;During the trial period.2、甲方以暴力、威脅或者非法限制人身自由的手段強迫勞動的;Party A forced Party A to labor by violence, threat or illegal restriction of personal freedom. 3、甲方未按勞動合同約定提供勞動保護
29、和勞動條件的;Party A failed to provide the labor protection and labor conditions.4、甲方未按照勞動合同的約定支付工資報酬的;Party A failed to pay wages in accordance with the labor contract.5、法律、行政法規(guī)規(guī)定勞動者可以解除勞動合同的其他情形。Other circumstances stipulated by laws, administrative regulations by which employee may terminate the labor
30、contract.九、勞動合同的終止Termination of labor contracts(一)有下列情形之一的,勞動合同即行終止:Of any of the following circumstances, the labor contract may be immediately terminate1、勞動合同期滿的;The labor contract expired.2、勞動者開始依法享受養(yǎng)老保險待遇的;Workers began to enjoy endowment insurance treatment lawfully.3、勞動者死亡,或者被人民法院宣告死亡或者宣告失蹤的;
31、Laborer died, or was declared dead or missing by the peoples court.4、甲方被依法宣告破產(chǎn)的;Party A was declared bankrupt by the peoples court5、甲方被吊銷營業(yè)執(zhí)照、責(zé)令關(guān)閉、撤銷或者提前解散的;Business license of Party B was revoked, ordered to close, cancellation or early dissolution of.6、法律、行政法規(guī)規(guī)定的其他情形。Other circumstances stipulated
32、 by laws, administrative regulations.(二)乙方應(yīng)在勞動合同期滿前30天通知甲方,甲方同意續(xù)訂,乙方應(yīng)及時申請辦理續(xù)訂手續(xù);若甲方不同意續(xù)訂,到期即辦理終止合同手續(xù)。乙方未辦理終止合同手續(xù)而離職的,甲方保留追究其法律責(zé)任的權(quán)利。Party B shall give notice to inform Party A to renew the labor contract ahead of 30 days. If Party A disagreed to new a lease, the labor contract would go expire. If Pa
33、rty B left without the termination procedures, Party A would retain right to pursue its legal responsibility.十、違反勞動合同的責(zé)任Breach of duty of the labor contract(一)賠償經(jīng)濟損失Compensation for economic losses甲方有下列情形之一,給乙方造成經(jīng)濟損失的,應(yīng)當(dāng)承擔(dān)賠償責(zé)任:Of any the following circumstances, party A shall be liable for compensat
34、ion of the economic losses of party B.1、由于甲方制定的勞動合同條款無效的;Since Labor Party established the terms of the invalid contract;2、違反勞動合同法規(guī)定的條件解除勞動合同的。Conditions in violation of the provisions of the “Labor Contract Law “to terminate the labor contract.乙方有下列情形之一,給甲方造成經(jīng)濟損失的,還應(yīng)當(dāng)承擔(dān)賠償責(zé)任:Of any the following cir
35、cumstances, party B shall be liable for compensation of the economic losses of party A.1、乙方違反勞動合同法規(guī)定的條件或者勞動合同的約定解除勞動合同,給甲方造成經(jīng)濟損失的,應(yīng)當(dāng)按照損失的程度,承擔(dān)賠償責(zé)任;Party B violated the conditions in the Labor Contract Law or terminated the labor contract to cause the economic losses of party A, Party B shall be liab
36、le for compensation of the economic losses of party A.2、乙方違反勞動合同約定的保密事項,給甲方造成經(jīng)濟損失的,應(yīng)當(dāng)依法承擔(dān)賠償責(zé)任;Confidential matters Party violations of labor contract, causing economic losses to the Party shall be liable for compensation according to law.3、乙方在合同期內(nèi)嚴重違反甲方的有關(guān)規(guī)章制度、操作規(guī)程給甲方造成損失或致甲方聘用的其他勞動者人身損害的,由乙方根據(jù)責(zé)任的大小
37、負責(zé)賠償。In the contract period, if Party B caused serious violations of relevant rules and regulations of the Party, procedures, or caused losses, or causes personal injury of other workers employed by the Party A. Party B shall pay compensation in accordance with the size of the responsibility.(二)違約金
38、Penalty1、甲方為乙方提供專項技能培訓(xùn),乙方違反培訓(xùn)協(xié)議,須向甲方支付違約金;Party A shall provide special skills training for Party B. If Party B violated training protocol, Party B shall pay liquidated damages to Party A.2、甲方對乙方實施了競業(yè)限制,乙方違反競業(yè)限制條款,須向甲方支付違約金。Party A implemented the non-competition for the Party B. If it is violated,
39、Party B shall pay liquidated damages十一、雙方約定條款 Agreed Terms by two Parties(一)甲方采取了保密措施保護的商業(yè)秘密,乙方負有保密義務(wù);Party A has taken measures to protect the confidentiality of trade secrets, Party B has the confidentiality obligations.(二)甲方可以就保密的內(nèi)容、范圍和地點,雙方的權(quán)利義務(wù),保密期限,違約責(zé)任以及競業(yè)限制條款等與乙方簽訂協(xié)議;Party A can sign with Pa
40、rty on confidentiality in content, scope and location of the rights and obligations of both parties, the confidentiality period, and breach of contract and non-compete clause.(三)若乙方在甲方是從事過管理、經(jīng)營、技術(shù)工作的,在離開甲方兩年以內(nèi),不得在本行業(yè)內(nèi)其它企業(yè)工作,不得泄露甲方的生產(chǎn)、經(jīng)營秘密;If Party B is engaged in the management, operation, technical work. After leaving the party in less than two years, Party B can not work in other companies in this industry, and shall not divulge production, business secrets of P
