圖書館服務承諾書：數(shù)字資源普及合同編號：__________LibraryServiceCommitmentLetter:DigitalResourcePopularizationThisLibraryServiceCommitmentLetter(the“CommitmentLetter”)isenteredintoasof__________(the“EffectiveDate”)andbetween:[InsertNameofLibrary](the“Library”),alegalentityorganizedandexistingunderthelawsof[InsertJurisdiction],withaprincipaladdressat[InsertAddress].(eacha“Party”andcollectivelythe“Parties”)RECITALS:WHEREAS,theLibrarydesirestoexpanditsdigitalresourceofferingstoitspatronsandtoensurethattheseresourcesareaccessibleandusedeffectively;NOW,THEREFORE,inconsiderationofthemutualpromisescontainedhereinandforothergoodandvaluableconsideration,thereceiptandsufficiencyofwhicharehereacknowledged,thePartiesagreeasfollows:1.DigitalResourceAccessandAvailability1.1TheLibraryshallprovideitspatronswithaccesstoawiderangeofdigitalresources,includingbutnotlimitedtoebooks,onlinejournals,databases,andaudiovisualmaterials.1.2TheLibraryshallensurethatthesedigitalresourcesareaccessibletopatronsthroughtheLibrary’swebsiteandotherappropriateplatforms,andthatappropriateinstructionsandsupportareprovidedtoassistpatronsinutilizingtheseresources.1.3TheLibraryshallmakereasonableeffortstomaintainandupdatethesedigitalresources,andtoreplaceorrepairanydefectiveormalfunctioningequipmentorsoftwarenecessaryforaccessingtheresources.2.QualityandReliabilityofDigitalResources2.1TheLibraryshallusereasonableeffortstoselectandprovidedigitalresourcesthatareofhighquality,reliable,andrelevanttotheneedsofitspatrons.2.2TheLibraryshallregularlyreviewandevaluatethedigitalresourcesprovided,andshallmakeadjustmentsorchangesasnecessarytoensuretheircontinuedqualityandrelevance.3.PrivacyandConfidentiality3.1TheLibraryshallprotecttheprivacyandconfidentialityofitspatrons’personalinformationandusagedata,inaccordancewithapplicablelawsandregulations.3.2TheLibraryshallimplementandmaintainappropriatesecuritymeasurestoprotectagainstunauthorizedaccess,use,modification,ordestructionofanydigitalresourcesorpatroninformation.4.TrainingandSupport4.1TheLibraryshallprovidetrainingandsupporttoitsstaffandpatronstoensurethattheyareabletoeffectivelyutilizethedigitalresourcesprovided.4.2TheLibraryshallestablishahelpdeskorothersupportmechanismtoassistpatronswithanyquestions,problems,orissuesrelatedtotheuseofthedigitalresources.5.TermandTermination5.2eitherPartymayterminatethisCommitmentLetteruponwrittennoticetotheotherPartyiftheotherPartybreachesanymaterialtermorconditionofthisCommitmentLetterandfailstocuresuchbreachwithin[InsertCurePeriod]afterreceiptofwrittennoticethereof.6.GoverningLawandDisputeResolution6.1ThisCommitmentLettershallbegovernedandconstruedinaccordancewiththelawsof[InsertGoverningJurisdiction],withoutregardtoitsconflictoflawsprinciples.6.2AnydisputesarisingoutoforinconnectionwiththisCommitmentLettershallberesolvedarbitrationinaccordancewiththerulesofthe[InsertArbitrationInstitution],andthedecisionofthearbitrator(s)shallbefinalandbindingupontheParties.7.EntireAgreement7.1ThisCommitmentLetterconstitutestheentireagreementbetweenthePartieswithrespecttothesubjectmatterhereof,andsupersedesallprioragreements,understandings,negotiations,anddiscussions,whetheroralorwritten,oftheParties.INWITNESSWHEREOF,thePartieshaveexecutedthisCommitmentLetterasoftheEffectiveDatefirstabovewritten.Library:By:___________________________Name:Title:Date:Patron:By:___________________________Name:Date:一、附件列表：1.數(shù)字資源清單2.培訓材料3.技術支持手冊4.隱私政策聲明5.安全協(xié)議6.仲裁協(xié)議二、違約行為及認定：1.未能提供或維護訪問數(shù)字資源的手段。2.數(shù)字資源的選擇和提供不符合質(zhì)量和相關性標準。3.未能保護用戶隱私和保密信息。4.未按時履行培訓和支持義務。5.未能在規(guī)定時間內(nèi)糾正違約行為。6.違反任何其他條款或條件，包括但不限于期限、終止條款、法律適用和爭端解決。三、法律名詞及解釋：1.數(shù)字資源：指圖書館通過電子手段提供的書籍、期刊、數(shù)據(jù)庫和其他信息材料。2.隱私和保密：保護用戶個人信息不被未經(jīng)授權(quán)的訪問、使用或披露。3.違約：違反合同中約定的任何條款或條件。4.爭端解決：處理合同執(zhí)行過程中出現(xiàn)的爭議的方法，本合同中通過仲裁解決。5.有效日期：合同開始執(zhí)行的日期。四、執(zhí)行中遇到的問題及解決辦法：1.技術問題：與供應商溝通，及時更新或修復軟件和硬件。2.用戶培訓：定期舉辦培訓研討會，提供操作指南和常見問題解答。3.訪問限制：確保用戶身份驗證系統(tǒng)的穩(wěn)定性和安全性，同
