2025年中國銀行個人貸款合同中英文版本合同（以下簡稱“本合同”）由以下雙方在平等、自愿的基礎(chǔ)上，依據(jù)相關(guān)法律法規(guī)及規(guī)章制度，經(jīng)友好協(xié)商后簽訂。甲方（借款人）：姓名：身份證號：聯(lián)絡(luò)方式：地址：乙方（貸款人）：中國銀行股份有限公司地址：法定代表人：聯(lián)絡(luò)方式：根據(jù)本合同約定，乙方同意向甲方提供個人貸款，甲方同意按本合同條款按時償還貸款本金及利息。雙方茲此立約如下：第一條貸款金額乙方同意向甲方提供人民幣元整（￥）的貸款（以下簡稱“貸款”）。第二條貸款用途甲方承諾將貸款用于。未經(jīng)乙方書面同意，甲方不得改變貸款用途。第三條貸款期限本合同項下貸款期限為年，自年月日起至年月日止。第四條貸款利率4.1貸款利率為%，按（固定/浮動）方式計息。4.2利息計算方式：按（月/季/年）計算，計息公式為：利息=本金×利率×計息時間。4.3利率調(diào)整：如遇中國人民銀行調(diào)整貸款基準利率，乙方將相應(yīng)調(diào)整本合同貸款利率，并提前通知甲方。第五條還款方式5.1甲方選擇以下第種還款方式：a)按月等額本金還款；b)按月等額利息還款；c)一次性還本付息。5.2還款日期：每月日為還款日，甲方應(yīng)按期足額償還貸款本息。5.3逾期還款：如甲方未能按期償還貸款本息，乙方將按逾期金額的%收取逾期利息。第六條擔(dān)保條款6.1為確保甲方按時履行還款義務(wù)，甲方同意以下種方式作為擔(dān)保：a)抵押：甲方以（具體抵押物名稱）提供抵押擔(dān)保；b)質(zhì)押：甲方以（具體質(zhì)押物名稱）提供質(zhì)押擔(dān)保；c)保證：由（保證人姓名）提供連帶責(zé)任保證擔(dān)保。6.2擔(dān)保范圍：擔(dān)保范圍包括但不限于主債權(quán)、利息、違約金、損害賠償金以及實現(xiàn)擔(dān)保權(quán)利的費用。第七條雙方權(quán)利與義務(wù)7.1乙方權(quán)利：a)按本合同約定向甲方提供貸款；b)監(jiān)督貸款的使用情況；c)如甲方未按合同履行義務(wù)，乙方有權(quán)提前收回貸款或采取其他法律措施。7.2乙方義務(wù)：a)按本合同約定及時發(fā)放貸款；b)保護甲方的個人信息，不得泄露或用于其他非法目的。7.3甲方權(quán)利：a)按本合同約定使用貸款；b)如甲方提前還款，可向乙方申請并支付相關(guān)手續(xù)費用。7.4甲方義務(wù)：a)按時足額償還貸款本息；b)如發(fā)生姓名、聯(lián)絡(luò)方式、地址等信息變更，應(yīng)及時通知乙方。第八條違約責(zé)任8.1甲方未按本合同約定按時償還貸款本息，乙方有權(quán)采取如下措施：a)收取逾期利息；b)加收違約金；c)提前收回貸款并要求甲方賠償損失；d)依法處分擔(dān)保物或要求保證人承擔(dān)連帶責(zé)任。8.2如因甲方違約導(dǎo)致乙方通過訴訟途徑追償，甲方需承擔(dān)產(chǎn)生的訴訟費、律師費及其他相關(guān)費用。第九條合同變更與解除9.1本合同經(jīng)雙方協(xié)商一致，可書面形式進行修改或補充。9.2如發(fā)生以下情形，乙方有權(quán)單方面解除本合同：a)甲方提供虛假信息或資料；b)甲方未按約定用途使用貸款；c)甲方未按約定履行還款義務(wù)；d)甲方或擔(dān)保人發(fā)生重大違約行為，影響甲方履行本合同能力。第十條其他條款10.1本合同未盡事宜，雙方可另行簽訂補充協(xié)議，補充協(xié)議與本合同具有同等法律效力。10.2本合同履行過程中如發(fā)生爭議，雙方應(yīng)友好協(xié)商解決；協(xié)商不成，任何一方可向乙方所在地人民法院提起訴訟。10.3本合同自雙方簽字或蓋章之日起生效。10.4本合同一式份，甲乙雙方各執(zhí)一份，具有同等法律效力。第十一條簽訂地本合同簽訂地為。甲方（簽字）：日期：乙方（蓋章）：法定代表人或授權(quán)代表（簽字）：日期：（英文版）ContractforPersonalLoanwithBankofChina,2025Thiscontract(hereinafterreferredtoas"thisContract")isenteredintobythefollowingpartiesonthebasisofequalityandmutualconsent,inaccordancewithrelevantlawsandregulations,afterfriendlynegotiation.PartyA(Borrower):Name:IDNumber:ContactInformation:Address:PartyB(Lender):BankofChinaLimitedAddress:LegalRepresentative:ContactInformation:InaccordancewiththetermsofthisContract,PartyBagreestoprovideapersonalloantoPartyA,andPartyAagreestorepaytheloanprincipalandinterestinaccordancewiththetermsofthisContract.Article1:LoanAmountPartyBagreestoprovidealoanofRMByuan(￥)toPartyA.Article2:PurposeoftheLoanPartyAundertakestousetheloanforonly.PartyAshallnotchangethepurposeoftheloanwithoutthewrittenconsentofPartyB.Article3:LoanTermThetermoftheloanunderthisContractisyears,fromontoon.Article4:LoanInterestRate4.1Theinterestratefortheloanis%,calculatedina(fixed/variable)manner.4.2InterestCalculation:Calculatedona(monthly/quarterly/annual)basis,withtheinterestformulabeing:Interest=Principal×Rate×Time.4.3InterestRateAdjustment:IfthePeople'sBankofChinaadjuststhebenchmarkloaninterestrate,PartyBwilladjusttherelevanttermsofthisContractaccordinglyandnotifyPartyAinadvance.Article5:RepaymentTerms5.1PartyAselectsthefollowingrepaymentmethod:a)Equalprincipalrepaymentmonthly;b)Equalinterestrepaymentmonthly;c)Repaymentofprincipalandinterestinfullatmaturity.5.2RepaymentDate:Thedayofeachmonthistherepaymentdate,andPartyAshallrepaytheprincipalandinterestinfullontime.5.3OverdueRepayment:IfPartyAfailstorepaytheprincipalandinterestontime,PartyBwillchargeapenaltyinterestof%oftheoverdueamount.Article6:GuaranteeTerms6.1ToensurethatPartyAperformsitsrepaymentobligationsunderthisContract,PartyAagreestousethefollowingmethodassecurity:a)Mortgage:PartyAprovidesamortgageguaranteewith(specificnameofthemortgagedproperty);b)Pledge:PartyAprovidesapledgeguaranteewith(specificnameofthepledgedproperty);c)Guarantee:Party(nameoftheguarantor)providesajointandseveralliabilityguarantee.6.2ScopeofGuarantee:Thescopeofguaranteeincludes,butisnotlimitedto,theprincipalclaim,interest,defaultinterest,damages,andothercostsincurredinrealizingthesecurityrights.Article7:RightsandObligationsofBothParties7.1PartyB'sRights:a)ToprovidetheloantoPartyAinaccordancewiththisContract;b)Tosupervisetheuseoftheloan;c)IfPartyAfailstofulfillitsobligationsunderthisContract,PartyBhastherighttorecovertheloaninadvanceortakeotherlegalmeasures.7.2PartyB'sObligations:a)ToprovidetheloantoPartyAinaccordancewiththetermsofthisContract;b)ToprotectPartyA'spersonalinformationandnotdiscloseitforotherillegalpurposes.7.3PartyA'sRights:a)TousetheloaninaccordancewiththetermsofthisContract;b)Toapplyforearlyrepaymentandpayrelevantfees.7.4PartyA'sObligations:a)Torepaytheprincipalandinterestinfullandontime;b)TopromptlynotifyPartyBofanychangesinname,contactinformation,oraddress.Article8:違約責(zé)任8.1IfPartyAfailstocomplywiththetermsofthisContractandfailstorepaytheprincipalandinterestontime,PartyBhastherighttotakethefollowingmeasures:a)Chargedefaultinterest;b)Imposesapenalty;c)RecovertheloaninadvanceandrequiresPartyAtocompensateforlosses;d)Tolawfullydisposeofthecollateralorrequiretheguarantortoassumeliability.8.2IfPartyA'sdefaultleadsPartyBtopursueremediesthroughlitigation,PartyAshallbearallrelatedcosts,includingbutnotlimitedtolitigationfees,lawyerfees,andotherrelatedexpenses.Article9:AmendmentandTerminationoftheContract9.1ThisContractmaybeamendedorsupplementedinwritinguponmutualagreement.9.2PartyBhastherighttounilaterallyterminatethisContractifanyofthefollowingoccurs:a)PartyAprovidesfalseinformationormaterials;b)PartyAdoesnotusetheloanfortheagreedpurpose;c)PartyAfailstoperformitsrepaymentobligationsundertheContract;d)PartyAortheguarantorengagesinsignificant違約behavior,impactingtheirabilitytofulfillthisContract.Article10:Miscellaneous10.1AnymattersnotcoveredbythisContractmaybeseparatelyagreeduponbybothpartiesina
