英文版勞動合同補充協(xié)議SupplementaryAgreementtotheLaborContractI.PartiestotheAgreementA.EmployerTheEmployeris[CompanyName],acompanylegallyregisteredandoperatingin[Country/Region],withitsregisteredaddressat[CompanyAddress].TheEmployerisengagedin[BusinessScopeoftheCompany],andholdsallnecessarybusinesslicensesandpermitsrequiredforitsoperations.B.EmployeeTheEmployeeis[EmployeeName],anaturalpersonwith[Nationality],andtheidentitydocumentnumberis[IDNumber].TheEmployee'scontactaddressis[EmployeeAddress].II.BackgroundThisSupplementaryAgreementismadeandenteredintoinaccordancewiththeLaborContract(hereinafterreferredtoasthe"OriginalContract")signedbetweentheEmployerandtheEmployeeon[DateofOriginalContract].ThepartiesherebysupplementandamendcertaintermsoftheOriginalContractbasedontheprincipleofequality,voluntariness,andmutualagreement,incompliancewiththerelevantprovisionsoftheCivilCodeofthePeople'sRepublicofChinaandotherapplicablelawsandregulations.III.SpecificSupplementaryProvisionsA.JobPositionandDuties1.OriginalProvision:AccordingtotheOriginalContract,theEmployee'sjobpositionwas[OriginalJobPosition].2.SupplementaryProvision:Thepartiesherebyagreethat,startingfrom[EffectiveDateofSupplementaryProvision],theEmployee'sjobpositionshallbeadjustedto[NewJobPosition].TheEmployeeshallberesponsiblefor[DetailedDutiesofNewPosition],whichincludebutarenotlimitedto[ListSpecificDuties].TheEmployeeshallperformthesedutiesinaccordancewiththeEmployer'sworkrequirements,qualitystandards,andworkprocesses.B.WorkingHoursandRest1.OriginalProvision:TheOriginalContractstipulatedthattheEmployee'sworkinghourswere[OriginalWorkingHours].2.SupplementaryProvision:Consideringthenatureofthenewjobposition,theEmployee'sworkinghoursshallbeadjustedto[NewWorkingHours].TheEmployeeshallwork[NumberofWorkingDays]daysaweek,from[StartTime]to[EndTime]eachday,witha[BreakTime]breakinbetween.Incaseofspecialcircumstances,theEmployermayarrangefortheEmployeetoworkovertimeinaccordancewiththelaw.TheEmployershallpaytheEmployeeovertimepayinaccordancewiththerelevantprovisionsofthelawandtheCompany'sregulations.C.Remuneration1.OriginalProvision:TheEmployee'smonthlysalaryundertheOriginalContractwas[OriginalSalary].2.SupplementaryProvision:Inlightoftheadjustmentofthejobpositionandtheincreaseinworkresponsibilities,theEmployee'smonthlysalaryshallbeadjustedto[NewSalary].ThesalaryshallbepaidinRMBonthe[PaymentDate]ofeachmonth.Thesalaryincludesbasicsalary,performancerelatedpay,andotherallowancesasspecifiedintheCompany'ssalarysystem.TheperformancerelatedpayshallbedeterminedbasedontheEmployee'sworkperformanceevaluationresults.D.ConfidentialityandNonCompetition1.OriginalProvision:TheOriginalContractcontainedcertainconfidentialityprovisions.2.SupplementaryProvision:Confidentiality:TheEmployeeshallkeepconfidentialalltradesecrets,businessinformation,customerinformation,technicalinformation,andotherconfidentialinformationoftheEmployer.Duringthetermofemploymentandwithin[ConfidentialityPeriod]aftertheterminationofthelaborrelationship,theEmployeeshallnotdisclose,use,orallowanythirdpartytousesuchconfidentialinformationwithoutthepriorwrittenconsentoftheEmployer.NonCompetition:Duringthetermofemploymentandwithin[NonCompetitionPeriod]aftertheterminationofthelaborrelationship,theEmployeeshallnotengageinanybusinessactivitiesthatareincompetitionwiththeEmployer'sbusinessinthesamegeographicalarea.TheEmployershallpaytheEmployeeanoncompetitioncompensationinaccordancewiththelaw.IV.RightsandObligationsofthePartiesA.RightsandObligationsoftheEmployer1.RightsTheEmployerhastherighttoarrangeworktasksfortheEmployeeinaccordancewiththeCompany'sbusinessneedsandtheEmployee'sjobposition.TheEmployerhastherighttoevaluatetheEmployee'sworkperformanceandtakecorrespondingmanagementmeasuresbasedontheevaluationresults.TheEmployerhastherighttorequiretheEmployeetocomplywiththeCompany'srulesandregulations,confidentialityprovisions,andnoncompetitionobligations.2.ObligationsTheEmployershallprovidetheEmployeewithasafeandhealthyworkingenvironmentandnecessaryworkingconditions.TheEmployershallpaytheEmployee'ssalary,overtimepay,andotherbenefitsinatimelyandfullmannerinaccordancewiththelawandtheagreement.TheEmployershallprovidetheEmployeewithnecessarytraininganddevelopmentopportunitiestoimprovetheEmployee'sworkability.B.RightsandObligationsoftheEmployee1.RightsTheEmployeehastherighttoreceivethesalary,overtimepay,andotherbenefitsinaccordancewiththelawandtheagreement.TheEmployeehastherighttorestandtakeleaveinaccordancewiththelawandtheCompany'sregulations.TheEmployeehastherighttoparticipateintheEmployer'straininganddevelopmentactivitiestoimprovepersonalskills.2.ObligationsTheEmployeeshallperformthejobdutiesinadiligentandresponsiblemanner,andcompletetheworktasksassignedbytheEmployerontimeandwithhighquality.TheEmployeeshallcomplywiththeEmployer'srulesandregulations,workdiscipline,confidentialityprovisions,andnoncompetitionobligations.TheEmployeeshallaccepttheEmployer'sworkperformanceevaluationandcooperatewiththeEmployer'smanagementmeasures.V.LiabilityforBreachofContractA.LiabilityoftheEmployer1.IftheEmployerfailstopaytheEmployee'ssalary,overtimepay,orotherbenefitsinatimelyandfullmanner,theEmployershallpaytheEmployeeanadditionalcompensationinaccordancewiththerelevantprovisionsofthelaw.2.IftheEmployerviolatestheconfidentialityornoncompetitioncompensationprovisions,theEmployeeshallhavetherighttoclaimcompensationforthelossessuffered.B.LiabilityoftheEmployee1.IftheEmployeefailstoperformthejobdutiesasagreed,orviolatestheEmployer'srulesandregulations,theEmployerhastherighttotakedisciplinaryactions,includingbutnotlimitedtowarning,fine,demotion,orterminationofthelaborcontract.2.IftheEmployeeviolatestheconfidentialityornoncompetitionobligations,theEmployeeshallcompensatetheEmployerforalllossessufferedbytheEmployer,includingbutnotlimitedtodirecteconomiclosses,lossofbusinessopportunities,andlegalexpenses.VI.DisputeResolution1.IncaseofanydisputesarisingfromtheperformanceofthisSupplementaryAgreement,thepartiesshallfirstattempttoresolvethedisputesthroughfriendlyconsultations.2.Iftheconsultationsfail,thepartiesmaysubmitthedisputestothelabordisputearbitrationcommitteeintheplacewheretheEmployerislocatedforarbitrationinaccordancewiththerelevantprovisionso
