2025租賃合同中英文范本正文本租賃合同(以下簡(jiǎn)稱“本合同”)由以下雙方于年月日在市簽訂:出租人(以下簡(jiǎn)稱“甲方”):姓名/公司名稱:身份證號(hào)/統(tǒng)一社會(huì)信用代碼:地址:聯(lián)系信息:承租人(以下簡(jiǎn)稱“乙方”):姓名/公司名稱:身份證號(hào)/統(tǒng)一社會(huì)信用代碼:地址:聯(lián)系信息:鑒于甲方愿意將其擁有的租賃物出租給乙方使用,乙方同意承租該租賃物,雙方本著平等、自愿、誠(chéng)實(shí)信用的原則,達(dá)成如下協(xié)議:第一條租賃物1.1租賃物的描述:甲方出租的租賃物為(具體描述租賃物,如房地產(chǎn)、設(shè)備、車輛等),以下簡(jiǎn)稱為“租賃物”。租賃物的詳細(xì)信息如下:所有權(quán)證明:權(quán)利人:位置/地址:具體描述:1.2租賃物的交付:甲方應(yīng)于年月日向乙方交付租賃物,交付時(shí)雙方應(yīng)共同確認(rèn)租賃物的現(xiàn)狀并簽署交付確認(rèn)書。第二條租賃期限2.1租賃期限:本合同租賃期限為年,自年月日起至年月日止。2.2租賃期限的延長(zhǎng):如雙方在租賃期限屆滿前天內(nèi)未書面通知對(duì)方終止租賃關(guān)系,則本合同自動(dòng)延長(zhǎng)年,除非雙方另行協(xié)商達(dá)成一致。第三條租金及支付方式3.1租金標(biāo)準(zhǔn):乙方應(yīng)按月/季度/年支付租金,租金為元(大寫:)。若租金調(diào)整,雙方應(yīng)協(xié)商一致并簽訂補(bǔ)充協(xié)議。3.2支付方式:乙方應(yīng)于每月/每季度/每的日前以方式支付當(dāng)期租金至甲方指定賬戶:賬戶名稱:賬號(hào):開戶銀行:3.3晚付違約金:如乙方逾期支付租金,應(yīng)按日計(jì)算支付逾期部分的%作為違約金,直至租金付清為止。第四條押金4.1押金數(shù)額:乙方應(yīng)于本合同簽訂之日向甲方支付押金元(大寫:)。押金用于擔(dān)保乙方履行本合同項(xiàng)下的義務(wù)。4.2押金的退還:租賃期限屆滿,雙方結(jié)清所有費(fèi)用且租賃物無損壞(自然損耗除外),甲方應(yīng)于日內(nèi)將押金無息退還乙方。第五條雙方的權(quán)利與義務(wù)5.1甲方的權(quán)利與義務(wù):5.1.1甲方應(yīng)確保租賃物的合法性,保證租賃物無權(quán)利瑕疵。5.1.2甲方應(yīng)按本合同約定的時(shí)間交付租賃物,并在租賃期間保持租賃物的可正常使用狀態(tài)。5.1.3甲方有權(quán)對(duì)租賃物的使用情況進(jìn)行監(jiān)督,但不得無故干涉乙方的正常使用。5.2乙方的權(quán)利與義務(wù):5.2.1乙方應(yīng)按本合同約定支付租金及相關(guān)費(fèi)用,妥善使用租賃物。5.2.2乙方在租賃期間不得擅自改變租賃物的結(jié)構(gòu)或用途,如需裝修或改造,應(yīng)書面通知甲方并獲得書面同意。5.2.3乙方應(yīng)按約定的時(shí)間歸還租賃物,租賃期限屆滿后不得繼續(xù)占用或留置租賃物。第六條維修責(zé)任6.1日常維護(hù):租賃期間,租賃物的日常維護(hù)由乙方負(fù)責(zé),費(fèi)用由乙方承擔(dān)。如租賃物因乙方使用不當(dāng)導(dǎo)致?lián)p壞,修復(fù)費(fèi)用由乙方承擔(dān)。6.2大修或更換:如租賃物因自然老化或不可抗力因素導(dǎo)致嚴(yán)重?fù)p壞,甲方有責(zé)任進(jìn)行維修或更換,費(fèi)用由甲方承擔(dān)。第七條保險(xiǎn)7.1租賃物的保險(xiǎn):甲方應(yīng)為其擁有的租賃物購(gòu)買相關(guān)保險(xiǎn),保險(xiǎn)費(fèi)用由甲方承擔(dān)。7.2乙方的保險(xiǎn):如乙方需為租賃物購(gòu)買額外保險(xiǎn),費(fèi)用由乙方承擔(dān),保險(xiǎn)受益人為乙方。第八條轉(zhuǎn)讓與轉(zhuǎn)租8.1轉(zhuǎn)讓限制:未經(jīng)甲方書面同意,乙方不得將本合同項(xiàng)下的權(quán)利義務(wù)轉(zhuǎn)讓給第三方。8.2轉(zhuǎn)租限制:未經(jīng)甲方書面同意,乙方不得將租賃物轉(zhuǎn)租給第三方。如獲同意,轉(zhuǎn)租所得收益應(yīng)優(yōu)先用于支付租金。第九條違約責(zé)任9.1乙方違約責(zé)任:9.1.1乙方逾期支付租金超過日,甲方有權(quán)解除合同,并要求乙方支付未付租金及違約金。9.1.2乙方擅自改變租賃物的用途或結(jié)構(gòu),甲方有權(quán)解除合同,并要求乙方恢復(fù)原狀或賠償損失。9.1.3乙方未經(jīng)甲方同意提前退租,需按本合同約定的租金標(biāo)準(zhǔn)支付未履行期間的租金作為違約金。9.2甲方違約責(zé)任:9.2.1甲方未按合同約定交付租賃物或在租賃期間無故收回租賃物,需退還押金并賠償乙方遭受的損失。第十條爭(zhēng)議解決10.1爭(zhēng)議解決方式:因本合同引起的或與本合同有關(guān)的任何爭(zhēng)議,雙方應(yīng)友好協(xié)商解決;協(xié)商不成時(shí),任何一方均可向租賃物所在地有管轄權(quán)的人民法院提起訴訟。第十一條其他條款11.1合同生效:本合同自雙方簽字或蓋章之日起生效,一式份,甲乙雙方各執(zhí)份。11.2通知:雙方確認(rèn)本合同中的聯(lián)系地址為有效送達(dá)地址,任何一方發(fā)送至該地址的書面通知視為已送達(dá)。11.3文本效力:如本合同的中英文版本出現(xiàn)不一致,以中文版本為準(zhǔn)。簽署確認(rèn)甲方(簽字/蓋章):簽署日期:年月日乙方(簽字/蓋章):簽署日期:年月日英文版本LeaseContract(DualChinese-EnglishVersion2025)MainTextThisLeaseContract(hereinafterreferredtoas"thisContract")isenteredintobythefollowingpartiesonday,month,yearin,China:Lessor(hereinafterreferredtoas"PartyA"):Name/CompanyName:IDNumber/UnifiedSocialCreditCode:Address:ContactInformation:Lessee(hereinafterreferredtoas"PartyB"):Name/CompanyName:IDNumber/UnifiedSocialCreditCode:Address:ContactInformation:ConsideringthatPartyAiswillingtoleasetheproperty/assets(hereinafterreferredtoas"theLeasedProperty")toPartyBforuse,andPartyBagreestorenttheLeasedProperty,bothpartiesherebyagreeasfollows:Article1DescriptionoftheLeasedProperty1.1DescriptionoftheLeasedProperty:TheLeasedPropertyis(specificallydescribetheLeasedProperty,suchasrealestate,equipment,vehicles,etc.),hereinafterreferredtoas"theLeasedProperty".DetailedinformationoftheLeasedPropertyisasfollows:OwnershipCertificate:RightsHolder:Location/Address:SpecificDescription:1.2DeliveryoftheLeasedProperty:PartyAshalldelivertheLeasedPropertytoPartyBonday,month,year.BothpartiesshallconfirmtheconditionoftheLeasedPropertyupondeliveryandsignadeliveryconfirmationdocument.Article2TermofLease2.1TermofLease:ThetermofthisContractisyears,fromday,month,yeartoday,month,year.2.2ExtensionofLeaseTerm:IfneitherPartyAnorPartyBnotifiestheotherinwritingoftheintentiontoterminatetheleaserelationshipdayspriortotheexpirationoftheleaseterm,thisContractshallautomaticallybeextendedforanotheryears,unlessotherwiseagreedbybothparties.Article3RentandPaymentTerms3.1RentStandards:PartyBshallpayrentmonthly/quarterly/yearly,withtherentbeingyuan(inwords:).Iftherentissubjecttoadjustment,bothpartiesshallagreeandsignasupplementaryagreement.3.2PaymentMethods:PartyBshallpaytherentforeachmonth/quarter/yearbeforeonthedayofeachmonth/quarter/yeartothedesignatedaccountofPartyA:AccountName:AccountNumber:OpeningBank:3.3LatePaymentPenalty:IfPartyBfailstopaytherentontime,PartyBshallpayalatepenaltyof%perdayontheoverdueamountuntiltherentisfullypaid.Article4Deposit4.1AmountofDeposit:PartyBshallpayadepositofyuan(inwords:)toPartyAonthedateofsigningthisContract.ThedepositisintendedtoguaranteetheperformanceofPartyB'sobligationsunderthisContract.4.2RefundofDeposit:Uponexpirationoftheleaseterm,PartyAshallrefundthedeposittoPartyBwithoutinterestwithindays,providedthatallfeeshavebeensettledandtheLeasedPropertyisnotdamaged(naturalwearandtear除外).Article5RightsandObligationsofBothParties5.1RightsandObligationsofPartyA:5.1.1PartyAshallensurethelegalityoftheLeasedPropertyandguaranteethattherearenoownershipdisputes.5.1.2PartyAshalldelivertheLeasedPropertytoPartyBinaccordancewiththetermsofthisContractandmaintaintheusabilityoftheLeasedPropertyduringtheleaseterm.5.1.3PartyAhastherighttosupervisetheuseoftheLeasedPropertybutshallnotunreasonablyinterferewithPartyB'snormaluse.5.2RightsandObligationsofPartyB:5.2.1PartyBshallpaytherentandrelatedfeesasstipulatedinthisContractandusetheLeasedPropertyincompliancewiththeleaseagreement.5.2.2WithoutthewrittenconsentofPartyA,PartyBshallnotalterthestructureorusetheLeasedPropertyforanypurposeotherthanasagreed.Ifanydecorationorrenovationisrequired,PartyBmustnotifyPartyAinwritingandobtainwrittenapproval.5.2.3PartyBshallreturntheLeasedPropertyonthedatetheleasetermexpiresandshallnotoccupyorretaintheLeasedPropertythereafter.Article6MaintenanceResponsibilities6.1RoutineMaintenance:Duringtheleaseterm,theroutinemaintenanceoftheLeasedPropertyshallbetheresponsibilityofPartyB,withcoststobebornebyPartyB.IftheLeasedPropertyisdamagedduetoimproperusebyPartyB,therepaircostsshallbebornebyPartyB.6.2MajorRepairsorReplacement:IftheLeasedPropertyisdamagedduetonaturalagingorforcemajeure,PartyAshallberesponsibleformaintenanceorreplacement,withcoststobebornebyPartyA.Article7Insurance7.1InsurancefortheLeasedProperty:PartyAshallpurchaserelevantinsurancefortheLeasedProperty,withcoststobebornebyPartyA.7.2InsuranceforPartyB:IfPartyBdeemsitnecessarytopurchaseadditionalinsurancefortheLeasedProperty,costsshallbebornebyPartyB,withtheinsuredpartybeingPartyB.Article8AssignmentandSubletting8.1RestrictiononAssignment:PartyBshallnotassignitsrightsandobligationsunderthisContracttoanythirdpartywithoutthewrittenconsentofPartyA.8.2RestrictiononSubletting:PartyBshallnotsublettheLeasedPropertytoanythirdpartywithoutthewrittenconsentofPartyA.Ifconsentisgranted,theincomefromsublettingshallbeusedfirsttopaytherent.Article9LiabilityforBreachofContract9.1LiabilityforBreachbyPartyB:9.1.1IfPartyBfailstopaytherentformorethandays,PartyAhastherighttoterminatetheContractanddemandpaymentoftheunpaidrentandlatefees.9.1.2IfPartyBalterstheuseoftheLeasedPropertyoritsstructurewithouttheconsentofPartyA,PartyAhastherighttoterminatetheContractanddemandthatPartyBrestoretheoriginalconditionorcompensatefortheloss.9.1.3IfPartyBwithdrawsfromtheleaseprematurelywithoutthewrittenconsentofPartyA,PartyBshallpaytherentfortheunfulfilledperiodasliquidateddamages.9.2LiabilityforBreachbyPartyA:9.2.1IfPartyAfailstodelivertheLeasedPropertyasstipulatedinthisContractorrecoverstheLeasedPropertywithoutcauseduringtheleaseterm,PartyAshallrefundthedepositandcompensatePartyBforanylossesincurred.Article10DisputeResolution10.1MethodofDisputeResolution:AnydisputesarisingfromorrelatedtothisContractshallberesolvedthroughfriendly
