第一條租賃內(nèi)容

1\.RENTCONTENT

1.1

租賃地址：甲方將其位于_________________________________的商鋪租賃給乙方作商業(yè)經(jīng)營用途。甲方對所出租的商鋪具有合法產(chǎn)權(quán)、并出示房產(chǎn)證(或具有出租權(quán)的有效證明)、身份證明等文件;乙方也應(yīng)提供身份證明文件。雙方可復(fù)印對方文件備存。所有復(fù)印件僅供本次租賃使用，不得挪作它用。

provideidentification.Thetwopartiescancopyeachotherdocumentsfor

keeping.Allcopiescanusefortherentaffairsonly,andcannotbeusedfor

anyotherpurpose.

1.2

租賃面積：甲方租賃給乙方的商鋪建筑面積為_____平方米,使用面積為_____平方米。甲方將該商鋪交付乙方使用時,商鋪結(jié)構(gòu)及配套設(shè)施為:簡裝修。承租期內(nèi)乙方在不改變和影響房屋整體結(jié)構(gòu)的前提下，可進行裝修裝飾、對室內(nèi)空間進行重新劃分;若期滿不續(xù)租，其裝修材料由乙方自行處理，若拆除，其費用由乙方自理。

rightstohandlethedecorations,ifdismantlethedecorations,PartBpayall

thecost.

第二條租賃期限

2\.TERMOFCONTRACT

2.1租賃期限：甲乙雙方商定,租賃期限自年月日起至24：00止,共力影響導(dǎo)致的合同終止情形外，任何一方不得破壞租賃期限的完整和連續(xù)。2.1

CONTRACTPERIOD:Afterbothpartiesagreed,thetermofcontractis:

contracttobeterminated,eitherpartiescannotdestroytheintegrityand

2.2裝修免租期：甲方承諾自交付商鋪給乙方的第一個月給乙方做裝修，免其租金。即自20xx年06月01日起20xx年07月01日止。租金從次月開始收取。

2.3

續(xù)租：合同期滿后,甲方如繼續(xù)出租該商鋪,則同等條件下,乙方可享有優(yōu)先承租權(quán)。乙方如有意續(xù)租,可于合同期滿前30天向甲方提出,雙方另行協(xié)商,訂立新的租賃合同。

2.3CONTRACTEXTENSION:Afterthecontractbeexpired,iftheshopstillbe

abletoberent,PartBhavethepriorityrighttorent.IfPartBhavethe

mindcontractbeexpired,afternegotiated,createthenewrentcontract.

2.4合同的中止

2.4CONTRACTTERNIMATION

2.4.1乙方有如下情形之一時,甲方有權(quán)提前中止合同,收回商鋪：

a,乙方利用該商鋪從事非法活動或損害公共利益的;

b,乙方拖欠租金超過

2.4.1UnderthefollowstatusofPartB,PartAhavetherightstoterminate

thecontract,takebacktheshop:a,PartBusetheshoptodotheillegalor

public-interestsdamaging

activities;

2.4.2甲方有如下情形之一時,乙方有權(quán)提前中止合同：

a,甲方不能提供商鋪或提供商鋪不符合條件，嚴重影響乙方正常使用;b,甲方未盡房屋修繕義務(wù)，嚴重影響乙方正常使用的。

2.4.2UnderthefollowstatusofPartA,PartBhavetherightstoterminate

thecontract:

a,PartAcannotoffertheshoportheshopmismatchconditions,

seriouslyaffectthenormalusingofPartB;

b,PartAdoesnotmattertheobligations,seriouslyaffectthenormaluseof

PartB.

第三條租金及其支付方式和其它費用

3\.RENTAL,MODEOFPAYMENTANDOTHERCHARGES

3.1

年租金總額：甲乙雙方商定,租賃期內(nèi)該商鋪的年租金為￥________(大寫：人民幣_____________________圓整)，合同期限內(nèi)無浮動。

3.2

租金的支付:租金按年計算,按半年收付。乙方在每半年到期后月份的5日前將下半個年度租金以現(xiàn)金或轉(zhuǎn)帳方式一次交付到甲方(節(jié)假日可順延)。甲方收款后應(yīng)提供給乙方有效的收款憑證。

3.3首期款的支付:訂立本合同后甲方將商鋪交付乙方裝修時,乙方一次向甲方交納相當于租金總額10%(百分之十)共計￥________(大寫：人民幣

3.4

水、電費及其他公用事業(yè)費:合同期內(nèi),政府對租賃物征收的有關(guān)稅、費項,由甲方負責繳交，該商鋪的衛(wèi)生費、電費、水費及經(jīng)營活動產(chǎn)生的一切費用由乙方負責,乙方應(yīng)如期足額繳交上述應(yīng)繳費用,如因乙方欠費造成向甲方追繳時,甲方有權(quán)向乙方追繳。

3.4WATER,ELECTRICANDOTHERPUBLICUTILITYCHARGES:Duringcontractperiod,

PartApayallthetaxandcharges,etcgovernmentrevenuefromtheshop,and

PartBpaytheclean,electric,waterandallthechargesbecausethe

business,PartBhavetheobligationstopaythechargesenoughandontime,

ifPartAbedisgorgedfromotherpartiescausePartBarrears,PartAhave

therightstodisgorgefromPartB.

3.5合同簽訂時水電表使用情況：

第四條招牌設(shè)置

4\.SHOPSIGNSETTING

甲方同意乙方在符合國家法律、法規(guī)、政府規(guī)章和規(guī)范性文件的前提下，在租賃商鋪的室內(nèi)外安裝設(shè)置帶有其公司標志的招牌等廣告裝置(例如帶照明的透明廣告燈箱、立牌和戶外廣告招牌等)，并協(xié)助乙方做好跟物業(yè)裝修申請、施工以及廣告設(shè)置的交涉工作。

PartAagreedPartBsettheshopsignsandotheradvertisingequipmentswith

companylogo(suchas:illuminatingtransparentadvertisinglampbox,erect

signsandoutsideadvertisingsigns,etc.)inoutsideoftheshopcomplywith

thestatelaws,regulations,governmentregulationsandnormativedocuments,

andPartAhavetheobligationstoassistPartBtoapplytotheproperty

managementcompany,constructionandothersignssettingworksneeded

negotiatewithotherparties.

第五條雙方的責任和權(quán)利

5\.OBLIGATIONSANDRIGHTS

5.1甲方的責任和權(quán)利

5.1OBLIGATIONSANDRIGHTSOFPARTA

a,甲方應(yīng)保證所出租的商鋪及配套設(shè)施在交付乙方使用時完好并能夠正

常使用;

a,PartAhavetheobligationtoissuetheshopandsupporting

equipmentsconditionisgoodandcanbeusenormally;

b,按公共契約負責商鋪結(jié)構(gòu)維修和保養(yǎng),凡遇政府部門要求需對商鋪或配

套設(shè)施進行改造時,相關(guān)費用由甲方負責;

b,PartAhavetheobligationtorepairandmaintenancetheshop

structures,ineverycaseofgovernmentrequestsreconstructshopor

supportingequipments,PartApayallthecharges;

c,負責協(xié)調(diào)本地區(qū)各有關(guān)部門的關(guān)系,并為乙方辦理營業(yè)執(zhí)照提供有效的

房產(chǎn)證明及相關(guān)手續(xù);

c,PartAhavetheobligationtocoordinatetherelationshipswithallthe

departmentsintheshoplocateddistrict,andofferthevalidproperty

ownershipcertificateandotherdocumentberelatetoPartBapplythe

businesslicense;

d,不得以任何理由占用乙方所租門面及其附屬設(shè)施，如門面前面的空地等。

d,PartAcannotoccupytheshopandequipmentswhichthePartBwithany

reason,suchastheemptylandoutsideoftheshop.

5.2乙方的責任和權(quán)利

a,合同有效期內(nèi),乙方對所租賃的商鋪及配套設(shè)施擁有合法使用權(quán);

a,PartBhavethelegalrighttousetherentedshopandsupporting

equipmentsduringtherentperiod;

b,乙方應(yīng)遵守國家法律,法規(guī),依法經(jīng)營;

b,PartBhavetheobligationstodobusinessasthestatelaw,

regulations;

c,乙方不得在租賃的商鋪內(nèi)貯存危險、違禁物品;

c,PartBcannotstorethedangers,prohibitedgoodsintheshop;

d,乙方必須依約繳納租金及其他因經(jīng)營產(chǎn)生的費用,不得無故拖欠;

d,PartBhavetheobligationstopayrentalandotherchargescause

businessontime,cannotarrearswithoutreason;

e,乙方在承租的商鋪內(nèi)需要安裝或者使用超過水、電表容量的任何水電設(shè)備,應(yīng)事前征得甲方同意,并由乙方負責到有關(guān)部門辦理增容手續(xù),費用由

乙方負擔;

e,PartBhavetheobligationtogettheauthorizationfromPartAwhen

installtheequipments’valueoverthelimitedofthewaterandelectric

meters’value,PartBalsohaveobligationtomaketheapplicationtothe

relateddepartmentandpayallthecharges;

e,租賃期滿或者解除合同時,所屬乙方的財物，均由乙方自行處理，甲方不得以任何理由進行任何形式的干涉;

e,Whenthecontractbeexpiredorterminated,allthepropertiesownedby

PartB,PartBhavetherightstohandletheproperties,PartAcannot

interferewithanyreasoninanymodality;

f,租賃期滿或者解除合同時,由甲乙雙方共同檢查商鋪和配套設(shè)施,檢查無

異議后,商鋪交還甲方。如發(fā)現(xiàn)有損壞的,則由乙方照價負責賠償。

f,Whenthecontractbeexpiredorterminated,bothpartiesneedcheckthe

shopandsupportingequipmentstogether,aftereitherparties

confirmed,PartAtakebacktheshop.Ifanythingbebroken,PartB

needpayforasmarketprice.

第六條出租方和承租方的變更

6\.PARTIESCHANGE

6.1

產(chǎn)權(quán)人與承租人：合同期內(nèi),甲方和乙方中任何一方法定代表人(或產(chǎn)權(quán)人)變更、企業(yè)遷址、合并,不影響本合同繼續(xù)履行。變更、合并后的一方即成為本合同當然執(zhí)行人,并承擔本合同的內(nèi)容之權(quán)利和義務(wù);

6.1OWNERANDRENTER:Duringcontractperiod,eitherofbothparties’legal

representative(orpropertyowner)bechanged,companymovedor

merged,willnotinfluencethecontractcontinueperform.Anyonefterchange,

mergebethesuccessorwillbetheperformer,andassumealltherightsand

obligationsinthecontract;

6.2轉(zhuǎn)租:合同期內(nèi),乙方如欲將租賃的商鋪轉(zhuǎn)租給第三方時,必須事先征得甲方同意,并由三方書面確認,取得使用權(quán)的第三方成為本合同的當然乙方,繼續(xù)履行本合同;

6.2SUBLEASE:Duringcontractperiod,ifPartBwantsublettheshoptoother

parties,shouldconsentbyPartAandgetthewrittenconfirm,thepartywho

gettheusingrights,willbethePartB,continueperformthiscontract;

6.3甲方欲出售房屋，必須在三個月前書面通知乙方，并且要保證租賃期限的完整。

6.3WhenthePartAwantselltheshop,mustwritteninformPartBatleast3

monthsbefore,andmustissuetherentperiodinthecontract.

第七條違約及處理

7\.DEFAULTANDDISPOSE

7.1任何一方未能履行本合同規(guī)定的條款的,均視為違約;

7.1Eitherpartiescannotperformtherulesandconditionsinthecontract,

alldeemedtobedefault;

7.2若乙方違約，甲方有權(quán)提前解除合同，并無需退還已繳納的房屋租金;

7.2.IfPartBdefaulted,PartAhavetherightstoterminatethecontractand

donotneedpaybackthepaidrental;

7.3若甲方違約，乙方有權(quán)提前解除合同，且甲方必須雙倍退還乙方已繳納但未完成使用期限的全部租金，并賠償乙方裝修費。裝修費賠償標準：若第一年內(nèi)違約，賠償全部裝修款(100%)，以實際裝修情況計算;若第二年違約。賠償裝修款的70%，以實際裝修情況計算;若第三年違約，賠償裝修款的50%，以實際裝修情況計算;

7.3IfPartAdefaulted,PartBhavetherightstoterminatethecontractand

PartAmustdoublepaytherentalPartBhadpaid,payforthedecoration

cost.Thedecorationcompensationstandardis:1styear,payfor100%ofthe

decorationcost,countastheactuallypayment;2ndyear,payfor70%ofthe

decorationcost,countastheactuallypaymentt;3rdyear,payfor50%ofthe

decorationcost,countastheactuallypayment.

7.4:違約方逾期向守約方賠付違約金或逾期向守約方賠償經(jīng)濟損失的,每逾期一天,守約方有權(quán)向違約方加收實欠違約金總額1%的滯納金;

7.4Thedefaulterwhoarrears,needpaytheliquidateddamagestoopposite

party,arrearsevery1day,performerhavetherightstocharge1%ofthe

totalarrearage;

7.5:因不可抗拒的因素引起本合同不能正常履行時,不視為違約,雙方互免承擔違約責任。

obligations.

第八條合同生效及糾紛處理

8.1:本合同自雙方簽字加印手印(右手食指)后即生效,具有法律效力;

8.1Aftersignatureandfingerprinted(rightindexfinger),thiscontractbe

gointoeffectwiththeforceoflaw;

8.2:本合同未盡事宜,甲乙雙方通過協(xié)商議定,制訂補充協(xié)議,補充協(xié)議經(jīng)甲、乙方簽字加印手印后作為本合同的附件,與本合同具有同等法律效力;
