1、最高人民法院公告（相關(guān)資料：地方法規(guī)4篇案例1篇裁判文書1244篇相關(guān)論文26篇實務(wù)指南）最高人民法院關(guān)于適用V中華人民共和國婚姻法若干問題的解釋（二）已于2003年12月4日由最高人民法院審判委員會第1299次會議通過?，F(xiàn)予公布，自2004年4月1日起施行。最高人民法院2003年12月25日最高人民法院關(guān)于適用中華人民共和國婚姻法若干問題的解釋（二）（2003年12月4日最高人民法院審判委員會第1299次會議通過法釋200319號）為正確審理婚姻家庭糾紛案件，根據(jù)中華人民共和國婚姻法（以下簡稱婚姻法）、中華人民共和國民事訴訟法等相關(guān)法律規(guī)定，對人民法院適用婚姻法的有關(guān)問題作出如下解釋：第一條

3、ncerningtheapplicationoftheMarriageLawbythepeoplescourtinaccordancewiththeMarriageLawofthePeoplesRepublicofChina(hereinafterreferredtoastheMarriageLaw),theCivilProceduralLawofthePeoplesRepublicofChinaandotherrelevantlawsandregulations:Article1Thepeoplescourtshallrefusetoacceptanylawsuitfiledbythepar

4、tiesconcernedtostopthecohabitation.But,ifthepartiesconcernedpleadtostopthecohabitationbetweenapersonwhohasaspousebutco-habitatswithathirdpersonasprovidedforinArticles3,32and46oftheMarriageLaw,thepeoplescourtshallacceptsuchlawsuitsandstopthecohabitationinaccordancewiththelaw.Thepeoplescourtshallaccep

5、tthelawsuitsfiledbythepartiesconcernedduetodisputesoverthepartitioningofpropertyortheupbringingofchildren.Article2Afterthepeoplescourthasacceptedapleadingforannouncingamarriageinvalid,ifitfinds,uponexamination,thatthecircumstanceistrue,itshallmakeajudgmentannouncingthemarriageinvalidinaccordancewith
