1、公開盜竊論文：公然以平和方式取財(cái)行為的定性分析【中文摘要】對“公然以平和方式取財(cái)行為”定性問題是我國實(shí) 踐中處理財(cái)產(chǎn)型犯罪問題的一個(gè)難點(diǎn)問題。綜觀相關(guān)理論,主要有“平 和搶奪說”和“公開盜竊說”兩種觀點(diǎn)。這兩種觀點(diǎn)對我國財(cái)產(chǎn)型犯 罪的各罪構(gòu)成和區(qū)分標(biāo)準(zhǔn)進(jìn)行了不同的描述，因此，對“公然以平和方 式取財(cái)行為”的定性研究具有較大的理論意義和實(shí)踐價(jià)值。本文以董 某非法占有摩托車案為研究素材，通過對這兩種學(xué)說的分析比較,以 及對搶奪罪、盜竊罪的犯罪構(gòu)成的探討，試圖為“公然以平和方式取 財(cái)行為”找到一個(gè)合適的定性,以此來解決這一難題給司法實(shí)踐所帶 來的困擾。本文除引言外共分為三個(gè)部分:第一部分,案件的基本

2、情 況。通對董某非法占有摩托車案的案由、案情進(jìn)行介紹，歸納出處理 本案的三種分歧意見，即對于董某公然以平和方式非法占有他人財(cái)物 的行為，公安機(jī)關(guān)認(rèn)為應(yīng)構(gòu)成搶奪罪，檢察院認(rèn)為應(yīng)構(gòu)成詐騙罪，法院 認(rèn)為應(yīng)構(gòu)成盜竊罪。第二部分是對“公然以平和方式取財(cái)行為”的定 性分析。通過總結(jié)本案的三種分歧意見，筆者得出了本案的爭議焦點(diǎn) 為，對“公然以平和方式取財(cái)行為”應(yīng)如何定性?理論上對“公然以平 和方式取財(cái)行為”的定性之爭主要集中在兩種觀點(diǎn):一種是“平和搶 奪說”，另一種“公開盜竊說”。對此，筆者先對“公然以平和方式取 財(cái)行為”中“公然”和“平和方式”的內(nèi)涵進(jìn)行分析，又分別探論了 搶奪罪的“暴力性”和盜竊罪的“秘

3、密性”。通過對上述兩種爭議觀 點(diǎn)的法理分析，筆者認(rèn)為“平和搶奪說”尚存缺陷“公開盜竊說”更 具有合理性，故贊同將“公然以平和方式取財(cái)行為”歸于“盜竊行為”。 第三部分是對本案的研究結(jié)論及立法啟示。結(jié)合對“公然以平和方式 取財(cái)行為”的定性分析，本案得出了明確的定罪結(jié)論。即董某的行為 不應(yīng)定性為搶奪罪,也不應(yīng)定性為詐騙罪，而應(yīng)定性為盜竊罪。同時(shí)， 通過對本案的研究，筆者得到了一些立法啟示。即在贊同“公開盜竊 說”的基礎(chǔ)上,建議把“公開盜竊”理論融入我國的刑法架構(gòu)對我國 財(cái)產(chǎn)型犯罪的區(qū)分標(biāo)準(zhǔn)進(jìn)行重新界定,擴(kuò)大搶奪罪中“情節(jié)特別嚴(yán)重” 的范圍，以此來完善我國的刑事立法?！居⑽恼縏he qualit

Taking Dongmou s illegal possession of a motorbike for example, the essay presents the causes and the details of the case, and then leads to the three different opinions: the public security gives the rea

8、son to constitute the sin of robbing, the people s procuratorate the sin of fraud, and the court the sin of stealing.The second part is the qualitative analysis of“gaining poverty openly with a peaceful way” . By summarizing the three kinds of disagreement, the author concluded that the focus of dis

Theoretically, the dispute as for“gaining poverty openly with apeaceful way” concentrated on two ideas: peaceful robbing” and public theft” . Thus, in this essay the author firstly makes a comparatively analysis between“ope

10、nly” and genteelly” . Then the author explores the difference of violence in the robbing crime and the secrecy in the crime of theft. Based on the legal analysis of the two mentioned disagreements, the author thinks that the opinion“peaceful robbing” still exists defects, while “public theft” sounds

Therefore, the author agrees the exchange of “gaining poverty openly with a peaceful way” to “theft behavior” .The third part is the conclusion of the study of this case and legislation inspiration. According to the qualitative analysis of “gaining poverty openly with a peaceful wa

12、y”，this case gets to a clear conclusion: Dongmou s behavior should not be regarded as robbing instead of fraud.
