企業(yè)職員雇用合同(中英文比照)EMPLOYMENTCONTRACT“://taxchina/gsgl/2005-09/06/cms401641article.shtml“://taxchina/gsgl/2005-09/06/cms401641article.shtmlThis Employment Contract is entered into by and between(姓名) ,of (hereinafterreferredtoasEmployer)and(姓名) ,of (hereinafterreferredtoasEmployee).此雇用合同由×××(以下簡(jiǎn)稱雇主)(公司名稱、地址等)和×××(以下簡(jiǎn)稱雇員)(單位名稱、地址等)締結(jié)。EmployerherebyemploysEmployeeandEmployeeherebyacceptstobeemployedbyEmployertoserveandperformthedutiesrequiredofhim/herinthejobcategoryprovidedbelow:行義務(wù)。A:DUTIESANDRESPONSIBILITIES:ThepartiesheretoagreethatEmployeeshallbeemployedonlyinthejobcategoryof andshallperformthefollowingdutiesandresponsibilities:義務(wù)和責(zé)任:合同雙方同意雇員將受聘從事××工作,并履行以下職責(zé)。B:TERM:Thetermofthiscontractshallbefortheperiodof commencingupon andendingon .期限:本合同有效期為××(年、月),從×年×月×日起至×年×月×日止。C.WORKDAYSANDHOURS:Employee”Sworkdays,hoursandworkweekshallbeto ,from to ,foratotalhoursperweek.小時(shí)。D.COMPENSATION:InconsiderationoftheservicestobeperformedbyEmployee,EmployeragreestopayEmployeecompensationintheamountof:酬勞:雇主同意就雇員的效勞供給以下酬勞:$ per and1.每(小時(shí))××元;$ per forovertimecompensationpayablebycheckinbiweeklyintervals.2.每加班(一小時(shí))××元,每?jī)芍芙Y(jié)算一次,支票支付。Othercompensation(bonuses,commissions,etc.),amountandmethodofcalculationspecifiedasfollows:3.其他酬勞(紅利、傭金等),數(shù)額及計(jì)算方法如下:E.DEDUCTIONS: taxesandSocialSecurity,ifapplicable,shallbewithheldfromEmployee”ssalaryeachpayperiod.NootherdeductionsfromEmployee”scompensationshallbemadebyEmployerunlessspecifiedhereinandapprovedbytheChiefofLabororhisauthorizeddesignee.Otherdeductions(setforthamountandpurposeofdeduction):(×××)稅收和社會(huì)保險(xiǎn)費(fèi)外,雇主(寫出扣款目的和數(shù)目);F.PRINCIPALPLACE0FWORK:Employee”sprincipalplaceofworkshallbeon .HoweverEmployeemayberequiredtoperformhis/herdutiesattheothersenatorialdistrictswithin dependingonthenaturalofEmployer”sbusinessanduponEmployer”scompliancewithapplicablelaborpoliciesand/orregulations.規(guī)定狀況下,雇主也可要求雇員在××地以內(nèi)其他選區(qū)履行職責(zé)。G.TRANSPORTATION:EmployershallberesponsibleforthepaymentofEmployee”sreturnairplanetickettohis/herpointofhireattheexpirationorterminationoftheEmploymentContract,regardlessofthenatureofthetermination.差旅費(fèi):在本合同到期或中止(不管中止緣由如何)時(shí),雇主將負(fù)責(zé)雇員返回雇用地的機(jī)票費(fèi)用。H.INSURANCE/MEDICALEXPENSES:EmployershallberesponsibleandliableforthemedicalinsuranceorpaymentofallmedicalexpensesofEmployee,includingthecostofreferralandevacuationofmedicaltreatmentoutsideof and,intheeventofEmployee”sdeath,thecostofembalmingandtransportationofEmployee”scorpsebacktohis/herpointoforigin.外的轉(zhuǎn)診和轉(zhuǎn)院費(fèi),如雇員因故死亡,雇主應(yīng)擔(dān)當(dāng)尸體保存及運(yùn)回原地的費(fèi)用。I.NOTIFICATIONOFNEXT-OF—KIN:InthecaseofanemergencyinvolvingseriousillnesaccidentordeathofEmployeEmployershallimmediatelynotifyEmployee”snext-of-kinwhosenameandaddrssareasfollows:最近的血親的通知雇員在消滅重病或死亡狀況雇主應(yīng)馬上通知其最近的血親雇員最 近 的 血 親 的 姓 名 和 地 址 如 下 :1of3(3—1頁(yè))J.BOARD,LODGINGANDOTHERS:Employershallensurethatthefollowingfacilitiesareprovided:食宿及其他:雇主必需保證供給以下便利: Employer—providedhousingatachargeof$ permonth. Employer-providedhousingfreeofcharge. Employeeself-arrangedhousing(Attachstatementorrentalagreement).(作記號(hào)以選擇或不選擇此項(xiàng))雇主供給住宿,每月收費(fèi)××元。(同上)雇主免費(fèi)供給住宿。(同上)雇員自備住宿(附聲明和房租協(xié)議)。 (number)mealsperdayatachargeOf$ 每日×餐,每月收費(fèi)××元。 Employeetoprovideownfood.(同上)雇員自理伙食。 FreetransportationtoandfromjobsiteatEmployerdesignatedpick,uppoints.(同上)上下班在雇主指定地上車,免收車費(fèi)。 Allowance:(同上)津貼: Others:(同上)其他:K.OTHERPROVISIONS:Thefollowingadditionalprovisionsapplytothiscontract:(Setforthorattachanyworkrules,livingaccommodationrulesandstandardsforEmployeeconduct.EveryofeveryattachmentmustbesignedbytheEmployeeandEmployer.)其他規(guī)定:以下附加規(guī)定適用于本合同:(制定或附加工作和膳宿規(guī)章,以及雇員行為標(biāo)準(zhǔn)。附加規(guī)定的每一頁(yè)都必需經(jīng)雇主和雇員簽字。)L.TERMINATION:ThisContractmaybeterminatedasfollows:終止合同:本合同可依據(jù)以下規(guī)定終止:Withoutcausebyeitherpartybygivingtheotherparty daysadvancewrittennotice;or無故:由一方當(dāng)事人提前××天以書面通知另一方當(dāng)事人;或Withcausebyeitherpartybygiventheotherparty daysadvancewrittennoticeandonlyafteranunsuccessfulgoodfaithattempttosettleanydisputehasbeenmadewiththeChiefofLabororhisdesignee.一方當(dāng)事人。Intheeventofterminationforcause,EmployershallpayEmployee”swagesorsalarythroughtheeffectivedateoftheterminationandshallpurchaseaone-wayticketforthereturnofEmployeetohis/herpointofhire.(她)返回雇傭地的單程機(jī)票。Terminationforcauseshallincludeanyofthefollowing:以下任何一條均構(gòu)成合同終止理由:a. unauthorizedabsencesand/or unauthorizedtardiestoworkbyEmployee;雇員×次無故曠工和(或)×次無故上班遲到;b.Neglect,carelessperformance,non-performanceornon-completionofassignedworkbyEmployee;雇員行為疏忽魯莽,或不完成任務(wù);C.Convictionin ofanyfelonyortwoormoremisdemeanors;在××地犯下重罪或兩項(xiàng)或兩項(xiàng)以上輕罪;d.AbandoningofjoborassigneddutybyEmployee;雇員放棄工作職責(zé);e.Incompetenceormisrepresentationofthequalifications,skills,physicalormentalfitnesstosatisfactorilyperformthedutiesforwhichEmployeewashired;f.Extremecrueltyorabuse,physicalorotherwise;在物質(zhì)或其他方面受到特別虐待;g.UnreasonabledelaysinthepaymentofEmployee”swagesorsalary;無故拖延支付雇員的工資;h.ThebreachofanyprovisionofthisContract;違犯本合同任何一項(xiàng)規(guī)定;i.Others(specify):其他規(guī)定:M.SETTLEMENTOFDISPUTE:爭(zhēng)議的解決:GrievanceandGoodFaithSettlement:怨情和友好調(diào)解:All grievancesordisputesunderthisEmploymentContractshallbesubjecttothefollowinggrievanceprocedure:本合同項(xiàng)下的全部怨情或爭(zhēng)議均應(yīng)按以下程序解決: Employeeshallcommunicatetohis/hersupervisor,orifthereisnosupervisor,thendirectlytoEmployer,anyandallgrievancesordisputeshe/shemayhaveregardinghis/heremployment;雇員須就雇用而產(chǎn)生的一切怨情或爭(zhēng)議向其治理員報(bào)告,如治理員不在,可直接報(bào)告雇主;2of3(3—2頁(yè))Ifthesupervisorisunabletoresolvethematterimmediately,thegrievanceordisputeshallbereducedtowritingbythesupervisorwhichshallstatethesectionoftheContract,law,orrulesandregulationstohavebeenviolated.Managementshallhavefiveworkingdaystoresolvethegrievance,disputeorstateinwritinghis/herreasonswhythereisnoviolation.規(guī)章的理由。Ifthegrievanceordisputeisnotresolvedinstep1or2above.EmployeemayfileacomplaintwiththeChiefofLabororhisdesignee.如上述第一、二步驟不能解決怨情或爭(zhēng)議,雇員可向工長(zhǎng)或工長(zhǎng)代理人書面申述。EmployeeandEmployershallmaintaintheemploymentrelationshipduringthependencyofanygrievanceordisputeunlesstheChiefofLabor,hisauthorizeddesignee,orahearingofficergrantatemporaryworkauthorization.調(diào)查員臨時(shí)準(zhǔn)予的除外。N.REMITTANCE/OTHEROBLIGATIONS.Employeeshallberesponsibleforremittinganymoneytohis/herfamilyandpaymentofanytaxesasrequiredbyhis/hergovernmentinhis/hercountryoforigin.匯款及其他義務(wù):雇員必需按原籍國(guó)政府的規(guī)定向其家人匯款和繳納全部稅收。0.ENTIREAGREEMENT:Theforegoingtermsandconditionsconstitutethesole,entireagreementofthepartieshereinandshallsupersedeanyotheragreement,eitherwritten,verbal,orotherwise.協(xié)定將取代任何其他書面、口頭和其他形式的協(xié)定。INWITHESSWHEREOF,thepartiesheretoaffixtheirnameson
