進口貨物運輸協(xié)議中英文對照版進口貨物運輸協(xié)議（中英文對照）AGREEMENTOFIMPORTGOODSTRANSPORTATION合同編號ContractNo.:簽訂日期DateofSignature:簽訂地點PlaceofSignature:訂約人：UndersignedParties:_____?托運客戶（以下簡稱甲方）_____?Consigningcustomers(hereinaftercalledPartyA)Address地址：?CountryTelNo?電話:FaxNo?.傳真:Representedby代表:_____?貨運代理有限公司（以下簡稱乙方）_____?FreightForwardingCo.Ltd(hereinaftercalledPartyB)Address地址：?CountryTelNo?電話:FaxNo.?傳真:Representedby?代表:一、協(xié)議內容Content本著互利互惠的原則，甲乙雙方經友好協(xié)商就進口貨物的運輸事宜達成以下協(xié)議：Withtheprinciplesofmutualbenefit，thetwopartieswillmakethisagreementonimporttransportasfollowing:1．由甲方委托乙方辦理香港進口貨物運輸業(yè)務，甲方承諾委托之貨物為合法產品；ThePartyAentrustthePartyBwithimporttransportationservicesfromHong?Kong?andthePartyAmustpromisethatthegoodsarelegal.2．甲方委托給乙方的貨物必須真實申報貨物品名、數量、價值、用途等產品，資料必須以書面形式委托給乙方，如因甲方申報不符所造成的所有責任由甲方負責；ThePartyAmustprovidethePartyBwiththerealinformationofproduct’sname,?number,?value,?purpose.AllofthisinformationmustberepresentedtothePartyBinawrittenform,asaresultofdiscrepanciescausedbythePartyA’sdeclaration,thePartyAwillberesponsibleforallliability.3．為確保正常報關和辦理通關手續(xù)，乙方有權對進口運輸的貨物進行開箱查檢。Toensuretheregularprocedureofdeclaring,thePartyBhasrighttoopentheboxandcheckthegoods.4．甲方承諾委托之貨物不能夾帶易燃、易爆物品及國家規(guī)定禁止進口之物品；ThePartyAmustpromisenottocarrycargoconsignedflammable,explosivematerialsandgoodsprohibitedforimportbystateregulations.5．甲方托運內容要求更改或取消時，必須書面形式通知乙方，在與乙方操作人員確認可以退件或終止運輸方可取消訂單；?Beforecheckingthecontent,changingorcancelingthetransportationterms,thePartyAmustnotifythePartyBinwrittenform.Changescanbemadeonlywiththeagreementofthesecondparty.6．如是因戰(zhàn)爭.臺風.地震等人力不可抗拒的自然災害所產生的貨物丟失不予賠償給甲方外；由于其它任何原因或情況產生的貨物損壞和丟失，乙方應在損失產生后5天內以全額現(xiàn)金方式賠償給甲方。Iftheproductsarelostbecauseofthewar,typhoon.earthquakesandotherhumanirresistiblenaturaldisasters,?thePartyBwillnevertakeresponsibility.Duetootherreasonsorcircumstancesarisingfromanydamageandlossofgoods,?theywillpay100%compensationforthelossin5daystothePartyA.7．甲方索賠需乙方通知甲方貨物丟失之日起15日內提出，過期視甲方放棄賠償；ThePartyAshallfileaclaimwithin15daysafterPartyBnotifiesPartyAofthelossofthegoods,andthepartyAshallbedeemedasawaiverofcompensation;二、付款方式payment1．運輸費用Transportationexpenses此運輸費用為全包價格,不可產生其他任何額外費用.Thispricecontainsallthetransportexpenses,maynotproduceanyextracharges預算到達時間需要3天左右。Deliverytime:3days.費用支付時間chargefortime：貨到付款cashondelivery3．甲、乙雙方欲終止本協(xié)議，應正式書面通知對方業(yè)務部，待確認后協(xié)議終止；Ifbothsideswanttoterminatethecontract,onepartywillnotifytheotherpartyinwrittenform.Contractcanbeterminatedafterconfirmation.三、協(xié)議修改agreementmodification本協(xié)議可經雙方書面確認通知另一方修改內容，經雙方共同簽字確認后以簽字日期為準立即生效，任何修改或補充內容雙方未簽字確認前仍按原協(xié)議內容執(zhí)行。Thisagreementcanbemodifiedandbecomeeffectiveonlywhenbothpartiesmakeanagreementaboutthecontent.四、法律與仲裁lawandarbitration如雙方產生法律糾紛并經協(xié)商無法達成一致，雙方同意委托當地法院調解，仲裁或訴訟解決。Ifbothsidescannotproducelegaldisputesandcannotreachagreementbynegotiation,bothsidesagreetocommissionalocalcourtmediation,arbitrationorlitigationtoresolve.五、協(xié)議生效agreement1．本協(xié)議自雙方簽訂日起生效，一單一簽，有效期至甲方收貨后7日內確認無異議則自動終止，否則自動順延；ThisAgreementshalltakeeffectfromthedatecontractissignedbybothparties,asinglesign,validuntil7daysafterreceivingconfirmationpartywithoutobjectionwillautomaticallyterminate,orautomaticallyextended.2．在協(xié)議執(zhí)行過程中，如雙方有何異議，雙方應以友好協(xié)商的方法解決。如任何一方要終止協(xié)議應提前一個月以書面形式通知對方。任何一方須履行協(xié)議中未盡事宜并負相應責任。Ifanydifferentopinionsduringtheexecutionoftheagreement,bothsidesshouldusefriendlyconsultationswaytoreachtheagreement.Ifanypartywantstoterminatetheagreement,?thereshouldbeawrittennoticefromonepartytoanotheronemonthinadvance.Implementationoftheagreementbyeitherpartytobeheldintheoutstandingissuesandthecorrespondingresponsibility.Inw
