Ⅰ.AnIntroductiontoInspectionUnitTheinspectionworkistheactundertakenbytheinspectionstafffromtheinspectionagenciesincludingdeclaringinspectionandquarantinetoinspectionandquarantineinstitutions,goingthroughrelevantformalitiesandstartinginspectionandquarantineprocedurewhichareallinaccordancewithlaw.Theinspectionunitisthemainbodyinvolvedininspection.Itreferstothedomesticlegalpersonsororganizationsthathaveobtainedinspectionqualificationbylegallyregisteringattheinspectionandquarantineagenciesorobtainedinspectionrightapprovedbythem.Theinspectionstaffintheinspectionagenciesisresponsibleforthespecificworkofquarantineagencies.Thenationalgovernmentmanagesinspectionstaffviaregistration.

Afterobtainingastatequalificationcertificateofinspection,theinspectionstaffcanbeginworkingonlyiftheyhaveappliedtothequarantineagenciesandgottheLicenseforInspector.Astothenon-tradeinspection,theinspectionstaffcandirectlygothroughformalitieswithvaliddocuments.

Accordingtothenatureoftheirregistration,therearetwotypesofinspectionunits：self-serviceinspectionunitandsubstitutedinspectionagency.Accordingtotheclassificationofinspectionunits,inspectioncanbedividedintoself-serviceinspectionandsubstitutedinspection.

一、報(bào)檢單位概述報(bào)檢工作是由報(bào)檢單位的報(bào)檢員來負(fù)責(zé)的，依法向檢驗(yàn)檢疫機(jī)構(gòu)申報(bào)檢驗(yàn)檢疫、辦理相關(guān)手續(xù)、啟動(dòng)檢驗(yàn)檢疫流程的行為。報(bào)檢單位是發(fā)生報(bào)檢行為的主體，依法在檢驗(yàn)檢疫機(jī)構(gòu)注冊(cè)登記取得報(bào)檢資格或經(jīng)檢驗(yàn)檢疫機(jī)構(gòu)批準(zhǔn)取得報(bào)檢權(quán)的境內(nèi)法人或者組織。報(bào)檢單位的具體工作則是由報(bào)檢單位的報(bào)檢員負(fù)責(zé)。國家對(duì)報(bào)檢員實(shí)行注冊(cè)管理。報(bào)檢人員取得“報(bào)檢員資格證”后，向檢驗(yàn)檢疫機(jī)構(gòu)提出申請(qǐng)，獲得“報(bào)檢員證”方可從事工作。非貿(mào)易性質(zhì)的報(bào)檢行為，報(bào)檢人員憑有效的證件直接辦理手續(xù)。按照?qǐng)?bào)檢單位登記的性質(zhì)，可分為自理報(bào)檢單位和代理報(bào)檢單位兩種。按照?qǐng)?bào)檢單位的類型分類，報(bào)檢行為分為自理報(bào)檢和代理報(bào)檢。Ⅱ.Self-serviceInspectionUnitTheself-serviceinspectionunitistheconsigneeorconsignorofentry-exitgoodsorothergoodssubjecttoinspection,ortheunitsforproducing,processing,storingandoperatingimportandexportgoods,whogothroughinspectionprocedureanddeclaretotheentry-exitquarantineagencybythemselvesorbysubstitutedinspectionagency.Itmustberegisteredandputonrecordsatthequarantineagencyandgetinspectionunitcodebeforehandlingrelevantinspectionanddeclarationbusinessinthefirstinspection.Self-serviceinspection,alsocalledself-serviceinspectionact,referstotheinspectionactinwhichtheengagedunitinspectsanddeclarestheimportandexportgoodsproduced,processed,storedoroperatedbyitsownenterprise.二、自理報(bào)檢單位自理報(bào)檢單位，是指根據(jù)我國法律法規(guī)規(guī)定辦理出入境檢驗(yàn)檢疫報(bào)檢/申報(bào)，或委托代理報(bào)檢單位辦理出入境檢驗(yàn)檢疫報(bào)檢/申報(bào)手續(xù)的出入境貨物或其他報(bào)檢物的收發(fā)貨人、進(jìn)出口貨物的生產(chǎn)、加工、儲(chǔ)存和經(jīng)營單位等，在首次報(bào)檢時(shí)須辦理備案登記手續(xù)，取得報(bào)檢單位代碼后，可辦理相關(guān)檢驗(yàn)檢疫報(bào)檢/申報(bào)業(yè)務(wù)。自理報(bào)檢是指自理報(bào)檢單位自行報(bào)檢本企業(yè)生產(chǎn)、加工、儲(chǔ)存或者經(jīng)營的進(jìn)出口貨物的報(bào)檢行為，也稱自理報(bào)檢行為。1.TheRangeofSelf-serviceInspectionUnit

（1）Thedomesticenterprisesthathavetheimport-exportoperationright;

（2）Theconsigneeoragentofimportedgoods;

（3）Theenterprisesthatproducegoodsforexporting;

（4）Theenterprisesoftransportingandpackingexportedgoods,ortheenterprisesofproducingpackagesfordangerousexportedgoodsaswellaspackingandtransportingthem;

（5）Chinese-foreignjointventure,Chinese-foreignco-operativeenterprise,andwhollyforeign-ownedenterprise;

（6）TheresidentrepresentativeinstitutionsofforeignenterprisesinChina;

（7）Theunitsforisolatedbreedingentry&exitanimalsandgrowingplants;

（8）Theunitsforproducing,processing,storingandtransportingtheproductsofentry&exitanimalsandplants;（9）Theunitsthatofferchemicalfumigationanddegassingservicetoentry&exitanimalandplantandtheirproducts,containers,packagingandtransportationtools;（10）Thescientificresearchinstitutionsthathaveentry&exitexchangebusiness;

（11）Otherunitsthatneedinspection.

1.自理報(bào)檢單位的范圍（1）有進(jìn)出口經(jīng)營權(quán)的國內(nèi)企業(yè)；（2）進(jìn)口貨物的收貨人或其代理人；（3）出口貨物的生產(chǎn)企業(yè)；（4）出口貨物運(yùn)輸包裝及出口危險(xiǎn)貨物運(yùn)輸包裝生產(chǎn)企業(yè)；（5）中外合資、中外合作、外商獨(dú)資企業(yè)；（6）國外企業(yè)常駐中國代表機(jī)構(gòu)；（7）進(jìn)出境動(dòng)物隔離飼養(yǎng)和植物繁殖生產(chǎn)單位；（8）進(jìn)出境動(dòng)植物產(chǎn)品的生產(chǎn)、加工、存儲(chǔ)、運(yùn)輸單位；（9）對(duì)進(jìn)出境動(dòng)植物、動(dòng)植物產(chǎn)品、裝載容器、包裝物、交通運(yùn)輸工具等進(jìn)行藥劑熏蒸和消毒服務(wù)的單位；（10）有進(jìn)出境交換業(yè)務(wù)的科研單位；（11）其他需要報(bào)檢的單位。2.FilingandRegistrationofSelf-serviceInspectionUnit

（1）Inspectionandquarantineinstitutionsimplementfilingmanagementsysteminallself-serviceinspectionunits

（2）Iftheunithandlesinspectionmattersforthefirsttime,itshouldpresentrelevantcertificatetolocalinspectionandquarantineinstitutionsandapplyforfilingandregistration.（3）TheGeneralAdministrationofQualitySupervision,InspectionandQuarantineofthePeople’sRepublicofChina（AQSIQ）isresponsibleforunifiedmanagementofself-serviceinspectionunitsacrossthecountry.Thelocalsubordinateinspectionandquarantinebureausareresponsiblefororganizingandimplantingfilingandregistrationofself-serviceinspectionunitsundertheirjurisdiction.Theinspectionandquarantineinstitutionsineachdistricttakechargeofspecificmanagement,suchasfiling,registrationandinformationchangeofself-serviceinspectionundertheirjurisdiction,theregularcheckonfilinginformationofself-serviceinspectionunitsaccordingtoactualsituations,dailysupervisionandadministration.（4）Theapplicantsofself-serviceinspectionunitscandirectlymakeapplicationstoinspectionandquarantineinstitutionsinthelocalityofitsindustryandcommerceregistrationforfilingandregistrationorsubmitapplicationsonline.Thesubmittedmaterialsinclude：Theapplicationformoffilingandregistrationforself-serviceinspectionunits;Originalsandcopiesof“businesslicenseofenterpriselegalperson”,stampedwithenterpriseofficialseal;Originalsandcopiesoforganizationorinstitutioncodecertificate,stampedwithenterpriseofficialseal;Theenterpriseswithimport-exportoperationrightmustproviderelevantproofmaterials;Othersupportingmaterialsthatapplicantsneedtooffertoinspectionandquarantineinstitutions;Otherrelevantmaterialsthatinspectionandquarantineinstitutionsrequire.

（5）Theinspectionandquarantineinstitutionmustreviewandcheckthematerialsprovidedbyapplicants,andputitonrecordandissue“thefilingandregistrationcertificateofself-serviceinspectionunit”totheapplicantsaftergainingtheapproval.Applicantsmustcarryunitcachetorcachetstamptoget“thefilingandregistrationcertificateofself-serviceinspectionunit”.Itsperiodofvalidityis5years.Afteritsexpiration,applicantsshouldgototheoriginalfilinginstitutionstogothroughcertificateextensionandreplacementprocedures.

（6）Self-serviceinspectionunitsshouldacceptsupervisionandadministrationfrominspectionandquarantineinstitutions,abidebylocalmanagementprinciplesandgothroughfilingandregistrationproceduresintheinspectionandquarantineinstitutionsinthelocalityofitsindustryandcommerceregistration.

（7）Theself-serviceinspectionunitswhoneedtoterminatethefilingandregistrationshouldgototheoriginalinspectioninstitutionstogothroughcancellationproceduresinwrittenform.Thecancellationwillbepermittedafterverification.

（8）Whentheself-serviceinspectionunitsandtheirregisteredinspectionstaffwhohavebeenputonrecordandregisteredintheinspectionandquarantineinstitutionsinthelocalityofitsindustryandcommerceregistrationgotootherplacesforinspection,theydonotneedtogothroughfiling,registrationandinspectorregistrationformalitiesaftertheinspectionandquarantineinstitutionshaveverifiedandacceptedtheprovidedfilingandregistrationinformationandcarryoutmanagementaccordingtorelevantregulations.2.自理報(bào)檢單位備案登記（1）檢驗(yàn)檢疫機(jī)構(gòu)對(duì)自理報(bào)檢單位實(shí)行備案管理制度。（2）首次辦理報(bào)檢業(yè)務(wù)的單位，須持有關(guān)證件向當(dāng)?shù)貦z驗(yàn)檢疫機(jī)構(gòu)申請(qǐng)辦理備案登記手續(xù)。（3）國家質(zhì)檢總局負(fù)責(zé)全國自理報(bào)檢單位的統(tǒng)一管理工作，各地直屬檢驗(yàn)檢疫局負(fù)責(zé)所轄地區(qū)自理報(bào)檢單位備案登記等工作的組織實(shí)施，各地檢驗(yàn)檢疫機(jī)構(gòu)負(fù)責(zé)轄區(qū)內(nèi)自理報(bào)檢單位的備案登記、信息更改、根據(jù)實(shí)際情況對(duì)自理報(bào)檢單位的備案信息定期進(jìn)行核實(shí)、日常監(jiān)督管理等具體管理工作。（4）自理報(bào)檢單位備案登記的申請(qǐng)人可以直接向其工商注冊(cè)所在地檢驗(yàn)檢疫機(jī)構(gòu)提出申請(qǐng)或網(wǎng)上提交申請(qǐng)，提交材料包括：①“自理報(bào)檢單位備案登記申請(qǐng)表”；②加蓋企業(yè)公章的“企業(yè)法人營業(yè)執(zhí)照”復(fù)印件及原件；③加蓋企業(yè)公章的組織機(jī)構(gòu)代碼證復(fù)印件及原件；④有進(jìn)出口經(jīng)營權(quán)的企業(yè)須提供有關(guān)證明材料；⑤申請(qǐng)人需要向檢驗(yàn)檢疫機(jī)構(gòu)提供的其他有關(guān)證明材料；⑥檢驗(yàn)檢疫機(jī)構(gòu)要求的其他相關(guān)材料。（5）檢驗(yàn)檢疫機(jī)構(gòu)對(duì)申請(qǐng)人提供的資料進(jìn)行審核，通過以后予以備案登記，并向申請(qǐng)人頒發(fā)“自理報(bào)檢單位備案登記說明書”,申請(qǐng)人須攜帶單位公章或公章印模以領(lǐng)取“自理報(bào)檢單位備案登記證明書”。其有效期為5年，期滿后應(yīng)當(dāng)?shù)皆瓊浒傅臋z驗(yàn)檢疫機(jī)構(gòu)辦理延期換證手續(xù)。

（6）自理報(bào)檢單位接受檢驗(yàn)檢疫機(jī)構(gòu)的監(jiān)督管理，遵守屬地管理原則，在其工商注冊(cè)所在地檢驗(yàn)檢疫機(jī)構(gòu)辦理備案登記手續(xù)。（7）自理報(bào)檢單位需要終止備案登記的，以書面形式向原備案登記的檢驗(yàn)檢疫機(jī)構(gòu)辦理注銷手續(xù)，經(jīng)審核后予以注銷。（8）已經(jīng)在工商注冊(cè)所在地檢驗(yàn)檢疫機(jī)構(gòu)備案登記的自理報(bào)檢單位及其已經(jīng)注冊(cè)的報(bào)檢員，前往注冊(cè)地以外報(bào)檢時(shí)，檢驗(yàn)檢疫機(jī)構(gòu)核實(shí)其提供的自理報(bào)檢單位備案登記信息后予以受理，并按照有關(guān)規(guī)定進(jìn)行管理，自理報(bào)檢單位無需在異地辦理備案登記和報(bào)檢員注冊(cè)手續(xù)。3.TheInformationModificationofSelf-serviceInspectionUnitTheself-serviceinspectionunitsthathaveinformationchangesshouldchangeinformationtimelytoensuretheaccuracyofthefilingandregistrationinformation.Ifthenameofself-serviceinspectionunit,registrationaddress,natureoftheenterprise,legalrepresentative,inspectionstaff,placeofbusiness,registeredcapital,telephonenumber,faxnumber,E-mailaddress,contactpersonandpostalcodehavechanged,inspectionandquarantineinstitutionhandlesinformationchangeproceduresaccordingtotheapplicationsubmittedbyself-serviceinspectionunits.Ifthename,addressandlegalrepresentativeofself-serviceinspectionunithavechanged,inspectionandquarantineinstitutionshouldissue“thefilingandregistrationcertificateofself-serviceinspectionunit”again.3.自理報(bào)檢單位的信息變更自理報(bào)檢單位備案登記的信息有變動(dòng)的，應(yīng)及時(shí)更改，以確保其備案登記信息的準(zhǔn)確性。自理報(bào)檢單位的名稱、注冊(cè)地址、企業(yè)性質(zhì)、法定代表人、報(bào)檢員、營業(yè)場(chǎng)所、注冊(cè)資金、電話號(hào)碼、傳真號(hào)碼、電子信箱、聯(lián)系人、郵政編碼等內(nèi)容有更改的，檢驗(yàn)檢疫機(jī)構(gòu)根據(jù)自理報(bào)檢單位提出的更改申請(qǐng)及時(shí)辦理信息變更手續(xù)。自理報(bào)檢單位名稱、地址、法定代表人有更改的，檢驗(yàn)檢疫機(jī)構(gòu)重新頒發(fā)“自理報(bào)檢單位備案登記證明書”。4.RightsandObligationsofSelf-serviceInspectionUnit（1）Rights：①Basedoninspectionandquarantinelaws,theunitcangothroughinspectionanddeclarationformalitiesofentry&exitgoods,staff,meansoftransport,animalsandplants,andtheirproductsaccordingtothelaw.Otherrelatedproceduresarealsoincluded.②TheunithastherighttorequestinspectionandquarantineinstitutionstocompleteinspectionandquarantineworkwithininspectionandquarantineperiodasstipulatedbyAQSIQ,andissuetheproofdocumentafterhandlinginspectionandprovidingeveryconditionofsampling,inspectionandquarantine.③Iftheself-serviceinspectionunithasobjectiontotheinspectionandquarantineresultsmadebyinspectionandquarantineinstitutions,ithastherighttoapplytooriginalinspectionandquarantineinstitutionsorsuperiorinstitutionsandevenAQSIQforreinspectionwithinthestipulatedtime.④Theself-serviceinspectionunithastherighttorequireinspectionandquarantineinstitutionanditsstafftokeepsecret,whentheunitprovidesrelevantcommercialandshippingdocumentsinconfidentialcircumstances.⑤Theself-serviceinspectionunithastherighttochargeandaccuseinspectionandquarantineinstitutionanditsstaffofanyactivitythatviolateslawsorregulations.4.自理報(bào)檢單位的權(quán)利和義務(wù)（1）權(quán)利：①根據(jù)檢驗(yàn)檢疫法律規(guī)定，依法辦理出入境貨物、人員、運(yùn)輸工具、動(dòng)植物及其產(chǎn)品等與其相關(guān)的報(bào)檢/申報(bào)手續(xù)。②按有關(guān)規(guī)定辦理報(bào)檢并提供抽樣、檢驗(yàn)檢疫的各種條件后，有權(quán)要求檢驗(yàn)檢疫機(jī)構(gòu)在國家質(zhì)檢總局統(tǒng)一規(guī)定的檢驗(yàn)檢疫期限內(nèi)完成檢驗(yàn)檢疫工作，并出具證明文件。③自理報(bào)檢單位對(duì)檢驗(yàn)檢疫機(jī)構(gòu)的檢驗(yàn)檢疫結(jié)果有異議的，有權(quán)在規(guī)定的期限內(nèi)向原檢驗(yàn)檢疫機(jī)構(gòu)或其上級(jí)檢驗(yàn)檢疫機(jī)構(gòu)以至國家質(zhì)檢總局申請(qǐng)復(fù)驗(yàn)。④自理報(bào)檢單位在保密情況下提供有關(guān)商業(yè)及運(yùn)輸單據(jù)時(shí)，有權(quán)要求檢驗(yàn)檢疫機(jī)構(gòu)及其工作人員予以保密。⑤自理報(bào)檢單位有權(quán)對(duì)檢驗(yàn)檢疫機(jī)構(gòu)及其工作人員的違法、違紀(jì)行為進(jìn)行控告、檢舉。（2）Obligations①Theunitshouldcomplywithrelevantstatelaws,regulationsandinspectionandquarantinerules,andberesponsiblefortheauthenticityofinspection.②Theself-serviceinspectionunitshouldselectinspectionstaffaccordingtotherequirementsofinspectionandquarantineinstitutions.Inspectionstaffshouldgothroughinspectionformalitieswith“thequalificationcertificateofinspectionapplier”issuedbyinspectionandquarantineinstitutions.Theself-serviceinspectionunitshouldstrengthenthemanagementofitsinspectionstaffandbearlegalresponsibilitiesfortheirinspectionconduct.③Theunitshouldprovidecorrect,complete,legalandvaliddocuments,andfillinthedeclarationformcompletely,accuratelyandclearly.Itshouldhandletheinspectionmattersintheprescribedplacewithinthespecifiedtime.④Aftergoingthroughinspectionprocedures,theself-serviceinspectionunitshouldcontactwithinspectionandquarantineinstitutionsasrequired,andassisttheirstafftohandlespotinspection,drawsamples,andalsoimplementsupervisionaswellasotherrelevantrequirementsproposedbyinspectionandquarantineinstitutions.⑤Theunitshouldstrengthenthebatchmanagementofexportedgoodsthathavepassedinspectionandbeenreleased.Wrongdelivery,wrongshipping,missingdeliveryisnotpermittedincasethatdocumentsandgoodsdonotconformwitheachother;theentrygoodswithoutinspectionandquarantineverificationorpermissioncannotbesold,used,unloadedordelivered.⑥Theunitshouldpayinspectionandquarantinefeeswhenapplyingforinspectionandquarantineandappraisal.（2）義務(wù)：①遵守國家有關(guān)法律法規(guī)和檢驗(yàn)檢疫規(guī)章，對(duì)所報(bào)檢的真實(shí)性負(fù)責(zé)。②自理報(bào)檢單位應(yīng)當(dāng)按檢驗(yàn)檢疫機(jī)構(gòu)的要求選用報(bào)檢員，由報(bào)檢員憑檢驗(yàn)檢疫機(jī)構(gòu)核發(fā)的“報(bào)檢員證”辦理報(bào)檢手續(xù)。自理報(bào)檢單位應(yīng)加強(qiáng)對(duì)本單位報(bào)檢員的管理并對(duì)報(bào)檢員的報(bào)檢行為承擔(dān)法律責(zé)任。③提供正確、齊全、合法、有效的證單，完整、準(zhǔn)確、清楚地填制報(bào)檢單，并在規(guī)定的時(shí)間和地點(diǎn)辦理報(bào)檢手續(xù)。④自理報(bào)檢單位在辦理報(bào)檢手續(xù)以后，應(yīng)該按照要求及時(shí)與檢驗(yàn)檢疫機(jī)構(gòu)聯(lián)系，協(xié)助檢驗(yàn)檢疫工作人員進(jìn)行現(xiàn)場(chǎng)檢驗(yàn)檢疫、抽（采）樣及檢驗(yàn)檢疫處理等事宜，并落實(shí)檢驗(yàn)檢疫機(jī)構(gòu)提出的檢驗(yàn)檢疫監(jiān)管及有關(guān)要求。⑤對(duì)已經(jīng)檢驗(yàn)檢疫合格放行的出口貨物應(yīng)加強(qiáng)批次管理，不得錯(cuò)發(fā)、錯(cuò)運(yùn)、漏發(fā)，以免造成貨證不符；對(duì)入境貨物，未經(jīng)檢驗(yàn)檢疫合格或許可，不得銷售、使用或拆卸、運(yùn)遞。⑥申請(qǐng)檢驗(yàn)檢疫、鑒定等工作時(shí)，應(yīng)該按照規(guī)定繳納檢驗(yàn)檢疫費(fèi)。Ⅲ.SubstitutedInspectionAgencyThesubstitutedinspectionagencyistheenterpriselegalpersoninsidetheterritoryofChina,whohasbeenregisteredandputonrecordintheindustrialandcommercialadministrationdepartments,aswellasinspectionandquarantineinstitutionsandlegallyacceptstheentrustmentfromrelevantpartiestohandleinspectionanddeclarationforthem..Substitutedinspectionreferstotheinspectionactthatthesubstitutedinspectionagencyhandlestheentryandexitinspectionandquarantineproceduresforrelevanttradepartiesontherelevanttradepartiesoftheirentrustment.Itisalsoknownassubstitutedinspectionact.Thesubstitutedinspectionisdividedintodirectandindirectsubstitutedinspection三、代理報(bào)檢單位代理報(bào)檢單位，是指經(jīng)檢驗(yàn)檢疫機(jī)構(gòu)注冊(cè)登記，依法接受有關(guān)關(guān)系人委托，為有關(guān)關(guān)系人辦理報(bào)檢/申報(bào)業(yè)務(wù)，在工商行政管理部門注冊(cè)登記的境內(nèi)企業(yè)法人。代理報(bào)檢是指代理報(bào)檢單位接受有關(guān)貿(mào)易關(guān)系人委托，為有關(guān)貿(mào)易關(guān)系人辦理出入境檢驗(yàn)檢疫手續(xù)的報(bào)檢行為，也稱代理報(bào)檢行為。代理報(bào)檢分為直接代理報(bào)檢和間接代理報(bào)檢。

（5）Othermattersrelatedtoinspectionandquarantine.1.代理報(bào)檢單位的范圍（1）辦理報(bào)檢手續(xù)。（2）繳納檢驗(yàn)檢疫費(fèi)用。（3）聯(lián)系和配合出入境檢驗(yàn)檢疫機(jī)構(gòu)實(shí)施檢驗(yàn)檢疫。（4）領(lǐng)取檢驗(yàn)檢疫證單和通關(guān)證明。（5）其他與檢驗(yàn)檢疫相關(guān)的事宜。

2.RegistrationofSubstitutedInspectionUnit

（1）AQSIQcarriesoutregistrationsystemwithinallsubstitutedquarantineunitswhomustget“RegistrationCertificateforSubstitutedInspectionUnits”beforeengaginginaspecifiedrangeofinspectionbusinessinthepermittedinspectionarea.Theinspectionandquarantineinstitutionsineachareashallnotacceptinspectionbusinessofinspectionandquarantineunitswithoutregistration.

（2）AQSIQshalluniformlyadministertheregistrationofsubstitutedinspectionunitsacrossthecountry,andberesponsibleforthesupervisionforregistrationwork.TheinspectionandquarantinebureausdirectlyundertheAQSIQareresponsibleforregistrationacceptanceandpreliminaryverificationofsubstitutedinspectionunitswithinitsjurisdiction,andimplementadministrativelicensingaccordingtoapprovalopinionsofAQSIQ.Theinspectionandquarantineinstitutionsatallplacestakechargeofdailysupervisionandmanagementworkofregistrationofsubstitutedinspectionunits.（3）Theapplicationsofsubstitutedquarantineunitsaregenerallyacceptedonceortwiceeachyear,foronemonthforeachtime.ThespecificacceptancetimewouldbeannouncedbyAQSIQonemonthinadvance.

（4）Thesubstitutedinspectionunitsshouldmeetthefollowingconditionsuponregistration：①Obtainthe“businesslicenseforenterpriselegalperson”issuedbydepartmentforindustryandcommerce,andthebusinessscopeofthislicenseexplicitlyclarifiesthesubstitutedinspectionorrelatedoperationrights;②RegisteredcapitalshavemorethanonemillionYuan;③Haveafixedbusinesssiteandthefacilitiesforhandlingthebusinessofinspectionandquarantine.④Thesoundandeffectiveinternalmanagementsystemshouldbeestablished;⑤Havenolessthanfivepersonswhohavepassedtheexaminationofinspectionandquarantineinstitutionsandobtained“qualificationcertificateofinspectionappliers”,andsignlegal“l(fā)aborcontract”witheachinspectionstaffaswellaspaysocialinsuranceforthem.

Branchcompanieswhoapplyforregistrationofsubstitutedinspectionunitsintheirownnameshouldget“businesslicense”,andmeettheaboverequirementsNo.③,No.④andNo.⑤.TheregistrationcapitalofitsparentcompanyshouldbemorethanonemillionYuan.

（5）Registrationofsubstitutedinspectionunitsadoptsthewayofonlineapplicationandwrittenconfirmation.Theapplicationunitsshouldapplytotheinspectionandquarantineinstitutionsinthelocalityofitsindustryandcommerceregistration.Thewrittenmaterialsthatapplicationunitsshouldsubmitinclude：“Theapplicantformforregistrationofsubstitutedentry-exitinspectionandquarantine”;enterprisestatement;Copiesof“businesslicenseofenterpriselegalperson”（theoriginalshallbesubmittedforverificationatthesametime）;“Copiesoforganizationorinstitutioncodecertificate”（theoriginalshallbesubmittedforverificationatthesametime）;Copiesof“qualificationcertificateofinspectionapplier”ofwould-beinspectionstaff（theoriginalshallbesubmittedforverificationatthesametime）;Thesamplesealmouldofapplicationunits;Copiesof“regulationsofenterprise”,stampedwithofficialsealsofapplicationunitsandfinal“copyofthequalificationverificationreport”,andtheoriginalshallbesubmittedforverificationatthesametime;Copiesof“l(fā)aborcontract”thatapplicationunitssignwiththeirwould-beinspectionstaff,stampedwithofficialseal,andtheoriginalshallbesubmittedforverificationatthesametime;Thecopiesandoriginalof“registrationcertificateforsocialinsurance”,andthedocumentsastheproofforapplicationunitstopaysocialinsuranceforeachinspectionstaff,whichareissuedorconfirmedbylaborandsocialsecuritydepartments;Copiesofmanagementsystemonsubstitutedquarantineoftheapplicationunits;otherdocumentsstipulatedbytheAQSIQtobesubmitted.2.代理報(bào)檢單位注冊(cè)登記（1）國家質(zhì)檢總局對(duì)代理報(bào)檢單位實(shí)行注冊(cè)登記制度，必須在取得“代理報(bào)檢單位注冊(cè)登記許可證書”以后，方可在許可的報(bào)檢區(qū)域內(nèi)從事指定范圍的代理報(bào)檢業(yè)務(wù)，各地檢驗(yàn)檢疫機(jī)構(gòu)不受理未經(jīng)注冊(cè)登記的報(bào)檢單位的報(bào)檢業(yè)務(wù)。（2）國家質(zhì)檢總局統(tǒng)一管理全國代理報(bào)檢單位的注冊(cè)登記工作，對(duì)代理報(bào)檢單位注冊(cè)登記工作進(jìn)行監(jiān)督。各直屬檢驗(yàn)檢疫局負(fù)責(zé)所轄地區(qū)代理報(bào)檢單位注冊(cè)登記的受理和初審工作，并根據(jù)國家質(zhì)檢總局的審批意見實(shí)行行政許可。各地檢驗(yàn)檢疫機(jī)構(gòu)負(fù)責(zé)代理報(bào)檢單位注冊(cè)登記的日常監(jiān)督管理工作。（3）代理報(bào)檢單位注冊(cè)登記申請(qǐng)一般每年受理一至兩次，每次時(shí)間為一個(gè)月，具體受理時(shí)間由國家質(zhì)檢總局提前一個(gè)月對(duì)外公布。（4）代理報(bào)檢單位注冊(cè)登記時(shí)應(yīng)具備下列條件：①取得工商行政管理部門頒發(fā)的“企業(yè)法人營業(yè)執(zhí)照”，該執(zhí)照經(jīng)營范圍中列明有代理報(bào)檢或與之相關(guān)的經(jīng)營權(quán)；②注冊(cè)資金在100萬元人民幣以上；③有固定的工作場(chǎng)所及開展報(bào)檢業(yè)務(wù)所需要的條件和設(shè)施；④建立健全的行之有效的內(nèi)部管理制度；⑤擁有不少于5名經(jīng)檢驗(yàn)檢疫機(jī)構(gòu)考試合格并取得“報(bào)檢員資格證”的人員，并與每個(gè)報(bào)檢員簽訂合法的勞動(dòng)合同，并為每個(gè)報(bào)檢員繳納社會(huì)保險(xiǎn)。分公司以自己的名義申請(qǐng)代理報(bào)檢企業(yè)注冊(cè)登記的，應(yīng)當(dāng)取得營業(yè)執(zhí)照，具備前款第③④⑤項(xiàng)要求的條件，且總公司注冊(cè)資金在人民幣100萬元以上。（5）代理報(bào)檢單位注冊(cè)登記實(shí)行網(wǎng)上申請(qǐng)、書面確認(rèn)的方式，申請(qǐng)單位須向工商注冊(cè)所在地的直屬檢驗(yàn)檢疫局申請(qǐng)，申請(qǐng)單位應(yīng)提交的書面材料：①“代理出入境檢驗(yàn)檢疫報(bào)檢單位注冊(cè)登記申請(qǐng)書”；②企業(yè)聲明；③“企業(yè)法人營業(yè)執(zhí)照”復(fù)印件（同時(shí)交驗(yàn)副本原件）；④“組織機(jī)構(gòu)代碼證”復(fù)印件（同時(shí)交驗(yàn)正本）；⑤擬任報(bào)檢員的“報(bào)檢員資格證”復(fù)印件（同時(shí)交驗(yàn)正本）；⑥申請(qǐng)單位的印章印模；⑦加蓋有申請(qǐng)單位公章的“公司章程”復(fù)印件和最后一次“驗(yàn)資報(bào)告復(fù)印件”，同時(shí)交驗(yàn)原件；⑧申請(qǐng)單位與其擬任報(bào)檢員簽訂的“勞動(dòng)合同”復(fù)印件，同時(shí)交驗(yàn)原件，且復(fù)印件加蓋公章；⑨“社會(huì)保險(xiǎn)登記證”復(fù)印件及其原件，以及由勞動(dòng)和社會(huì)保障部門出具或者確認(rèn)的申請(qǐng)單位為每個(gè)報(bào)檢員繳納社會(huì)保險(xiǎn)的證明文件；⑩申請(qǐng)單位有關(guān)代理報(bào)檢的管理制度的復(fù)印件；11國家質(zhì)檢總局規(guī)定需要的其他文件。3.SupervisionandAdministrationofSubstitutedInspectionUnits （1）TheInformationModificationofSubstitutedInspectionUnitIncaseofanymodificationwithasubstitutedinspectionunit'sname,address,legalrepresentative,businessscopeorothermajorissues,theagencyshall,within15daysasofthemodification,applytotheinspectionandquarantinebureaudirectlyundertheAQSIQatitslocalityandgothroughtheinformationmodificationformalities.Thesubstitutedquarantineunitwhochangesregistrationinformationwithoutpermissionbearsthelegalresponsibilityandconsequenceforitsbehaviors.（2）RoutineVerificationofSubstitutedQuarantineUnitsTheinspectionandquarantineinstitutionsimplementtheroutineverificationsystemwithinsubstitutedquarantineunitseverytwoyears.EachsubstitutedinspectionunitshallapplytotheinspectionandquarantinebureauatitslocalityforroutineverificationfromMarch1sttoMarch31stintheverificationyearandsubmitthe"RoutineVerificationReport"oflastyear.InspectionandquarantineinstitutionsshouldfinishitsroutineverificationbeforeMay31stinthatyear.Subordinateinspectionandquarantinebureausconductvariousformsofreviewontheauthenticityandsubstantivecontentsoftheverifiedmaterials.Theformsincludeon-sitecheck,spottingreview,discussions,issuanceofquestionnairesandsoon.Thecontentverifiedincludesregisteredcapital,thenumberofinspectionstaff,operationsite,conditionsrequiredforsubstitutedquarantinebusiness,annualsubstitutedquarantinebusiness,inspectionerrors,theinformationonabidancebytheadministrativeprovisionsforsubstitutedinspectionunitsaswellasinspectionandquarantineregulationsandlaws,andfeedbackfromrelevantentrusters.3.代理報(bào)檢單位監(jiān)督管理（1）代理報(bào)檢單位的信息變更代理報(bào)檢單位的名稱、地址、法定代表人、非法人企業(yè)的負(fù)責(zé)人、經(jīng)營范圍等重大事項(xiàng)發(fā)生變更的，應(yīng)當(dāng)在變更之日起30日內(nèi)辦理信息更改手續(xù)，向直屬檢驗(yàn)檢疫局申請(qǐng)變更。代理報(bào)檢單位隨意更改注冊(cè)信息的，產(chǎn)生的法律責(zé)任和后果由代理報(bào)檢單位承擔(dān)。（2）代理報(bào)檢單位例行審核檢驗(yàn)檢疫機(jī)構(gòu)每2年對(duì)代理報(bào)檢單位實(shí)行一次例行審核制度，代理報(bào)檢單位應(yīng)當(dāng)在審核年度的3月1日至3月31日向所在地檢驗(yàn)檢疫機(jī)構(gòu)申請(qǐng)例行審核，提交上2年度的《例行審核報(bào)告書》。檢驗(yàn)檢疫機(jī)構(gòu)應(yīng)當(dāng)在當(dāng)年的5月31日前完成代理報(bào)檢企業(yè)的例行審核。直屬檢驗(yàn)檢疫局對(duì)例行審核材料的真實(shí)性及實(shí)質(zhì)性內(nèi)容進(jìn)行包括現(xiàn)場(chǎng)核查、實(shí)地檢查、座談會(huì)、發(fā)放調(diào)查表等多種形式的審查。審查內(nèi)容包括注冊(cè)資金、報(bào)檢員人數(shù)、經(jīng)營場(chǎng)所及辦理檢驗(yàn)檢疫代理業(yè)務(wù)所需要的條件，年度代理報(bào)檢業(yè)務(wù)及報(bào)檢差錯(cuò)情況，遵守代理報(bào)檢單位管理規(guī)定情況，遵守檢驗(yàn)檢疫法律法規(guī)情況，有關(guān)委托人的反映等。4.ClassificationManagementofSubstitutedInspectionUnit’sCreditRatingsTheevaluationofsubstitutedquarantineunits’creditratingsisonthebasisoftheinformationonabidancebylawsandregulationsindailysubstitutedquarantinebusinessaswellasitsperformanceonobligationfulfillment,gradingsystemisadoptedhere.Accordingtogradingresultsandadditionalconditions,itisdividedintofourlevels,namelyA,B,C,andD.ForsubstitutedquarantineunitsofLevelAandLevelB,differentdegreesofconvenientcustomsclearancemeasuresandloosemanagementmeasurescanbeprovidedtothem;forLevelCandD,themeasuresofreinforcedmanagementcanbeseparatelyadoptedsuchastightenedsupervision,drawingupblacklistandsoon.4.代理報(bào)檢單位信用等級(jí)分類管理代理報(bào)檢單位信用等級(jí)評(píng)定以代理報(bào)檢單位在日常代理報(bào)檢業(yè)務(wù)中遵守法律法規(guī)、履行代理報(bào)檢職責(zé)的情況為依據(jù)，實(shí)行評(píng)分制度，并根據(jù)評(píng)分的結(jié)果及附加條件確定A、B、C、D四個(gè)等級(jí)。對(duì)于A級(jí)、B級(jí)的代理報(bào)檢單位，可給予不同程度的便利通關(guān)措施和寬松的管理措施；對(duì)于C級(jí)、D級(jí)的代理報(bào)檢單位，可以分別采取嚴(yán)加監(jiān)管、列入“黑名單”等強(qiáng)化管理措施。5.RightsandObligationsofSubstitutedQuarantineUnitRights：（1）Aftertheregistrationofsubstitutedquarantineunitsislicensed,itsinspectionstaffwhohaveregisteredatinspectionandquarantineinstitutionsandobtained“thequalificationcertificateofinspectionapplier”cangothroughsubstitutedquarantinebusinesswithininspectionandquarantineinstitutionsintheapprovedsubstitutedquarantineareas,butthenamecannotbelenttoothersfordealingwithinspectionbusiness.（2）Exceptforthosespecialrules,substitutedquarantineunithasrightstoactasanagentforentry-exitinspectionandquarantinemattersthattheconsignorsentrust.（3）Theconsigneeofimportgoodscanentrustinspectiontosubstitutedquarantineunitsintheplaceofcustomsdeclarationorplaceofreceipt.Theconsignorofexportgoodscanentrustinspectiontosubstitutedquarantineunitsintheplaceoforiginorcustomsdeclaration.（4）TheunithastherighttorequestinspectionandquarantineinstitutionstocompleteinspectionandquarantineworkwithininspectionandquarantineperiodasstipulatedbyAQSIQ,andissuetheproofdocumentsafterhandlinginspectionandprovidingeveryconditionofsampling,inspectionandquarantine.（5）Ifthesubstitutedquarantineunithasobjectiontotheinspectionandquarantineresultsmadebyinspectionandquarantineinstitutions,ithastherighttoapplytooriginalinspectionandquarantineinstitutionsorsuperiorinstitutionsandevenAQSIQforreinspectionwithinthestipulatedtime.（6）Thesubstitutedquarantineunithastherighttorequireinspectionandquarantineinstitutionanditsstafftokeepsecret,whentheunitprovidesrelevantcommercialandshippingdocumentsinconfidentialcircumstances.（7）Thesubstitutedquarantineunithastherighttochargeandaccuseinspectionandquarantineinstitutionanditsstaffofanyactivitythatviolateslawsorregulations.

5.代理報(bào)檢單位的權(quán)利、義務(wù)權(quán)利：（1）代理報(bào)檢單位被許可登記注冊(cè)后，有權(quán)在批準(zhǔn)的代理報(bào)檢區(qū)域內(nèi)由其在檢驗(yàn)檢疫機(jī)構(gòu)注冊(cè)并持有“報(bào)檢員證”的報(bào)檢員向檢驗(yàn)檢疫機(jī)構(gòu)辦理代理報(bào)檢業(yè)務(wù)，但不得出借名號(hào)供他人辦理報(bào)檢業(yè)務(wù)。（2）除另有規(guī)定外，代理報(bào)檢單位有權(quán)代理委托人委托的出入境檢驗(yàn)檢疫報(bào)檢業(yè)務(wù)。（3）進(jìn)口貨物的收貨人可以在報(bào)關(guān)地或收貨地委托代理報(bào)檢單位報(bào)檢，出口貨物發(fā)貨人可以在產(chǎn)地或報(bào)關(guān)地委托代理報(bào)檢單位報(bào)檢。（4）按照有關(guān)規(guī)定代理報(bào)檢，并提供抽樣、檢驗(yàn)檢疫的各種條件后，有權(quán)要求檢驗(yàn)檢疫機(jī)構(gòu)在質(zhì)檢總局規(guī)定的期限內(nèi)完成檢驗(yàn)檢疫工作，并出具證明文件。（5）代理報(bào)檢單位對(duì)檢驗(yàn)檢疫機(jī)構(gòu)的檢驗(yàn)檢疫結(jié)果有異議的，有權(quán)在規(guī)定的期限內(nèi)向原檢驗(yàn)檢疫機(jī)構(gòu)或其上級(jí)檢驗(yàn)檢疫機(jī)構(gòu)乃至國家質(zhì)檢總局申請(qǐng)復(fù)驗(yàn)。（6）代理報(bào)檢單位在保密情況下提供有關(guān)商業(yè)
