房屋租賃合同甲方(出租方):姓名:______________________身份證號(hào)碼:________________聯(lián)系地址:________________聯(lián)系電話:________________乙方(承租方):姓名:______________________身份證號(hào)碼:________________聯(lián)系地址:________________聯(lián)系電話:________________鑒于甲方擁有一套位于[房屋詳細(xì)地址](以下簡(jiǎn)稱“該房屋”)的房產(chǎn),并愿意將其出租給乙方使用;乙方希望租賃該房屋并愿意按照本合同約定支付租金及其他費(fèi)用。雙方經(jīng)友好協(xié)商,根據(jù)《中華人民共和國(guó)民法典》及相關(guān)法律法規(guī)的規(guī)定,達(dá)成如下協(xié)議:一、租賃房屋及用途1.甲方將上述該房屋出租給乙方使用,建筑面積為[X]平方米。2.乙方租賃該房屋僅作為[居住/辦公]用途使用,未經(jīng)甲方書面同意,乙方不得擅自改變?cè)摲课莸挠猛?。二、租賃期限1.本合同租賃期自[起始日期]起至[結(jié)束日期]止,共計(jì)[X]個(gè)月。2.租賃期滿,乙方應(yīng)如期交還該房屋。如乙方續(xù)租,須在租賃期滿前[X]個(gè)月書面通知甲方,經(jīng)甲方同意后,重新簽訂租賃合同。在同等條件下,乙方享有優(yōu)先續(xù)租權(quán)。三、租金及押金1.該房屋租金為每月人民幣[X]元(大寫:[大寫金額])。租金支付方式為[支付周期,如每月/每季度]支付一次,乙方應(yīng)在每個(gè)支付周期開(kāi)始前[X]天向甲方支付租金。2.乙方應(yīng)向甲方支付人民幣[X]元(大寫:[大寫金額])作為押金。租賃期滿或合同解除后,扣除應(yīng)由乙方承擔(dān)的費(fèi)用后,押金應(yīng)無(wú)息退還給乙方。四、其他費(fèi)用1.乙方在租賃期間需自行承擔(dān)因使用該房屋產(chǎn)生的水、電、燃?xì)?、物業(yè)、網(wǎng)絡(luò)、電話等費(fèi)用,并按時(shí)向相關(guān)部門繳納。2.甲方應(yīng)確保該房屋及其附屬設(shè)施在交付時(shí)處于正常使用狀態(tài)。租賃期間,該房屋及其附屬設(shè)施的自然損壞由甲方負(fù)責(zé)維修;因乙方使用不當(dāng)或人為造成的損壞,由乙方負(fù)責(zé)修復(fù)或賠償。五、雙方權(quán)利與義務(wù)1.甲方權(quán)利與義務(wù)-甲方有權(quán)按照本合同約定收取租金及押金。-甲方應(yīng)保證乙方在租賃期間對(duì)該房屋的正常使用,不得無(wú)故干擾乙方的生活或經(jīng)營(yíng)活動(dòng)。-甲方應(yīng)按照合同約定負(fù)責(zé)該房屋及其附屬設(shè)施的維修維護(hù),但乙方使用不當(dāng)或人為造成的損壞除外。2.乙方權(quán)利與義務(wù)-乙方有權(quán)在租賃期間按照約定使用該房屋及其附屬設(shè)施。-乙方應(yīng)按照合同約定按時(shí)支付租金及其他費(fèi)用。-未經(jīng)甲方書面同意,乙方不得將該房屋轉(zhuǎn)租給他人。-乙方應(yīng)愛(ài)護(hù)該房屋及其附屬設(shè)施,不得擅自改變房屋結(jié)構(gòu)或損壞房屋及附屬設(shè)施。如需對(duì)房屋進(jìn)行裝修或增設(shè)附屬設(shè)施,須事先征得甲方書面同意,并在租賃期滿或合同解除時(shí)按照原狀恢復(fù)或經(jīng)甲方同意后處置。六、合同的解除1.經(jīng)甲乙雙方協(xié)商一致,可以提前解除本合同。2.因不可抗力因素導(dǎo)致該房屋損壞或滅失,致使本合同無(wú)法繼續(xù)履行的,雙方可協(xié)商解除合同,且互不承擔(dān)責(zé)任。3.乙方有下列情形之一的,甲方有權(quán)單方解除合同,并要求乙方賠償損失:-未經(jīng)甲方書面同意,擅自改變房屋用途的;-未經(jīng)甲方書面同意,擅自將房屋轉(zhuǎn)租給他人的;-拖欠租金或其他費(fèi)用累計(jì)達(dá)[X]天以上的;-損壞房屋及其附屬設(shè)施,且拒絕修復(fù)或賠償?shù)?。七、違約責(zé)任1.若甲方未按照合同約定履行義務(wù),導(dǎo)致乙方無(wú)法正常使用該房屋的,應(yīng)按照租金的[X]%向乙方支付違約金,并賠償乙方因此遭受的損失。2.若乙方未按照合同約定支付租金或其他費(fèi)用,每逾期一天,應(yīng)按照未支付金額的[X]%向甲方支付違約金。逾期超過(guò)[X]天的,甲方有權(quán)解除合同,并要求乙方支付應(yīng)付未付的租金、費(fèi)用及違約金。3.如因一方違約導(dǎo)致合同提前解除的,違約方應(yīng)向?qū)Ψ街Ц断喈?dāng)于[X]個(gè)月租金的違約金,并賠償對(duì)方因此遭受的損失。八、爭(zhēng)議解決本合同在履行過(guò)程中如發(fā)生爭(zhēng)議,雙方應(yīng)首先友好協(xié)商解決;協(xié)商不成的,任何一方均有權(quán)向房屋所在地有管轄權(quán)的人民法院提起訴訟。九、其他條款1.本合同未盡事宜,可由雙方協(xié)商后簽訂補(bǔ)充協(xié)議,補(bǔ)充協(xié)議與本合同具有同等法律效力。2.本合同一式兩份,甲乙雙方各執(zhí)一份,自雙方簽字(或蓋章)之日起生效。甲方(簽字/蓋章):____________________日期:______年____月____日乙方(簽字/蓋章):____________________日期:______年____月____日HOUSELEASECONTRACTLessor(PartyA):Name:______________________IDNumber:________________ContactAddress:________________ContactPhone:________________Lessee(PartyB):Name:______________________IDNumber:________________ContactAddress:________________ContactPhone:________________WHEREASPartyAownsapropertylocatedat[DetailedAddressofthePremises](hereinafterreferredtoas"thePremises")andiswillingtoleaseittoPartyBforuse;andPartyBwishestoleasethePremisesandiswillingtopaytherentandotherexpensesinaccordancewiththiscontract.Afterfriendlyconsultations,inaccordancewiththeprovisionsofthe"CivilCodeofthePeople'sRepublicofChina"andrelevantlawsandregulations,thetwopartieshavereachedthefollowingagreement:1.LeasedPremisesandUse1.PartyAleasestheabove-mentionedPremisestoPartyBforuse,withafloorareaof[X]squaremeters.2.PartyBshallusethePremisesonlyfor[residential/office]purposes.WithoutthepriorwrittenconsentofPartyA,PartyBshallnotchangetheuseofthePremiseswithoutauthorization.2.LeaseTerm1.Theleasetermofthiscontractshallcommenceon[StartDate]andendon[EndDate],foratotalof[X]months.2.Attheexpirationoftheleaseterm,PartyBshallreturnthePremisesonschedule.IfPartyBwishestorenewthelease,itmustnotifyPartyAinwriting[X]monthsbeforetheexpirationoftheleaseterm.AfterobtainingPartyA'sconsent,anewleasecontractshallbesigned.Underthesameconditions,PartyBshallhavetherightoffirstrefusaltorenewthelease.3.RentandDeposit1.TherentforthePremisesisRMB[X]permonth(inwords:[FullAmountinChineseCharacters]).Therentshallbepaid[PaymentCycle,suchasmonthly/quarterly].PartyBshallpaytherenttoPartyA[X]daysbeforethestartofeachpaymentcycle.2.PartyBshallpayPartyAadepositofRMB[X](inwords:[FullAmountinChineseCharacters]).Aftertheexpirationoftheleasetermortheterminationofthecontract,thedepositshallberefundedtoPartyBwithoutinterestafterdeductingtheexpensesthatshouldbebornebyPartyB.4.OtherExpenses1.Duringtheleaseterm,PartyBshallbeartheexpensesforwater,electricity,gas,propertymanagement,Internet,telephone,etc.arisingfromtheuseofthePremisesandpaythemtotherelevantdepartmentsontime.2.PartyAshallensurethatthePremisesanditsauxiliaryfacilitiesareinanormalusableconditionatthetimeofdelivery.Duringtheleaseterm,PartyAshallberesponsiblefortherepairofnaturaldamagestothePremisesanditsauxiliaryfacilities;damagescausedbyPartyB'simproperuseorhumanfactorsshallberepairedorcompensatedbyPartyB.5.RightsandObligationsofBothParties1.RightsandObligationsofPartyA-PartyAhastherighttocollecttherentanddepositinaccordancewiththiscontract.-PartyAshallensurePartyB'snormaluseofthePremisesduringtheleasetermandshallnotinterferewithPartyB'slifeorbusinessactivitieswithoutjustifiablereasons.-PartyAshallberesponsiblefortherepairandmaintenanceofthePremisesanditsauxiliaryfacilitiesinaccordancewiththecontract,exceptfordamagescausedbyPartyB'simproperuseorhumanfactors.2.RightsandObligationsofPartyB-PartyBhastherighttousethePremisesanditsauxiliaryfacilitiesinaccordancewiththeagreementduringtheleaseterm.-PartyBshallpaytherentandotherexpensesontimeinaccordancewiththecontract.-WithoutthepriorwrittenconsentofPartyA,PartyBshallnotsubleasethePremisestoothers.-PartyBshalltakegoodcareofthePremisesanditsauxiliaryfacilitiesandshallnotchangethestructureofthePremisesordamagethePremisesanditsauxiliaryfacilitieswithoutauthorization.IfPartyBneedstodecoratethePremisesoraddauxiliaryfacilities,itmustobtainPartyA'spriorwrittenconsentandrestorethemtotheiroriginalstateattheexpirationoftheleasetermorupontheterminationofthecontract,ordisposeofthemwithPartyA'sconsent.6.TerminationoftheContract1.Thetwopartiesmayterminatethiscontractinadvancethroughmutualagreement.2.IfthePremisesaredamagedordestroyedduetoforcemajeure,makingitimpossibletocontinueperformingthiscontract,thetwopartiesmaynegotiatetoterminatethecontract,andneitherpartyshallbeliabletotheother.3.InanyofthefollowingcircumstancesofPartyB,PartyAhastherighttounilaterallyterminatethecontractanddemandcompensationfromPartyBforlosses:-ChangingtheuseofthePremiseswithoutthepriorwrittenconsentofPartyA;-SubleasingthePremisestootherswithoutthepriorwrittenconsentofPartyA;-Defaultingonrentorotherexpensesforacumulativeperiodof[X]daysormore;-DamagingthePremisesanditsauxiliaryfacilitiesandrefusingtorepairorcompensate.7.LiabilityforBreachofContract1.IfPartyAfailstoperformitsobligationsinaccordancewiththecontract,resultinginPartyB'sinabilitytousethePremisesnormally,PartyAshallpayPartyBliquidateddamagesequivalentto[X]%oftherentandcompensatePartyBforthelossessufferedthereby.2.IfPartyBfailstopaytherentorotherexpensesinaccordancewiththecontract,itshallpayPartyAliquidateddamagesatarateof[X]%oftheunpaidamountforeachdayofdelay.Ifthedelayexceeds[X]days,PartyAhastherighttoterminatethecontractanddemandthatPartyBpaytheunpaidrent,expensesandliquidateddamages.3.Ifthecontractisterminatedinadvanceduetothebreachofcontractbyoneparty,thebreachingpartyshallpaytheotherpartyliquidateddamagesequivalentto[X]months'rentandcompensatetheotherparty
