紐約租房英文合同范本NewYorkRentalAgreement一、合同雙方身份ThisRentalAgreement(the“Agreement”)ismadeandenteredintoasof[date]byandbetween:Landlord:Name:[Landlord'sfullname]Address:[Landlord'saddress]ContactInformation:[Phonenumber/Email]Tenant:Name:[Tenant'sfullname]Address:[Tenant'scurrentaddress]ContactInformation:[Phonenumber/Email]二、標的物或服務具體描述2.1RentalPropertyTheLandlordherebyleasestotheTenant,andtheTenantherebyleasesfromtheLandlord,thefollowingdescribedrealproperty(the“Property”):Address:[FulladdressoftherentalpropertyinNewYork,includingapartmentnumberifapplicable]Description:ThePropertyconsistsof[numberofbedrooms],[numberofbathrooms],anda[descriptionofothersignificantfeaturessuchasalivingroom,kitchen,etc.].ThePropertyisfurnishedwith[listoffurnitureandappliancesifapplicable],includingbutnotlimitedto[specificitems].2.2TermofLeaseThetermofthislease(the“LeaseTerm”)shallcommenceon[startdate]andshallendon[enddate].TheTenantshallhavetherighttooccupythePropertyduringtheLeaseTerm.三、權利義務3.1Landlord'sRightsandObligations3.1.1RightsTheLandlordhastherighttoreceiverentinaccordancewiththetermsofthisAgreement.TheLandlordhastherighttoenterthePropertyuponreasonablenotice(exceptincaseofemergency)forthepurposesofinspection,repair,orshowingthePropertytoprospectivebuyersortenants.TheLandlordhastherighttoenforcealltermsandconditionsofthisAgreementandtakeappropriatelegalactionincaseofTenant'sbreach.3.1.2ObligationsTheLandlordshallmaintainthePropertyinahabitablecondition,complyingwithallapplicablebuilding,health,andsafetycodes.Thisincludes,butisnotlimitedto,providingandmaintainingproperheating,plumbing,andelectricalsystems.TheLandlordshallmakenecessaryrepairsinatimelymanneruponnoticefromtheTenant,exceptfordamagescausedbytheTenant'snegligenceormisuse.TheLandlordshallnotinterferewiththeTenant'squietenjoymentoftheProperty.3.2Tenant'sRightsandObligations3.2.1RightsTheTenanthastherighttoquietenjoymentofthePropertyduringtheLeaseTerm,freefromunreasonableinterferencebytheLandlord.TheTenanthastherighttohavethePropertymaintainedinahabitableconditionasrequiredbylaw.3.2.2ObligationsTheTenantshallpayrentintheamountof[rentamount]onorbeforethe[duedate]ofeachmonth.Rentshallbepaidby[paymentmethod,e.g.,check,banktransfer]totheLandlordattheaddressspecifiedaboveorasotherwisedirectedbytheLandlord.TheTenantshallkeepthePropertycleanandsanitaryandshallnotcauseanydamagetotheProperty,exceptfornormalwearandtear.TheTenantshallnotmakeanyalterationsorimprovementstothePropertywithoutthepriorwrittenconsentoftheLandlord.TheTenantshallcomplywithallapplicablelaws,regulations,andrulesofthebuildingorcomplexwherethePropertyislocated.TheTenantshallnotsubletthePropertyorassignthisAgreementwithoutthepriorwrittenconsentoftheLandlord.四、RentandSecurityDeposit4.1RentTheTenantshallpayrentintheamountof[rentamount]permonth.Rentshallbedueonthe[duedate]ofeachmonth.Iftherentisnotpaidwithin[graceperiod]daysaftertheduedate,alatefeeof[latefeeamount]shallbecharged.4.2SecurityDepositTheTenantshallpayasecuritydepositintheamountof[securitydepositamount]totheLandlorduponsigningthisAgreement.ThesecuritydepositshallbeheldbytheLandlordassecurityfortheperformanceoftheTenant'sobligationsunderthisAgreement.AttheendoftheLeaseTerm,theLandlordshallreturnthesecuritydeposittotheTenant,lessanyamountreasonablywithheldfordamagestothePropertybeyondnormalwearandtear,unpaidrent,orotherchargesowedbytheTenant.TheLandlordshallprovidetheTenantwithanitemizedlistofdeductionswithin[numberofdays]daysaftertheendoftheLeaseTerm.五、UtilitiesandServices5.1UtilitiesTheTenantshallberesponsibleforpayingallutilitiesusedattheProperty,includingbutnotlimitedtoelectricity,gas,water,sewer,andtrashremoval.TheTenantshallarrangefortheconnectionofutilitiesintheTenant'snamepriortothestartoftheLeaseTerm.5.2ServicesTheLandlordshallberesponsibleforprovidingservicessuchas[listofservicesprovidedbythelandlord,e.g.,snowremoval,landscaping]asspecifiedinthisAgreement.IftheLandlordfailstoprovidetheseservices,theTenantmaynotifytheLandlordinwriting,andtheLandlordshallhave[numberofdays]daystocorrectthesituation.六、Insurance6.1Tenant'sInsuranceTheTenantisstronglyrecommendedtoobtainrenter'sinsurancetoprotecttheTenant'spersonalpropertyandprovideliabilitycoverage.TheTenantshallprovidetheLandlordwithproofofinsuranceuponrequest.6.2Landlord'sInsuranceTheLandlordshallmaintainpropertyinsuranceonthePropertytocoverdamageorlosstothebuildinganditsfixtures.TheLandlord'sinsuranceshallnotcovertheTenant'spersonalproperty.七、DefaultandRemedies7.1DefaultbyTenantIftheTenantfailstopayrent,violatesanyothermaterialtermofthisAgreement,orcausesdamagetothePropertybeyondnormalwearandtear,theTenantshallbeindefault.Incaseofdefault,theLandlordmay:SendawrittennoticetotheTenantspecifyingthedefaultandgivingtheTenant[numberofdays]daystocurethedefault.IftheTenantfailstocurethedefaultwithinthespecifiedtime,theLandlordmayterminatethisAgreementandevicttheTenantinaccordancewithapplicablelaw.TheLandlordmayalsorecoveralldamagessufferedasaresultoftheTenant'sdefault,includingunpaidrent,latefees,andthecostofrepairstotheProperty.7.2DefaultbyLandlordIftheLandlordfailstomaintainthePropertyinahabitableconditionorotherwisebreachesthisAgreement,theTenantmay:SendawrittennoticetotheLandlordspecifyingthebreachandgivingtheLandlord[numberofdays]daystocurethebreach.IftheLandlordfailstocurethebreachwithinthespecifiedtime,theTenantmayseeklegalremedies,includingbutnotlimitedtowithholdingrent,terminatingtheAgreement,orseekingdamagesforanyharmsufferedasaresultoftheLandlord'sbreach.八、AssignmentandSublettingTheTenantshallnotassignthisAgreementorsubletthePropertywithoutthepriorwrittenconsentoftheLandlord.Anyattemptedassignmentorsublettingwithoutsuchconsentshallbevoid.IftheLandlordconsentstoanassignmentorsubletting,theTenantshallremainliablefortheperformanceofallobligationsunderthisAgreement.九、MaintenanceandRepairs9.1Tenant'sResponsibilityTheTenantshallberesponsibleforminorrepairsandmaintenance,suchaschanginglightbulbs,uncloggingdrainscausedbytheTenant'smisuse,andreplacingairfilters.9.2Landlord'sResponsibilityTheLandlordshallberesponsibleformajorrepairsandmaintenance,includingbutnotlimitedtostructuralrepairs,repairstoheating,plumbing,andelectricalsystems,andrepairstotheroofandexteriorofthebuilding.十、TerminationofLease10.1EarlyTerminationbyTenantTheTenantmayterminatethisAgreementearlyonlyuponwrittennoticetotheLandlordandpaymentofanearlyterminationfeeintheamountof[earlyterminationfeeamount].Theearlyterminationshallbeeffectiveonthedatespecifiedinthenotice,providedthatallrentandotherobligationsuptothatdatehavebeenpaid.10.2EarlyTerminationbyLandlordTheLandlordmayterminatethisAgreementearlyonlyincaseoftheTenant'smaterialbreachofthisAgreementorasotherwisepermittedbylaw.TheLandlordshallprovidetheTenantwithwrittennoticeofterminationinaccordancewithapplicablelaw.10.3ExpirationofLeaseTermAttheendoftheLeaseTerm,thisAgreementshallterminateautomatically,unlessrenewedbymutualagreementoftheparties.IftheTenantcontinuestooccupythePropertyaftertheendoftheLeaseTermwithouttheLandlord'sconsent,theTenantshallbeconsideredaholdovertenantandshallbesubjecttoamonthlyrentincreaseof[holdoverrentincreasepercentage].十一、GoverningLawandJurisdictionThisAgreementshallbegovernedbyandconstruedinaccordancewiththelawsoftheStateofNewYork.AnydisputesarisingoutoforinconnectionwiththisAgreementshallbesubjecttotheexclusivejurisdictionofthecourtsof[county]intheStateofNewYork.十二、EntireAgreementThisAgreementconstitutestheentireagreementbetweenthepartieswith
