房屋租賃合同(中英雙文規(guī)范版)ResidentialLeaseAgreement(StandardChinese-EnglishVersion)出租方(甲方):Landlord(PartyA):姓名/公司名稱:Name/CompanyName:地址:Address:聯(lián)系方式:ContactInformation:承租方(乙方):Tenant(PartyB):姓名/公司名稱:Name/CompanyName:地址:Address:聯(lián)系方式:ContactInformation:第一條租賃房屋描述Clause1:DescriptionoftheLeasedPremises甲方同意將位于________(詳細地址)的房屋(以下簡稱"該房屋")出租給乙方使用。該房屋建筑面積為______平方米,戶型為______室______廳______衛(wèi)。PartyAherebyagreestoleasetoPartyBthepremiseslocatedat________(fulladdress),hereinafterreferredtoas"thePremises".ThePremiseshasaconstructionareaof______squaremetersandconsistsof______bedrooms,______livingrooms,and______bathrooms.第二條租賃期限Clause2:LeaseTerm本合同租賃期限自______年____月____日起至______年____月____日止,共計____個月。租賃期限屆滿前,乙方如有意續(xù)租,應(yīng)提前______天書面通知甲方,雙方另行協(xié)商續(xù)租事宜并簽訂新的租賃合同。TheleasetermofthisAgreementshallcommenceon______andendon______,totaling______months.IfPartyBintendstorenewtheleaseuponexpiration,itshallnotifyPartyAinwritingatleast______dayspriortotheexpirationdate.Thetwopartiesshallnegotiatethetermsofrenewalandexecuteanewleaseagreement.第三條租金及支付方式Clause3:RentandPaymentMethod該房屋每月租金為人民幣______元(大寫:____________________)。ThemonthlyrentforthePremisesshallbeRMB______(inwords:____________________).租金支付方式為:按______(月/季/半年)支付。乙方應(yīng)在每個支付周期開始前______天內(nèi),將租金支付至甲方指定的銀行賬戶。甲方銀行賬戶信息如下:Therentshallbepaidona______(monthly/quarterly/semi-annual)basis.PartyBshallpaytherenttoPartyA'sdesignatedbankaccount______dayspriortothestartofeachpaymentperiod.ThebankaccountdetailsofPartyAareasfollows:開戶銀行:____________________BankName:____________________賬戶名稱:____________________AccountHolder:____________________賬號:____________________AccountNumber:____________________若乙方逾期支付租金,每逾期一日,應(yīng)按未支付金額的______%向甲方支付違約金。逾期超過______天的,甲方有權(quán)解除本合同,并要求乙方承擔(dān)違約責(zé)任。IntheeventthatPartyBfailstopaytherentontime,itshallpayPartyAalatefeeof______%oftheoverdueamountforeachdayofdelay.Ifthedelayexceeds______days,PartyAshallhavetherighttoterminatethisAgreementandrequirePartyBtoassumeliabilityforbreachofcontract.第四條押金Clause4:SecurityDeposit乙方應(yīng)在本合同簽訂之日起______天內(nèi),向甲方支付押金人民幣______元(大寫:____________________)。該押金作為乙方履行本合同各項義務(wù)的擔(dān)保。PartyBshallpayPartyAasecuritydepositofRMB______(inwords:____________________)within______daysaftertheexecutionofthisAgreement.ThesecuritydepositshallserveascollateralforPartyB'sperformanceofallobligationsunderthisAgreement.租賃期限屆滿或本合同提前終止后,在乙方結(jié)清所有應(yīng)付款項(包括但不限于租金、水電費、物業(yè)費等)并將該房屋完好交還甲方后的______天內(nèi),甲方應(yīng)將押金無息退還乙方。若乙方存在違約行為或造成房屋損壞,甲方有權(quán)從押金中扣除相應(yīng)費用,不足部分乙方應(yīng)另行補足。UponexpirationoftheleasetermorearlyterminationofthisAgreement,PartyAshallrefundthesecuritydeposittoPartyBwithoutinterestwithin______daysafterPartyBhassettledallpayableamounts(includingbutnotlimitedtorent,utilities,propertymanagementfees,etc.)andreturnedthePremisestoPartyAingoodcondition.IfPartyBhascommittedanybreachofcontractorcauseddamagetothePremises,PartyAhastherighttodeductthecorrespondingexpensesfromthesecuritydeposit.PartyBshallmakeupanyshortfall.第五條房屋用途Clause5:PermittedUse乙方租賃該房屋僅作為______(居住/辦公/商業(yè)等)使用,乙方保證在租賃期限內(nèi)不改變房屋用途,不利用該房屋從事任何違法違規(guī)活動。PartyBshallusethePremisessolelyfor______(residential/office/commercial,etc.)purposes.PartyBwarrantsthatitwillnotchangetheuseofthePremisesduringtheleasetermandwillnotengageinanyillegalorirregularactivitiesonthePremises.若乙方違反本條規(guī)定,甲方有權(quán)立即解除本合同,并要求乙方承擔(dān)違約責(zé)任,同時乙方應(yīng)賠償甲方因此遭受的一切損失。IfPartyBbreachesthisclause,PartyAshallhavetherighttoterminatethisAgreementimmediatelyandrequirePartyBtoassumeliabilityforbreachofcontract.PartyBshallalsocompensatePartyAforalllossesincurredasaresultthereof.第六條房屋維修與保養(yǎng)Clause6:RepairandMaintenance租賃期限內(nèi),甲方應(yīng)負責(zé)該房屋的主體結(jié)構(gòu)、公共設(shè)施設(shè)備的正常維修和保養(yǎng),確保房屋及其附屬設(shè)施處于安全和適用狀態(tài)。但因乙方使用不當(dāng)或故意造成的損壞除外。Duringtheleaseterm,PartyAshallberesponsibleforthenormalrepairandmaintenanceofthemainstructureofthePremisesandpublicfacilitiestoensurethatthePremisesanditsappurtenancesareinasafeandusablecondition,exceptfordamagescausedbyimproperuseorintentionalactsofPartyB.乙方應(yīng)合理使用并愛護該房屋及其附屬設(shè)施。如發(fā)現(xiàn)房屋及其附屬設(shè)施有損壞或故障時,應(yīng)及時通知甲方維修。乙方因使用不當(dāng)或故意造成房屋及其附屬設(shè)施損壞的,應(yīng)負責(zé)修復(fù)或承擔(dān)賠償責(zé)任。PartyBshallusethePremisesanditsappurtenancesreasonablyandwithcare.IfPartyBdiscoversanydamageormalfunctiontothePremisesoritsappurtenances,itshallpromptlynotifyPartyAforrepair.PartyBshallberesponsibleforrepairingorcompensatingforanydamagetothePremisesoritsappurtenancescausedbyitsimproperuseorintentionalacts.對于乙方的維修通知,甲方應(yīng)在接到通知后的______天內(nèi)進行維修。如甲方未及時維修,乙方可自行維修,費用由甲方承擔(dān)。但緊急情況(如漏水、漏電等)下,乙方有權(quán)立即進行維修,費用由甲方承擔(dān)。PartyAshallcarryoutrepairswithin______daysafterreceivingPartyB'srepairnotice.IfPartyAfailstorepairinatimelymanner,PartyBmayarrangeforrepairsonitsown,andtheexpensesshallbebornebyPartyA.However,incaseofemergencies(suchaswaterleakage,electricleakage,etc.),PartyBhastherighttocarryoutrepairsimmediately,andtheexpensesshallbebornebyPartyA.第七條物業(yè)管理與費用承擔(dān)Clause7:PropertyManagementandExpenseResponsibility乙方應(yīng)遵守該房屋所在小區(qū)的物業(yè)管理規(guī)定,按時足額繳納物業(yè)管理費、水電費、燃氣費、有線電視費、網(wǎng)絡(luò)費等因使用該房屋而產(chǎn)生的各項費用。PartyBshallabidebythepropertymanagementregulationsofthecommunitywherethePremisesislocatedandpayontimeandinfullthepropertymanagementfees,utilities(includingwater,electricity,gas,etc.),cableTVfees,internetfees,andotherexpensesincurredfromtheuseofthePremises.上述費用的繳納方式和時間按照相關(guān)部門或物業(yè)公司的規(guī)定執(zhí)行。乙方應(yīng)保存好繳費憑證,并在甲方要求時提供相關(guān)證明。Thepaymentmethodsanddeadlinesfortheaboveexpensesshallbeinaccordancewiththeregulationsoftherelevantauthoritiesorpropertymanagementcompany.PartyBshallkeepthepaymentvouchersandproviderelevantcertificatesuponPartyA'srequest.第八條違約責(zé)任Clause8:LiabilityforBreachofContract若甲方違反本合同約定,提前收回該房屋或妨礙乙方正常使用該房屋的,應(yīng)退還乙方已支付但尚未使用的租金和押金,并按照相當(dāng)于______個月租金的標準向乙方支付違約金。若違約金不足以彌補乙方損失的,甲方還應(yīng)承擔(dān)賠償責(zé)任。IfPartyAbreachesthisAgreementbytakingbackthePremisesinadvanceorinterferingwithPartyB'snormaluseofthePremises,PartyAshallrefundtherentandsecuritydepositpaidbyPartyBbutnotyetused,andpayPartyBapenaltyequivalentto______months'rent.IfthepenaltyisinsufficienttocompensateforPartyB'slosses,PartyAshallalsobeartheliabilityforcompensation.若乙方違反本合同約定,逾期支付租金或其他費用、擅自改變房屋用途、損壞房屋及其附屬設(shè)施等,甲方有權(quán)要求乙方限期改正,并按照相當(dāng)于______個月租金的標準向甲方支付違約金。若乙方在甲方規(guī)定的期限內(nèi)未改正的,甲方有權(quán)解除本合同,并要求乙方承擔(dān)違約責(zé)任。IfPartyBbreachesthisAgreementbyfailingtopayrentorotherexpensesontime,changingtheuseofthePremiseswithoutauthorization,damagingthePremisesoritsappurtenances,etc.,PartyAshallhavetherighttorequirePartyBtocorrectthebreachwithinaspecifiedtimelimitandpayPartyAapenaltyequivalentto______months'rent.IfPartyBfailstocorrectthebreachwithinthetimelimitspecifiedbyPartyA,PartyAshallhavetherighttoterminatethisAgreementandrequirePartyBtoassumeliabilityforbreachofcontract.第九條合同解除Clause9:TerminationoftheAgreement經(jīng)甲乙雙方協(xié)商一致,可以解除本合同。ThisAgreementmaybeterminatedbymutualagreementofPartyAandPartyB.有下列情形之一的,甲方有權(quán)單方解除本合同:PartyAshallhavetherighttoterminatethisAgreementunilaterallyunderanyofthefollowingcircumstances:乙方逾期支付租金超過______天的;PartyBfailstopaytherentformorethan______days;乙方擅自將該房屋轉(zhuǎn)租、轉(zhuǎn)借他人或擅自與他人互換使用的;PartyBsubletsthePremises,transferstheleasetoathirdparty,orexchangesthePremiseswithotherswithoutauthorization;乙方損壞房屋主體結(jié)構(gòu)或造成其他嚴重損壞,經(jīng)甲方要求仍未修復(fù)的;PartyBdamagesthemainstructureofthePremisesorcausesotherseriousdamageandfailstorepairitafterbeingrequestedbyPartyA;乙方利用該房屋從事違法違規(guī)活動的。PartyBusesthePremisestoengageinillegalorirregularactivities.有下列情形之一的,乙方有權(quán)單方解除本合同:PartyBshallhavetherighttoterminatethisAgreementunilaterallyunderanyofthefollowingcircumstances:甲方未按照本合同約定交付該房屋,經(jīng)乙方催告后______天內(nèi)仍未交付的;PartyAfailstodeliverthePremisesasagreedinthisAgreementandstillfailstodeliveritwithin______daysafterbeingurgedbyPartyB;甲方嚴重干擾乙方對該房屋的正常使用,經(jīng)乙方催告后______天內(nèi)仍未改正的;PartyAseriouslyinterfereswithPartyB'snormaluseofthePremisesandfailstocorrectitwithin______daysafterbeingurgedbyPartyB;該房屋因不可抗力或政府行為導(dǎo)致無法繼續(xù)使用的。ThePremisesbecomesunavailableforcontinueduseduetoforcemajeureorgovernmentactions.任何一方依據(jù)本條規(guī)定單方解除本合同的,應(yīng)書面通知對方。本合同自通知送達對方之日起解除。AnypartyterminatingthisAgreementunilaterallyinaccordancewiththisclauseshallnotifytheotherpartyinwriting.ThisAgreementshallbeterminatedonthedatethenoticeisservedontheotherparty.第十條爭議解決Clause10:DisputeResolution本合同在履行過程中如發(fā)生爭議,由甲乙雙方協(xié)商解決;協(xié)商不成的,任何一方均有權(quán)向該房屋所在地有管轄權(quán)的人民法院提起訴訟。AnydisputesarisingfromtheperformanceofthisA
