柬埔寨公寓租賃合同范本ThisLeaseAgreement("Agreement")ismadeandenteredintoonthis______dayof______________,20__,byandbetween:LANDLORD:[FullNameofLandlord],anindividualresidingat[FullAddressofLandlord],[Landlord'sNationality],withIdentificationNumber/PassportNumber[Landlord'sID/PassportNumber]("Landlord")TENANT:[FullNameofTenant],anindividualresidingat[FullAddressofTenant],[Tenant'sNationality],withIdentificationNumber/PassportNumber[Tenant'sID/PassportNumber]("Tenant")WHEREAS,theLandlordistheownerofthepropertylocatedat[FullAddressoftheApartment],including[DescriptionoftheUnit,e.g.,apartmentunitnumber,floor,buildingname,residentialcomplexname]("theProperty");WHEREAS,theTenantdesirestoleasethePropertyfromtheLandlordforresidentialpurposes;NOW,THEREFORE,inconsiderationofthemutualcovenantsandpromiseshereincontained,thepartiesagreeasfollows:1.LEASETERMThetermofthisLeaseshallcommenceon[StartDate,e.g.,MM/DD/YYYY]("CommencementDate")andshallendon[EndDate,e.g.,MM/DD/YYYY]("TerminationDate"),unlessterminatedearlierinaccordancewiththeprovisionsofthisAgreement.2.RENTTheTenantshallpayLandlordamonthlyrentof[AmountinCambodianRiel(orUSD)]([Currency])("Rent"),dueonthe[Number,e.g.,first]dayofeachmonth,beginningwiththeCommencementDate.RentshallbepaidtotheLandlordat[Landlord'sDesignatedPaymentAddressorAccountInformation].3.SECURITYDEPOSITTheTenantshallpayLandlordasecuritydepositintheamountof[AmountinCambodianRiel(orUSD)]([Currency])("SecurityDeposit")uponsigningthisAgreement.TheSecurityDepositshallbeheldbyLandlordduringtheLeaseTermtocoveranydamagestothePropertycausedbytheTenant'snegligenceormisuse,aswellasanyunpaidrent,utilities,orotherfeesowedbytheTenantuponterminationoftheLease.TheSecurityDepositshallberefundedtotheTenantwithin[Number,e.g.,30]daysaftertheLeaseTermends,providedtheTenanthasfulfilledallobligationsunderthisAgreement,includingpayingalldueamountsandreturningthePropertyingoodcondition(reasonablewearandtearexcepted),uponwrittennoticefromtheTenantrequestingtherefund.4.UTILITIESANDFEESTheTenantagreestoberesponsibleforandpayallutilitiesandfeesassociatedwiththeProperty,includingbutnotlimitedtoelectricity,water,sewage,internet,andtelevision,asapplicable.TheTenantshallpaythesechargesdirectlytotherespectiveserviceproviders.TheTenantshallalsoberesponsibleforpayinganyPropertyManagementFee,ifapplicable,attherateof[Amount/Frequency]per[Month/Year],due[Day]ofeach[Month/Quarter].5.USEOFTHEPROPERTYThePropertyshallbeusedexclusivelyforresidentialpurposesbytheTenantandtheirimmediatefamilymembers.TheTenantshallnotsublet,assign,transfer,orpermitanyotherpersontooccupythePropertywithoutthepriorwrittenconsentoftheLandlord.TheTenantshallnotmakeanyalterations,modifications,oradditionstothePropertywithoutthepriorwrittenconsentoftheLandlord.6.MAINTENANCEANDREPAIRSTheTenantshallmaintainthePropertyinacleanandsanitaryconditionandshallberesponsibleforthecostofrepairinganydamagecausedbytheTenant'snegligence,misuse,orfailuretocomplywiththisAgreement.TheTenantshallpromptlynotifytheLandlordofanyneededrepairsresultingfromnormalwearandtearoranymaintenanceissues.TheLandlordshallberesponsibleforallmajorrepairs,maintenance,andreplacementsrelatedtothestructuralintegrityofthePropertyanditsmajorsystems(e.g.,plumbing,electrical,HVAC).7.POSSESSIONANDENTRYTheLandlordshalldeliverpossessionofthePropertytotheTenantontheCommencementDate.TheLandlordshallhavetherighttoenterthePropertyatreasonabletimesforpurposesofinspection,maintenance,orrepair,providedreasonablenotice(atleast[Number,e.g.,24]hours)isgiventotheTenantunlessthereisanemergency.8.TERMINATIONANDEARLYTERMINATIONEitherpartymayterminatethisAgreementearlyonlywiththepriorwrittenconsentoftheotherparty.Notwithstandingtheforegoing,theTenantmayterminatetheLeaseearlyonlyunderthefollowingconditions:a)IftheLandlordfailstomakenecessaryrepairsaffectinghabitabilityafterbeinggivenareasonableperiod(e.g.,[Number,e.g.,14]days)todoso.b)IftheLandlordviolatesanymaterialtermofthisAgreement.c)IfthePropertybecomesuninhabitableduetoreasonsbeyondtheTenant'scontrol(e.g.,naturaldisaster).InanyterminationcausedbytheTenantunderthissubclause,theTenantshallberesponsibleforpayingrentfortheremainingterm,unlessotherwiseagreedinwriting.TheLandlordmayterminatetheLeaseearlyonlyunderthefollowingconditions:a)IftheTenantfailstopayRentforanymonthforaperiodofmorethan[Number,e.g.,15]daysafteritbecomesdue.b)IftheTenantviolatesanymaterialtermofthisAgreement.c)IftheTenantusesthePropertyforpurposesotherthanthosespecifiedinthisAgreement.d)IftheTenantdamagesthePropertysignificantlyorfailstorestoreittoitsconditionuponexpirationoftheLease.UponearlyterminationbytheLandlordforcause,theLandlordshallreturntheSecurityDeposittotheTenant,lessanyamountsduetotheLandlordfordamages,unpaidrent,orotherfees.9.NOTICESAllnoticesrequiredorpermittedunderthisAgreementshallbegiveninwritingandshallbedeemedeffectivelygivenwhendeliveredpersonally,sentbyregisteredmail(returnreceiptrequested),sentbyemailtotheaddressesspecifiedbelow,orpostedontheofficialbulletinboardoftheProperty(ifapplicable).Landlord'sAddressforNotices:[FullAddressofLandlord]Tenant'sAddressforNotices:[FullAddressofTenant]10.GOVERNINGLAWANDDISPUTERESOLUTIONThisAgreementshallbegovernedbyandconstruedinaccordancewiththelawsoftheKingdomofCambodia.AnydisputearisingoutoforinconnectionwiththisAgreementshallfirstbeattemptedtoberesolvedthroughgoodfaithnegotiationbetweentheparties.Ifnegotiationfails,thepartiesagreetosubmitthedisputetotheCambodianArbitrationCentre("CAMAR")forresolutioninaccordancewiththethen-currentCAMARRules.ThearbitrationshallbeheldinPhnomPenh,Cambodia.The仲裁languageshallbe[Choose:Khmer,English,orboth].11.ENTIREAGREEMENTThisAgreement,includingallattachmentsandexhibitsthereto,constitutestheentireagreementbetweenthepartieswithrespecttothesubjectmatter
