4、聘用崗位和聘用期限1 .聘用崗位江西中醫(yī)藥大學(xué)柔性特聘教授崗。(可根據(jù)實際聘任其崗位)2 .合同期限甲方根據(jù)工作的需要,以柔性特聘的方式聘用乙方到甲方工作,合同期限為3_年(自 年 月 日起至 年 月 日止)(以學(xué) 校研究通過后簽訂合同之日起算)。聘用期滿,根據(jù)甲方工作需要及 乙方要求,經(jīng)雙方協(xié)商同意可以續(xù)簽合同。Article 1 Post employed and term of employment1. Post employedDistinguished professor flexibly employed by Jiangxi University of TCM2. Term of
5、 contractParty A intends to employ Party B in the form of flexible employment according to the needs of the work. The contract term is 豈 years (from XX XX, XXXX to XX XX, XXXX ). Upon completion of the employment term, according to the needs of the work and Party B's requirement, and with the co
6、nsent of the two parties, the contract can be renewed.第二條乙方工作目標(biāo)和任務(wù)XXXXXXXXXXXXXXXX(描述務(wù)必具體明確,如不便寫明具體數(shù)量,聘任單位必須提供 附件,明確聘請該人才本單位需完成的具體任務(wù), 在聘期結(jié)束后應(yīng)當(dāng) 取得的具體成績,明確具體的培養(yǎng)對象和培養(yǎng)效果等)Article 2 Work objectives and tasks of Party BXXXXXXXXXXXXXXXXXXXXXXXXXXXX第三條權(quán)利和義務(wù)一、甲方的權(quán)利和義務(wù)(一)甲方的權(quán)利1 .根據(jù)江西中醫(yī)藥大學(xué)有關(guān)柔性特聘教授(實際聘任的崗位)崗 位工
7、作目標(biāo)和工作任務(wù),對乙方進(jìn)行管理。2 .依照國家法律、法規(guī)及學(xué)校關(guān)于柔性特聘教授(實際聘任的崗 位)的相關(guān)工作目標(biāo)和任務(wù),對乙方進(jìn)行考核和獎懲。3 .乙方合同期未滿離校或未按照合同要求履行在甲方的工作時 間和任務(wù),甲方有權(quán)停發(fā)乙方的一切待遇。Article 3 Rights and Obligations1. Party A's rights and obligations.1.1 The rights of Party A.1.1.1. Responsible for the management of Party B according to Party As requiremen
8、ts on the work objectives and tasks of the flexibly employed distinguished professors.1.1.2. Responsible for the assessment,rewards and punishments of Party B s work in accordance with national laws and regulations as well as the Party As requirements on the work objectives and tasks of the flexibly
9、 employed distinguished professors.1.1.3. If Party B leaves the school before the expiration of the contract or fails to fulf川 the time requirement and assignments as stipulated in the contract, Party A has the right to suspend all kinds of remuneration to Party B.(二)甲方的義務(wù)1 .甲方依法維護(hù)乙方應(yīng)享有的各項權(quán)利。2 .甲方按規(guī)
10、定為乙方提供相應(yīng)的工作條件。3 .甲方提供乙方年薪人民幣 萬元(稅前)。其中,一萬元(稅 前)每年按月發(fā)放;萬元(稅前)根據(jù)年度考核結(jié)果發(fā)放。(根據(jù) 江西中醫(yī)藥大學(xué)柔性引進(jìn)高層次人才暫行辦法 柔性引進(jìn)的人才層 次待遇,或商定的待遇執(zhí)行)4 .甲乙雙方聘期滿未續(xù)簽合同,甲方有權(quán)對乙方是否假借雙方原 聘用職務(wù)或“江西中醫(yī)藥大學(xué)”名號從事講學(xué)、商業(yè)等一切非甲方授 權(quán)的用途進(jìn)行監(jiān)督,一經(jīng)發(fā)現(xiàn),甲方有權(quán)利用法律途徑向乙方追究相 關(guān)責(zé)任及經(jīng)濟(jì)賠償。1.2. The obligations of Party A1.2.1. Party A shall safeguard Party B' due r
11、ights in accordance with the law.1.2.2. Party A shall provide Party B with necessary working conditions.1.2.3. Party A shall provide Party B with annual salary of RMB_ (before tax), among which, _ yuan (pre-tax) is paid monthly and _ yuan (before tax) paid according to the annual assessment.1.2.4. W
12、hen the employment contract expires and is not renewed, Party A has the right to supervise whether Party B is still using the originally appointed title or the name of Jiangxi University of Traditional Chinese Medicine“ to give lectures or conduct business activities that are not authorized by Party

Upon discovery, Party A has the right to ask Party B for accountabilities or financial compensation through legal channels.二、乙方的權(quán)利和義務(wù)(一)乙方的權(quán)利1 .乙方聘期內(nèi)享受甲方根據(jù)合同約定的工作、生活條件及薪酬待 遇。2 .甲方如不能按照規(guī)定履行其應(yīng)盡義務(wù)時,有權(quán)向上級有關(guān)部門 進(jìn)行申訴。2. Party B's rights and obligations2.1 The rights of Party B2.1.1. Party B has the
14、 rights to enjoy Party A's work, living conditions and remuneration as stipulated in the contract.2.1.2. If Party A fails to fulfill its due obligations in accordance with the contract, Party B has the right to appeal to the relevant departments at higher levels.(二)乙方的義務(wù)1 .聘期內(nèi),全面完成合同約定的工作目標(biāo)和任務(wù),承
15、諾每年在甲 方工作時間不少于一個月(按實際能到校的時間填寫,便于考核), 接受甲方的監(jiān)督、考核及管理。2 .認(rèn)真遵守國家各項法律法規(guī),及甲方的各項規(guī)章制度。3 .聘期內(nèi),在受聘崗位上所取得的教學(xué)、科研成果與知識產(chǎn)權(quán), 發(fā)表的有關(guān)論文、著作或申報有關(guān)獎項、專利和科研項目及經(jīng)費(fèi)等權(quán) 益,均署名甲方。4 .甲乙雙方聘期滿未續(xù)簽合同,乙方不得假借原聘用職務(wù)或以“江西中醫(yī)藥大學(xué)”名號從事講學(xué)、商業(yè)等任何未經(jīng)甲方授權(quán)用途。2.2 The obligations of Party B2.2.1. As a commitment of Party B, during the employment period
16、, the annual cumulative working time at Party A shall be no less than _ months with a view to accomplishing the work objectives and tasks, and Party B shall accept the supervision, assessment and management from Party A.2.2.2. Party B shall observe the relevant laws and regulations of China and the
17、rules and regulations of Party A.2.2.3. During the term of employment, for those teaching and scientific research achievements and intellectual property rights; papers and works; awards, patents, research projects and funds etc., that are obtained at the post appointed, the institution of authorship
18、 or ownership belong to Party A.2.2.4. When the employment contract expires and is not renewed, Party B has no right to use the originally appointed title or the name of “Jiangxi University of Traditional Chinese Medicine” to give lectures or conduct business activities that are not authorized by Pa
19、rty A.第四條 考核甲方對乙方實行年度考核、聘期考核。其中,年度考核由乙方所在部門根據(jù)其工作目標(biāo)和任務(wù)組織實施;聘期考核由甲方組織專家組進(jìn)行,考核的具體方案另行制定。如乙方考核結(jié)果為“不合格”,甲方可以單方面解除本合同。Article 4 AssessmentParty A shall assessParty B s work on annual and term basis. The annual assessment shall be made by the department where Party B is employed in accordance with the work
20、 objectives and tasks. The term assessmentshall be made by expert panel organized by Party A, detail of which is to be specified separately. If theassessment result is "unqualified", then Party A has the right to unilaterally terminate the employment contract.第五條 違反合同責(zé)任甲乙雙方任何一方違反本合同約定的,應(yīng)當(dāng)承
21、擔(dān)繼續(xù)履行、采取補(bǔ)救措施或者賠償損失等責(zé)任。給對方造成經(jīng)濟(jì)損失的,有責(zé)任一方應(yīng)按照實際損失承擔(dān)對方相應(yīng)經(jīng)濟(jì)賠償責(zé)任。Article 5 Breach liabilitiesIf any party violates the contract, it shall resume its responsibilities, take remedy measuresor make compensations.In case of any economic losses, the responsible party shall bear the economic liability for the ac
22、tual loss.第六條 合同的變更與解除1 .聘期內(nèi),乙方如不能履行合同所規(guī)定的工作目標(biāo)和任務(wù),考核不合格或出現(xiàn)違法違紀(jì)行為,甲方有權(quán)立即終止合同。2 .聘期內(nèi),如因不可抗力因素,致使合同無法正常履行,需要變更或解除合同的,雙方應(yīng)按照國家有關(guān)規(guī)定妥善處理。Article 6 Modification and termination of the contract1. If Party B fails to fulfill the work objectives and tasks stipulated in this contract or fails to pass the assess
23、mentor violate laws and regulations during the contract term, then Party A has the right to terminate the contract immediately.2. If the contract terms fail to be fulfilled due to force majeure, leading to the modification or cancellation of the contract, both parties shall handle the matter in acco
24、rdance with the relevant provisions of the country.第七條 爭議處理甲乙雙方因履行本合同發(fā)生爭議的,由甲乙雙方協(xié)商解決。協(xié)商不成或不愿協(xié)商的,需先向江西中醫(yī)藥大學(xué)勞動人事爭議調(diào)解委員會提出調(diào)解,調(diào)解不成的,當(dāng)事人可以在規(guī)定的期限內(nèi)向江西省仲裁委員會申請仲裁。Article 7 Settlement of the disputeDisputes arising out of implementation of this contract shall be settled through friendly negotiation by both p
25、arties. If the said negotiation fails to settle the dispute, the case in dispute shall be firstly submitted to the Labor and Personnel Dispute Mediation Committee of Jiangxi University of TCM for mediation. If the said mediation fails, the Party concerned may apply to Jiangxi Provincial Arbitration Com
