2、tion Bureau together.2簽訂協(xié)議前,出賣人應(yīng)當(dāng)向買受人出示商品房預(yù)售許可證及其他關(guān)于證書和證明資料文件。Before signing of the presale Contract, the Seller shall show the presale license of commodity housing and other related certificates and documents to the Buyer.3當(dāng)事人應(yīng)當(dāng)依照自愿、公平及誠實信用的原則訂立協(xié)議,任何一方不得將自己的意志強(qiáng)加給另一方。各方當(dāng)事人可以對文本條款的內(nèi)容進(jìn)行修改、增補(bǔ)或刪減。協(xié)議生效后,

3、未被修改的文本打印文字視為各方當(dāng)事人同意內(nèi)容。Both parties should achieve this contract in accordance with the principle of voluntariness, fairness and good faith; either must not impose the views on the other party. Both parties can modify, supplement or delete the content of the articles. After the Contract comes into e

4、ffect, the confirmed text will be considered as the content agreed by both parties.4簽訂協(xié)議前,買受人應(yīng)當(dāng)仔細(xì)閱讀協(xié)議條款,應(yīng)當(dāng)特別仔細(xì)審閱其中具有選擇性、補(bǔ)充性、填充性、修改性的內(nèi)容。Before signing of the presale Contract, the Buyer should read the Contract articles carefully, especially the content of selectivity, complementariness, fallibility

39、任。The Seller shall guarantee that the House for sale is not involved in any dispute of ownership. In case of the inability to handle ownership registration or occurrence of credit and debt disputes, the seller shall undertake all the responsibilities.第八條規(guī)劃變更的商定Article 8 Agreements on Planning Altera

40、tion出賣人應(yīng)當(dāng)依照規(guī)劃行政主管部門核發(fā)的xx工程規(guī)劃許可證規(guī)定的條件xx商品房,不得擅自變更。出賣人確需變更xx工程規(guī)劃許可證規(guī)定條件的,應(yīng)當(dāng)書面征得受影響的買受人同意,并取得規(guī)劃行政主管部門的批準(zhǔn)。因規(guī)劃變更給買受人的權(quán)益造成損失的,出賣人應(yīng)當(dāng)給予相應(yīng)的補(bǔ)償。The Seller shall build the House according to the conditions stipulated in the Construction Planning Permit approved and issued by the Planning Administration Departme

42、es of the buyers interests caused by the planning alteration, the Seller should provide the corresponding compensation.第九條設(shè)計變更的商定Article 9 Agreements on Design Alteration(一)經(jīng)規(guī)劃行政主管部門委托的設(shè)計審查單位批準(zhǔn),建筑工程施工圖設(shè)計資料文件的下列設(shè)計變更影響到買受人所購商品房質(zhì)量或使用功能的,出賣人應(yīng)當(dāng)在設(shè)計審查單位批準(zhǔn)變更之日起10日內(nèi),書面通知買受人。1該商品房結(jié)構(gòu)形式、戶型、空間尺寸、朝向;2供熱、采暖方式;I. 44、he approval of the design inspection unit.1. The construction, layout, space dimension, orientation;2. Heating methods; 出賣人未在規(guī)定時限內(nèi)通知買受人的,買受人有權(quán)退房。(二)買受人應(yīng)當(dāng)在通知送達(dá)之日起15日內(nèi)做出是否退房的書面答復(fù)。買受人逾期未予以書面答復(fù)的,視同接受變更。(三)買受人退房的,出賣人應(yīng)當(dāng)自退房通知送達(dá)之日起_日內(nèi)退還買受人已付房價款,并依照_利率付給利息。買受人不退房的,應(yīng)當(dāng)與出賣人另行簽訂補(bǔ)充協(xié)議。If the seller doesnt inform t

If not cancel the order, the Buyer shall sign a supplementary agreement with the Seller.第十條逾期付款責(zé)任Article 10 Purchasers Responsibility for Breach of Contract Due to Overdue Payment買受人未依照商定的時間付款的,依照下列第_種方式處理:1依照逾期時間,分別處理(1)和(2)不作累加)(1)逾期在_日之內(nèi),自商定的應(yīng)付款期限屆滿之次日起至實際支付應(yīng)付款之日止,買受人按日計算向出賣人支付逾期應(yīng)付款萬分

49、percent of the overdue payment per day within 30 days after the actual payment date to the Seller as a penalty from the second day after the payment deadline stipulated in this contract to the actual payment date, and the contract continues to be effective.(2)逾期超過_日(該日期應(yīng)當(dāng)與第(1)項中的日期相同)后,出賣人有權(quán)解除協(xié)議。出賣人

50、解除協(xié)議的,買受人應(yīng)當(dāng)自解除協(xié)議通知送達(dá)之日起_日內(nèi)依照累計的逾期應(yīng)付款的_%向出賣人支付違約金,并由出賣人退還買受人全部已付款。買受人自愿繼續(xù)履行協(xié)議的,經(jīng)出賣人同意后,協(xié)議繼續(xù)履行,自商定的應(yīng)付款期限屆滿之次日起至實際支付應(yīng)付款之日止,買受人按日計算向出賣人支付逾期應(yīng)付款萬分之_(該比率應(yīng)當(dāng)不小于第(1)項中的比率)的違約金,并于實際支付應(yīng)付款之日起_日內(nèi)向出賣人支付違約金。本條所稱逾期應(yīng)付款是指依照第六條商定的到期應(yīng)付款與該期實際已付款的差額;采取分期付款的,依照相應(yīng)的分期應(yīng)付款與該期的實際已付款的差額確定。If the overdue period is over 30 days (t

If the Buyer is willing to continue performing the contract, the contract will continue to be effective with the approval of the Seller. From the second day after the payment deadline stipulated in this contract t

53、o the actual payment date, the purchaser shall pay 0.002 percent (This rate should be no less than the rate stipulated in the item (1) of the overdue payment per day within 10 days after the actual payment date to the Seller as a penalty.The overdue payment in this article refers to the balance betw

54、een the due payable stipulated in Article Six of this contract and the actual payment in that term. If installment payment is adopted, the overdue payment shall be decided by the balance between the due installment and the actual payment in that term.第十一條交付條件Article 11 Delivery Term(一)出賣人應(yīng)當(dāng)在_年_月_日前向
