plishmentsinlast50yearsbutalsoleavespaceforprogress.Ibelievediscourseysis,inlongterm,willgoonwithamorepromisingdevelopment,notonlybecausethereisenoughspacefortheoryimprovementbutalsocanitbepractical,helpfulforbusinessactivities.Discourseysishasgrownintoawide-rangingandheterogeneousdisciplinewhichfindsitsunityinthedescriptionoflanguageabovethesentenceandaninterestinthecontextsandculturalinfluenceswhichaffectlanguageinuse.AsChina’sentryintoWTO,thetradeexchangesbetweenChinesecompaniesandoverseacompaniesare ingmoreandmorefrequent.Technicallyspeaking,businesscontract,whichstipulatestherightsandobligationoftwopartiessinceeconomicandtradeactivities,hasbeennecessitieseversinceeconomicandtradeactivitiesemergedacrossregionsandbetweencountries.However,thereappearmanyproblemsinunderstandingandwritingbusinesscontractforitisnotwellknownanddeeplyunderstoodasalegallyeffectivepr,neitherareitslinguisticfeatures.TheEnglishbusinesscontracthasbeenstudiedsincethedayitwasborn.Itisquitenecessaryforustoexplorethelanguagevarietyintermsofdiscourseysisandbeneficialforfurtherunderstandingandcontractwriting.Peoplewilldobetterinprotectingtheirlegalrights,whichgreatlyinternationaltradesinourcountry.Basedonrelateddiscourseysis,thispr,byadoptingvarioustheoriesandmethods,makesafurtherresearchtowardsbusinesscontractmainlyfromthreeaspectsofwords,phrases,andsentencestructures.Onthewordslevel,compoundadverbandformalwordsaretwomainlyfocusinthisthesis.BasedontheexamplestakenfromthecontractnamedOceanMarineCargoClause,Iwillmakeanysisoftheformationofcompoundadverbanditsfunctionsandadvantagesitbrings.Mostofthecompoundadverbsbelongtoarchaicwords.Theycontributetothesolemnityandauthorityofbusinesscontractandmakessentencestructuremorecompact.Asfortheformalwords,fromwhatIdiscussinthethesis,itiswidespreadanddeemedthedefiniteprincipleofbusinesscontract.Withoutformalwords,therewillbenoexistenceofbusinesscontract.Onthephraselevel,wemainlyfocusontwotypes:conjoinedphrasesandadjectivephrases.Conjoinedwordssometimesincludetwowordswithsimilarmeaningforpreciseexplanation,sometimestwowordswithtotallydifferentmeaningtomakethedescriptioncoverallpossiblesituationstoavoidomission.Itisofgreatsignificanceandpracticability.Onthesentencelevel,thefrequentuseofpassivevoicecanbespottedfromthoseillustratedsentences.Andinmostcases,passivesentencesareusedforthedraftingofsucharticlesincontractaspacking,payment,insurance,disputesettlementandsoon.ThesentencesinEnglishbusinesscontractareinclinedtoemploylongandcomplexsentences,yetinordinaryEnglishcontext,thiskindoffrequenttendencyisrarelydiscovered.ThereasonliesinthatthelongandcomplexsentencesaremoreconcreyandpreciselyexplaintherightsandobligationsofpartiesrelatedtotheEnglishbusinesscontract.Therefore,thelanguageofthebusinesscontractmanifestsitselfinaprecise,logicalandstylisticallyrigidform,whichcontributestothemeticulousexpressionandcriticalstipulationofthecontract.Thecohesionofthediscourseofbusinesscontractisfullydemonstratedbyitswords,phrasesandsentencesfeatures.Thissectionismadeupoftwoparts.ly,thedevelopmentofdiscourseysisbothathomeandabroadisintroduced,itisdiscoveredthatdiscourseysishasdevelopintoacommon-usedandpopulartheoryamongthestudyoftextinvariouswritingstyle.Andthusthebusinesscontracthasnoexception.Inthesecondpart,thecurrentresearchsituationofbusinesscontractinChinaisexploredbylistingthoserecentresearchesofChinesescholars.DevelopmentofDiscourseDiscourseysisisanewsubject.In1920s,somelinguistspaidattentiontothestudyoflanguageinuse,butitreallybegantodevelopfrom1960sand1970s,includingLinguistics,Semiotics,Psychology,AnthropologyandSociology.Itstartsintheearly1970sandhasdevelopedintoavarietyofapproachesmotivatedbyawiderangeofinterestsandTheResearchDevelopmentofDiscourseysisZellingHarris,anAmericanlinguist,presentedthisterminhisprDiscourseysis.HeapproachesdiscourseysiswiththehelpofAmericanStructuralismandbelievesthatthissubject,eitherinwrittenorspokenlanguage,canbesuccessfullystudiedthroughthedistributionoflinguisticelements.VanDijkofHollandcontributedgreatlytodiscourseysis,theearlystudyofwhomwascalledTextGrammar.In1972,hepublishedhisworkSomeAspectsofTextGrammars.AccordingtoVanDijk,discourseysishas eanewcross-disciplinaryfieldofysissincetheearly1970s.VanDijkfinishedandpublishedhisfamousHandbookofDiscourseysisin1985,whichincludesfourvolumesofDisciplinesofDiscourse,DimensionsofDiscourse,DiscourseandDialogueandDiscourseysisinSociety.Thefamouslinguists,M.A.KHalliday,madehiscontributiontothetheoryofdiscourseysisaswell,whichcanbediscoveredinhiswell-knownworkCohesionin1976.the1980suntilnow,discourse ysisis ingmoreandmoreprominentinlinguisticandquitenumberoffabulousdiscourse ysishavesprang.HallidaypublishedhisfamousmonographnamedAnIntroductiontoFunctionalGrammar,inwhichhefurtherdiscusshistheoryofcohesionandcoherence.ThistheoryhasallalongplayedacrucialroleinAsthediscourseysisgotonthestageofinternationallinguisticstudy,itsresearchamongChineselinguisticshasgreatlydevelopedandthusachievedalotfromthedayitwasbrought.InChina,thediscourseysishasneverceasedtobewidelyresearchedinvariouskindofwritingstyles.From1980s,thelinguisticswasbroughtintoforeignlanguageresearchfield.Thetheoryofdiscourseysisisallthewaydiscussedinavarietyofperiodicalprs.HuangGuowenisthescholartobeintroduced.HeyzedEnglishdiscoursestructurethoroughlyandcomprehensively.Heholdsthatdiscoursereferstoalanguageentirelycomposedofaseriesofcontinuousspeechorsentences.HisresearchresultscontributedalottothediscourseysisinChina.Furthermore,ChineselinguisticssuchasHuZhuanglinandsomeotherfamouslinguistshavealsodelvedagreatintothecontentsofdiscourseysis.AccordingtoHuZhuanglin,discoursecanberegardedasanynaturallanguagewhichisnottotallyconfinedtogrammarbutdenotescompletemeaninginacertaincontext,itmaybeasentence,aphase,acouplet,averse,aquarreloraspeechoftwoorthreehours.Besides,accordingtoLiYuncing,discoursehierarchyfindsitsbasisinthefactthatdiscourseisjustageneralnotion,thereforenecessarytoseparatediscourseintodifferenthierarchiesinconcreteresearchandysis.Therefore,inChina,discourseysishasgrowintoawide-rangingandheterogeneousdisciplinewhichfindsitsunityinthedescriptionoflanguageabovethesentenceandaninterestinthecontextsandculturalinfluenceswhichaffectlanguageinuse.Itisalsonow,increasingly,formingabackdroptoresearchinAppliedLinguisticsandSecondLanguageLearningandTeachinginparticular.TheCurrentResearchSituationofBusinessAsChina’sentryintoWTO,thetradeexchangesbetweenChinesecompaniesandoverseacompaniesare ingmoreandmorefrequent.Technicallyspeaking,businesscontract,whichstipulatestherightsandobligationoftwopartiessinceeconomicandtradeactivities,hasbeennecessitieseversinceeconomicandtradeactivitiesemergedacrossregionsandbetweencountries.Asalegalbusinesscontract,theEnglishbusinesscontracthasbeenstudiedsincethedayitwasborn.TheEnglishcontractplaysanessentialroleinbindingrightsandobligationsoftwopartiesinacertaineconomicinteractionandtransaction,and esoneoftheessentialfileinregulatingtwopartiesintheeconomicandtradeactivities.Therefore,itseemsthatitisdefiniynecessaryforscholarshomeandabroadstudytheconstructionandstructureofEnglishbusinesscontract.Scholarsoverseasareinclinedtostudyorngresearchesonthebusinesscontractfromvariouss.Somestudythegraphologyandformsofbusinesscontract.Somefromtheviewpointoftranslationinbusinesstradebetweencountries,andothersstudiedthestylisticapproaches.SomebusinesscontractstudiesarecarriedoutfromtheofcontrastiveysisofEnglishandChinese,somefromthetheoryofdynamicequivalence,andsomefromtheviewpointofcooperativeprinciples.Otherstudiesarecarriedoutfromtheprinciplesofaccuracy,whiletherearestillsomeothersfromthatofsomespecifictheoriesofdiscourseysis.Theachievementsofcontracttranslationaremanifestedinperiodicalprsandgraduatethesis.Thevariousapproachestostudyingcontracttranslationarelikeflowersofeverykindinbloom.StudyofBusinessContractatly,businesscontractisastylisticformoflegalefficiency,thusitowesitspeculiarfeaturesingraphologyandforms.Therefore,scholarshomeandabroadpublishedquitenumbersofperiodicalprsonthisareainordertoproposesomebeneficialideastotheregulationofbusinesscontract.Businesscontractowesitssetofformsandformula.Whileduringthefrequentinternationaltrades,thethoroughlyaccurateinterpretationofcontractisimpossible,andamongthemtheformsofcontracthastakenintoprominencealltheway.Itwasdiscoveredthattheshoftypeisnearlythesame,commaandstoptakethepredominance,andcapitalizationistheprevalenceatgraphlogicallevel.Secondly,contracttranslationhastakenonsuchprominenceinrecentyearsofresearchonbusinesscontract.AndthatofEnglishtoChineseorChinesetoEnglisharethemainwaysofprobingintobusinesscontracttranslationinChina.TheachievementgainedincontracttranslationstudiesbyChinesescholarsareessentiallyembodiedinmonographs,Master’sdissertationsandpediclepr.Furthermore,manyscholarstriedtoemploythemethodsofstylisticysis,registerysisandgenreysistomakeasystematicandcomprehensiveinvestigationtotextualfeaturesofbusinesscontract.Inordertoutilizetheefficienciesofthethreeapproaches,andremedytheinefficientaspectsofthem,todemonstratethesocialcommunicativepurpose,registerfeaturesandlinguisticstrategiesofthecontractinanattempttoidentifypedagogicalimplicationstotheformulationofcontractsandagreementsinInaddition,amethodadoptedbymostChinesescholarsistoexplorethebusinesscontractfromtheofdiscourseysis.Thisisawidespreadresearchtrendsofbusiness.Itisanviewpointsharedbymostscholarsthatitisnecessaryforustoexplorethelanguagevarietyintermsofdiscourseysis.Inbusinesscontract,cohesivedevicesareveryimportantindiscourseysis.Thecoherenceofatextiscarriedoutintheformofvariouscohesivedevices,grammaticaldevices,lexicalcohesion,logicalconnectors,etc.Suchdevicescanmakethelogicofreasonmoreclarified.[3]Inaconclusion,onthebasisofscholars’achievementabove,thethesisistoadoptoneresearchpattern,thatis,exploringbusinesscontractinaccordancewiththediscourseysis.Inordertoachievethis,thethesisisinclinedtoexploreinthefollowingsectionssomerelativetheoriesofdiscourseysiswhichpavethewayforthefundamentalconstructionofTheRelatedTheoriesof Asaresearching,discourseysisrelatestovariousrelativetheories.Comparingwithmosttraditionallinguistics,currentdiscourseystsnotonlystudylanguageuseof“beyondthesentenceboundary”,butalsoprefertoyze“naturallyExplanationofDiscourseInthispart,thedefinition,theresearchinglevelsandaspectsofdiscourseysisarerelated.Fromthose,wecangetanoverviewofthediscourseysis,andthuscontributetothefurtherunderstandingofdiscourseysis.DefinitionofDiscourseAsforthedefinitionofdiscourseysis,differentscholarshomeandabroaddefineitfromdifferentaspectsandviewpoint.Somelinguistsdefinediscourseysisaccordingtotheresearchingobject.Therefore,itisbelievedthatdiscourseysisreferstodiscoursegrammarbySinclairandCoulthard.Furthermore,WiddowsonandHallidaybelievedthatdiscourseysisisthestudyoftextcohesionanddiscoursecoherence.Roughlyspeaking,itreferstoattemptstostudytheanizationoflanguageabovethesentenceorabovetheclause,andthereforetostudylargerlinguisticunits,suchasconversationalexchangesorwrittentexts.Itfollowsthatdiscourseysisisalsoconcernedwithlanguageinuseinsocialcontextsandinparticularlywithinteractionordialoguebetweenspeakers.Discourseysisconcernstheinteractionoftextswitowledgeofcontexttocreatediscourse.Anddiscourse,asapposedtotext,issstretchoflanguageinuse,takingonmeaningincontextforitsusers,andperceivedbythemaspurposeful,meaningful,andconnected.Thisqualityofperceivedpurpose,meaning,andconnectionisknownasAndstillthereisotherlinguisticswhodefinesdiscourseysisfromtheviewpointoffunction.Brown&Yuleregard“theysisofdiscourseisnecessarily,theysisoflanguageinuse.“Fromthosedefinitionsmentionedabove,Itisdiscoveredthatdiscoursesysisisconcentratedwithlanguageaswellasthecontextsofcommunication.Itismentionedthatwewillexplorethediscourseysisfromitsdifferentlevelsandaspectsaswellasapplyingthetheoryofcohesion.Fromthosetheoriesofdiscourseysis,theEnglishbusinesscontractisyzedindetails.AspectsandLevelsofDiscourseScholarshomeandabroaddoresearchesondiscourseysisfromquitenumbersofaspectsandonvariouslevelsofdiscourseysis.Ononehand,discourseysisisdiscussedindifferentaspects,andamongthem,themostprominentofaspectsarethefunction,theregister,thecontext,thecohesionandcoherence,theconnectorsaswellasthecontextualstructure.Ontheotherhand,thelevelsofdiscourseysisconsistofwordlevel,phraselevel,sentencelevelandcontextuallevel.Asfortheaspectsandlevelsofdiscourseysismentionedabove,wecangetafurtherunderstandingthatlinguistyzediscourseysisinalotofviewpoints.Andwhenthosemethodsarebeingappliedintotheysisofbusiness,itisnodoubtthatallofthosetheoriescanbeadopted,however,consideringthevividnessofthethesis,weadoptedsomeaspectsandsomelevelsofthediscourseysis.Sothattheviewpointofthethesiswillbeclear-out.Initially,thediscoursecanbeyzedinseverallevelsofword,phrase,sentenceandcontextvertically.Thusinthethesis,theselectionofwordsandphrase,thearrangementofsentenceincontractshouldbeconsidered.Secondly,inthehorizontal,theelementscohesion,coherenceandcontextualstructureareCohesionin AswehavereferredinthepartofLiteraturereview,Cohesionrepresentsalotinthedevelostageofdiscourseysis,whichwasmainlyproposedbyM,A.KHallidayinhisbookCohesionandFunctionalGrammar.TheDefinitionofAccordingtothedefinitiononWikipedia,Cohesionreferstothelinguisticelementsthatmakeadiscoursesemanticallycoherent.InCohesioninEnglish,Halliday&Hasandefinedthat“Cohesionisasemanticone;itreferstotherelationsofmeaningthatexistwithinthetext,andthatdefineitasatext.Supposeonepartofdiscoursedominatestheotherpart,andthenthereisacohesiverelationbetweenthesetwoparts.Cohesionliesnotonlyinintersentencebutalsoinsidesentence.”AccordingtoHalliday&Hasan,therearefivecohesiveresources,namelyreference,substitution,ellipsis,conjunctionandlexicalcohesion.CohesionandCohesionandcoherence innature.Thesocialcommunicativepurposeofcontractthatisdesignedtofulfill,istoestablish,modifyandterminatethelegalobligationsanddutiesbetweenthepartiesconcernedwiththecontract.Itisenforceablebylaw,andanypartythatfailstofulfillhiscontractualobligationsmaybesuedandforcedtomakecompensation,thoughmostcontractsdonotgiverisetodisputes.Thebodyofabusinesscontractusuallyincludesdefinitionclause,generaltermsandconditions,basicconditions,assignment,arbitration,andsoon.Inaddition,inthisthesis,wetrytoapproachtheEnglishbusinesscontractfromtheofdiscourseysis.Amongthoserelatedtheories,thewordlevel,phraselevelandsentencelevelofysisaswellasthecohesionindiscourseysisareemphasized.Inthefollowingpartsofthissection,wewillyzethemindetail.WordsarethebasiccomponentsinLanguageweuse.ThelanguageinbusinesscontractisdefiniydifferentfromthatweusedindailyEnglisheitherintheselectionofwordsorinstylebeadopted.ThewordsusedinEnglishbusinesscontractarecharacterizedbylegality,formality,clarityandexactitude.Inthefollowingpartofthisthesis,wewillexploretheselectionofwordsinEnglishbusinesscontractfromtheaspectsofcompoundadverbandformalwords.CompoundThefrequentuseofcompoundadverbsisoneofthemainfeaturesofbusinesscontract.Thosecompoundadverbsaredistinct,whichextractedthemselvesfromarchaicwordsandareusuallycomposedofoneadverbandonepreposition.Therefore,inbusinesscontract,itisalwaysspottedthiskindofwordssuchas“hereunder”“thereafter”“whereby”.Inthispart,somespecificexamplesinthecontractnamedOceanMarineCargoClausefromAninsurancelimitedcompanyareexplainedtoillustratetheviewpointinthisthesis.Thefollowingsentencesareselectedfromdifferentpartofthiscontract.WarehousetoWarehouseClause:ThisinsuranceattachesfromthetimethegoodsherebyinsuredleavethewarehouseorplaceofstoragenamedinthePolicyforthecommencementofthetransitandcontinuesinforceintheordinarycourseoftransitincludingsea,landandinlandwaterwaytransitsandtransitinlighteruntiltheinsuredgoodsaredeliveredtotheconsignee’sfinalwarehouseorplaceofstorageatthedestinationnamedinthePolicyortoanyotherplaceusedbytheInsuredforallocationordistributionofthegoodsorforstorageotherthanintheordinarycourseoftransit.InEnglishdictionary,theword“hereby”meansinawaythatmakessomethingLegalandapparently,hereitmeansthegoodsareinsuredbytheprocedureasexactlyaswhatisstipulatedinlawsofinsurance.ItisthedutyoftheInsuredtoattendtoallmattersasspecifiedIf,owingtodelay,deviation,forceddischarge,reshipmentortransshipmentbeyondthecontroloftheInsuredoranychangeorterminationofthevoyagearisingfromtheexerciseofalibertygrantedtotheship-ownersunderthecontractofaffreightment,theinsuredgoodsarriveataportorplaceotherthanthatnamedinthePolicy,subjecttoimmediatenoticebeinggiventotheinsurerbytheInsuredandanadditionalpremiumbeingpaid,ifrequired,thisinsuranceshallremaininforceandshallterminateasThemeasuressotakenbytheInsuredorbytheinsurershallnotbeconsideredrespectively,asawaiverofabandonmenthereunder,orasanacceptancethereof.Thefollowing panyanyclaimhereundermadeagainsttheWecoulddiscoverthattheword“hereunder”appearsforetofivetimesinjusttwopagesofthiscontract,anditsmeaningissimilarto“below”insentence2,sentence3andsentence6,while“hereunder”showsmuchmoreauthority,formality,concisenessthantheusualword“below”,whichcharacterizesbusinesscontractthananyotherwritingstyles,andithaswidermeaningswhichcanbeseeninsentence3and5
