乙方應(yīng)及時(shí)以書面形式通乙方按修改或變更?施工中如發(fā)現(xiàn)因甲方要求而發(fā)生的設(shè)計(jì)錯(cuò)誤或嚴(yán)重不合理的地方,知甲方，由甲方及時(shí)會(huì)同乙方等有關(guān)單位研究確定修改意見或變更設(shè)計(jì)文件,的設(shè)計(jì)文件進(jìn)行施工。若發(fā)生增加費(fèi)用（包括返工損失、停工、窩工、人員和機(jī)構(gòu)設(shè)備調(diào)遷、材料構(gòu)配件積壓的實(shí)際損失）由甲方負(fù)責(zé)，并調(diào)整合同造價(jià)。乙方應(yīng)及時(shí)以書面形式通乙方按修改或變更IfandwhenanyerrorormaterialunreasonableproblemofdesignduetopartyArequirement.PartyBshallnotifyPartyApromptlyinwritinganddecidetheamendmentormodification ofthedesigndocumentationbytheconsultation andnegotiation betweenpartiesandunitsconcerned.PartyBshallcarryoutconstruction accordingtothedesigndocumentsmodifiedorchanged.Ifprojectcostincrease(includingtheactuallossofreworkloss,stoppageorslowdown,personnelandmachineequipmentrelocated,materialstructures,fixturesbacklog),shallberesponsibilitybyParty A,andbeadjustedthecontractpricetogetherwithPartyB.三?乙方在保證工程質(zhì)量和不降低設(shè)計(jì)標(biāo)準(zhǔn)的前提下，提岀修改設(shè)計(jì)、修改工藝的合理化建議，經(jīng)甲方、設(shè)計(jì)單位或有關(guān)技術(shù)部門同意后采取實(shí)施。AnyreasonablesuggestiononthemodificationsofdesignandcraftproposedbyPartyB,subjecttothequalityandwithoutreducingstandardsofdesign,couldbecarriedoutupontheapprovalofPartyA,designunitorconcernedtechnicaldepartment.四?甲方如需設(shè)計(jì)變更，必須作岀正式修改通知書和修改圖紙， 乙方才予實(shí)施。重大修改和增加造價(jià)時(shí)，必須另行協(xié)商，乙方才予實(shí)施。PartyAshould,ifanynecessarydesignchange,maketheformalamendmentandmodifydrawingsforPartyB 'simplementation..MaterialchangesandcostincreasedmustbenegotiatedbybothpartiesbeforePartyBimplementthesame.第七條 工程驗(yàn)收Article7Acceptaneeofproject一?工程施工中地下工程、結(jié)構(gòu)工程必須具有隱蔽驗(yàn)收簽證、 試水、抗?jié)B等驗(yàn)收合格記錄。甲方須及時(shí)辦理驗(yàn)收簽訂手續(xù)。Theundergroundengineering,structuralengineeringintheconstructionofprojectshouldbecheckedandwithissueofcertificateandtherecordofacceptaneeofwatertest,anti-permeabilityandsoon.PartyAshoulddealwiththeacceptaneesignedformalitiestimely.二.工程竣工驗(yàn)收后，甲方才可使用 PartyAcanusetheprojectaftercompletionacceptanee在規(guī)定的保修期內(nèi)， 凡因施工造成的質(zhì)量缺陷應(yīng)由乙方無償保修。 其保修條件、范圍和期限按城鄉(xiāng)建設(shè)環(huán)境保護(hù)部(84)城建字第79號(hào)通知印發(fā)的《建筑工程保修辦法(試行)》執(zhí)行。Intheprovisionwarrantyperiod,anyconstructionquality defects,PartyBshouldmakemaintenancefreeofthequalitydefectduetoconstruction, thescopeanddurationcarryoutaccordingtotheissuaneeofChengJianNo.79notification"Constructionengineeringguaranteemeasures(Trial)"byUrbanandRuralConstructionandEnvironmentalProtectionDepartment(84).第八條 違約責(zé)任Article8Liabilityforbreachofcontract乙方的責(zé)任： ResponsibilityofPartyB:一?工程質(zhì)量不符合合同規(guī)定的，負(fù)責(zé)無償修理和返工。Takechargeofgratisrepairandreworkifprojectqualitydoesn'tmeetcontact'sstipulation二?工程不能按合同規(guī)定的工期交付使用的， 按合同中關(guān)于建設(shè)工期提交或拖后的獎(jiǎng)罰規(guī)定償付逾期罰款。Iffailtodelivertheconstruction accordingtothecontract ontime,Theoverduefinesaccordingtopunishmentorawardof theprovision concerningthedeliveryordelay.甲方的責(zé)任： TheresponsibilityofPartyA:一?未能按照合同的規(guī)定履行自己應(yīng)負(fù)的責(zé)任， 除竣工日期得以順延外， 還應(yīng)賠償乙方由此造成的實(shí)際損失。Failedtofulfilltheirresponsibilitiesinaccordaneewiththeprovisionsofthecontract,inadditiontothecompletiondatetobepostponedshouldbecompensationfortheactuallossofPartyB.二?工程中途停建、緩建或由于設(shè)計(jì)變更以及設(shè)計(jì)錯(cuò)誤造成的返工， 應(yīng)采取措施彌補(bǔ)或減少損失。同時(shí)，賠償乙方由此造成的停工、窩工、返工、倒運(yùn)、人員和機(jī)械設(shè)備調(diào)遷、材料和構(gòu)件積壓的實(shí)際損失。Theongoingprojectisstopped,postponedorduetodesign
