《中華人民共和國(guó)勞動(dòng)合同法實(shí)施條例》已經(jīng)2008年9月3日國(guó)務(wù)院第25次常務(wù)會(huì)議通過,現(xiàn)予公布,自公布之日起施行。

中華人民共和國(guó)勞動(dòng)合同法實(shí)施條例ChapterIGeneralProvisions第一章總則
Article1ThisRegulationisformulatedtoimplementtheEmploymentContractLawofthePeople’sRepublicofChina(hereinafterreferredtoasEmploymentContractLaw).[url=]第一條[/url]為了貫徹實(shí)施《中華人民共和國(guó)勞動(dòng)合同法》(以下簡(jiǎn)稱勞動(dòng)合同法),制定本條例。Article2Thepeople’sgovernmentsatalllevels,thelaboradministrativedepartmentsofthepeople’sgovernmentsatorabovethecountylevel,andthelaborunions,etc.shalltakestepstopromotetheimplementationoftheEmploymentContractLawanddevelopaharmoniousemploymentrelationship.[url=]第二條[/url]各級(jí)人民ZF和縣級(jí)以上人民ZF勞動(dòng)行政等有關(guān)部門以及工會(huì)等組織,應(yīng)當(dāng)采取措施,推動(dòng)勞動(dòng)合同法的貫徹實(shí)施,促進(jìn)勞動(dòng)關(guān)系的和諧。Article3Legallyestablishedaccountingfirms,lawfirmsandotherpartnershipsandfoundationsareemployersdefinedintheEmploymentContractLaw.[url=]第三條[/url]依法成立的會(huì)計(jì)師事務(wù)所、律師事務(wù)所等合伙組織和基金會(huì),屬于勞動(dòng)合同法規(guī)定的用人單位。ChapterIIConclusionofEmploymentContracts第二章勞動(dòng)合同的訂立
Article4AbranchofficeestablishedbyanemployerasdefinedintheEmploymentContractLawwhichhasobtaineditsbusinesslicenseorregistrationcertificateaccordingtolawmayconcludeemploymentcontractswithemployeesinthenameofanemployer;ifithasfailedtoobtainedabusinesslicenseorregistrationcertificate,itmayconcludeemploymentcontractswithemployeesonlyupontheauthorizationoftheemployer.[url=]第四條[/url]勞動(dòng)合同法規(guī)定的用人單位設(shè)立的分支機(jī)構(gòu),依法取得營(yíng)業(yè)執(zhí)照或者登記證書的,可以作為用人單位與勞動(dòng)者訂立勞動(dòng)合同;未依法取得營(yíng)業(yè)執(zhí)照或者登記證書的,受用人單位委托可以與勞動(dòng)者訂立勞動(dòng)合同。Article5Whereanyemployee,afterbeingnotifiedbytheemployerinwriting,failstoconcludeawrittenemploymentcontractwiththeemployerwithinonemonthfromthedaywhenheisemployed,theemployershallterminatetheemploymentrelationshipwiththeemployeeandnotifytheemployeeinwriting,inwhichcase,theemployerisnotrequiredtomakeanyeconomiccompensationtotheemployee,butshallpaytheemployeeforhisactualworkingtime.[url=]第五條[/url]自用工之日起一個(gè)月內(nèi),經(jīng)用人單位書面通知后,勞動(dòng)者不與用人單位訂立書面勞動(dòng)合同的,用人單位應(yīng)當(dāng)書面通知?jiǎng)趧?dòng)者終止勞動(dòng)關(guān)系,無需向勞動(dòng)者支付經(jīng)濟(jì)補(bǔ)償,但是應(yīng)當(dāng)依法向勞動(dòng)者支付其實(shí)際工作時(shí)間的勞動(dòng)報(bào)酬。Article6Whereanemployerfailstoconcludeawrittenemploymentcontractwithanemployeeafterthelapseofmorethanonemonthbutlessthanoneyearfromthedatewhentheemployeeisemployed,itshallpaytotheworkerhismonthlywagesindoubleamountaccordingtoArticle82oftheEmploymentContractLaw,andshallconcludeawrittenemploymentcontractwiththeemployee.Whereanemployeerefusestoconcludeawrittenemploymentcontractwithhisemployer,theemployershallterminatetheemploymentrelationship,notifytheemployeeinwriting,andmakeeconomiccompensationstotheemployeeaccordingtoArticle47oftheEmploymentContractLaw.
Thestarttimeoftheperiodwhenanemployerisrequiredtopayanemployeehismonthlywagesindoubleamountshallbethedayfollowingthefullmonthfromthedaywhentheemployeeisemployed,andtheendtimeshallbethedaybeforethedaywhenthewrittenemploymentcontractisconcluded.[url=]第六條[/url]用人單位自用工之日起超過一個(gè)月不滿一年未與勞動(dòng)者訂立書面勞動(dòng)合同的,應(yīng)當(dāng)依照勞動(dòng)合同法第八十二條的規(guī)定向勞動(dòng)者每月支付兩倍的工資,并與勞動(dòng)者補(bǔ)訂書面勞動(dòng)合同;勞動(dòng)者不與用人單位訂立書面勞動(dòng)合同的,用人單位應(yīng)當(dāng)書面通知?jiǎng)趧?dòng)者終止勞動(dòng)關(guān)系,并依照勞動(dòng)合同法第四十七條的規(guī)定支付經(jīng)濟(jì)補(bǔ)償。
前款規(guī)定的用人單位向勞動(dòng)者每月支付兩倍工資的起算時(shí)間為用工之日起滿一個(gè)月的次日,截止時(shí)間為補(bǔ)訂書面勞動(dòng)合同的前一日。Article7Whereanemployerfailstoconcludeawrittenemploymentcontractwithanemployeeafterthelapseofonefullyearfromthedaywhentheemployeeisemployed,underArticle82oftheEmploymentContractLaw,theemployershallpayhismonthlywagesindoubleamountfromthedaynexttothelapseofafullmonthtothedaybeforeitisafullyearsincetheemployee’semployment,anditshallbedeemedthattheemployerhasconcludedanemploymentcontractwithoutafixedtermwiththeemployeeonthedaywhenitisafullyearsincetheemployee’semployment,andawrittenemploymentcontractwithoutafixedtermshallbeconcludedwiththeemployeeimmediately.[url=]第七條[/url]用人單位自用工之日起滿一年未與勞動(dòng)者訂立書面勞動(dòng)合同的,自用工之日起滿一個(gè)月的次日至滿一年的前一日應(yīng)當(dāng)依照勞動(dòng)合同法第八十二條的規(guī)定向勞動(dòng)者每月支付兩倍的工資,并視為自用工之日起滿一年的當(dāng)日已經(jīng)與勞動(dòng)者訂立無固定期限勞動(dòng)合同,應(yīng)當(dāng)立即與勞動(dòng)者補(bǔ)訂書面勞動(dòng)合同。Article8TherosterofemployeesasmentionedinArticle7oftheEmploymentContractLawshallcontaintheemployees’name,gender,citizen’sidentitynumber,registeredpermanentresidenceaddressandcurrentaddress,contactinformation,formofemployment,starttimeofemployment,andtermoftheemploymentcontract,etc.[url=]第八條[/url]勞動(dòng)合同法第七條規(guī)定的職工名冊(cè),應(yīng)當(dāng)包括勞動(dòng)者姓名、性別、公民身份號(hào)碼、戶籍地址及現(xiàn)住址、聯(lián)系方式、用工形式、用工起始時(shí)間、勞動(dòng)合同期限等內(nèi)容。Article9Thestarttimeoftheterm“10consecutiveyears”asmentionedinParagraph2ofArticle14oftheEmploymentContractLawshallbethedaywhentheemployerhiredtheemployee,includingthetimeofemploymentbeforetheEmploymentContractLawcameintoforce.[url=]第九條[/url]勞動(dòng)合同法第十四條第二款規(guī)定的連續(xù)工作滿10年的起始時(shí)間,應(yīng)當(dāng)自用人單位用工之日起計(jì)算,包括勞動(dòng)合同法施行前的工作年限。Article10Whereanemployeeistransferredtoanewemployerforreasonsnotattributabletohimself,hisworkingtimewiththeoriginalemployershallbeconsolidatedintohisworkingtimewiththenewemployer.Iftheoriginalemployerhasmadeeconomiccompensationsforhisworkingtimewiththeoriginalemployer,thenewemployershallnotconsidertheemployee’sworkingtimewiththeoriginalemployerwhencalculatingeconomiccompensationsmadetosuchemployeefordissolvingorterminatingtheemploymentcontractwithhim.[url=]第十條[/url]勞動(dòng)者非因本人原因從原用人單位被安排到新用人單位工作的,勞動(dòng)者在原用人單位的工作年限合并計(jì)算為新用人單位的工作年限。原用人單位已經(jīng)向勞動(dòng)者支付經(jīng)濟(jì)補(bǔ)償?shù)?,新用人單位在依法解除、終止勞動(dòng)合同計(jì)算支付經(jīng)濟(jì)補(bǔ)償?shù)墓ぷ髂晗迺r(shí),不再計(jì)算勞動(dòng)者在原用人單位的工作年限。Article11WhereanemployeeproposestheconclusionofanemploymentcontractwithoutafixedtermwiththeemployerunderParagraph2,Article14oftheEmploymentContractLaw,theemployershallconcludeanemploymentcontractwithoutafixedtermwithhim,unlessitisotherwiseagreedtobybothparties.Thecontentsofanemploymentcontractshallbedeterminedbybothpartiesundertheprinciplesoflegality,equity,freewill,consensusandgoodfaith.AnydisputeoverthecontentsshallbesettledaccordingtoArticle18oftheEmploymentContractLaw.[url=]第十一條[/url]除勞動(dòng)者與用人單位協(xié)商一致的情形外,勞動(dòng)者依照勞動(dòng)合同法第十四條第二款的規(guī)定,提出訂立無固定期限勞動(dòng)合同的,用人單位應(yīng)當(dāng)與其訂立無固定期限勞動(dòng)合同。對(duì)勞動(dòng)合同的內(nèi)容,雙方應(yīng)當(dāng)按照合法、公平、平等自愿、協(xié)商一致、誠(chéng)實(shí)信用的原則協(xié)商確定;對(duì)協(xié)商不一致的內(nèi)容,依照勞動(dòng)合同法第十八條的規(guī)定執(zhí)行。Article12Forthepublicwelfarepostsarrangedbythelocalpeople’sgovernmentsatvariouslevelsandtherelevantdepartmentsofthelocalpeople’sgovernmentatorabovethecountylevelforpeoplewithemploymentdifficultieswhichenjoypost-basedsubsidiesandsocialinsurancesubsidies,theprovisionsoftheEmploymentContractLawwithrespecttoemploymentcontractswithoutafixedtermandeconomiccompensationsarenotapplicabletotheemploymentcontractsforthoseposts.[url=]第十二條[/url]地方各級(jí)人民ZF及縣級(jí)以上地方人民ZF有關(guān)部門為安置就業(yè)困難人員提供的給予崗位補(bǔ)貼和社會(huì)保險(xiǎn)補(bǔ)貼的公益性崗位,其勞動(dòng)合同不適用勞動(dòng)合同法有關(guān)無固定期限勞動(dòng)合同的規(guī)定以及支付經(jīng)濟(jì)補(bǔ)償?shù)囊?guī)定。Article13AnemployerandanemployeemaynotagreeonanyothertermfortheterminationoftheemploymentcontractbeyondthecircumstancesfortheterminationofemploymentcontractsasprescribedinArticle44oftheEmploymentContractLaw.[url=]第十三條[/url]用人單位與勞動(dòng)者不得在勞動(dòng)合同法第四十四條規(guī)定的勞動(dòng)合同終止情形之外約定其他的勞動(dòng)合同終止條件。Article14Wheretheplaceofperformanceofanemploymentcontractisnottheplaceofregistrationoftheemployer,suchmattersabouttheemployeeasthemaximumwagelevel,laborprotection,workconditions,preventionagainstoccupationalharmandthelocalaveragemonthlywagesinthelastyearshallbegovernedbytherelevantprovisionsoftheplaceofperformanceoftheemploymentcontract.Iftherelevantstandardsattheplaceofregistrationoftheemployerarehigherthanthoseattheplaceofperformanceoftheemploymentcontractandboththeemployerandtheemployeehaveagreedonfollowingtherelevantprovisionsoftheplaceofregistrationoftheemployer,therelevantprovisionsoftheplaceofregistrationoftheemployershallapply.[url=]第十四條[/url]勞動(dòng)合同履行地與用人單位注冊(cè)地不一致的,有關(guān)勞動(dòng)者的最低工資標(biāo)準(zhǔn)、勞動(dòng)保護(hù)、勞動(dòng)條件、職業(yè)危害防護(hù)和本地區(qū)上年度職工月平均工資標(biāo)準(zhǔn)等事項(xiàng),按照勞動(dòng)合同履行地的有關(guān)規(guī)定執(zhí)行;用人單位注冊(cè)地的有關(guān)標(biāo)準(zhǔn)高于勞動(dòng)合同履行地的有關(guān)標(biāo)準(zhǔn),且用人單位與勞動(dòng)者約定按照用人單位注冊(cè)地的有關(guān)規(guī)定執(zhí)行的,從其約定。Article15Anemployee’wagesduringprobationshallnotbelessthan80%oftheminimumwagesforthesamepostoftheemployeror80%ofthewagesstipulatedintheemploymentcontract,andshallnotbelessthantheminimumwageleveloftheplacewheretheemployerislocated.[url=]第十五條[/url]勞動(dòng)者在試用期的工資不得低于本單位相同崗位最低檔工資的80%或者不得低于勞動(dòng)合同約定工資的80%,并不得低于用人單位所在地的最低工資標(biāo)準(zhǔn)。Article16ThetrainingexpensesasmentionedinParagraph2,Article22oftheEmploymentContractLawincludethetrainingexpensesspentbytheemployeronprovidingprofessionaltechnicaltrainingsforanemployee,thetravelexpensesduringthetraining,andotherdirectexpensesspentontheemployeeasaresultofthetraining.[url=]第十六條[/url]勞動(dòng)合同法第二十二條第二款規(guī)定的培訓(xùn)費(fèi)用,包括用人單位為了對(duì)勞動(dòng)者進(jìn)行專業(yè)技術(shù)培訓(xùn)而支付的有憑證的培訓(xùn)費(fèi)用、培訓(xùn)期間的差旅費(fèi)用以及因培訓(xùn)產(chǎn)生的用于該勞動(dòng)者的其他直接費(fèi)用。Article17WhereanemploymentcontractexpireswhenthetermofservicestipulatedbytheemployerandtheemployeeaccordingtoArticle22oftheEmploymentContractLawhasnotexpiredyet,theemploymentcontractshallperformeduntilatleasttheexpirationofthetermofservice,unlessitisotherwisestipulatedbybothparties.[url=]第十七條[/url]勞動(dòng)合同期滿,但是用人單位與勞動(dòng)者依照勞動(dòng)合同法第二十二條的規(guī)定約定的服務(wù)期尚未到期的,勞動(dòng)合同應(yīng)當(dāng)續(xù)延至服務(wù)期滿;雙方另有約定的,從其約定。ChapterIIIDissolutionandTerminationofEmploymentContract第三章勞動(dòng)合同的解除和終止
Article18Underanyofthefollowingcircumstances,anemployeemay,accordingtotheconditionsandproceduresprescribedintheEmploymentContractLaw,dissolveanemploymentcontractwithafixedterm,anemploymentcontractwithoutafixedtermoranemploymentcontractthatsetsthecompletionofaspecifictaskasthetermofthecontractconcludedwiththeemployer:
1.theemployeeandtheemployersoagree;
2.theemployeehasnotifiedtheemployeeofthedissolutioninwritingatleast30daysinadvance;
3.theemployeehasnotifiedtheemployerofthedissolutionthreedaysinadvanceduringprobation;
4.theemployerfailstoprovidelaborprotectionorworkconditionsasithaspromisedintheemploymentcontract;
5.theemployerfailstopaylaborremunerationsonscheduleorinfullamount;
6.theemployerfailstopaysocialinsurancepremiumsfortheemployeeasrequiredbylaw;
7.someoftheemployer’srulesorprocedureshavecontravenedthelawanddamagedtherightsandinterestsoftheemployee;
8.theemployer,bymeansofdeceptionorcoercionorbytakingadvantageoftheemployee’sdifficulties,forcestheemployeetoconcludeorchangetheemploymentcontractagainsttheemployee’struewill;
9.theemployerdisclaimsitslegalliabilityordeniestheemployee’srightsintheemploymentcontract;
10.theemployerviolatesthemandatoryprovisionsofanylaworadministrativeregulation;
11.theemployercompelstheemployeetoworkbyforce,threatorillegallyrestrictingthepersonalfreedomoftheemployee;
12.theemployergivesordersinviolationofthesafetyregulationsorforcestheemployeetoriskhislife;or
13.othercircumstancesunderwhichtheemployeecandissolvetheemploymentcontractassetforthinlawsoradministrativeregulations.[url=]第十八條[/url]有下列情形之一的,依照勞動(dòng)合同法規(guī)定的條件、程序,勞動(dòng)者可以與用人單位解除固定期限勞動(dòng)合同、無固定期限勞動(dòng)合同或者以完成一定工作任務(wù)為期限的勞動(dòng)合同:
(一)勞動(dòng)者與用人單位協(xié)商一致的;
(二)勞動(dòng)者提前30日以書面形式通知用人單位的;
(三)勞動(dòng)者在試用期內(nèi)提前3日通知用人單位的;
(四)用人單位未按照勞動(dòng)合同約定提供勞動(dòng)保護(hù)或者勞動(dòng)條件的;
(五)用人單位未及時(shí)足額支付勞動(dòng)報(bào)酬的;
(六)用人單位未依法為勞動(dòng)者繳納社會(huì)保險(xiǎn)費(fèi)的;
(七)用人單位的規(guī)章制度違反法律、法規(guī)的規(guī)定,損害勞動(dòng)者權(quán)益的;
(八)用人單位以欺詐、脅迫的手段或者乘人之危,使勞動(dòng)者在違背真實(shí)意思的情況下訂立或者變更勞動(dòng)合同的;
(九)用人單位在勞動(dòng)合同中免除自己的法定責(zé)任、排除勞動(dòng)者權(quán)利的;
(十)用人單位違反法律、行政法規(guī)強(qiáng)制性規(guī)定的;
(十一)用人單位以暴力、威脅或者非法限制人身自由的手段強(qiáng)迫勞動(dòng)者勞動(dòng)的;
(十二)用人單位違章指揮、強(qiáng)令冒險(xiǎn)作業(yè)危及勞動(dòng)者人身安全的;
(十三)法律、行政法規(guī)規(guī)定勞動(dòng)者可以解除勞動(dòng)合同的其他情形。Article19Underanyofthefollowingcircumstances,anemployermay,accordingtotheconditionsandproceduresprescribedintheEmploymentContractLaw,dissolveanemploymentcontractwithafixedterm,anemploymentcontractwithoutafixedtermoranemploymentcontractthatsetsthecompletionofaspecifictaskasthetermofthecontractconcludedwithanemployee:
1.theemployerandtheemployeesoagree;
2.theemployeeisprovedtohavefailedtomeettheemploymentconditionsduringtheprobation;
3.theemployeeseriouslyviolatestherulesandproceduressetupbytheemployer;
4.theemployeeseriouslyneglectshisdutiesorengagesinmalpracticeforpersonalgainsandhascausedseveredamagestotheemployer;
5.theemployeesimultaneouslyentersanemploymentrelationshipwithanyotheremployerandthusseriouslyaffectshiscompletionofthetasksassignedbytheemployer,ortheemployeerefusestocorrectaftertheemployerhaspointedouttheproblem;
6.theemployee,bymeansofdeceptionorcoercionorbytakingadvantageoftheemployer’sdifficulties,forcestheemployertoconcludeorchangetheemploymentcontractagainsttheemployer’struewill;
7.theemployeeisunderinvestigationforcriminalliabilities;
8.theemployeeissickorisinjuredforanon-work-relatedreasonandcannotresumehisoriginalpositionaftertheexpirationoftheprescribedtimeperiodformedicaltreatment,norcanheassumeanyotherpositionarrangedbytheemployer;
9.theemployeeisincompetentforhispositionorisstillsoaftertrainingorbeingassignedtoanotherposition;
10.theobjectivesituationonwhichtheconclusionoftheemploymentcontractisbasedhaschangedconsiderably,whichmakesitimpossibletoperformtheemploymentcontract,andnoagreementonchangingthecontentsoftheemploymentcontracthasbeenreachedafternegotiationsbetweentheemployerandtheemployee;
11.theemployerisbeingrestructuredaccordingtotheEnterpriseBankruptcyLaw;
12.theemployerencountersseriousdifficultiesinproductionandbusinessoperations;
13.theemployerchangesitsproducts,makesimportanttechnologicalrenovations,oradjuststhewayofbusinessoperations,anditisstillnecessarytolayoffsomeemployeesaftermodifyingtheemploymentcontract;or
14.otherobjectiveeconomicsituationsinwhichtheemploymentcontractisbasedchangesubstantially,whichmakesitimpossibletoperformtheemploymentcontract.[url=]第十九條[/url]有下列情形之一的,依照勞動(dòng)合同法規(guī)定的條件、程序,用人單位可以與勞動(dòng)者解除固定期限勞動(dòng)合同、無固定期限勞動(dòng)合同或者以完成一定工作任務(wù)為期限的勞動(dòng)合同:
(一)用人單位與勞動(dòng)者協(xié)商一致的;
(二)勞動(dòng)者在試用期間被證明不符合錄用條件的;
(三)勞動(dòng)者嚴(yán)重違反用人單位的規(guī)章制度的;
(四)勞動(dòng)者嚴(yán)重失職,營(yíng)私舞弊,給用人單位造成重大損害的;
(五)勞動(dòng)者同時(shí)與其他用人單位建立勞動(dòng)關(guān)系,對(duì)完成本單位的工作任務(wù)造成嚴(yán)重影響,或者經(jīng)用人單位提出,拒不改正的;
(六)勞動(dòng)者以欺詐、脅迫的手段或者乘人之危,使用人單位在違背真實(shí)意思的情況下訂立或者變更勞動(dòng)合同的;
(七)勞動(dòng)者被依法追究刑事責(zé)任的;
(八)勞動(dòng)者患病或者非因工負(fù)傷,在規(guī)定的醫(yī)療期滿后不能從事原工作,也不能從事由用人單位另行安排的工作的;
(九)勞動(dòng)者不能勝任工作,經(jīng)過培訓(xùn)或者調(diào)整工作崗位,仍不能勝任工作的;
(十)勞動(dòng)合同訂立時(shí)所依據(jù)的客觀情況發(fā)生重大變化,致使勞動(dòng)合同無法履行,經(jīng)用人單位與勞動(dòng)者協(xié)商,未能就變更勞動(dòng)合同內(nèi)容達(dá)成協(xié)議的;
(十一)用人單位依照規(guī)定進(jìn)行重整的;
(十二)用人單位生產(chǎn)經(jīng)營(yíng)發(fā)生嚴(yán)重困難的;
(十三)企業(yè)轉(zhuǎn)產(chǎn)、重大技術(shù)革新或者經(jīng)營(yíng)方式調(diào)整,經(jīng)變更勞動(dòng)合同后,仍需裁減人員的;
(十四)其他因勞動(dòng)合同訂立時(shí)所依據(jù)的客觀經(jīng)濟(jì)情況發(fā)生重大變化,致使勞動(dòng)合同無法履行的。Article20Whereanemployerdecidestodissolvetheemploymentcontractwithanemployeebypayingthelatteranadditionalmonth’swagesaccordingtoArticle40oftheEmploymentContractLaw,theamountoftheadditionalmonth’swagesshallbedeterminedaccordingtotheemployee’swagesinthelastmonth.[url=]第二十條[/url]用人單位依照勞動(dòng)合同法第四十條的規(guī)定,選擇額外支付勞動(dòng)者一個(gè)月工資解除勞動(dòng)合同的,其額外支付的工資應(yīng)當(dāng)按照該勞動(dòng)者上一個(gè)月的工資標(biāo)準(zhǔn)確定。Article21Anemploymentcontractshallbeterminatedwhenanemployeereachesthemandatoryageforretirement.[url=]第二十一條[/url]勞動(dòng)者達(dá)到法定退休年齡的,勞動(dòng)合同終止。Article22Whereanemploymentcontractthatsetsthecompletionofaspecifictaskasthetermofthecontractisterminateduponthecompletionofthespecifictask,theemployershallmakeeconomiccompensationstotheemployeeaccordingtoArticle47oftheEmploymentContractLaw.[url=]第二十二條[/url]以完成一定工作任務(wù)為期限的勞動(dòng)合同因任務(wù)完成而終止的,用人單位應(yīng)當(dāng)依照勞動(dòng)合同法第四十七條的規(guī)定向勞動(dòng)者支付經(jīng)濟(jì)補(bǔ)償。Article23Whereanemployerterminatestheemploymentcontractwithanemployeeinjuredatwork,itshall,apartfrommakingeconomiccompensationsaccordingtoArticle47oftheEmploymentContractLaw,paymedicalsubsidiesforthework-relatedinjuryandemploymentsubsidiestothedisabledonceandforallaccordingtothestateprovisionsonwork-relatedinjuryinsurance.[url=]第二十三條[/url]用人單位依法終止工傷職工的勞動(dòng)合同的,除依照勞動(dòng)合同法第四十七條的規(guī)定支付經(jīng)濟(jì)補(bǔ)償外,還應(yīng)當(dāng)依照國(guó)家有關(guān)工傷保險(xiǎn)的規(guī)定支付一次性工傷醫(yī)療補(bǔ)助金和傷殘就業(yè)補(bǔ)助金。Article24Aemploymentcontractdissolutionorterminationcertificateissuedbyanemployershallbearthetermoftheemploymentcontract,thedatewhenitisdissolvedorterminated,thepositionoftheemployeeandtheworkingtimeoftheemployeewiththisemployer.[url=]第二十四條[/url]用人單位出具的解除、終止勞動(dòng)合同的證明,應(yīng)當(dāng)寫明勞動(dòng)合同期限、解除或者終止勞動(dòng)合同的日期、工作崗位、在本單位的工作年限。Article25WhereanyemployerdissolvesorterminatestheemploymentcontractwithanemployeeagainsttheEmploymentContractLaw,ifithaspaidacompensationaccordingtoArticle87oftheEmploymentContractLaw,itisnotrequiredtomakeeconomiccompensations.Theworkingtimebasedonwhichthesaidcompensationiscalculatedshallbecalculatedfromthedaywhentheemployeewashired.[url=]第二十五條[/url]用人單位違反勞動(dòng)合同法的規(guī)定解除或者終止勞動(dòng)合同,依照勞動(dòng)合同法第八十七條的規(guī)定支付了賠償金的,不再支付經(jīng)濟(jì)補(bǔ)償。賠償金的計(jì)算年限自用工之日起計(jì)算。Article26Ifanemployerandanemployeehavestipulatedtheperiodofserviceintheemploymentcontract,whentheemployeedissolvestheemploymentcontractaccordingtoArticle38oftheEmploymentContractLaw,itisnotagainstthestipulationoftheperiodofservice,andtheemployerisnotentitledtoasktheemployeetopayapenaltyforbreachofcontract.
Iftheemployerdissolvestheemploymentcontractwhichhasstipulatedtheperiodofserviceunderanyofthefollowingcircumstances,theemployeeshallpayapenaltyforbreachofcontracttotheemployer:
1.theemployeeseriouslyviolatestherulesandproceduressetupbytheemployer;
2.theemployeeseriouslyneglectshisdutiesorengagesinmalpracticeforpersonalgainsandhascausedseveredamagestotheemployer;
3.theemployeesimultaneouslyentersanemploymentrelationshipwithanyotheremployerandthusseriouslyaffectshiscompletionofthetasksassignedbytheemployer,ortheemployeerefusestocorrectaftertheemployerhaspointedouttheproblem;
4.theemployee,bymeansofdeceptionorcoercionorbytakingadvantageoftheemployer’sdifficulties,forcestheemployertoconcludeorchangetheemploymentcontractagainsttheemployer’struewill;or
5.theemployeeisunderinvestigationforcriminalliabilities.[url=]第二十六條[/url]用人單位與勞動(dòng)者約定了服務(wù)期,勞動(dòng)者依照勞動(dòng)合同法第三十八條的規(guī)定解除勞動(dòng)合同的,不屬于違反服務(wù)期的約定,用人單位不得要求勞動(dòng)者支付違約金。
有下列情形之一,用人單位與勞動(dòng)者解除約定服務(wù)期的勞動(dòng)合同的,勞動(dòng)者應(yīng)當(dāng)按照勞動(dòng)合同的約定向用人單位支付違約金:
(一)勞動(dòng)者嚴(yán)重違反用人單位的規(guī)章制度的;
(二)勞動(dòng)者嚴(yán)重失職,營(yíng)私舞弊,給用人單位造成重大損害的;
(三)勞動(dòng)者同時(shí)與其他用人單位建立勞動(dòng)關(guān)系,對(duì)完成本單位的工作任務(wù)造成嚴(yán)重影響,或者經(jīng)用人單位提出,拒不改正的;
(四)勞動(dòng)者以欺詐、脅迫的手段或者乘人之危,使用人單位在違背真實(shí)意思的情況下訂立或者變更勞動(dòng)合同的;
(五)勞動(dòng)者被依法追究刑事責(zé)任的。Article27AccordingtoArticle47oftheEmploymentContractLaw,themonthlywagesforcalculatingtheeconomiccompensationtobepaidtoanemployeeshallbethemonthlywagesthattheemployeedeserves,includingthehourlywagesorpieceworkwagesandothermonetaryincomessuchasbonuses,allowancesandsubsidies.Iftheaveragewagesoftheemployeeinthe12monthsbeforetheemploymentcontractisdissolvedorterminatedarebelowthelocalminimumwageslevel,theeconomiccompensationshallbecalculatedbasedonthelocalminimumwages.Iftheworkingtimeoftheemployeeislessthan12months,theaveragewagesshallbecalculatedbasedontheactualworktime.[url=]第二十七條[/url]勞動(dòng)合同法第四十七條規(guī)定的經(jīng)濟(jì)補(bǔ)償?shù)脑鹿べY按照勞動(dòng)者應(yīng)得工資計(jì)算,包括計(jì)時(shí)工資或者計(jì)件工資以及獎(jiǎng)金、津貼和補(bǔ)貼等貨幣性收入。勞動(dòng)者在勞動(dòng)合同解除或者終止前12個(gè)月的平均工資低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)的,按照當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)計(jì)算。勞動(dòng)者工作不滿12個(gè)月的,按照實(shí)際工作的月數(shù)計(jì)算平均工資。ChapterIVSpecialProvisionsonLaborDispatch第四章勞務(wù)派遣特別規(guī)定
