招標(biāo)機(jī)構(gòu)及合格的投標(biāo)人TenderingAgentforICBProcurementofMechanicandElectronicProductsandEligibleBidders2.1 招標(biāo)機(jī)構(gòu)TenderAgent機(jī)電產(chǎn)品國(guó)際招標(biāo)機(jī)構(gòu)是指依照中華人民共和國(guó)商務(wù)部令2005年第6號(hào)《機(jī)電產(chǎn)品國(guó)際招標(biāo)機(jī)構(gòu)資格審定辦法》取得招標(biāo)資格并從事機(jī)電產(chǎn)品國(guó)際招標(biāo)代理業(yè)務(wù)的企業(yè)法人。本次招標(biāo)的招標(biāo)機(jī)構(gòu)名稱、地址、電話和傳真見(jiàn)投標(biāo)資料表。TheTenderingAgentforICBProcurementofMechanicandElectronicProducts(hereinafterreferredtoas“TenderingAgent”)meanstheLegalPersonapprovedandauthorizedbytheMinistryofCommercetohandletheprocurementofmechanicandelectronicproductsbywayofInternationalCompetitiveBidding(ICB)inaccordancewiththeMeasuresforExaminingandApprovingtheQualificationofInternationalTenderingInstitutionsforElectromechanicalProducts,DecreeNo.6,2005oftheMinistryofCommerceofthePeople’sRepublicofChinaDetailssuchasname,address,telephoneandfacsimileoftheTenderingAgentforthisbiddingarelistedintheBidDataSheet.2.2 合格的投標(biāo)人EligibleBidders1） 投標(biāo)人是響應(yīng)招標(biāo)、參加投標(biāo)競(jìng)爭(zhēng)的法人或其他組織。除非另有規(guī)定，凡是來(lái)自中華人民共和國(guó)或是與中華人民共和國(guó)有正常貿(mào)易往來(lái)的國(guó)家或地區(qū)（以下簡(jiǎn)稱“合格來(lái)源國(guó)/地區(qū)”）的供貨人均可投標(biāo)。Biddersarelegalpersonsorotherorganizationswhoparticipateinbidding.ThisInvitationforBidsisopentoallsuppliersfromwithinthePeople’sRepublicofChina(hereinafterabb.as“PRC”)andallcountries/areaswhichhaveregulartraderelationswithPRC(hereinaftercalled“theeligiblesourcecountries/areas”),exceptasprovidedhereinafter.2） 本款所述的“原產(chǎn)地”是指貨物開采、生長(zhǎng)或生產(chǎn)或提供有關(guān)服務(wù)的來(lái)源地。所述的“貨物”是指通過(guò)制造、加工或用重要的和主要的元部件裝配而成的，其基本特征、功能或效用應(yīng)是商業(yè)上公認(rèn)的與元部件有著實(shí)質(zhì)性區(qū)別的產(chǎn)品。Forpurposesofthisclause,“origin”meanstheplacewherethegoodsaremined,grownorproduced,ortheplacefromwhichtherelatedservicesaresupplied.Goodsareproducedwhen,throughmanufacturing,processing,orsubstantialandmajorassemblyofcomponents,acommerciallyrecognizedproductresultsthatissubstantiallydifferentinbasiccharacteristicsorinpurposeorutilityfromitscomponents.3.3 貨物和服務(wù)的原產(chǎn)地有別于投標(biāo)人的國(guó)籍。Theoriginofgoodsandservicesisdistinctfromthenationalityofthebidder.4. 投標(biāo)費(fèi)用CostofBid4.1
