海洋運(yùn)輸貨物保險(xiǎn)條款一、定義海洋運(yùn)輸貨物保險(xiǎn)，是指保險(xiǎn)人針對承保范圍內(nèi)的貨物所承擔(dān)的一種責(zé)任保險(xiǎn)。二、保險(xiǎn)范圍保險(xiǎn)人對于以下情形的貨物損失、損壞或滅失負(fù)責(zé)：橋角、船舶倉內(nèi)裝貨或卸貨過程中發(fā)生的事故。公路、鐵路或水路從貨站到倉庫/客戶之間途中發(fā)生的事故。因天氣、海難、罷工、政治事件或其他原因?qū)е碌暮Ｉ线\(yùn)輸時(shí)間延誤，但延誤時(shí)間須達(dá)到承保條款規(guī)定。三、除外責(zé)任以下責(zé)任情形保險(xiǎn)公司不予賠償：本保險(xiǎn)條款未明示承保之貨物。貨物在裝車、裝箱或裝運(yùn)、放置過程中的損失、損壞或滅失。貨物因其自身的性質(zhì)導(dǎo)致的損失、損壞或滅失，例如病菌、霉菌、自然變化、污染、腐爛或腐蝕等。因貨物包裝不當(dāng)所引起的損失、損壞或滅失。因收件人或發(fā)件人的過錯(cuò)所引起的損失、損壞或滅失。因政府或法院行為所引起的損失、損壞或滅失。超過承運(yùn)人運(yùn)輸時(shí)限的時(shí)間內(nèi)的損失、損壞或滅失。貨物失蹤或未按送貨要求到達(dá)目的地而未經(jīng)通知的損失。四、擔(dān)保金額擔(dān)保金額以貨物運(yùn)輸?shù)膶?shí)際總價(jià)值為準(zhǔn)，如需超過貨物實(shí)際總價(jià)值的保險(xiǎn)金額，保險(xiǎn)人需要收取額外費(fèi)用。五、索賠程序貨物遭受損失、損壞或滅失時(shí)，被保險(xiǎn)人必須在以下時(shí)限內(nèi)向保險(xiǎn)人提出索賠：事故發(fā)生后10天之內(nèi)向保險(xiǎn)人報(bào)告貨物損失或滅失事故。在30天內(nèi)向保險(xiǎn)人提供有關(guān)貨物價(jià)值和損失/損壞的證明文件。六、適用法律本保險(xiǎn)合同適用于中華人民共和國保險(xiǎn)法和其他有關(guān)的法規(guī)，并且在保險(xiǎn)合同中有規(guī)定的條款和條件是有效的。MarineTransportCargoInsuranceTermsandConditions1.DefinitionMarineTransportCargoInsuranceisakindofliabilityinsuranceundertakenbytheinsureragainsttheinsuredgoodswithinthescopeofcoverage.2.ScopeofInsuranceTheinsurerisresponsiblefortheloss,damageordestructionofgoodscausedbythefollowingsituations:Accidentsthatoccurduringloadingorunloadinginportsoronboard.Accidentsthatoccurbetweentransportstationsandwarehousesorcustomersonhighways,railwaysorwaterways.Delaysinseatransportationduetoweather,maritimeaccidents,strikes,politicaleventsorotherreasons,providedthatthedelaytimemeetstherequirementsoftheinsuranceclause.3.ExclusionsThefollowingresponsibilitiesarenotcoveredbytheinsurancecompany:Goodsthatarenotcoveredinthisinsuranceclause.Loss,damageordestructionofgoodsduringtheloading,crating,shippingorplacementprocess.Loss,damageordestructionofgoodscausedbytheirownnature,suchasbacteria,mold,naturalchanges,pollution,decayorcorrosion.Loss,damageordestructionofgoodscausedbyimproperpackaging.Loss,damageordestructionofgoodscausedbythefaultoftheconsigneeorconsignor.Loss,damageordestructionofgoodscausedbygovernmentorcourtaction.Loss,damageordestructionofgoodsthatoccurafterthecarrier’stransportationtimelimitexpires.Lossofgoodsthataremissingornotdeliveredtothedestinationasrequiredwithoutnotice.4.GuaranteeAmountTheguaranteeamountshallbebasedontheactualtotalvalueofthegoodstransported.Iftheinsuranceamountexceedstheactualtotalvalueofthegoods,theinsurerneedstochargeadditionalfees.5.ClaimsProcedureWhengoodsarelost,damaged,ordestroyed,theinsuredmustfileaclaimwiththeinsurerwithinthefollowingtimelimits:Reportthelossordestructionofgoodstotheinsurerwithin10daysaftertheaccident.Providedocumentsrelatedtothevalueofthegoodsandtheloss/damagetotheinsurerwithin30days.6.ApplicableLawThisinsurancecontractissubjecttotheInsuranceLawof
