租賃協(xié)議LEASECONTRACT出租方:(如下簡(jiǎn)稱甲方):Lessor(hereinafterreferredtoasPartyA):承租方:(如下簡(jiǎn)稱乙方):Tenant(hereinafterreferredtoasPartyB):乙雙方通過(guò)友好協(xié)商一致簽訂本協(xié)議,以資共同遵守。PartyAandPartyB,havinghadfriendlydiscussion,herebyagreetoenterintothefollowingcontracttobeabidedbybothparties.一、物業(yè)地址:甲方將其所有的位于上海市的房屋及附屬設(shè)施在良好狀態(tài)下出租給乙方使用。AddressofBuilding:PartyAshallleasethehouseofitsownanditsaccessoryfacilitieswhichisingoodconditionandlocatedatDistrict,ShanghaitoPartyBfor.二、房屋面積:出租房屋的建筑面積為平方米。Floorageofhouse:Theconstructionfloorageofthehousetoletisspuaremeters.三、租賃期限:租賃期自年月日起至年月日止為期年個(gè)月。甲方應(yīng)于年月日此前將房屋騰空交給乙方使用。LeaseTerms:Theleasetermshallbefrom(mouth)(day)(year),to(month)(day)(year).AndPartyAshouldvacatethehouseandturnitovertoPartyBforusebefore(month)(day)(year).四、定金1、乙方應(yīng)付的定金為元整,乙方于年月日此前支付給甲方定金合計(jì)元整。2、在本協(xié)議簽定之后至租期開(kāi)始之前如甲方違約,則上述定金由甲方雙倍返還乙方,如乙方違約則定金由甲方?jīng)]收。定金的賠償不影響違約金的索賠。3、租期開(kāi)始之后,上述定金全額自動(dòng)轉(zhuǎn)化為:。EarnestMoney:1、PartyBwillpayasanearnestmoney.TheearnestmoneyshouldbepaidtoPartyAbefore(month)(day)(year).2、Afterthecontractissignedandbeforetheleasetermbegins,incasePartyAbreachesthecontract,itshouldpaydoubleamountoftheearnestmoneybacktoPartyB.IncasePartyBbreaches,PartyAwillconfiscatetheearnestmoney.Thecompensationoftheearnestmoneywillnotaffectclaimsagainstbeachofthecontract.3、Aftertheleasetermbegins,theabove-mentionedearnestmoneywilltranslateintoautomatically.五、租金1、數(shù)額:雙方議定租金為每月元整,乙方以形式支付給甲方。匯率按支付當(dāng)日中國(guó)人民銀行公布之外匯官方牌價(jià)中間價(jià)計(jì)。2、租金調(diào)整約定:。3、支付方式:租金按個(gè)月為壹期支付,第一期租金于年月日此前付清,后來(lái)每期租金于的日前繳納,先付后住(若乙方以劃帳形式支付租金,則匯出日為支付日,匯費(fèi)由匯出方承擔(dān)),甲方收到租金后應(yīng)予以書(shū)面簽收。4、如乙方逾期支付租金,則須支付每天相稱于月租金百分之一的滯納金;若逾期且在經(jīng)甲方正式告知后仍未付租金總計(jì)超過(guò)拾個(gè)工作日,則視為乙方自動(dòng)退租,構(gòu)成違約,甲方有權(quán)收回房屋,并追究乙方違約責(zé)任。Rental:1、Amount:Therentalagreeduponbybothpartiesshallbepermonth.BytransferringtheamountofsuchrenttoabankaccountdesignatedbyPartyAinAccordingtotheofficialstandardrateatpaymentday.2、Agreementofrentaladjustment:3、Paymentofrental:Thepaymentofrentalshallbemadeeverymonths.ThefirstPaymentshallbemadebefore(month)(day)(year).Eachsuccessivepaymentshallbemadebeforeateverypaymentmonth.PartyBshallpaytherentalbeforeitmovesintothehouse.(IfPartyBpaystherentalintheformofremittance,thedateofremittingshallbedayofrentalpayment.Theremittancefeeshallbebornebytheremitter.)PartyAshouldsignawrittenreceiptaftereachpaymentofrentalisreceived.4、IfPartyBdelayssuchrentalpayment,theinterestwouldbeimposedonoverdueaccountatadailyrateof1%ofmonthrental.AfterformalinformingbyPartyA,ifPartyBstilldelaysintheexcessoftenworkingdays,itshalldeemedasautomaticallyquittingtenancy,whichshallconstituteofcontract.六、保證金為保證房屋及其附屬設(shè)施之安全與完好及租賃內(nèi)有關(guān)費(fèi)用之準(zhǔn)期結(jié)算,乙方同意于年月日之前支付給甲方元整。作為乙方保證協(xié)議之保證金。甲方在收到保證金后應(yīng)予以書(shū)面簽收。除協(xié)議另有約定之外,甲方應(yīng)于租賃關(guān)系消除且乙方遷空、點(diǎn)清、并付清所有應(yīng)付費(fèi)用后,當(dāng)日將保證金全額無(wú)息退還乙方。因乙方違反本協(xié)議的規(guī)定,而產(chǎn)生的違約金、損害賠償以及應(yīng)付租金及有關(guān)費(fèi)用,甲方可在保證金扣抵,局限性部分乙方必須在接到甲方付款告知后十天內(nèi)補(bǔ)足。DepositofSecurity:1、Toensurethatthehouseanditsaccessoryfacilitiesaresafeandingoodconditionandthataccountsofrelevantfeesaresettledonscheduleduringthetermoflease,PartyBagreestopaytoPartyAbefore(month)(day)(year)asadepositofsecurityforfulfillingtoContract.Afterreceivingthedeposit,PartyAshouldsignawrittenreceipt.2、Unlessotherwiseagreedupon,PartyAshouldreturntoPartyBthefullamountofdepositofsecurityinterestfreeonthedayleaseisdissolvedandPartyBhasvacatedthehouse,lefteverythinginthehouseintactandpaidupallexpensesdue.Anypenaltyforbreachofcontract,compensationfordamageandrentalandotherrelevantfeespayablearisingfromPartyB’sviolationoftheprovisionsoftheContractmaybemadeupforbyPartyBwithintendaysofthereceiptofthenoticeofpaymentissuedbyPartyA.七、其他費(fèi)用乙方應(yīng)承擔(dān)租賃期內(nèi)的水費(fèi)、電費(fèi)、煤氣費(fèi)、通訊費(fèi)和其他由乙方實(shí)際使用而產(chǎn)生的費(fèi)用,并按單準(zhǔn)期繳納。地租、房產(chǎn)稅、租賃所得稅、房屋維修費(fèi)、物業(yè)管理費(fèi)等原由甲方支付的費(fèi)用,仍由甲方承擔(dān)。OtherFee:PartyBshouldbearthewater,electricity,gasandcommunicationfeesandallotherfeesincurredbyPartyBinactualuseandpaythebillsonscheduleduringthetermoflease.Thelandrent,housetax,incometaxandhousemaintenancefee,managementfeesthatwereoriginallypayablebyPartyAshallcontinuetobepaidbyPartyA.八、甲方的義務(wù):甲方須準(zhǔn)時(shí)將房屋及附屬設(shè)施交付乙方使用。房屋設(shè)施如因質(zhì)量原因,自然損耗或?yàn)?zāi)害而受到損壞時(shí),甲方有修繕的責(zé)任并承擔(dān)有關(guān)的費(fèi)用。甲方應(yīng)保證所出租的房屋享有出租的權(quán)利,如在租賃期內(nèi),該房屋發(fā)生所有權(quán)所有或部分的轉(zhuǎn)移、設(shè)定他項(xiàng)物權(quán)或其他影響乙方權(quán)益的事情時(shí),甲方應(yīng)保證所有權(quán)人,他項(xiàng)權(quán)利人或其他影響乙方權(quán)益的第三者能繼續(xù)遵守本協(xié)議所有條款,反之如乙方權(quán)益因此而遭受損害,甲方應(yīng)負(fù)賠償責(zé)任。ObligationsofPartyA:PartyAshallturnoverthehouseandaccessoryfacilities(seetheappendixfordetail)onscheduletoPartyBforuse.PartyAshallberesponsibleforrepairinganydamageofthehouseduetopoorquality,naturaltearandwearorcalamitiesandbeartheexpensesthereof.PartyAshouldensurethatthehouseletoutisentitled,tothelease.Ifallorpartoftheownershipofthehouseistransferred,otherrightsitemaresettled,oranyotherhappeningaffectstherightsandinterestsofPartyBduringtheleasehold,PartyAshouldguaranteethattheowner,persontotherightsitemoranyotherthirdpartythataffectstherightsandinterestofPartyBcontinuetoabidebyallthearticlesoftheContract.Otherwise,PartyAshallbeliableforcompensatingtolosstotherightsandinterestssufferedbyPartyBtherefrom.九、乙方的義務(wù):乙方應(yīng)按協(xié)議的規(guī)定,準(zhǔn)時(shí)支付租金、保證金及其他各項(xiàng)應(yīng)付費(fèi)用。乙方經(jīng)甲方同意,可在承租用房?jī)?nèi)進(jìn)行裝修及添置設(shè)備。租賃期滿后,乙方可將添置的可拆動(dòng)的動(dòng)產(chǎn)部分自行拆運(yùn),并保證不影響房屋的完好及正常使用。未經(jīng)甲方同意,乙方不得將承租的房屋轉(zhuǎn)租或分租,并愛(ài)惜使用租賃的房屋。如因乙方的過(guò)錯(cuò)或過(guò)錯(cuò)致使房屋及設(shè)施受到損壞,乙方應(yīng)負(fù)賠償責(zé)任。乙方應(yīng)按本協(xié)議的約定合法使用租賃房屋,不得私自變化使用性質(zhì),不應(yīng)寄存危險(xiǎn)物品,如因此發(fā)生損害,乙方應(yīng)承擔(dān)所有責(zé)任。ObligationsofPartyB:PartyBshouldpaytherental,depositofsecurityandotherfeespayableonscheduleaccordingtotheprovisionsofthecontract.PartyBmay,uponapprovalbyPartyA,fituptherentedhouseandaddequipmentthereinduringtheleasehold.Uponexpirationoftheleasedhold,PartyBmayremovetheaddedpartofpropertythatisremovable,butitmustensurethatthehouseisingoodconditionfornormaluse.PartyBmustnottransfertheleaseofthehouseithasrentedorsubletitwithouttheapprovalbyPartyA.PartyBshouldtakegoodcareofthehouserented.PartyBshallbeliableforcompensatingforanydamagecausedtothehouseandfacilitiesduetoPartyB’sfaultormisuse.PartyBshouldusetherentedhouselawfullyaccordingtotheprovisionsoftheContract.Itmusttonotchangethenatureoftheuseofthehousewithoutauthorization.Nohazardousmaterialsandgoodsshallbeallowedtobekeptinthehouse.Ifanydamageisattributabletosuchuse,PartyBshallfullyliable.十、協(xié)議終止及解除的規(guī)定:乙方在租賃期滿后,乙方有優(yōu)先承租權(quán),如需續(xù)租,應(yīng)提前兩個(gè)月告知對(duì)方,由雙方另行協(xié)商續(xù)租事宜。租賃期滿后,乙方應(yīng)在天內(nèi)將承租的房屋交還甲方,如有留置的任何物品,在未獲得甲方諒解之下,均視為放棄,任憑甲方處置,乙方?jīng)Q無(wú)異議。本協(xié)議一經(jīng)雙方簽字后立即生效,未經(jīng)雙方同意,不得任意終止,如有未盡事宜,甲、乙雙方可另行協(xié)商。TerminationandDissolutionoftheContract:IfPartyBintendstorenewtheleasedholduponitsexpiration,itshouldnotifyPartyAofsuchintentiontwomonthinadvance.Then,thetwopartiesshalldiscussmatterovertherenewalofleasehold.Upontheexpirationoftheleasehold,PartyBshouldturntherentedhousebacktoPartyAwithindays.Anybelongingsleftbehindinthehouseshall,withoutobtainingpreviousunderstandingofPartyA,bedeemedasthingsgivenupbyPartyBandshallbedisposedofbyPartyAatitsdiscretion,towhichPartyBshallraisenoobjection.Thiscontractshallgointoeffectthemomentitissignedbybothparties.Itmustnotbeterminatedatwillwithouttheapprovalofbothparties.AnythingnotcoveredintheContractshallbediscussedseparatelybyPartyAandPartyB.十一、違約處理:1、甲乙任何一方如未按協(xié)議的條款履行,導(dǎo)致中途終止協(xié)議,并且過(guò)錯(cuò)方在未征得對(duì)方諒解的狀況下,則視為違約,雙方同意違約金為元整。若違約金局限性彌補(bǔ)無(wú)過(guò)錯(cuò)方之損失,則違約方還需就局限性部分支付賠償金。凡在執(zhí)行本協(xié)議或與本協(xié)議有關(guān)的事情時(shí)雙方發(fā)生爭(zhēng)議,應(yīng)首先友好協(xié)商,協(xié)商不成,可向有管轄權(quán)的人民法院提起訴訟。HandingofBreachofContact:1、IffailureofeitherPartyAorPartyBtofulfilthearticlesoftheContractbeforeitsexpiration,thePartyatfaultshallbedeemedasviolatingtheContractwithoutobtainingtheunderstandingoftheotherParty.Thetwopartiesagreethatthepenaltyforbreachofcontractshallbe.Incasesuchpenaltyisnotsufticienttomakeupforthelosssufferedbythefaultlessparty.ThepartythathasviolatedtheContractshallpayadditionalcompensation.AnydisputearisingfromexecutionoftheContractorinconnectionwiththeContractshouldbesettlethroughfriendlydis
