Risks

1.Thisinsurancecoversallrisksoflossofordamagetothesubject-matterinsuredexceptasexcludedbytheprovisionsofClauses4,5,6and7below.

GeneralAverage

2.Thisinsurancecoversgeneralaverageandsalvagecharges,adjustedordeterminedaccordingtothecontractofcarriageand/orthegoverninglawandpractice,incurredtoavoidorinconnectionwiththeavoidanceoflossfromanycauseexceptthoseexcludedinClauses4,5,6and7below.

"BothtoBlameCollisionClause"

3.ThisinsuranceindemnifiestheAssured,inrespectofanyriskinsuredherein,againstliabilityincurredunderanyBothtoBlameCollisionClauseinthecontractofcarriage.IntheeventofanyclaimbycarriersunderthesaidClause,theAssuredagreetonotifytheInsurerswhoshallhavetheright,attheirowncostandexpense,todefendtheAssuredagainstsuchclaim.

EXCLUSIONS

4.Innocaseshallthisinsurancecover

4.1lossdamageorexpenseattributabletowilfulmisconductoftheAssured

4.2ordinaryleakage,ordinarylossinweightorvolume,orordinarywearandtearofthesubject-matterinsured

4.3lossdamageorexpensecausedbyinsufficiencyorunsuitabilityofpackingorpreparationofthesubject-matterinsuredtowithstandtheordinaryincidentsoftheinsuredtransitwheresuchpackingorpreparationiscarriedoutbytheAssuredortheiremployeesorpriortotheattachmentofthisinsurance(forthepurposeoftheseClauses"packing"shallbedeemedtoincludestowageinacontainerand"employees"shallnotincludeindependentcontractors)

4.4lossdamageorexpensecausedbyinherentviceornatureofthesubject-matterinsured

4.5lossdamageorexpensecausedbydelay,eventhoughthedelaybecausedbyariskinsuredagainst(exceptexpensespayableunderClause2above)

4.6lossdamageorexpensecausedbyinsolvencyorfinancialdefaultoftheownersmanagerscharterersoroperatorsofthevesselwhere,atthetimeofloadingofthesubject-matterinsuredonboardthevessel,theAssuredareaware,orintheordinarycourseofbusinessshouldbeaware,thatsuchinsolvencyorfinancialdefaultcouldpreventthenormalprosecutionofthevoyage

Thisexclusionshallnotapplywherethecontractofinsurancehasbeenassignedtothepartyclaiminghereunderwhohasboughtoragreedtobuythesubject-matterinsuredingoodfaithunderabindingcontract

4.7lossdamageorexpensedirectlyorindirectlycausedbyorarisingfromtheuseofanyweaponordeviceemployingatomicornuclearfissionand/orfusionorotherlikereactionorradioactiveforceormatter.

5.5.1Innocaseshallthisinsurancecoverlossdamageorexpensearisingfrom

5.1.1unseaworthinessofvesselorcraftorunfitnessofvesselorcraftforthesafecarriageofthesubject-matterinsured,wheretheAssuredareprivytosuchunseaworthinessorunfitness,atthetimethesubject-matterinsuredisloadedtherein

5.1.2unfitnessofcontainerorconveyanceforthesafecarriageofthesubject-matterinsured,whereloadingthereinorthereoniscarriedoutpriortoattachmentofthisinsuranceorbytheAssuredortheiremployeesandtheyareprivytosuchunfitnessatthetimeofloading.

5.2Exclusion5.1.1aboveshallnotapplywherethecontractofinsurancehasbeenassignedtothepartyclaiminghereunderwhohasboughtoragreedtobuythesubject-matterinsuredingoodfaithunderabindingcontract.

5.3TheInsurerswaiveanybreachoftheimpliedwarrantiesofseaworthinessoftheshipandfitnessoftheshiptocarrythesubject-matterinsuredtodestination.

6.Innocaseshallthisinsurancecoverlossdamageorexpensecausedby

6.1warcivilwarrevolutionrebellioninsurrection,orcivilstrifearisingtherefrom,oranyhostileactbyoragainstabelligerentpower

6.2captureseizurearrestrestraintordetainment(piracyexcepted),andtheconsequencesthereoforanyattemptthereat

6.3derelictminestorpedoesbombsorotherderelictweaponsofwar.

7.Innocaseshallthisinsurancecoverlossdamageorexpense

7.1causedbystrikers,locked-outworkmen,orpersonstakingpartinlabourdisturbances,riotsorcivilcommotions

7.2resultingfromstrikes,lock-outs,labourdisturbances,riotsorcivilcommotions

7.3causedbyanyactofterrorismbeinganactofanypersonactingonbehalfof,orinconnectionwith,anyorganisationwhichcarriesoutactivitiesdirectedtowardstheoverthrowingorinfluencing,byforceorviolence,ofanygovernmentwhetherornotlegallyconstituted

7.4causedbyanypersonactingfromapolitical,ideologicalorreligiousmotive.

8.8.1SubjecttoClause11below,thisinsuranceattachesfromthetimethesubject-matterinsuredisfirstmovedinthewarehouseorattheplaceofstorage(attheplacenamedinthecontractofinsurance)forthepurposeoftheimmediateloadingintoorontothecarryingvehicleorotherconveyanceforthecommencementoftransit,continuesduringtheordinarycourseoftransitandterminateseither

8.1.1oncompletionofunloadingfromthecarryingvehicleorotherconveyanceinoratthefinalwarehouseorplaceofstorageatthedestinationnamedinthecontractofinsurance,

8.1.2oncompletionofunloadingfromthecarryingvehicleorotherconveyanceinoratanyotherwarehouseorplaceofstorage,whetherpriortooratthedestinationnamedinthecontractofinsurance,whichtheAssuredortheiremployeeselecttouseeitherforstorageotherthanintheordinarycourseoftransitorforallocationordistribution,or

8.1.3whentheAssuredortheiremployeeselecttouseanycarryingvehicleorotherconveyanceoranycontainerforstorageotherthanintheordinarycourseoftransitor

8.1.4ontheexpiryof60daysaftercompletionofdischargeoversideofthesubject-matterinsuredfromtheoverseavesselatthefinalportofdischarge,whichevershallfirstoccur.

8.2If,afterdischargeoversidefromtheoverseavesselatthefinalportofdischarge,butpriortoterminationofthisinsurance,thesubject-matterinsuredistobeforwardedtoadestinationotherthanthattowhichitisinsured,thisinsurance,whilstremainingsubjecttoterminationasprovidedinClauses8.1.1to8.1.4,shallnotextendbeyondthetimethesubject-matterinsuredisfirstmovedforthepurposeofthecommencementoftransittosuchotherdestination.

8.3Thisinsuranceshallremaininforce(subjecttoterminationasprovidedforinClauses8.1.1to8.1.4aboveandtotheprovisionsofClause9below)duringdelaybeyondthecontroloftheAssured,anydeviation,forceddischarge,reshipmentortranshipmentandduringanyvariationoftheadventurearisingfromtheexerciseofalibertygrantedtocarriersunderthecontractofcarriage.

TerminationofContractofCarriage

9.IfowingtocircumstancesbeyondthecontroloftheAssuredeitherthecontractofcarriageisterminatedataportorplaceotherthanthedestinationnamedthereinorthetransitisotherwiseterminatedbeforeunloadingofthesubject-matterinsuredasprovidedforinClause8above,thenthisinsuranceshallalsoterminateunlesspromptnoticeisgiventotheInsurersandcontinuationofcoverisrequestedwhenthisinsuranceshallremaininforce,subjecttoanadditionalpremiumifrequiredbytheInsurers,either

9.1untilthesubject-matterinsuredissoldanddeliveredatsuchportorplace,or,unlessotherwisespeciallyagreed,untiltheexpiryof60daysafterarrivalofthesubject-matterinsuredatsuchportorplace,whichevershallfirstoccur,or

9.2ifthesubject-matterinsuredisforwardedwithinthesaidperiodof60days(oranyagreedextensionthereof)tothedestinationnamedinthecontractofinsuranceortoanyotherdestination,untilterminatedinaccordancewiththeprovisionsofClause8above.

ChangeofVoyage

10.10.1Where,afterattachmentofthisinsurance,thedestinationischangedbytheAssured,thismustbenotifiedpromptlytoInsurersforratesandtermstobeagreed.Shouldalossoccurpriortosuchagreementbeingobtainedcovermaybeprovidedbutonlyifcoverwouldhavebeenavailableatareasonablecommercialmarketrateonreasonablemarketterms.

10.2Wherethesubject-matterinsuredcommencesthetransitcontemplatedbythisinsurance(inaccordancewithClause8.1),but,withouttheknowledgeoftheAssuredortheiremployeestheshipsailsforanotherdestination,thisinsurancewillneverthelessbedeemedtohaveattachedatcommencementofsuchtransit.

CLAIMS

InsurableInterest

11.11.1InordertorecoverunderthisinsurancetheAssuredmusthaveaninsurableinterestinthesubject-matterinsuredatthetimeoftheloss.

11.2SubjecttoClause11.1above,theAssuredshallbeentitledtorecoverforinsuredlossoccurringduringtheperiodcoveredbythisinsurance,notwithstandingthatthelossoccurredbeforethecontractofinsurancewasconcluded,unlesstheAssuredwereawareofthelossandtheInsurerswerenot.

ForwardingCharges

12.Where,asaresultoftheoperationofariskcoveredbythisinsurance,theinsuredtransitisterminatedataportorplaceotherthanthattowhichthesubject-matterinsurediscoveredunderthisinsurance,theInsurerswillreimbursetheAssuredforanyextrachargesproperlyandreasonablyincurredinunloadingstoringandforwardingthesubject-matterinsuredtothedestinationtowhichitisinsured.

ThisClause12,whichdoesnotapplytogeneralaverageorsalvagecharges,shallbesubjecttotheexclusionscontainedinClauses4,5,6and7above,andshallnotincludechargesarisingfromthefaultnegligenceinsolvencyorfinancialdefaultoftheAssuredortheiremployees.

ConstructiveTotalLoss

13.NoclaimforConstructiveTotalLossshallberecoverablehereunderunlessthesubject-matterinsuredisreasonablyabandonedeitheronaccountofitsactualtotallossappearingtobeunavoidableorbecausethecostofrecovering,reconditioningandforwardingthesubject-matterinsuredtothedestinationtowhichitisinsuredwouldexceeditsvalueonarrival.

IncreasedValue

14.14.1IfanyIncreasedValueinsuranceiseffectedbytheAssuredonthesubject-matterinsuredunderthisinsurancetheagreedvalueofthesubject-matterinsuredshallbedeemedtobeincreasedtothetotalamountinsuredunderthisinsuranceandallIncreasedValueinsurancescoveringtheloss,andliabilityunderthisinsuranceshallbeinsuchproportionasthesuminsuredunderthisinsurancebearstosuchtotalamountinsured.

IntheeventofclaimtheAssuredshallprovidetheInsurerswithevidenceoftheamountsinsuredunderallotherinsurances.

14.2WherethisinsuranceisonIncreasedValuethefollowingclauseshallapply:

Theagreedvalueofthesubject-matterinsuredshallbedeemedtobeequaltothetotalamountinsuredundertheprimaryinsuranceandallIncreasedValueinsurancescoveringthelossandeffectedonthesubject-matterinsuredbytheAssured,andliabilityunderthisinsuranceshallbeinsuchproportionasthesuminsuredunderthisinsurancebearstosuchtotalamountinsured.

IntheeventofclaimtheAssuredshallprovidetheInsurerswithevidenceoftheamountsinsuredunderallotherinsurances.

BENEFITOFINSURANCE

15.Thisinsurance

15.1coverstheAssuredwhichincludesthepersonclaimingindemnityeitherasthepersonbyoronwhosebehalfthecontractofinsurancewaseffectedorasanassignee,

15.2shallnotextendtoorotherwisebenefitthecarrierorotherbailee.
