第1篇

ThisLeasingAgreement(the"Agreement")ismadeandenteredintoasof[Date],byandbetween[Landlord'sFullLegalName],of[Landlord'sAddress],(hereinafterreferredtoasthe"Landlord"),and[Tenant'sFullLegalName],of[Tenant'sAddress],(hereinafterreferredtoasthe"Tenant"),collectivelyreferredtoasthe"Parties".

RECITALS

WHEREAS,theLandlordistheownerofcertainrealpropertysituatedat[PropertyAddress](hereinafterreferredtoasthe"Property"),whichiscurrentlyoccupiedbytheTenant;

WHEREAS,theLandlorddesirestoleasethePropertytotheTenantforresidentialpurposes;

WHEREAS,theTenantdesirestoleasethePropertyfromtheLandlordforresidentialpurposesunderthetermsandconditionssetforthinthisAgreement;

NOW,THEREFORE,inconsiderationofthemutualcovenantsandpromisescontainedherein,thePartiesagreeasfollows:

1.LEASETERM

1.1ThetermofthisAgreement(the"LeaseTerm")shallcommenceon[StartDate]andshallcontinueforaperiodof[NumberofYears]years,unlessterminatedearlierinaccordancewiththeprovisionsofthisAgreement.

1.2UpontheexpirationoftheinitialLeaseTerm,thisAgreementshallautomaticallyrenewforsuccessivetermsof[NumberofYears]years,unlesseitherPartygiveswrittennoticeofterminationtotheotherPartyatleast[NumberofDays]dayspriortotheexpirationofthethen-currentLeaseTerm.

2.RENT

2.1TheTenantshallpaytotheLandlordamonthlyrentof[Amount](the"Rent")onorbeforethe[DayoftheMonth]ofeachmonthduringtheLeaseTerm.

2.2Rentshallbepayableby[PaymentMethod](e.g.,cash,check,electronicfundstransfer,etc.).

2.3IftheTenantfailstopaytheRentontheduedate,theTenantshallpayalatefeeof[Amount]foreachdaytheRentremainsunpaid.

2.4TheRentshallbeadjustedannuallyon[Date]toreflectanychangesintheConsumerPriceIndexforthe[City/Country].

3.SECURITYDEPOSIT

3.1TheTenantshallpaytotheLandlordasecuritydeposit(the"SecurityDeposit")of[Amount]uponexecutionofthisAgreement.

3.2TheSecurityDepositshallbeheldbytheLandlordforthedurationoftheLeaseTermandshallberefundedtotheTenantupontheTenant'svacatingtheProperty,subjecttothedeductionssetforthinSection7ofthisAgreement.

3.3TheSecurityDepositshallbereturnedtotheTenantwithin[NumberofDays]daysaftertheTenantvacatestheProperty,providedthattheTenanthasfulfilledallobligationsunderthisAgreement.

4.USEANDOCCUPANCY

4.1TheTenantshalluseandoccupythePropertysolelyforresidentialpurposesandshallnotusethePropertyforanycommercial,industrial,orothernon-residentialpurposes.

4.2TheTenantshallnotmakeanyalterations,improvements,oradditionstothePropertywithoutthepriorwrittenconsentoftheLandlord.

4.3TheTenantshallnotsublet,assign,orotherwisetransferthePropertyoranyinterestinthePropertywithoutthepriorwrittenconsentoftheLandlord.

5.MAINTENANCEANDREPAIRS

5.1TheLandlordshallmaintainthePropertyingoodrepairandconditionduringtheLeaseTerm,subjecttonormalwearandtear.

5.2TheTenantshallkeepthePropertyinacleanandsafeconditionduringtheLeaseTerm.

5.3TheTenantshallpromptlyreportanydamageornecessaryrepairstotheLandlord.

5.4TheTenantshallberesponsibleforallrepairsandmaintenancerequiredforanyfixtures,appliances,orequipmentinstalledinthePropertybytheTenant.

6.INSURANCE

6.1TheTenantshallmaintainadequateliabilityinsuranceforthedurationoftheLeaseTerm.

6.2TheLandlordshallmaintainpropertyinsuranceonthePropertyforthedurationoftheLeaseTerm.

7.DAMAGEANDNUISANCE

7.1TheTenantshallnotcommitorpermitanynuisanceorannoyanceonthePropertyorintheneighborhood.

7.2TheTenantshallnotwillfullyornegligentlydamagethePropertyoranypartthereof.

7.3TheTenantshallpromptlyrepairanydamagecausedbytheTenantortheTenant'sguests.

8.TERMINATION

8.1ThisAgreementmaybeterminatedbyeitherPartyupontheoccurrenceofanyofthefollowingevents:

(a)AbreachofanytermorconditionofthisAgreementbytheotherParty,providedthatthebreachingPartyisgivenwrittennoticeofthebreachandfailstocurethebreachwithin[NumberofDays]daysafterreceiptofsuchnotice;

(b)TheTenant'sfailuretopaytheRentontheduedateforaperiodof[NumberofDays]days;

(c)TheTenant'sviolationofanylocal,state,orfederallawsorregulations;

(d)TheLandlord'sdecisiontosellorotherwisedisposeoftheProperty.

8.2UponterminationofthisAgreement,theTenantshallvacatethePropertywithin[NumberofDays]days.

9.MISCELLANEOUS

9.1ThisAgreementconstitutestheentireagreementbetweenthePartiesandsupersedesallprioragreements,negotiations,andunderstandings,whetherwrittenororal,relatingtothesubjectmatterofthisAgreement.

9.2ThisAgreementmaybeamendedonlybyawritteninstrumentexecutedbybothParties.

9.3IfanyprovisionofthisAgreementisheldtobeinvalidorunenforceable,theremainingprovisionsshallremaininfullforceandeffect.

9.4ThisAgreementshallbegovernedbyandconstruedinaccordancewiththelawsof[State/Country].

ThisLeaseAgreement(the"Agreement")ismadeandenteredintoasof[Date],byandbetween[Landlord'sFullLegalName],hereinafterreferredtoas"Landlord,"and[Tenant'sFullLegalName],hereinafterreferredtoas"Tenant,"collectivelyreferredtoasthe"Parties.")

1.Premises

ThePremisesconsistofthefollowingpropertylocatedat[FullAddressoftheProperty],whichismoreparticularlydescribedasfollows:

2.Rent

3.SecurityDeposit

3.1TheTenantshallpaytotheLandlordasecuritydepositof[Amount]atorbeforethecommencementoftheLeaseTerm.ThissecuritydepositshallbeheldbytheLandlordforthepurposeofensuringcompliancewiththetermsofthisAgreementandfortherepairorreplacementofanydamagetothePremisescausedbytheTenantortheTenant'sguests,exceptfornormalwearandtear.

3.2UpontheterminationoftheLeaseTerm,theLandlordshallreturnthesecuritydeposittotheTenant,lessanydeductionsfordamagesorcleaningcosts,within[Numberofdays]aftertheTenanthasvacatedthePremisesandreturnedthekeystotheLandlord.

4.UseofPremises

4.1TheTenantshallusethePremisessolelyforresidentialpurposesandshallnotuseorpermittheuseofthePremisesforanyillegalpurposeorinanymannerthatmaybeanuisancetotheLandlordortheneighbors.

4.2TheTenantshallnotmakeanyalterationsorimprovementstothePremiseswithoutthepriorwrittenconsentoftheLandlord.

4.3TheTenantshallnotkeepanyanimalsonthePremiseswithoutthepriorwrittenconsentoftheLandlord.

5.MaintenanceandRepairs

5.1TheTenantisresponsibleforthemaintenanceandrepairofthePremises,exceptforrepairsthataretheresponsibilityoftheLandlordunderapplicablelawsorthisAgreement.

5.2TheTenantshallkeepthePremisesingoodrepairandconditionduringtheTermofthisAgreement,exceptfornormalwearandtear.

5.3TheTenantshallimmediatelyreporttotheLandlordanydamagetothePremisesoranynecessaryrepairsthatneedtobemade.

6.Utilities

6.1TheTenantshallberesponsibleforallutilitiesandservicesusedduringtheTermofthisAgreement,includingbutnotlimitedtoelectricity,gas,water,andinternetservice.

6.2TheTenantshallprovidetheLandlordwithcopiesofutilitybillsuponrequest.

7.SublettingandAssignment

7.1TheTenantshallnotsubletorassignthePremiseswithoutthepriorwrittenconsentoftheLandlord.

7.2AnysubtenantorassigneeshallbeboundbyallthetermsandconditionsofthisAgreement.

8.TerminationofLease

8.1TheLeaseTermmaybeterminatedbyeitherPartyupontheexpirationoftheLeaseTerm.

8.2TheTenantmayterminatetheLeasebyprovidingtheLandlordwith[Numberofdays]writtennoticepriortotheendoftheLeaseTerm.

8.3TheLandlordmayterminatetheLeaseforanybreachofthetermsofthisAgreementbytheTenant,uponprovidingtheTenantwith[Numberofdays]writtennotice.

9.DefaultandRemedies

9.1IftheTenantdefaultsunderanytermorconditionofthisAgreement,theLandlordmay,atitsoption,terminatethisAgreementandrecoverpossessionofthePremises.

9.2Intheeventoftermination,theTenantshallbeliableforanydamagessufferedbytheLandlordasaresultoftheTenant'sdefault.

10.GoverningLaw

ThisAgreementshallbegovernedbyandconstruedinaccordancewiththelawsoftheStateof[State].

11.EntireAgreement

ThisAgreementconstitutestheentireagreementbetweenthePartiesandsupersedesallprioragreements,negotiations,andunderstandings,whetherwrittenororal,relatingtothesubjectmatterofthisAgreement.

12.Signatures

RECITALS

WHEREAS,theLandlordistheownerofcertainrealpropertylocatedat[PropertyAddress](the"Property");

WHEREAS,theTenantdesirestoleasethePropertyfromtheLandlordforresidentialpurposes;

WHEREAS,theLandlordiswillingtoleasethePropertytotheTenantuponthetermsandconditionssetforthinthisAgreement;

NOW,THEREFORE,inconsiderationofthemutualcovenantsandpromiseshereincontained,thepartiesheretoagreeasfollows:

1.LeaseTerm

3.3UpontheterminationoftheLeaseTerm,theLandlordshallreturntheSecurityDeposittotheTenant,lessanyamountsowedbytheTenantunderthisAgreement,within[NumberofDays]daysoftheTenantvacatingtheProperty.

4.UseofProperty

4.1TheTenantshallusethePropertysolelyforresidentialpurposesandshallnotusethePropertyforanyillegalpurposeorinanymannerthatviolatesanyapplicablelawsorregulations.

4.2TheTenantshallnotmakeanyalterations,improvements,oradditionstothePropertywithoutthepriorwrittenconsentoftheLandlord.

4.3TheTenantshallnotrent,sublet,assign,orotherwisetransferthePropertytoanythirdpartywithoutthepriorwrittenconsentoftheLandlord.

5.MaintenanceandRepairs

5.1TheTenantshallkeepthePropertyingoodrepairandconditionduringtheLeaseTerm,ordinarywearandtearexcepted.

5.2TheTenantshallimmediatelynotifytheLandlordofanyneededrepairsormaintenancetotheProperty.

5.3TheLandlordshallperformallnecessaryrepairsandmaintenancetotheProperty,exceptforrepairsandmaintenancethataretheresponsibilityoftheTenantunderthisAgreement.

6.UtilitiesandOtherExpenses

6.1TheTenantshallberesponsibleforallutilitiesandotherexpensesassociatedwiththeuseoftheProperty,includingbutnotlimitedtoelectricity,gas,water,andinternetservice.

6.2TheTenantshallprovidetheLandlordwiththenamesandcontactinformationofallutilityprovidersandshallberesponsibleforallutilitybillsuntiltheTenantvacatestheProperty.

7.Pets

7.1[Ifapplicable]TheTenantispermittedtokeep[NumberofPets]petsontheProperty,providedthattheTenantcomplieswiththefollowingconditions:

a.TheTenantmustobtainwrittenconsentfromtheLandlordpriortobringinganypetontotheProperty.

b.TheTenantshallberesponsibleforalldamagescausedbythepetandshallkeepthePropertyfreefromanyodorormesscausedbythepet.

c.TheTenantshallpayanadditionalpetdepositof[PetDepositAmount]whichshallberefundableupontheTenantvacatingthePropertyingoodcondition.

8.EntrytotheProperty

8.1TheLandlordortheLandlord'sauthorizedagentshallhavetherighttoenterthePropertyatanyreasonabletimeforthepurposeofinspectingtheProperty,makingrepairs,orshowingthePropertytopotentialpurchasersortenants.

8.2TheLandlordshallprovidetheTenantwithatleast[NumberofDays]days'writtennoticepriortoenteringthePropertyforinspectionorrepairs.

9.Termination
