第四章WTO貿(mào)易政策審查機(jī)制WTOTradePolicyReviewMechanism一、概述審查各國的貿(mào)易政策是WTO重要職能之一。WTO貿(mào)易政策審查機(jī)制(TPRM)是由WTO文件《貿(mào)易政策審查機(jī)制》(TradePolicyReviewMechanism,TPRM)確立的?！顿Q(mào)易政策審查機(jī)制》內(nèi)容分目標(biāo)、國內(nèi)透明度、審查程序、報(bào)告、與《GATT1994》和GATS的收支條款的關(guān)系、對機(jī)制的評價(jià)及國際貿(mào)易環(huán)境發(fā)展的總評價(jià)等7部分。2WTO貿(mào)易政策審查是提高WTO各成員貿(mào)易政策法規(guī)透明度重要手段。但須說明的是這種審查不是適用WTO爭端解決機(jī)制的基礎(chǔ)，也并不因此要求成員作出新的政策上的承諾。另一方面，WTO也鼓勵(lì)WTO成員增強(qiáng)其在有關(guān)貿(mào)易政策國內(nèi)決策方面的透明度。當(dāng)然這必須建立在自愿的基礎(chǔ)上（onavoluntarybasis）并且由各成員國根據(jù)其法律和政治制度自主決定是否這樣做。

3二、WTO“貿(mào)易政策審查”的含義WTO“貿(mào)易政策審查”是由WTO貿(mào)易政策審查機(jī)構(gòu)（TPRB）對每個(gè)成員的貿(mào)易政策、做法及其對多邊貿(mào)易體制的影響進(jìn)行的審查和評估，以確保WTO多邊貿(mào)易規(guī)則及各成員的承諾得到更好的遵守,增加各成員貿(mào)易政策和做法的透明度，并加強(qiáng)成員彼此之間的理解。

1、一般規(guī)則(Generalrules)ThetradepoliciesandpracticesofallMemberswillbesubjecttoperiodicreview.ThefrequencyofreviewsisdecidedbyaMember’sshareofworldtradeinarecentrepresentativeperiod.Thefirstfourtradingentitiessoidentified(forexample,theUnitedStates,EuropeanUnion,ChinaandJapan,i.e.theso-called“four-horsecarriages”inthepresentworldtrade)aresubjecttorevieweverytwoyears.Thenext16tradingentitieswillbereviewedeveryfouryears.OtherMemberswillbereviewedeverysixyears.Nevertheless,alongerintervalwillbefixedforleast-developedcountryMembers.6

所有WTO成員的貿(mào)易政策和做法將被定期審查。這種審查的頻率主要決定于各成員在最近代表期內(nèi)占世界貿(mào)易的份額。以此確定的前四個(gè)貿(mào)易實(shí)體（如美國、中國、歐盟和日本，即當(dāng)前世界貿(mào)易中的“四駕馬車”）每兩年審查一次，隨后的16個(gè)成員每四年審查一次，其他成員國每六年審查一次，但是對最不發(fā)達(dá)成員國的審查間隔期將更長。

2、針對中國的特殊安排在我國《加入議定書》中規(guī)定：ThereviewoftheimplementationbyChinaoftheWTOrulesandtheprovisionsoftheProtocolontheAccessionofthePRCwilltakeplaceafteraccessionineachyearforeightyears.Therewillbeafinalreviewinyear10oratanearlierdatedecidedbytheGeneralCouncil.對中國實(shí)施WTO規(guī)則和《中國加入議定書》中規(guī)定的審查將在中國加入WTO后的8年內(nèi)每年都要進(jìn)行。在加入后的第10年進(jìn)行最后的審查，或由總理事會決定提前進(jìn)行這種最后的審查。11四、貿(mào)易政策審查需準(zhǔn)備的文件Secretariatreport

12五、審查程序WTO貿(mào)易政策審查程序主要包括以下五個(gè)步驟：

1.TheTPRBmeetingswillconcentrateondiscussingtheMember'stradepoliciesandpractices.2.TheTPRBwillestablishaprogrammeofreviewsforeachyearinconsultationwiththeMembersdirectlyconcerned.3.TheTPRBshallbaseitsworkonafullreportdescribingthetradepoliciesandpracticessuppliedbytheMemberorMembersunderreview.4.ThereportsbytheMemberunderreviewandbytheSecretariat,togetherwiththeminutesoftherespectivemeetingoftheTPRB,willbepublishedpromptlyafterthereview.5.Thesedocumentsabove-saidwillbeforwardedtotheMinisterialConference.

、成員提交的報(bào)告及TPRB每次會議紀(jì)要在實(shí)施貿(mào)易政策審查后都應(yīng)立即公布。5、上述這些文件將被提交給部長會議。

14六、貿(mào)易政策審議中的通報(bào)制度Inordertoachievethefullestpossibledegreeoftransparency,WTOrequireseachMemberreportfullyandregularlytotheTPRBthetradepoliciesandpracticespursuedbytheMemberorMembersconcernedand,betweenreviews,providebriefreportsonanysignificantchangesintheirtradepolicies.為了保證各國貿(mào)易政策最大程度的透明度，WTO要求每個(gè)成員定期地向TPRB全面報(bào)告其或其他成員所實(shí)行的貿(mào)易政策和做法、其年度統(tǒng)計(jì)信息，并提供有關(guān)在審查期間貿(mào)易政策作重大調(diào)整的簡要報(bào)告。

TradePolicyReviewofChinaUndertheWTOTPRM自中國2001年12月11日加入WTO以來，WTO利用其貿(mào)易政策審查機(jī)制對中國的貿(mào)易政策和措施及其對多邊貿(mào)易體制的影響進(jìn)行了多次審查。17前四次審查的時(shí)間第一次：2006年4月19日至21日；第二次：2008年5月21

至23日；第三次：2010年5月31日至6月2日；第四次：2012年6月12

日至14日。

18一種現(xiàn)象事實(shí)上WTO對中國的貿(mào)易審查頻率是每兩年審查一次，盡管中國在2011年已成為世界第二大出口國和第三大進(jìn)口國。19

一、與對中國貿(mào)易政策審查有關(guān)的文件
