◆以完成一定工作任務(wù)為期限的勞動(dòng)合同或者勞動(dòng)合同期限不滿三個(gè)月的,不得約定試用期。Noprobationperiodmaybespecifiedinanemploymentcontractwithatermtoexpireuponcompletionofacertainjoboranemploymentcontractwithatermoflessthanthreemonths.◆同一用人單位與同一勞動(dòng)者只能約定一次試用期。AnEmployermaystipulateonlyoneprobationperiodwithanygivenEmployee
◆試用期包含在勞動(dòng)合同期限內(nèi)。勞動(dòng)合同僅約定試用期的,試用期不成立,該期限為勞動(dòng)合同期限。Theprobationperiodshallbeincludedinthetermoftheemploymentcontract.Ifanemploymentcontractprovidesforaprobationperiodonly,thenthereisnoprobationperiodandthetermconcernedshallbethetermoftheemploymentcontract.
◆勞動(dòng)者在試用期的工資不得低于本單位相同崗位最低檔工資或者勞動(dòng)合同約定工資的百分之八十,并不得低于用人單位所在地的最低工資標(biāo)準(zhǔn)。ThewagesofaEmployeeonprobationmaynotbelessthanthelowestwagelevelforthesamejobwiththeEmployerorlessthan80percentofthewageagreeduponintheemploymentcontract,andmaynotbelessthantheminimumwagerateintheplacewheretheEmployerislocated.

(一)勞動(dòng)者患病或者非因工負(fù)傷,在規(guī)定的醫(yī)療期滿后不能從事原工作也不能從事由用人單位另行安排的工作的;Afterthesetperiodofmedicalcareforanillnessornon-work-relatedinjury,theEmployeecanengageneitherinhisoriginalworknorinotherworkarrangedforhimbyhisEmployer;

TheEmployeeisincompetentandremainsincompetentaftertrainingoradjustmentofhisposition(三)勞動(dòng)合同訂立時(shí)所依據(jù)的客觀情況發(fā)生重大變化,致使原勞動(dòng)合同無(wú)法履行,經(jīng)當(dāng)事人協(xié)商不能就變更勞動(dòng)合同達(dá)成協(xié)議的。Amajorchangeintheobjectivecircumstancesrelieduponatthetimeofconclusionoftheemploymentcontractrendersitunperformableand,afterconsultations,theEmployerandEmployeeareunabletoreachagreementonamendingtheemploymentcontract.用人單位單方解除權(quán)之——非過(guò)錯(cuò)性解除(二)勞動(dòng)者不能勝任工作,經(jīng)過(guò)培訓(xùn)或者調(diào)整工作崗位,仍不能勝8用人單位單方解除權(quán)之——裁員解除
Terminationbyreducingemployee《勞動(dòng)合同法》第四十一條
《勞動(dòng)法》第二十七條有下列情形之一,需要裁減人員二十人以上或者裁減不足二十人但占企業(yè)職工總數(shù)百分之十以上的,用人單位應(yīng)當(dāng)提前三十日向工會(huì)或者全體職工說(shuō)明情況,聽(tīng)取工會(huì)或者職工的意見(jiàn)后,裁減人員方案經(jīng)向勞動(dòng)行政部門報(bào)告,可以裁減人員:Ifanyofthefollowingcircumstancesmakesitnecessarytoreducetheworkforceby20personsormoreorbyanumberofpersonsthatislessthan20butaccountsfor10percentormoreofthetotalnumberoftheenterprise’semployees,theEmployermayreducetheworkforceafterithasexplainedthecircumstancestoitsTradeunionortoallofitsemployees30daysinadvance,hasconsideredtheopinionsoftheTradeunionortheemployeesandhassubsequentlyreportedtheworkforcereductionplantothelaboradministrationdepartment:
用人單位瀕臨破產(chǎn)進(jìn)行法定整頓期間或者生產(chǎn)經(jīng)營(yíng)狀況發(fā)生嚴(yán)重困難,確需裁減人員的,應(yīng)當(dāng)提前三十日向工會(huì)或者全體職工說(shuō)明情況,聽(tīng)取工會(huì)或者職工的意見(jiàn),經(jīng)向勞動(dòng)行政部門報(bào)告后,可以裁減人員。用人單位單方解除權(quán)之——裁員解除

Theenterpriseswitchesproduction,introducesamajortechnologicalinnovationorrevisesitsbusinessmethod,and,afteramendmentofemploymentcontracts,stillneedstoreduceitsworkforce:(四)其他因勞動(dòng)合同訂立時(shí)所依據(jù)的客觀經(jīng)濟(jì)情況發(fā)生重大變化,致使勞動(dòng)合同無(wú)法履行

《勞動(dòng)合同法》第四十六條
No.46contractlaw●經(jīng)濟(jì)補(bǔ)償按勞動(dòng)者在本單位工作的年限,每滿一年支付一個(gè)月工資的標(biāo)準(zhǔn)向勞動(dòng)者支付。六個(gè)月以上不滿一年的,按一年計(jì)算;不滿六個(gè)月的,向勞動(dòng)者支付半個(gè)月工資的經(jīng)濟(jì)補(bǔ)償。AEmployeeshallbepaidseverancepaybasedonthenumberofyearsworkedwiththeEmployerattherateofonemonth’swageforeachfullyearworked.Anyperiodofnotlessthansixmonthsbutlessthanoneyearshallbecountedasoneyear.TheseverancepaypayabletoaEmployeeforanyperiodoflessthansixmonthsshallbeone-halfofhismonthlywages.
●本條所稱月工資是指勞動(dòng)者在勞動(dòng)合同解除或者終止前十二個(gè)月的平均工資“Monthlywage”meanstheEmployee’saveragemonthlywageforthe12monthspriortotheterminationorendingofhisemploymentcontract.

勞動(dòng)者月工資高于用人單位所在直轄市、設(shè)區(qū)的市級(jí)人民政府公布的本地區(qū)上年度職工月平均工資三倍的,向其支付經(jīng)濟(jì)補(bǔ)償?shù)臉?biāo)準(zhǔn)按職工月平均工資三倍的數(shù)額支付,向其支付經(jīng)濟(jì)補(bǔ)償?shù)哪晗拮罡卟怀^(guò)十二年。

有下列情形之一的,用人單位在提前三十日以書(shū)面形式通知?jiǎng)趧?dòng)者本人或者額外支付勞動(dòng)者一個(gè)月工資后,可以解除勞動(dòng)合同:AnEmployermayterminateanemploymentcontractbygivingtheEmployeehimself30days’priorwrittennotice,oronemonth’swageinlieuofnotice,if:《勞動(dòng)法》第二十六條《勞動(dòng)合同法》第四十條用人單位單方解除權(quán)之——非過(guò)錯(cuò)性解除(一)勞動(dòng)者患病或者非因22(二)勞動(dòng)者不能勝任工作,經(jīng)過(guò)培訓(xùn)或者調(diào)整工作崗位,仍不能勝任工作的;TheEmployeeisincompetentandremainsincompetentaftertrainingoradjustmentofhisposition(三)勞動(dòng)合同訂立時(shí)所依據(jù)的客觀情況發(fā)生重大變化,致使勞動(dòng)合同無(wú)法履行,經(jīng)用人單位與勞動(dòng)者協(xié)商,未能就變更勞動(dòng)合同內(nèi)容達(dá)成協(xié)議的Amajorchangeintheobjectivecircumstancesrelieduponatthetimeofconclusionoftheemploymentcontractrendersitunperformableand,afterconsultations,theEmployerandEmployeeareunabletoreachagreementonamendingtheemploymentcontract.(二)勞動(dòng)者不能勝任工作,經(jīng)過(guò)培訓(xùn)或者調(diào)整工作崗位,仍不能勝任工作的;

《勞動(dòng)法》第二十七條有下列情形之一,需要裁減人員二十人以上或者裁減不足二十人但占企業(yè)職工總數(shù)百分之十以上的,用人單位應(yīng)當(dāng)提前三十日向工會(huì)或者全體職工說(shuō)明情況,聽(tīng)取工會(huì)或者職工的意見(jiàn)后,裁減人員方案經(jīng)向勞動(dòng)行政部門報(bào)告,可以裁減人員:Ifanyofthefollowingcircumstancesmakesitnecessarytoreducetheworkforceby20personsormoreorbyanumberofpersonsthatislessthan20butaccountsfor10percentormoreofthetotalnumberoftheenterprise’semployees,theEmployermayreducetheworkforceafterithasexplainedthecircumstancestoitsTradeunionortoallofitsemployees30daysinadvance,hasconsideredtheopinionsoftheTradeunionortheemployeesandhassubsequentlyreportedtheworkforcereductionplantothelaboradministrationdepartment:
用人單位瀕臨破產(chǎn)進(jìn)行法定整頓期間或者生產(chǎn)經(jīng)營(yíng)狀況發(fā)生嚴(yán)重困難,確需裁減人員的,應(yīng)當(dāng)提前三十日向工會(huì)或者全體職工說(shuō)明情況,聽(tīng)取工會(huì)或者職工的意見(jiàn),經(jīng)向勞動(dòng)行政部門報(bào)告后,可以裁減人員。用人單位單方解除權(quán)之——裁員解除
