1.1thestudystatusquo

Intheconstructionprojectconstructioncontractistheproductofthedevelopmentofmarketeconomy,istheownerandthecontractortocompletetheconstructionandinstallation,cleartherightsandobligationsofbothparties,bothpartiesbehaviorandconstraintrelationshipbetweenthelegaldocuments,bearing,bothsidesinthecontractisconstructionprocessinthehigheststandardsofbehaviour.Followtheconstructioncontract,thecontractorshallcompletetheownertotheconstructionandinstallationconstructiontasks,andownershouldaccordingtothecontracttoprovidethenecessaryconstructionconditionandpayfortheengineeringcost.Tostrengthenprojectconstructioncontractmanagement:ontheonehandwecanfromthelegalAngletoprojectcontractingactivitiesmakepredictions,putforwardtoavoidtheriskoflegalscheme,enhancestheenterprisethestrain,developmentandcompetitionability;Ontheotherhandtostrengthenthecontractmanagementandimprovetheperformanceofthecontractconsciouslyconsciousness,formaintainingtheorderofconstructionmarketcanplayapositiverole.Atthesametimeitalsoformedinanopen,fairandjustmarketcompetitionmechanism,improvingengineeringquality,reducetheconstructioncostandshortentheconstructionperiodareplayinganimportantrole.However,becauseatpresentourcountryconstructionmarketremainstobeperfect,theconstructioncontractintheimplementationandmanagementofthenormalthereexistmanyproblems,sostrengtheningandimprovingtheconstructioncontractmanagementisveryimportant.

subject;(3)thecontracttextnotrigorous;(4)thetermsofthecontractGuaYiLouWan;(5)only

fromthecontractwithoutthecontract;(6)inviolationoflawsandregulations,nocontractsigned;

(7)contractworkisdifficulttoclaimtheimplementation;(8)overseascontracttextquestion;And

alsopointedouttheperformanceofthecontractstageproblems:(1)thecontractshouldbe

changedwithoutchange;(2)shallbeissuedletters(meetingminutes)nohair;(3)shallconfirmthe

novisasvisaconfirmation;(4)shallbetheresponsibilityofbutthelimitation;(5)shallexercise

thepowerofnoexercise;(6)attentionshallbepaidtotheevidence(material)ofthelegaleffectof

butdidn'tgetenoughattentionto[1].LiuZhiWei(2002)contractmanagementisahard,

complicatedsystemengineering,andweshouldtryhardtolearnfromforeignadvanced

experience,familiarwithinternationalengineeringandmastertheoperationofthemarket

standardandoperationpractice,andstrivetoimproveourcountryconstructionengineeringunits

managementlevelandtheoverallquality,forourenterprisestoparticipateininternational

engineeringconstructionmarketcompetitionactivelycreateconditions[3].

1.2theresearchcontent

Inthesocialistmarketeconomysystem,buildingactivitiesmainlythroughtherealizationof

constructionmarket,andthecontractisthemaintenancemarketoperationofthecarrier.The

constructionprojectcontractbothsidesiscontractingfortherealizationoftheconstructionproject

goal,clearresponsibility,mutualrightsandobligationsoftheagreement,isacontractwherebythe

contractorperformsprojectconstructionandobtainthesourceofreasonableprofit,butalsothe

developerpaystheprice,thecontrolprojectquality,progress,investment,andensurethesmooth

engineeringconstructionactivitiesanimportantlegaldocuments.Strengtheningthecontract

managementistoguaranteethecontractingpeoplefullyfulfilltheircontractualobligations,

realizethegoalistoensurethattheconstruction(quality,investment,timelimit)theimportant

means.

China'sconstructionmarketdevelopmentdevelopmentforovertenyears,themarketeconomy

systemoperationthatadapttothelaw,itisnotperfect,imperfect,andnotbedetailedspecific,so

poor,oftencausemarketmainbodybehaviorisnotstandard,inthecontractsigningand
