2025建筑工程施工合同-中英對(duì)照版ContractAgreementonConstructionEngineering-BilingualVersion(2025)ThisContractAgreementisenteredintoonthisdayof,2025,byandbetweenthefollowingparties:甲方(PartyA):Name:Address:ContactInformation:乙方(PartyB):Name:Address:ContactInformation:Hereinafterreferredtoas"theContractor"and"theEmployer"respectively.鑒于(WHEREAS)TheEmployerintendstocarryouttheconstructionoftheProject(hereinafterreferredtoas"theProject")andhasselectedtheContractorastheconstructioncontractorfortheProject.TheContractorhasthenecessaryqualifications,experience,andcapacitytoundertaketheconstructionoftheProjectinaccordancewiththerequirementsoftheEmployer.為明確雙方的權(quán)利義務(wù)，依據(jù)《中華人民共和國合同法》及相關(guān)法律法規(guī)，本著平等、自愿、誠實(shí)信用的原則，雙方經(jīng)協(xié)商一致，簽訂本合同。(INORDERTOCLARIFYTHERIGHTSANDOBLIGATIONSOFTHEPARTIES,THECHINACONTRACTUALLAWANDOTHERRELATEDLEGALPROVISIONSAREHEREBY_referenced,andbasedontheprinciplesofequality,voluntariness,andgoodfaith,theEmployerandtheContractorhaveagreeduponandenteredintothisContractthroughmutualconsultation.)第一條工程概況(Article1-GeneralDescriptionoftheProject)1.1工程名稱(ProjectName):1.2工程地點(diǎn)(ProjectLocation):1.3工程規(guī)模(ProjectScale):1.4工程結(jié)構(gòu)類型(TypeofStructure):1.5工程承包范圍(ScopeofWorks):詳見附件一(AnnexI).第二條合同工期(Article2-ContractDuration)2.1開工日期(CommencementDate):2.2竣工日期(CompletionDate):2.3總工期(TotalContractDuration):日歷天(calendardays).2.4若因不可抗力或甲方原因?qū)е鹿て谘诱`，乙方有權(quán)要求延長(zhǎng)工期。(Ifthe工期isdelayedduetoforcemajeureortheEmployer'sreasons,theContractorhastherighttoclaimanextensionoftime.)第三條質(zhì)量標(biāo)準(zhǔn)(Article3-QualityStandards)3.1工程質(zhì)量標(biāo)準(zhǔn)(EngineeringQualityStandards):須達(dá)到《混凝土結(jié)構(gòu)工程施工質(zhì)量驗(yàn)收規(guī)范》(GB50204-2025)及其他相關(guān)國家規(guī)范。(Theengineeringqualitymustmeetthe"ConcreteStructureEngineeringQualityAcceptanceSpecification"(GB50204-2025)andotherrelevantnationalstandards.)3.2質(zhì)量保修范圍和期限(ScopeandPeriodofQualityWarranty):詳見附件二(AnnexII).第四條合同金額與支付方式(Article4-ContractPriceandPaymentMethods)4.1合同總價(jià)(TotalContractPrice):元(RMB).4.2付款方式(PaymentTerms):預(yù)付款(AdvancePayment):合同簽訂后日內(nèi)支付合同總價(jià)的%。(WithindaysafterthesigningofthisContract,theEmployershallpay%ofthetotalcontractpriceasadvancepayment.)進(jìn)度款(ProgressPayment):按月支付已完工程的%。(Monthlypaymentof%ofthecompletedworks.)結(jié)算款(FinalSettlementPayment):工程竣工驗(yàn)收合格后日內(nèi)支付余款。(Withindaysafterthesuccessfulcompletionacceptance,theremainingamountshallbepaid.)4.3若甲方未按約定支付款項(xiàng)，乙方有權(quán)暫停施工并要求違約金。(IftheEmployerfailstomakepaymentsasagreed,theContractorhastherighttosuspendconstructionandclaimpenalties.)第五條工程驗(yàn)收與保修(Article5-EngineeringAcceptanceandWarranty)5.1分部驗(yàn)收(PartialAcceptance):工程施工至各分部時(shí)，乙方應(yīng)提前日通知甲方進(jìn)行驗(yàn)收。(TheContractorshallnotifytheEmployertoconductpartialacceptanceinspectionsatleastdaysinadvancewhentheconstructionreacheseachsub-item.)5.2中間驗(yàn)收(InterimAcceptance):工程施工至中間節(jié)點(diǎn)時(shí)，甲方應(yīng)組織相關(guān)單位進(jìn)行驗(yàn)收。(Interimacceptanceinspectionsshallbeconductedatkeyintermediatestagesoftheproject,organizedbytheEmployer.)5.3竣工驗(yàn)收(FinalAcceptance):工程竣工后，乙方應(yīng)提交完整的竣工資料，并通知甲方組織驗(yàn)收。(Uponcompletionoftheproject,theContractorshallsubmitcomplete竣工資料andnotifytheEmployertoorganizethefinalacceptance.)5.4質(zhì)量保修(QualityWarranty):詳見附件二(AnnexII).第六條雙方權(quán)利與義務(wù)(Article6-RightsandObligationsofBothParties)甲方權(quán)利與義務(wù)(Employer'sRightsandObligations):6.1按合同約定支付工程款，并提供施工場(chǎng)地及相關(guān)資料。(Paythecontractpriceasagreedandprovidetheconstructionsiteandrelevantdocuments.)6.2有權(quán)對(duì)施工質(zhì)量進(jìn)行監(jiān)督，提出合理修改意見。(Havetherighttosupervisetheconstructionqualityandproposereasonablemodificationsuggestions.)6.3按合同約定組織工程驗(yàn)收。(Organizeengineeringacceptanceinaccordancewiththecontract.)乙方權(quán)利與義務(wù)(Contractor'sRightsandObligations):6.4按合同約定施工，確保工程質(zhì)量和工期。(Carryoutconstructioninaccordancewiththecontract,ensuringengineeringqualityandduration.)6.5有權(quán)要求甲方按時(shí)支付工程款。(HavetherighttorequesttheEmployertopaythecontractpriceinatimelymanner.)6.6負(fù)責(zé)施工現(xiàn)場(chǎng)的安全管理，確保施工安全。(Beresponsibleforsafetymanagementattheconstructionsitetoensureconstructionsafety.)第七條違約責(zé)任(Article7-LiabilityforBreachofContract)7.1若甲方未按約定支付工程款，乙方有權(quán)暫停施工，并要求賠償由此造成的損失。(IftheEmployerfailstopaythecontractpriceasagreed,theContractorhastherighttosuspendconstructionandclaimcompensationforthelossesthusincurred.)7.2若乙方未按合同工期完成工程，甲方有權(quán)要求乙方支付違約金，金額為元/天。(IftheContractorfailstocompletetheprojectwithintheagreedcontractduration,theEmployerhastherighttoclaimapenaltyofRMBperday.)7.3若工程質(zhì)量問題導(dǎo)致返工或修復(fù)，相關(guān)費(fèi)用由乙方承擔(dān)，并賠償造成的損失。(Ifqualityissuesintheprojectleadtoreworkorrepairs,therelatedcostsshallbebornebytheContractor,andcompensationfortheresultinglossesshallbepaid.)第八條爭(zhēng)議解決(Article8-DisputeResolution)8.1若本合同發(fā)生爭(zhēng)議，雙方應(yīng)通過友好協(xié)商解決。協(xié)商不成的，任何一方均可向項(xiàng)目所在地人民法院提起訴訟。(IntheeventofanydisputesarisingfromthisContract,thepartiesshallfirstseektoresolvethedisputesthroughfriendlyconsultations.Ifconsultationsfail,anypartymaybringproceedingsagai
