進出口貿(mào)易保險合同協(xié)議THISIMPORT/EXPORTTRADEINSURANCECONTRACTAGREEMENT(“Contract”)ISMADEANDENTEREDINTOONTHIS_____DAYOF_______,20__,BETWEEN[INSURERFULLNAME],havingitsprincipalplaceofbusinessat[INSURERADDRESS](“Insurer”),and[INSUREDFULLNAME],havingitsprincipalplaceofbusinessat[INSUREDADDRESS](“Insured”).NOWTHEREFORE,inconsiderationofthemutualcovenantsandagreementssetforthherein,theInsureragreestoissueaninsurancepolicyorcertificatecoveringthesubjectmatterofthisContractashereinprovided,andtheInsuredagreestopaythepremiumforsuchinsuranceasprovidedherein.1.SubjectMatterofInsuranceThisContractcoversthefollowinggoodsbeingtransportedunderorinconnectionwiththefollowingcontract(s)ofcarriage:*DescriptionofGoods:[Detaileddescriptionofthegoods,includingname,grade,quantity,packing,etc.]*Value:InsuredValue(IV)asperinvoicevalueat[CIF/CFR]price[InsertCurrency][Amount].TheIVrepresentstheinvoicevalueofthegoodsplus[SpecifyPercentage,e.g.,10%]forfreightandinsurance.*Quantity:[Specifyquantity,e.g.,Onehundred(100)metrictons]*MarksandNumbers:[Specifymarksandnumbersonthepackages]*Origin:[Placeofshipment,e.g.,Shanghai,China]*Destination:[Placeofdestination,e.g.,鹿特丹,荷蘭]2.PeriodofInsuranceTheperiodofinsuranceshallcommenceat[Time,e.g.,onboardthevessel]onorabout[DateofShipment,e.g.,June15,20__],andshallcontinueuntil[Time,e.g.,ondischarge]at[DateofArrival,e.g.,July15,20__],oruntilthegoodsaredeliveredtothefinaldestinationwarehouseoftheInsuredatthedestinationmentionedabove,whicheveroccursfirst,providedthatnoextensionofcoveragebeyondtheterminationdateshallbegrantedwithoutadditionalpremiumandtheInsurer'swrittenconsent.3.PerilsCoveredSubjecttotheterms,conditions,andexclusionssetforthinthisContract,theInsurershallbeliabletopayclaimsforlossesincurredbytheInsuredduringthePeriodofInsurancearisingfromtherisksof:*ICC(B):WithParticularAverage(orspecifyICC(C):AllRisks,orCIC:WPA/A.R.,asagreed),includingbutnotlimitedto:*Fireorexplosion;*Impactbyseawave,浪擊、擱淺、碰撞、觸碰、傾覆；*Drowning,sinking,grounding,beingstranded,runningaground,collision,contact,overturning;*Strikes,riots,andcivilcommotion;*Shortageinquantity,shortweight;*Damageduetomoisture,humidity,sweating,condensation;*Damageresultingfromexternalcausesuchasbreakageofpacking,leakage,breakageofcontainers,contactwithothergoodscausingcontamination;*FreefromParticularAverage(FPA)risks,asdefinedintherelevantInstituteCargoClauses(A)orCICF.P.A.conditions;*AdditionalRisks:WarRisk,StrikesRisk,FailuretoDeliverRisk,ImportDutyRisk(asapplicable,subjecttoseparateacceptanceandadditionalpremium).[Listanyotherspecificadditionalrisksinsured,e.g.,OnDeckRisk,FrostDamageRisk,etc.]4.ExclusionsTheInsurershallnotbeliableforanylossordamagearisingfrom:*TheintentionalactornegligenceoftheInsuredoritsemployees;*Inherentviceornatureofthegoodsorlossduetonormalwearandtear,pilferageofsmallarticles,orlossofindividualpackages;*LossordamagearisingfromperilsexcludedunderthisContract,includingbutnotlimitedto:*Risksofwar,civilwar,rebellion,insurrection,civilcommotion,actsofterrorism,warlikeoperations,capture,seizure,arrest,requisition,orconsequencesofwarorinsurrection;*Risksofstrikes,lockouts,orsimilarindustrialactions;*Risksofnuclearreaction,radiation,orcontamination;*Lossresultingfromdelayindelivery,lossofprofit,lossofmarket,orincreaseinfreightcharges;*Lossordamageoccurringpriortotheinceptionofthisinsurance;*LossordamagenotresultingfromperilscoveredunderthisContract;*OtherexclusionsasmaybestipulatedintherelevantInstituteCargoClauses(B)/(C)orCICWPA/AllRisksconditions,oranyotherattachedendorsements.5.SumInsuredTheSumInsuredunderthisContractis[InsertCurrency][Amount]aspertheinvoicevaluementionedinClause1.TheInsurershallonlybeliabletopayclaimsuptothisSumInsured.6.PremiumThepremiumforthisinsuranceis[InsertCurrency][Amount]calculatedattherateof[InsertPremiumRatePercentage,e.g.,0.5%]ontheSumInsured.PaymentofthepremiumshallbedueandpayablebytheInsuredtotheInsurerwithin[Number,e.g.,30]daysafterthedateofthisContractorthedateoftheinsurancepolicy/certificate,whicheverislater.7.ClaimSettlement*NoticeofLoss:Intheeventofanyloss,damage,ordelayoccurringwithinthePeriodofInsurancecoveredbythisContract,theInsuredshallgivepromptnoticethereoftotheInsureratitsaddressshownabove,ortosuchotheraddressastheInsurermaydesignate.TheInsuredshallalsotakeallreasonablemeasurestopreventorminimizetheloss.*ClaimSubmission:TheInsuredshallsubmittotheInsureraclaim,togetherwithallnecessarydocuments,suchasaninsurancepolicyorcertificate,invoice,billoflading,certificateofloss,surveyreport,andanyotherdocumentsrequiredbytheInsurer,within[Number,e.g.,60]daysafterthedateofthelossorknowledgethereof.*Survey:TheInsuredshall,atitsownexpense,arrangeforasurveytobeconductedbyasurveyoracceptabletotheInsurerinaccordancewiththerequirementsoftherelevantInstituteCargoClausesorCICconditions.Thesurveyor'sreportshallbesubmittedtotheInsurer.*Indemnity:TheInsurershall,uponreceiptoftheclaimandsupportingdocuments,investigatethelossordamage.IfthelossisdeterminedtobewithinthescopeofcoverageandtheInsured'sliabilityunderthisContract,theInsurershallpaytheindemnitytotheInsuredwithin[Number,e.g.,90]daysaftertheclaimissubmitted,providedallnecessarydocumentsareprovidedandthelossdoesnotexceedtheSumInsured.*ProportionateIndemnity:IftheSumInsuredislessthantheactualvalueofthegoodsatthetimeoftheloss,theindemnityshallbeproportionallyreduced.*Subrogation:IntheeventofpaymentofanindemnityunderthisContract,theInsurershallbeentitled,inthenameoftheInsured,toallrightsandrecoveriesavailableunderthelawagainstanypersonwhomaybelegallyresponsibleforthelossordamage.Uponpayment,theInsuredshallassignsuchrightsandrecoveriestotheInsurerwithoutfurtherconsideration.TheInsuredshallalsocooperatewiththeInsurerinanyproceedingforrecoveryofsuchlossordamage.*Abandonment:IfthetotallossoftheinsuredgoodsappearslikelytoexceedtheSumInsured,theInsuredmay,withtheInsurer'swrittenconsent,abandonthegoodsandsurrenderallrightsandtitletheretototheInsurerinreturnforfullpaymentbytheInsurerunderthisContract.8.GoverningLawThisContractshallbegovernedbyandconstruedinaccordancewiththelawsofthePeople'sRepublicofChina.9.NoticesAllnotices,requests,demands,andothercommunicationsrequiredorpermittedhereundershallbeinwritingandshallbedeemedtohavebeendulygivenwhendeliveredpersonall
