菲律賓家政服務(wù)雇傭協(xié)議書ThisEmploymentAgreementismadeandenteredintoonthis______dayof__________,20__,byandbetween:Employer:________________________,havingitsaddressat________________________(hereinafterreferredtoasthe"Employer"),andEmployee:________________________,acitizenandresidentofthePhilippines,havinghis/heraddressat________________________(hereinafterreferredtoasthe"Employee").1.TERMOFEMPLOYMENTThisAgreementshallcommenceon______dayof__________,20__,andcontinueuntilterminatedinaccordancewiththeprovisionsofthisAgreementorotherwiseprovidedbyPhilippineLaborLaws.ThisAgreementmaybereneweduponmutualagreementandsatisfactionoftheconditionsspecifiedintherenewalagreement.Aninitialtrialperiodof______days(uptothirtydays)shallapply,commencingonthefirstdayofemployment.EithertheEmployerortheEmployeemayterminatethisAgreementduringthetrialperiodbygivingatleastthree(3)days'writtennoticetotheotherparty.ShouldtheEmployeesuccessfullycompletethetrialperiod,theAgreementshallbeconsideredeffectiveforthedurationspecifiedaboveorasfurtheragreeduponinwriting.2.POSITIONANDDUTIESTheEmployeeshallbeemployedinthepositionofHomeHelper/DomesticHelper.TheprimarydutiesandresponsibilitiesoftheEmployeeshallinclude,butnotbelimitedto:a.Performinggeneralhouseholdcleaning,includingsweeping,mopping,dusting,andwashingoffloorsandsurfaceswithintheassignedareasoftheEmployer'sresidenceonadailyandweeklybasisasdirected.b.Washing,drying,ironing,folding,andputtingawaylaundryandlinensasassigned.c.PreparingandservingmealsfortheEmployer'sfamilyasinstructed,includingbasicmealplanningandgroceryshoppingwithintheallocatedbudget,ifapplicable.d.Maintainingthecleanlinessandorderofthekitchen,includingwashingdishes,cleaningutensils,andkitchensurfaces.e.Caringforchildren,ifapplicable,whichmayincludeassistingwithfeeding,changingdiapers,playing,lighthousekeepingrelatedtothechildren,andensuringtheirsafetyunderthedirectsupervisionoftheEmployerorauthorizedperson.TheEmployeeisnotresponsibleforadministeringmedicationunlessspecificallyauthorizedinwritingbytheEmployerforadesignatedperiodandwithclearinstructions.f.Caringforelderlypersons,ifapplicable,whichmayincludeassistingwithpersonalhygiene,mobility,mealpreparation,andcompanionship,asreasonablyrequiredanddirectedbytheEmployer.g.PerformingotherreasonablehouseholdtasksasrequestedbytheEmployer,includinglightgardening,receivingandarrangingdeliveries,andassistingwithminorhouseholdrepairsastheEmployeeiscapable.h.Adheringtotheschedulesandworkinghoursasmutuallyagreedupon,typically______hoursperday,MondaytoFriday,startingat______AM/PMandendingat______AM/PM.OvertimeworkshallbeperformedonlywiththepriorwrittenconsentoftheEmployerandshallbecompensatedatoneandahalf(1.5)timestheEmployee'sregularhourlyrate.TheEmployeeshallperformthedutieswithdiligence,care,andgoodfaithinaccordancewiththestandardsoftheindustryandthereasonableinstructionsgivenbytheEmployerortheEmployer'sfamilymembers.3.WORKINGCONDITIONSANDRULESTheEmployeeshallworkattheEmployer'sresidencelocatedat________________________.Theworkingenvironmentistypicalofaprivatehousehold.TheEmployeeagreestoabidebythereasonablehouseholdrulesestablishedbytheEmployer,whichmayinclude:a.MaintainingaprofessionalandrespectfuldemeanoratalltimesandusingappropriatelanguagewheninteractingwiththeEmployerandothermembersofthehousehold.b.Notenteringprivaterooms(e.g.,bedrooms,study)withoutpermission.c.NotusingtheEmployer'spersonalproperty,money,orbankaccountswithoutexplicitwrittenauthorization.d.Keepingpersonalbelongingsandworkareascleanandorderly.e.ReportinganypotentialhazardsormaintenanceissuesinthehouseholdpromptlytotheEmployer.f.Complyingwithhealthandsafetyregulationsasrequiredbylaw.4.COMPENSATIONANDBENEFITSTheEmployee'smonthlybasicsalaryshallbePHP______,payableinPhilippinePesos(PHP).Paymentshallbemadeonthe______dayofeachmonth,unlessthatdayfallsonaweekendorpublicholiday,inwhichcasepaymentshallbemadeonthefirst(1st)workingdayfollowingsuchweekendorholiday.PaymentshallbemadebydirectbankdepositintotheEmployee'saccountnumbered________________________at________________________,orbycash,ifagreeduponinwriting.TheEmployershallprovidebreakfastandlunchdailywithinthehousehold.Ifaccommodationisprovided,itshallbeaseparateroomwithcleanbedlinensprovidedregularly.Ifaccommodationisnotprovided,theEmployeeshallbeentitledtoPHP______permonthashousingallowance,payablemonthly.TheEmployeeshallbeentitledtoone(1)dayofrestperweek,typicallyonSaturday.PaidannualleaveshallbeinaccordancewithPhilippinelaws,providingtwelve(12)daysofpaidannualleaveafterone(1)fullyearofcontinuousservicewiththesameEmployer.PaidsickleaveshallbegrantedbasedonattendancerecordsandasperPhilippinelaws.Otherbenefits,suchascontributionstosocialsecurityschemes(PhilHealthandPag-IBIG),shallbeprovidedbytheEmployerincompliancewithPhilippinelaborlaws,withtheEmployeecontributingtherequiredshare.5.CONFIDENTIALITYTheEmployeeagreestomaintainstrictconfidentialityregardingallinformationpertainingtotheEmployer'sfamily,householdaffairs,businessoperations,finances,personalhabits,andtheidentitiesofguests.Thisconfidentialityobligationshallremainineffectforaperiodoftwelve(12)monthsfollowingtheterminationofthisAgreement.6.DdisciplineANDTerminationTheEmployerreservestherighttodisciplinetheEmployeeforanybreachofthisAgreementorformisconduct,insubordination,orfailuretoperformdutiesproperly.Disciplineshallbeadministeredprogressively,startingwithaverbalwarning,followedbyawrittenwarningifnecessary.TheEmployeeshallhavetherighttoterminatethisAgreementbygivingtheEmployeratleastfifteen(15)days'writtennotice.TheEmployershallhavetherighttoterminatethisAgreementbygivingtheEmployeeatleastfifteen(15)days'writtennoticeorimmediateterminationforjustcause,asdefinedbyPhilippineLaborLaws(e.g.,willfuldisobedienceoflawfulorders,dishonesty,grossmisconduct).Intheeventofterminationforanyreason,theEmployeeshallbeentitledtoreceivealloutstandingmonetarycompensations,suchasfinalsalary,13thmonthpay(ifapplicableandearned),vacationleavecredits,andanyotherbenefitsdueunderPhilippineLaborLawsandthisAgreement.TheEmployeeshallberequiredtosurrenderallkeys,accesscards,andEmployerpropertyupontermination.7.COMPLIANCEWITHPHILIPPINELABORLAWThisAgreementshallbegovernedbyandconstruedinaccordancewiththelawsofthePhilippines,includingbutnotlimitedtotheCivilCodeofthePhilippines,theLaborCodeofthePhilippines,andallrelevantPresidentialDecrees,Regulations,andOrdinances.TheEmployerandEmployeeagreetocomplywithallapplicablelaborlawsandregulationsregardingwages,workinghours,benefits,socialsecurity,andterminationprocedures.8.MISCELLANEOUSa.AnyamendmentormodificationofthisAgreementmustbemadeinwritingandsignedbyboththeEmployerandtheEmployee.b.AllnoticesorcommunicationsrequiredorpermittedunderthisAgreementshallbeinwritingandshallbedeemedeffectively
