3 摘要 二十世紀(jì)八十年代后期,農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)在我國廣大農(nóng)村悄然興 起。土地承包經(jīng)營權(quán)的流轉(zhuǎn)不僅解決了農(nóng)村土地撂荒等現(xiàn)實問題, 而且推動了土 地規(guī)模經(jīng)營,加快了農(nóng)村經(jīng)濟(jì)的發(fā)展,把傳統(tǒng)農(nóng)業(yè)向現(xiàn)代農(nóng)業(yè)推進(jìn)了一步。然 而,由于我國農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)制度立法存在問題,使其成為制約農(nóng)村 經(jīng)濟(jì)發(fā)展的一大瓶頸,完善農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)制度已成為當(dāng)前發(fā)展農(nóng)村 家庭聯(lián)產(chǎn)承包經(jīng)營制度的一項重要措施。因此,現(xiàn)階段如何規(guī)范土地承包經(jīng)營 權(quán)合理有序流轉(zhuǎn),確保農(nóng)民的合法權(quán)益在流轉(zhuǎn)中不受侵害,進(jìn)一步完善農(nóng)村土 地承包經(jīng)營權(quán)流轉(zhuǎn)制度,成為擺在我們面前的一個重要課題。 全文共分為四部分, 第一部分引言;第二部分農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)制度 概述;第三部分我國農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)制度的立法現(xiàn)狀及存在的問題; 第四部分完善農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)制度的思考。 第一部分,簡要介紹了本文的選題背景及意義、研究現(xiàn)狀綜述和研究方法。 第二部分,從理論上對土地承包經(jīng)營權(quán)進(jìn)行了界定,隨后介紹了理論界對 土地承包經(jīng)營權(quán)流轉(zhuǎn)內(nèi)涵的幾種典型觀點,并提出了自己的理解,即農(nóng)村土地 承包經(jīng)營權(quán)流轉(zhuǎn)是指通過家庭承包方式取得土地承包經(jīng)營權(quán)的承包方在承包期 內(nèi),依法、自愿將其承包的土地部分或全部流轉(zhuǎn)給具備農(nóng)業(yè)生產(chǎn)經(jīng)營能力的第 三方從事生產(chǎn)經(jīng)營活動的行為;概括出農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)的法律特征, 并對我國農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)的意義作了闡述。 第三部分,闡述了我國農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)制度的立法現(xiàn)狀,并從流 轉(zhuǎn)方式、流轉(zhuǎn)受讓主體、登記制度、監(jiān)管制度等方面對土地承包經(jīng)營權(quán)流轉(zhuǎn)制 4 度立法存在的問題作了較為全面地分析。 第四部分,針對我國農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)制度存在的問題,提出了相應(yīng) 的完善措施。土地承包經(jīng)營權(quán)流轉(zhuǎn)是我國農(nóng)村經(jīng)濟(jì)發(fā)展的必然選擇,也是農(nóng)村 土地制度改革的方向。實踐證明,土地承包經(jīng)營權(quán)的流轉(zhuǎn)促進(jìn)了生產(chǎn)力的發(fā)展, 推動了土地規(guī)?;?jīng)營,增加了農(nóng)民收入。為進(jìn)一步推進(jìn)農(nóng)村土地承包經(jīng)營權(quán) 流轉(zhuǎn),確保土地流轉(zhuǎn)的規(guī)范化、制度化,更好地促進(jìn)社會主義新農(nóng)村建設(shè),筆 者提出完善我國農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)制度的思考:一是完善農(nóng)村土地承包 經(jīng)營權(quán)流轉(zhuǎn)制度應(yīng)堅持的原則;二是完善農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)制度;三是 加強(qiáng)農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)相關(guān)制度建設(shè)。 【關(guān) 鍵 詞】 土地承包 土地承包經(jīng)營權(quán) 流轉(zhuǎn)制度 完善 5 abstract since the late 1980s, the transferring of rural land contract for the managerial right has been arised in the vast countryside in china quietly. the transferring of rural land contract for the managerial right not only has solved the uncultivated land in rural area and so on the realistic problems, but also has promoted the appropriate land scale of operation and speeds up the development of rural economy, so that it has advanced the traditional agriculture to modern agriculture. however, because there are the problems of legislation in the transferring system of rural land contract for the managerial right in china, which has become a major bottleneck of restraining the rural economic development, improving the transferring system of rural land contract for the managerial right has now become an important measure for developing of the rural household contract management system. therefore, at the current stage, how to regulate the land contract management right and make it to operate orderly have become an important subject for us, so as to ensure that the peasant s legitimate rights and interests from being encroached during the transferring course, and further improving the transferring system of rural land contract for the managerial right . the full text is divided into four parts, the first part is the introduction of background and meaning of selecting topics and the general introduction of current situation of research; the second part is 6 the introduction of transferring system of rural land contract for the managerial right ; the third part is the general introduction of current situation of legislation is worked out for transferring system of rural land contract for the managerial right in china, and the system problems of the transferring of rural land contract for the managerial right in china; and the fourth part is about the consideration of establishing and improving of transferring system of rural land contract for the managerial right. in the first part of the text, there is the introduction of background and meaning of selecting topics and the general introduction of current situation of research of transferring system of rural land contract for the managerial right. in the second part of the text, from the theory to defined the contractual operation right of land, then there is the introduction of several typical viewpoints about the meaning of the transferring of rural land contract for the managerial right which comes from the theory circle. and the writer proposes his own understanding that the transferring of rural land contract for the managerial right is the action of the contractor who has obtained the contractual operation right of land by the household contract way, transfers lawfully and voluntarily his part or all contracted land to the third party with the operation capacity of agricultural production for engaging in the production and operation activities within 7 the contract period;
