11、uot;fourgood" lea dershipconstructi on特種作業(yè)人員管理實(shí)施細(xì)則(試行)第一章總則第一條為規(guī)范特種作業(yè)人員的管理,預(yù)防生產(chǎn)安全事故發(fā)生,促進(jìn)安全生產(chǎn),根據(jù)建設(shè)工程安全生產(chǎn)管理?xiàng)l例(國(guó)務(wù)院令第 393 號(hào)) 、 特種作業(yè)人員安全技術(shù)培訓(xùn)考核管理規(guī)定( 國(guó)家安監(jiān)總局令第30 號(hào))等有關(guān)法律、法規(guī),制定本實(shí)施細(xì)則。第二條本實(shí)施細(xì)則適用于中交第二公路工程局有限公司(以下簡(jiǎn)稱“局”) 及子公司、分公司、事業(yè)部(以下簡(jiǎn)稱“局屬各單位” ) 對(duì)特種作業(yè)人員的管理。第二章一般規(guī)定第三條本實(shí)施細(xì)則所稱特種作業(yè),是指容易發(fā)生事故,對(duì)操作者本人,他人的安全健康及設(shè)備、設(shè)

19、業(yè)人員必須具備以下條件:(一)年滿18 周歲,且不超過(guò)國(guó)家法定退休年齡;(二) 經(jīng)社區(qū)或者縣級(jí)以上醫(yī)療機(jī)構(gòu)體檢健康合格,并無(wú)妨礙從事相應(yīng)特種作業(yè)的器質(zhì)性心臟病、癲癇病、美尼爾氏癥、眩暈癥、癔病、震顫麻痹癥、精神病、癡呆癥以及其他疾病和生理缺陷;(三)具有初中及以上文化程度;(四)具備必要的安全技術(shù)知識(shí)與技能;(五)相應(yīng)特種作業(yè)規(guī)定的其他條件。第六條特種作業(yè)人員必須經(jīng)專門(mén)的安全技術(shù)培訓(xùn)并考核合格,取得由國(guó)家安全監(jiān)管總局統(tǒng)一式樣、標(biāo)準(zhǔn)及編號(hào),有效期laylevels ca dres in enter prise development i n theof back bone ba ckbone r

26、" lea dershipconstructi on為 6 年, 在全國(guó)范圍內(nèi)有效的中華人民共和國(guó)特種作業(yè)操作證(以下簡(jiǎn)稱特種作業(yè)操作證)后,方可上崗作業(yè)。第七條參加特種作業(yè)安全操作資格考試的人員,應(yīng)當(dāng)填寫(xiě)考試申請(qǐng)表,由申請(qǐng)人或申請(qǐng)人的用人單位持學(xué)歷證明或者培訓(xùn)機(jī)構(gòu)出具的培訓(xùn)證明向申請(qǐng)人戶籍所在地或者從業(yè)所在地的考核發(fā)證機(jī)關(guān)或其委托的單位提出申請(qǐng)。第八條特種作業(yè)操作證需要復(fù)審的,應(yīng)當(dāng)在期滿前60 日內(nèi), 由申請(qǐng)人或者申請(qǐng)人的用人單位向原考核發(fā)證機(jī)關(guān)或者從業(yè)所在地考核發(fā)證機(jī)關(guān)提出申請(qǐng),并提交下列材料:(一)社區(qū)或者縣級(jí)以上醫(yī)療機(jī)構(gòu)出具的健康證明;(二)從事特種作業(yè)的情況;(三)安全培訓(xùn)

34、關(guān)的特種作業(yè)人員管理信息系統(tǒng)查詢確認(rèn),無(wú)證或證件失效的人員不得入場(chǎng)操作。對(duì)所有進(jìn)出場(chǎng)特種作業(yè)人員建立檔案臺(tái)帳,實(shí)行動(dòng)態(tài)管理。第九條編制特種作業(yè)的技術(shù)操作規(guī)程、安全操作規(guī)程、特種設(shè)備維護(hù)保養(yǎng)規(guī)程和相應(yīng)的應(yīng)急救援預(yù)案。第十條具有連續(xù)性或需要倒班作業(yè)的特種作業(yè)應(yīng)編制交接班制度。第十一條加強(qiáng)對(duì)特種作業(yè)人員進(jìn)行繼續(xù)教育,崗位培訓(xùn)的力度,做到時(shí)間保證、費(fèi)用落實(shí),通過(guò)學(xué)習(xí)培訓(xùn)使特種作業(yè)人員能及時(shí)掌握先進(jìn)安全生產(chǎn)的新知識(shí),新技術(shù)和新方法。特別要做好對(duì)分包單位和租賃機(jī)械特種作業(yè)操作人員的管理工作。第十二條向特種作業(yè)人員提供安全防護(hù)用具和用品,設(shè)置必要的安全防護(hù)設(shè)施,書(shū)面告知危險(xiǎn)崗位的操作規(guī)程和違章操作的危害。l

41、ess roleand pioneermodel role;to conti nuestostrengt heni ng "fourgood" lea dershipconstructi on第十三條為從事危險(xiǎn)作業(yè)的人員辦理意外傷害保險(xiǎn)。第十四條接受采納特種作業(yè)人員有關(guān)安全生產(chǎn)方面的合理化建議。第四章特種作業(yè)人員的責(zé)權(quán)第十五條特種作業(yè)人員在獨(dú)立上崗作業(yè)前,必須進(jìn)行與本工種相適應(yīng)的、專門(mén)的安全技術(shù)理論學(xué)習(xí)和實(shí)際操作訓(xùn)練。第十六條特種作業(yè)人員必須持有效證件上崗。應(yīng)當(dāng)遵守安全生產(chǎn)的有關(guān)強(qiáng)制性標(biāo)準(zhǔn)、規(guī)章制度和操作規(guī)程,正確使用安全防護(hù)用具、用品等,正確操作機(jī)械設(shè)備。第十七條特種作業(yè)
42、人員有權(quán)對(duì)作業(yè)現(xiàn)場(chǎng)的作業(yè)條件、危害作業(yè)人員生命和健康安全的作業(yè)程序和作業(yè)方式中存在的安全問(wèn)題提出批評(píng)、建議或檢舉、控告, 有權(quán)拒絕違章指揮和強(qiáng)令冒險(xiǎn)作業(yè)。第十八條在作業(yè)中發(fā)生危及人身安全的緊急情況時(shí),有權(quán)立即停止作業(yè)或采取必要的應(yīng)急措施后撤離危險(xiǎn)區(qū)等。第十九條特種作業(yè)人員要保持相對(duì)穩(wěn)定,跨地區(qū)從業(yè)或跨地區(qū)流動(dòng)施工的特種作業(yè)人員必須接受從業(yè)所在地安全生產(chǎn)監(jiān)laylevels ca dres in enter prise development i n theof back bone ba ckbone r ole;toful lstrengtheni ng membersyouthwork,fu

49、十條特種作業(yè)人員有下列情形之一的,不得上崗工作:(1) 未按規(guī)定時(shí)限進(jìn)行復(fù)審或復(fù)審不合格的;(2) 經(jīng)確認(rèn)身體條件已不適宜繼續(xù)從事所規(guī)定的特種作業(yè)的。(3) 違章操作造成嚴(yán)重后果或有2次以上違章行為,并經(jīng)查證確實(shí)的;(四)拒絕、阻礙安全生產(chǎn)監(jiān)管監(jiān)察部門(mén)監(jiān)督檢查的;(五)有安全生產(chǎn)違法行為,并給予行政處罰的;(六)對(duì)發(fā)生生產(chǎn)安全事故負(fù)有責(zé)任的;(七)特種作業(yè)操作證記載虛假信息的;(八)以欺騙、賄賂等不正當(dāng)手段取得特種作業(yè)操作證的;(九)特種作業(yè)操作證被依法撤銷的。第二十一條離開(kāi)特種作業(yè)崗位6 個(gè)月以上的特種作業(yè)人員,應(yīng)當(dāng)重新進(jìn)行實(shí)際操作考核,經(jīng)確認(rèn)合格后方可上崗作業(yè)。第二十二條特種作業(yè)操作證不得
